The Adjourned Meeting of the Kane County Board was held at the Kane County Government Center, Geneva, IL at 9:54 a.m. on Tuesday January 12, 2010 Chairman, Karen McConnaughay, John Cunningham, Clerk.

Roll call as follows: PRESENT: Allan, Castro, Collins, Davoust, Fahy, Ford, Frasz, Hoscheit, Hurlbut, Jones, Kudlicki, Kunkel, Laesch, Leonberger, Lewis, Lindgren, Mayer, Mihalec, Mitchell, Tredup, Van Cleave, Vasquez, Wojnicki, Wyatt: ABSENT: Kenyon, McConnaughay PRESENT: 24 ABSENT: 2

APPROVAL OF MINUTES Motion by Van Cleave, seconded by Vasquez that the minutes of November 10, 2009

meeting be approved. Motion carried unanimously by voice vote.

Motion by Mitchell; seconded by Mayer that minutes of the December 8, 2010 meeting be approved. Jim Mitchell motioned that the minutes of the December 8, 2009 County Board meeting be amended, second by John Mayer, to reflect that on Res. #09-487 (Video Gambling) to have the Chairman of the County Board cast the tying vote, Mitchell furthered stated that the Chairman said she could not do this. Also, Mitchell stated the County Board attorney said that the Chairman could not cast the tying vote. Motion carried unanimously by voice vote to amend and approve the minutes of the December 8, 2009 meeting.

IN APPRECIATION OF BOB PHILLIPS

WHEREAS, all Kane County employees have been encouraged to work on ways to reduce County expenditures and increase efficiencies; and

WHEREAS, Bob Phillips, mail room supervisor, rose to the challenge and began negotiating with FedEx to reduce the cost of the County's overnight deliveries. By combining all of the individual department and office accounts into one Kane County account with one carrier, the County has been able to receive a 28 percent volume discount on the shipping of overnight deliveries. Further, by completing shipping bills on line, an additional 10 percent savings has been realized. It is appropriate to note that Bob worked with FedEx to ensure the training of more than 100 Kane County employees on the new software; and

WHEREAS, the new on line FedEx program has been very successful and, with its 38 percent discount in shipping, the County saved $10,000 in 2009 utilizing this program; and

WHEREAS, by adding mail delivery and pickup services to outlying departments, Bob and the Mail Room staff have been able to eliminate department couriers and department

vehicle use for these purposes. Bob was able to accomplish this by rescheduling lunch hours and streamlining the mail processing unit. By eliminating unnecessary deliveries, Bob saved the County approximately 15 man hours per week; and

WHEREAS, Bob Phillips also led the development of bid specifications to presort and bar code the County's outgoing mail which entitles the mail to receive discounted rates from the U.S. Postal Service, specifically a savings of approximately 4.6 cents on every letter and 7 cents on every flat mailed for a total estimated savings of $40,000 per year.

NOW, THEREFORE, ON THIS 12TH DAY OF JANUARY 2010, the Kane County Board wishes to express how grateful they are to Bob Phillips for his resourcefulness, for the many dollars and man hours saved as a result of excellent management, and for the leadership he has demonstrated. Further, the Board thanks Bob for shouldering his many tasks with unfailing good humor and grace.

Jim Mitchell presented the Certificate of Recognition to Bob Phillips for his outstanding job and his ability to save money for the County. Bob Phillips thanked the County Board.

TRAVELING TROPHY FOOD DRIVE 2009 Maureen Anderson stated that the Kane County employees donated 220 of food bags of

groceries, this translated intol 3 pounds of food, which provided 36,576 meals. Kane County employees donated $8,922.10 in cash by using the online donation system through the Northern Illinois Food Bank. Traveling trophy went to the overall winner this year, Maureen Anderson presented the trophy to the Environmental Management and Water Resource Dept. which was given to the Director Tim Harbaugh. His department of nine employees donated 260 lbs per person and also gave $2, 345. Maureen further stated that the most contributed department was the Regional Office of Schools which gave 38 bags of groceries for their department.

New initiative for 2010 is 10 in 10 which means $10 for 2010. If employees donate 25 cents a week for the year or to give $10 in December 2010, Anderson stated that this could raise over $13,000.00, which would be the highest Kane County has donated. Chairman McConnaughay thanked Maureen Anderson for her work and contribution on this project.

