Les machines semi-automatiques sont équipées d'un mouvement d'archet et d'étau à commande hydraulique, d'une unité de réduction composée d'engrenages trempés, d'un rapide mouvement d'archet haut / bas et d'une coupe avec un réglage infinitésimal. Toutes les scies à ruban semi-automatiques ont un double bouton de sécurité pour le démarrage du cycle et le système électrique basse tension a été conçu selon les règles CE.

réviser, tester ou autrement apprécier le résultat des services rendus jusqu’à ce moment par le prestataire de services. Dans un délai maximal de cinq (5) jours suivant la demande du prestataire de services, le client doit approuver ou refuser le travail effectué par le prestataire de services. Si le client approuve le travail effectué ou omet de manifester son approbation ou son refus à ’intérieur dudit délai, le travail effectué est réputé approuvé et fait conformément aux spécifications, et le prestataire de services peut continuer son travail, s’il y a lieu. Si le client refuse le travail effectué, en tout ou en partie, il doit aviser le prestataire de services à l’intérieur dudit délai et par écrit de toute erreur, omission, non-conformité aux spécifications ou autre motif de refus, en donnant les indications utiles et précisions nécessaires à une bonne compréhension des points reprochés. Le prestataire de services dispose alors d’un délai dix (10) jours ouvrable afin de procéder à la correction des points reprochés et de soumettre de nouveau au client le résultat de son travail. Si le prestataire de services est en désaccord avec le client sur un ou plusieurs des points soulevés dans l’avis de refus, il doit faire part de sa position par écrit au client dans un délai maximal de cinq (5) ours suivant la réception dudit avis de refus.


Effet et conditionsLa vente des produits et services décrits aux présentes est soumise à ces conditions et régie uniquement par elles et aucune condition liée au bon de commande de l’acheteur, aucun accord ni aucune autre entente ne liera le vendeur ni ne s’appliquera de quelques manières à la vente de tels produits. Aucune modification de ces conditions ne sera exécutoire à moins d’être signée par un agent autorisé du vendeur. Aucun devis, dessin, imprimé ou photo préparés par l’acheteur relativement à sa commande de produit ou services ne liera le vendeur.

Élection de domicileLes parties conviennent d’élire domicile dans le district judiciaire de Québec, Province de Québec, Canada, et choisissent celui-ci comme le district approprié pour l’audition de toute réclamation découlant de l’interprétation, l’application, l’accomplissement, l’entrée en vigueur, la validité et les effets du présent contrat.

Modalités de paiementSauf indication contraire, les prix sont indiqués en dollar canadien pour les produits vendus à même les stocks ou envoyés directement à l’acheteur par le fabricant (franco camion au point d’expédition). Un intérêt de 1.5% par mois (18% par année) sera imputé aux comptes en souffrance. Le vendeur suspendra les livraisons ou l’exécution en vertu des présentes ou de tous autres contrats avec l’acheteur jusqu’à ce que son compte soit en règle.

Livraison et délai d’exécution des prestations de serviceLes dates d’expédition et d’exécution sont approximatives et le vendeur n’assume aucune responsabilité pour les retards.

F.O.B : CanadaLes envois seront faits selon la méthode la plus économique, prépayée et chargée au client, à moins d’avis contraire, international : La marchandise est vendue FOB Québec, QC et les risques ainsi que les responsabilités sont transférés à l’acheteur lors de l’arrivée au point FOB, à moins d’avis contraires.

Titre de propriété et risque de perteTous les droits, titres de propriété et intérêts liés aux produits subsisteront pour le vendeur jusqu’à ce que les produits aient été payés intégralement. L’acheteur accepte par la présente la publication de cette

disposition. Le risque de perte de tels produits sera entièrement assumé par l’acheteur à compter du moment ou elles seront confiées à un transporteur public et les pertes, les dommages, la détérioration ou la destruction des produits par la suite ne dégageront pas l’acheteur de ses obligations en vertu des présentes. En cas de défaut de paiement, le vendeur aura le droit de prendre possession de tous produits déjà livrés et de retirer ceux-ci sans avis et sans procédures judiciaires, auquel cas tous les paiements jusque-là versés seront crédités au compte de l’acheteur après déduction de frais de location raisonnable et des coûts des reprises de possession, le cas échéant, y compris les frais juridique. L’acheteur accepte par les présentes de défendre, d’indemniser et de mettre à couvert le vendeur relativement à toutes réclamations, poursuites et autre demandes en raison, mais sans s’y limiter, de la conservation du titre de propriété des produits par le vendeur alors que le risque s’y rapportant est assumé par l’acheteur.

Réclamations concernant les produitsToute réclamation relative à un envoi incomplet ou à des inexactitudes doit être fait dans les deux (2) jours de la date de réception des produits.

