Love's travel plaza planned for Angleton

ANGLETON — The city’s plans to extend utility lines along Highway 288 at FM 523 to attract growth and expansion are proving attractive to businesses, as a third customer is in line to set up on the site. City Council this week approved spending

$517,700 to extend water and sewer lines to the southwest corner of the intersection for the 21.02-acre tract that Love’s Travel

Stops and Country Stores Inc. has plans to develop into a gas station and convenience store.

The city agreed to having the utility lines in place by the second quarter of 2016, and Love’s will be responsible for $315,300 in impact fees, according to the agreement. The fee will be paid in two installments, one when the agreement is signed and the

other when the utility lines are complete.

“That’s their share of the improvements,” City Manager Michael Stoldt said. Because an official impact fee has not been

adopted by council, Love’s will be reimbursed if the impact fee comes in lower than $15,000 per acre, which is how the $315,000 was determined, he said.

Love’s Travel Stops Media Specialist Kealey Dorian said there weren’t many details she could give about the store yet becauseit is early in the development phase, but the company is looking to expand its reach in Texas and across the nation, and Angleton fits the company’s desired location.

“We like the area, it fits in really well with the network of locations we already have,” Dorian said. “We like to look for a mix of local people who can support the store and also areas that see those traveling and professional drivers. We look for that trifecta.” There aren’t any building plans yet, but a typical Love’s Travel Stop is an all-in-one convenience store with at least one restaurant attached to the structure, Dorian said. The stores generally offer fresh fruit, snacks, fountain drinks and ready-made sandwiches and also a section for long-haul drivers to get supplies for the trucks and other things they might need, she said. Often, there is also a Love’s Truck Tire Care facility on site that is a separate structure that performs routine tire and other checks for truck drivers, Dorian said. On average, a Love’s store employs about 60 people, she said.

The city had already planned to spend $1.4 million to extend utilities to the area along the highway near FM 523 for the Angleton 288 Industrial Park and future development, Stoldt said. The new lines added for Love’s will also be larger than necessary so that if other businesses come along, they can be tied into the Love’s lines, he said. “It’s so we can continue those lines to the next area. To say they’re just to serve Love’s isn’t entirely true. They’ll be larger than just to serve Love’s so we can continue lines to further serve other areas,” Stoldt said.

The next steps for Love’s will be to get the lot annexed into the city then rezoned to make sure it has the correct land-use designation before construction can begin, Stoldt said. The company’s representatives have already submitted the requests forboth changes, he said.

Dorian said the company is eager to move forward in the process. “We’re really hopeful this location will come through,” she said

IF THE BROKER REPRESENTS THE OWNER:The broker becomes the owner’s agent by enteringinto an agreement with the owner, usually through awritten - listing agreement, or by agreeing to act as asubagent by accepting an offer of subagency from thelisting broker. A subagent may work in a different realestate office. A listing broker or subagent can assistthe buyer but does not represent the buyer and mustplace the interests of the owner first. The broker is required to treat eachparty honestly and fairly and to comply with TheTexas Real Estate License Act. A broker who acts asan intermediary in a transaction:

(1) shall treat all parties honestly;(2) may not disclose that the owner will accept aprice less than the asking price unless authorizedin writing to do so by the owner;(3) may not disclose that the buyer will pay a pricegreater than the price submitted in a written offerunless authorized in writing to do so by the buyer;and(4) may not disclose any confidential information orany information that a party specifically instructsthe broker in writing not to disclose unlessauthorized in writing to disclose the information or

or required to do so by The Texas Real EstateLicense Act or a court order or if the informationmaterially relates to the condition of the property.

With the parties’ consent, a broker acting as anintermediary between the parties may appoint aperson who is licensed under The Texas RealEstate License Act and associated with the broker tocommunicate with and carry out instructions of oneparty and another person who is licensed under thatAct and associated with the broker to communicatewith and carry out instructions of the other party.

If you choose to have a broker represent you,you should enter into a written agreement with thebroker that clearly establishes the broker’sobligations and your obligations. The agreementshould state how and by whom the broker will bepaid. You have the right to choose the type ofrepresentation, if any, you wish to receive. Yourpayment of a fee to a broker does not necessarilyestablish that the broker represents you. If you haveany questions regarding the duties andresponsibilities of the broker, you should resolvethose questions before proceeding.