William Trunkel, Petitioner Representative and Dan Rheaume, Vice President of River Hills Memorial Park were signed up to speak. Allen asked why did City of Batavia object to this petition. Chairman asked for the staff to answer. Batavia preferred to see a more permanent structure; the structure proposed is a mobile unit, a former sales office.

The five stipulations from the original petition #4045 shall remain in effect.

A temporary ditch/berm on the east and south sides of the Fox River Bluffs subdivision, as shown on the attached Gerald Heinz and Associates drainage improvement plan sheet, latest revision date November 4, 2009, shall be constructed by Beverly Materials or an agent thereof within 6 months of the County's approval of the amended special use to relieve pre-existing drainage problems within the subdivision. The drainage improvements will re-direct stormwater runoff from approximately 34 acres to the east of the subdivision

around the southeast corner of the subdivision to reduce flooding associated with the drainage problems in the subdivision. The required improvements are limited to the improvements on the Max McGraw property as shown on the above referenced plan sheet. Additional drainage work on individual lots within the Fox River Bluffs subdivision shall be done by Beverly Materials and/or Max McGraw subject to the additional conditions, submitted by the Petitioner dated December 1, 2009, within six months of the receipt of the waiver, release and indemnification from the homeowner. Once overburden material is available, Beverly Materials will construct the permanent berm through this area in accordance with the original mining restoration plan. Approximately 60' of buffer trees and vegetation will remain between the subdivision and the temporary ditch/berm construction along the east end of the subdivision until such time that the permanent berm can be constructed.

Maintenance of the existing berms, and establishment of plantings and habitat on newly constructed berms, included cutting and selective herbiciding of invasive species, shall continue for the establishment of the plantings and habitat in accordance with the Habitat Development Plan dated April 2005.

A new mining license shall be applied for upon approval of the rezoning by the County Board and shall include a five (5) year Dust Control Plan with three (3) monitoring locations as approved by Development staff.

That the zoning maps of Kane County, Illinois, be amended accordingly.

This ordinance shall be in full force and effect from and after its passage and approved as provided by Law.

John Fahy motioned to amend Item #2)- 4. to state: A new mining license shall be applied for upon approval of the rezoning by the County Board and shall include a five (5) year Dust Control Plan with three (3) monitoring locations as approved by Development staff; seconded by Hollie Lindgren.

Six people were signed up to speak for the Petitioner, David Zumbrun, Dan Plote, Warren Fuller, Attorney, for Petitioner, Ronald Schrack Consulting Engineer, Clark Ganshirt, Max McGraw Representative, Charles Potter Max McGraw Representative. Chairman McConnaughay ask that one person be chosen to speak on behalf of the petitioner. Warren Fuller was chosen and stated that they have submitted the Dust Control Plan and conferred with staff and Mr. Fahy. know they will be monitored by staff. John Fahy stated that there was a public hearing in Carpentersville Village Hall and everyone that came to the hearing were in favor of this program. Allan asked about water monitoring. Staff answered that water monitoring was one of the original stipulations and the program is in place and there has been no contamination.

Gerard Keating, petitioner, John Scheaffer, Consulting Engineer, Jason Fowler, Consulting Engineer, Kathy Grozis, Consulting Surveyor, Tom Egger, Consulting Surveyor and Chris Niedett, Land Planner are present to speak. Chris Niedett spoke on behalf of the petitioner. Allen asked how many units are planned for the property. Mr. Niedett answered that there are 45 parcels, designed intended for 15 building sites. The area is zoned agriculture and he is proposing an ecologically based design.

Motion carried unanimously by voice vote. Petition #4232 IS GRANTED.

RESOLUTION #10-01 AUTHORIZATION TO EXTEND THE CONTRACT FOR JANITORIAL SERVICES

WHEREAS, bids were previously solicited and received for providing outside janitorial services for the Kane County Judicial Center, Government Center, 3rd Street Courthouse, 6th Street Facility, Diagnostic Center, St. Charles Randall Road Facility, Juvenile Justice Center, Aurora Heath Department, Elgin Health Department, Elgin and Aurora Court Services, and the Division of Transportation; and

WHEREAS, the Administration Committee recommends extending the current contract with DuKane Contract Services, Batavia, IL, on a month-to-month basis for a period of not to exceed 90 days at a cost of Thirty One Thousand Five Hundred Sixty Two Dollars ($31,562.00) per month for all locations listed above; and

WHEREAS, adequate funds have been budgeted and approved in the FY10 budget to cover said expenses for janitorial services.