Données techniquesTous les dessins, textes descriptifs, dimensions, plans électriques et données de rendement soumis avec l’accusé de réception du bon de commande du vendeur, ou intégrés à celui-ci, sont fondés sur les renseignements fournis par l’acheteur conformément à ses exigences et le vendeur n’assume aucune responsabilité concernant l’exactitude de ces renseignements.

Garantie limitée pour les produits et piècesSous réserve de ce qui suit, le vendeur (Montfort International Ltée étant le distributeur/ revendeur) fera bénéficier à son client de toutes les garanties offertes par les fabricants. Tout produit susceptible à un retour et/ouréclamation de garantie est sujet à une inspection et évaluation de notre département de contrôle de qualité qui confirmera ou infirmera que ledit produit fut utilisé dans un contexte d’usage normal. Est exclus de la garantie, les frais de déplacement et de subsistance des techniciens (Point de départ Ville de Québec, Qc, G1M 3K8) et tout produit ayant subi une modification, utilisation, installation, et manipulation inappropriée. La garantie ci-dessus est la seule exclusive expresse ou tacite, fournie par le vendeur et elle remplace toutes les autres garanties, de quelques natures que ce soit,

contractuelle, juridique, règlementaire ou autre, à des fins de commercialité, de qualité, de compatibilité ou autrement. La responsabilité du vendeur ne dépassera en aucun cas le prix d’achat des produits payés. En aucun cas, le vendeur (y compris, s’il y a lieu, ses filiales et sa maisonmère ainsi que ses actionnaires, dirigeants, cadres, employés, collaborateurs et sous-traitants) ne peut être tenu responsable envers l’acheteur ou envers des tiers de tout dommage indirect, incident, punitif ou exemplaire, de même que de façon non limitative de toute perte de profit ou autre perte économique, notamment, mais sans limiter ce qui précède, quant aux performances des équipements ou produits acquis par l’acheteur.

En aucun cas le prestataire de services (y compris, s’il y a lieu, ses filiales et sa maison-mère ainsi que ses actionnaires, dirigeants, cadres, employés, collaborateurs et sous-traitants) ne peut être tenu responsable envers le client ou envers des tiers de tout dommage indirect, incident, punitif ou exemplaire, de même que de façon non limitative de toute perte de profit ou autre perte économique, notamment, mais sans limiter ce qui précède, quant aux performances des équipements ou produits acquis par le client. En aucun cas la responsabilité du prestataire de services envers le client ne pourra dépasser la valeur des services rendus au client et payés par ce dernier. Le client dégage expressément le prestataire de services de toute responsabilité au-delà de cette limite.

Processus de vérification, de test et d’approbation pour la prestation de serviceSur demande formulée par le prestataire de services au terme de chacune des phases de prestation de services indiquées dans les spécifications, le client doit vérifier,

Limitation of responsibility and Guaranteed limited for the service offer On no account the value of the guarantee can exceed the value of the services provided to the Purchaser and paid by this one. The Purchaser gives up expressly any complaint on guarantee beyond this limit. The Vendor/Service provider cannot be held responsible toward the Purchaser of any fault and any damage, direct or indirect, being able to ensue from it, and the Purchaser holds the quits and unhurt Vendor/Service provider of any complaint, including any complaint on guarantee, in the one or other one of the following cases: modifications brought to the contents by someone other than the Vendor/Service provider or his representative; illegal or non-authorized intervention of any third party in the equipments of the Purchaser. Except when otherwise planned in the present contract, on no account the Vendor/Service provider (including, if necessary, his subsidiaries and his parent company as well as his shareholders, managers, executives, employees, co-workers and subcontractors) cannot be held responsible toward the Purchaser or a the third parties of any indirect, incidental, special, punitive or exemplary damage, includes in a not restrictive way any loss of profit or the other economic loss (ensuing from a contractual fault, from a liable to penalty fault or from negligence) even if the Vendor/Service provider was warned of the possibility that such a damage occur. In no account the value of the guarantee can exceed the value of the services provided to the Purchaser and paid by this one. The Purchaser gives up expressly any complaint on guarantee beyond this limit.


Terms and conditions of saleVendor accepts Purchaser’s order on the express condition that Purchaser agrees to and is bound by the terms and conditions set forth below. All orders by Purchaser shall be subject to the following terms and conditions of sale. Such agreement shall be conclusively and irrevocably evidenced by Purchaser accepting delivery of shipment under such order or by Purchaser’s payment of the invoice covering such payment. The sale of the Goods described herein (The Goods) is subject to and governed solely by these terms and conditions and no terms or conditions or Purchaser’s purchase order , any agreement or any other understanding shall be binding on Vendor or apply in any manner to the sale of such Goods. No modification of these terms and conditions shall be of any force or effect unless signed by an authorized officer of Vendor. No specification, drawing, print or photograph prepared by Purchaser relative to Purchaser’s order shall be binding on Vendor for any purpose unless signed by an authorized officer of Vendor

Choice of residenceThe parties agree to elect place of residence in the judicial district of Quebec, Province of Quebec, Canada, and choose this one as the district suited as the hearing of any complaint ensuing from the interpretation, the application, the fulfillment, the coming into force, the validity and the effects of the present contract.