WHEREAS, the discoloration and/or environmental hazards relating to the roof of the Kane County Judicial Center (Judicial Center) required that the roof be replaced and environmental remediation be completed both on-site and off-site (the "Abatement"); and

WHEREAS, the Kane County Public Building Commission (the "PBC"), has heretofore filed suit in the Circuit Court of the Sixteenth Judicial Circuit, Kane County, Illinois, Gen. No.: 03 LK 475 (the "Litigation"), seeking damages in connection with the Abatement at the Judicial Center; and

WHEREAS, the County leases the Judicial Center from the PBC and is participating in the litigation and has otherwise agreed to fund the Abatement and the Litigation; and

WHEREAS, Resolution 05-341 authorized a total payment of $175,000.00 for payment of legal services, costs and expenses for the Abatement and Litigation, Resolution 07-129 authorized

WHEREAS, the Kane County Board adopted Resolution 08-278, Implementation of County Financial Policies Regarding Personnel Hiring and Replacement; and

WHEREAS, Resolution 08-278 specifically states: "A moratorium on the hiring of new County personnel and the replacement of existing or future personnel vacancies is hereby adopted effective upon passage of this Resolution. No new personnel shall be hired unless specifically approved by the County Board"; and

WHEREAS, from May I to August 4, 2009, the Department of Building Management has reduced its total headcount from 31 to 27, and requires to hire a maintenance worker at the Judicial Center to fill a position which was vacated in October 2009 to meet the maintenance requirements of this facility; and

WHEREAS, the filling of this position has been included in the FY10 budget. With this replacement hire included, the Department has cut salaries and headcount by 10% from May 1, 2009 to December 1, 2009; and

WHEREAS, as required by Resolution 08-278, the hiring of said maintenance worker has been approved by the Administration and Finance Committees; and

WHEREAS, due to the need for replacement of a supervisor to oversee staff as well as technological processes within the Department, Court Services is requesting that this position be posted at a base salary of Forty Five Thousand Two Hundred One Dollars ($45,201), or Twenty Two Thousand Six Hundred Dollars ($22,600) for this six month period; and

WHEREAS, the Kane County Development & Community Services Department administers and has received federal funds in the amount of $2,015,942.00 for 2009 annual allocations for CDBG and HOME Investment Partnership Programs and an additional $3,432,151.00 under the American Recovery and Reinvestment Act of 2009 for CDBG, Neighborhood Stabilization and Homeless Prevention and Rapid Rehousing; and

WHEREAS, all Federal funds have requirements for identifying projects and spending these funds in a timely manner; and

WHEREAS, as this annual Federal funding, additional funding and new programs have been administered by existing staff, resulting in a lack of capacity to administer these funds in a timely manner; and

WHEREAS, said Federal funding provides that a percentage of the funds may be used to pay for staff salaries and other expenses associated with the planning, administration, monitoring of sub recipients and reporting requirements; and

WHEREAS, staff administering these programs are paid 100% from grant funds, not from the County's general fund, and it is desirable for Kane County to increase the staff capacity to effectively administer these funds.

WHEREAS, the Kane County Regional Superintendent of Schools ("Regional Superintendent"), the Chief Judge of the Sixteenth Judicial Circuit ("Chief Judge"), St. Charles School District No. 303 ("School District"), and the County of Kane (together "Participants"), have all expressed a desire to provide educational services for residents of the Kane County Juvenile Justice Center ("JJC") pursuant to the provisions of the Agreement to Provide Educational Services at the Kane County Juvenile Justice Center ("Agreement"); and

WHEREAS, the County of Kane must provide educational services at the JJC pursuant to 55 ILCS 75/2.1; and

WHEREAS, educational services at the JJC have been provided by the Regional Superintendent in cooperation with the Chief Judge and Court Services since the opening of the JJC; and

WHEREAS the Participants agree the Regional Superintendent should continue to be responsible for the educational services at the JJC; and

WHEREAS, School District desires the Regional Superintendent continue to provide educational services at the JJC; and

WHEREAS, the Regional Superintendent, School District, and the Chief Judge shall agree to be responsible for certain duties with respect to said educational services pursuant to the terms and provisions of the Agreement; and

WHEREAS, it is anticipated the costs of operating said educational program shall be covered by reimbursements from the State; and

WHEREAS, the Participants have determined it is in their respective best interests to enter into the Agreement to provide said educational services to the residents of the JJC.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Regional Superintendent is hereby authorized to operate said educational services at the JJC, including, but not limited to, hiring necessary teaching personnel.

WHEREAS, Justice Benefits of Dallas, Texas, was approved to locate new revenue for Kane County by identifying inmates in the Kane County Correctional Facility who are not U.S. citizens for reimbursement from the federal government (State Criminal Alien Assistance Program) for program year 2009; and

OF THE COUNTY OF KANE, ILLINOIS

WHEREAS, the County Board of the County of Kane, Illinois (the "County") by Ordinance No. 02-256 adopted on August 30, 2002 (the "Ordinance"), did provide for the issue of $7,000,000 General Obligation Bonds (Alternate Revenue Source), Series 2002 (the "Bonds") and the levy of a direct annual tax sufficient to pay the debt service on the Bonds; and

WHEREAS, the County Treasurer has determined that the Pledged Revenues (as defined in the Ordinance) for the calendar year 2009 provides an amount not less than 1.25 times the debt service on the Bonds upto and including June 1,2011, pursuant to Section 16 of the Ordinance; and

WHEREAS, the County has sufficient Pledged Revenues (as defined in the Ordinance) on deposit in the Pledged Revenues Account of the Alternate Bond Fund established pursuant to Section 12 of the Ordinance for the purpose of paying the debt service on the Bonds up to and including Junel, 2011; and

WHEREAS, it is necessary and in the best interests of the County that the tax heretofore levied for the year 2009 to pay the debt service on the Bonds be abated.

NOW, THEREFORE, BE IT ORDAINED by the County Board of the County of Kane, Illinois, as follows:

Section 1. Abatement of Tax. The tax heretofore levied for the year 2009 in the Ordinance is hereby abated in its entirety.

Section 2. Filing of the Ordinance. Forthwith upon the adoption of this Ordinance, the County Clerk of the County shall file a certified copy hereof in his office and it shall be the duty of said County Clerk to abate said tax levied for the year 2009 in accordance with provisions hereof.

WHEREAS, the Users of the Kane County Emergency Communications Board have requested that both fire and police users provide input to the Kane County Emergency Communications Board; and

Sec. 8.5.2. Membership:

WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and the Illinois Compiled Statutes (5 ILCS 220/1 et seq.) authorizes the Village of South Elgin (Village) and the County of Kane (County) to cooperate in the performance of their respective duties and responsibilities by contract and other agreements; and

WHEREAS, the Village has exclusive jurisdiction over McDonald Road and desires to transfer jurisdiction to that part of McDonald Road from Randall Road to Umbdenstock Road to the County under the terms and conditions as set forth in the Intergovernmental Agreement for Jurisdictional Transfer (a copy of which is on file with the Kane County Clerk); and

WHEREAS, the County desires to accept exclusive jurisdiction of McDonald Road from Randall Road to Umbdenstock Road pursuant to the aforementioned agreement.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County of Kane accept jurisdiction of McDonald Road from Randall Road to Umbdenstock from the Village of South Elgin and that the County Board Chairman is authorized to execute an agreement and any other documents necessary to accomplish the same; said jurisdictional transfer to be effective in accordance with the Local Agency Agreement for Jurisdictional Transfer executed by the County of Kane, the Village of South Elgin and the Illinois Department of Transportation.

WHEREAS, Phase II Engineering services are required for the proposed intersection improvements of Kane County Highway No. 34 (also known as Randall Road) at its intersection with Bolcum Road (hereinafter referred to as the "Project"); and

WHEREAS, in order to accomplish the Project, it is necessary to retain the services of a professional engineering firm to provide Phase II Engineering services; and

WHEREAS, Ciorba Group, Inc., 5507 North Cumberland Avenue, Suite 402, Chicago, IL 60656-1471 has experience and professional expertise in Phase II Engineering and is willing to perform the required services for an amount not to exceed Forty One Thousand Eight Hundred Eighteen and 96/100 Dollars ($41,818.96).