Terms of paymentUnless otherwise specified, prices are quoted in Canadian dollars for Goods being sold from inventory, FOB Vendor’s delivery truck at Vendor’s warehouse, and FOB manufacturer’s plant for domestic Goods being drop-shipped to Purchaser. Interest at the rate of 1.5% per month will be charged on past due accounts (18% per annum). If Purchaser’s account is past due, in addition to other rights and remedies. Vendor may suspend shipments, deliveries or performance hereunder or under any other contract with Purchaser until Purchaser’s account becomes current.

Delivery and period of execution of servicesShipping dates are approximate only and Vendor assumes no responsibility for delays.

Title and risk of lossAll right, title and interest in and to the Goods shall remain with Vendor until such Goods have been paid for in full. However, such Goods shall be entirely at Purchaser’s risk from the time placed on a common

carrier and the loss, damage, deterioration or destruction of the Goods thereafter shall not release purchaser from its obligation hereunder. In the event of any default to make payment by the Purchaser, Vendor shall have the right to take possession of any Goods already delivered and to remove same without notice and without legal proceeding, in which case all payments theretofore made shall be credited to the Purchaser’s account after deduction of a reasonable rental fee and the costs of repossession, if any, including reasonable legal fees. Purchaser hereby agrees to defend, indemnify, and save harmless Vendor from any and all loss arising out of any or all claims, suits and demands by reason of, but not limited to, the retention of title to the Goods by Vendor while same are at the Purchaser’s risk.

ClaimsAll claims for missing items or inaccuracies must be made within two days of the date of receipt of Goods.

Procedure for inquiry, test and approval for the provision of serviceOn request formulated by the Vendor/Service provider in the term of each of the phases of service offer indicated in the specifications, the Purchaser has to verify, revise, test or otherwise appraise the result of the services given until now by the Vendor/Service provider. For a maximal delay of five (5) days following the request of the Vendor/Service provider, the Purchaser has to approve or refuse the work made by the Vendor/Service provider. If the customer approves the service supplied or omits to show his approval or his refusal inside the aforementioned delay, the service supplied is considered approved and made according to the specifications and the Vendor/Service provider can continue its work, if necessary. If the Purchaser refuses the service supplied, in all or in part, he has to inform the Vendor/Service provider inside the aforementioned delay and in writing about any error, omission, non-compliance in the specifications or the other motive for his refusal, by giving the useful indications and the precision necessary for a good understanding of the liability. The Vendor/Service provider has then a ten (10) working days period to proceed to the correction of the blamed points and subject again to the Purchaser the result of its modification. If the Vendor/Service provider disagrees with the Purchaser on one or some of the points raised in the notice of refusal, he has to announce his position in writing to the Purchaser for a maximal delay of five (5) days following the reception of the aforementioned notice of refusal.

Technical dataAll drawings, descriptive matter, weights, dimensions and performance data submitted with or made a part of Vendor’s Order Acknowledgement are based upon information furnished by the Purchaser in accordance with its requirements and Vendor assumes no responsibility for the accuracy of such information.

Force majeure Vendor / Service provider cannot be considered faulty by virtue of the present contract if the execution of its obligations, in all or in part, is delayed or prevented as a result of a situation of force majeure. For all purposes hereof, force majeure includes any act of God, war, mobilization, governmental regulation, strike, lockout, drought, flood, total or partial fire, obstruction of navigation, loss, damage or detention in transit, defective materials or delays by shippers, or other contingences or causes beyond Vendor’s control which might prevent the manufacture, shipment or delivery of Goods covered hereby. Performance of Vendor’s obligations may be suspended pending force majeure, without Vendor being responsible to Purchaser for any damages or losses resulting from such suspension.

Limited warranty for products and services The Vendor /Service provider shall ensure that Purchaser benefits from existing manufacturers, warranties and in no event shall Vendor’s warranty exceed the warranty given by manufacturers, of the Goods. The sole obligation of Vendor under such warranty shall be to replace or repair as deemed appropriate by manufacturer Any product susceptible to be return and\or claim of warranty is subject to an inspection and an evaluation from our department of quality control which will confirm or will counter that the aforementioned product was used in a context of normal use. Any product having sudden a modification, an use, an installation, and inappropriate manipulation are excluded. The above is the sole and exclusive warranty, express or implied, provided by Vendor and is in lieu of all other warranties, of any nature whatsoever, contractual, legal, statutory or other, and whether for merchantability, quality, fitness or otherwise. The liability of Vendor will not under any circumstances exceed the purchase price of the Goods furnished. Is excluded from the warranty; Travel and living expenses for the technicians (Starting point: Québec City, QC, G1M 3K8).