WHEREAS, the County and the State desire to undertake Phase II Engineering for the Improvement at an estimated cost of $41,820.00; and

WHEREAS, the Improvement is deemed by the County and the State to be of immediate benefit to the residents of the County of Kane and the State of Illinois in that it shall facilitate the safe and efficient movement of traffic and shall provide for the safety of the motoring public; and

WHEREAS, the County of Kane (hereinafter "County") has entered into an intergovernmental agreement (hereinafter "Agreement") with the Illinois Department of Transportation (hereinafter "IDOT") for funding the salary of the County of Kane's County Engineer's (hereinafter "County Engineer"); and

WHEREAS, the Agreement provides fifty percent (50%) funding of the County Engineer's salary from Surface Transportation Program Funds if said salary conforms to at least ninety-five percent (95%) of the salary schedule recommended by IDOT for County Engineers; and

WHEREAS, the County Engineer's salary conforms with IDOT's guidelines and is at least ninety-five percent (95%) of the IDOT salary schedule; and

BE IT FURTHER RESOLVED that the funding source for the County Engineer's salary shall be Fifty Nine Thousand Five Hundred Seventeen and 50/100 Dollars ($59,517.50) in Motor Fuel Tax Funds and Fifty Nine Thousand Five Hundred Seventeen and 50/100 Dollars ($59,517.50) in State of Illinois (hereinafter "State") funds received from IDOT in exchange for County Surface Transportation Program funds pursuant to said Agreement. WHEREAS, the County Board of Kane County has entered into an agreement with the Illinois Department of Transportation for the transfer of federal funds to pay one-half of the salary paid to the County Engineer.

WHEREAS, these fees collected shall be used solely for the reimbursement to the County of costs for medical expenses and administration of the fund.

NOW, THEREFORE, BE IT ORDAINED by the Kane County Board that the fee shall be taxed as costs to be collected from the defendant, if possible, upon conviction or entry of an order of supervision. This fee shall not be considered a part of the fine for purposes of any reduction in the fine. All such fees collected shall be deposited by the county in the County Jail Medical Costs Fund.

Allan said that this resolution is putting a band-aid on a problem. Allen is voting against this resolution due to ones who receive court supervision have to pay a fine to pay for medical cost. Allen further stated that when a person is in jail receiving medical treatment; the county should pursue to see if the person has medical insurance or public aid to cover the cost of treatment. Allen will be voting against this. Hurlbut stated that the company the county already hired go after the inmates to see if they have medical insurance and have that pay for the treatment/reimbursement. Allen stated further that the cost amount people who do court supervision will never be in jail will be asked to pay the medical cost.

APPROVING ALTERATION OF SPEED LIMIT LANDROSE LANE - VIRGIL TOWNSHIP

WHEREAS, Kane County through its Division of Transportation has caused an engineering and traffic investigation to be made on Landrose Lane, a highway not under the jurisdiction of the Illinois Department of Transportation; and

WHEREAS, the Transportation Committee of the Kane County Board has reviewed the results of said investigation and has recommended the alteration of the existing maximum speed limit of thirty (30) miles per hour as set forth in the Illinois Vehicle Code, (625 ILCS 5/11-604), so as to be both reasonable, safe and proper.

NOW, THEREFORE, BE IT ORDAINED by the Kane County Board, that pursuant to Illinois Vehicle Code, (625 ILCS 5/11-604), the maximum speed limit on the section of Landrose Lane shall be twenty five (25) miles per hour as indicated in the schedule set forth below.

BE IT FURTHER ORDAINED, that this ordinance shall be effective upon the approval of the Kane County Board as provided by Statute and the posting of signs giving notice of said twenty five (25) miles per hour maximum speed limit.

WHEREAS, the sworn peace officers (deputies and sergeants) and civilian employees of the Kane County Sheriffs Office ("Union") maintain a Collective Bargaining Agreement in effect through November 30, 2010; and

WHEREAS, the County of Kane, the Kane County Sheriff and the Policemen's Benevolent Labor Committee (PBLC) have engaged in effective and meaningful negotiations concerning wages, hours and other terms and conditions of employment affecting the Union members for the purpose of attempting to balance the 2010 Fiscal Year Budget of the Sheriffs Office; and

WHEREAS, all parties have agreed to a Union Concession Memorandum of Understanding that will bridge a deficit in the Sheriffs Office 2010 Fiscal Year Budget.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that upon approval and execution of the Union Concession Memorandum of Understanding by the Kane County Sheriff and the PBLC, the Kane County Board Chairman is hereby authorized and directed to
