The operation, which lasted over 10 hours, saw immigration officers from the Department of Home Affairs, with other special forces from the police, and almost 100 law enforcement officials infiltrating the Mountain Rise Policing area. Immigration officers said that many of the foreigners come from Malawi. Often these people hide out in ships, on the shelf near the propellers or in the area where the anchor and chain is stored. The officers also said that theses people can survive two weeks with glucose powder and a bottle of water. The first stage of the operation took place in Site 11 informal settlement in Woodlands. Members of the police showed visibility and conducted stop and searches when necessary in order to root out any illegal immigrants. “The entire area was covered with police and immigration officers. Various houses in the informal settle- ments were identified. Police were able to apprehend 11 undocumented persons without a valid passport or permit to be in our country,” said Warrant Officer Joshua Maistry, corporate communications and youth desk coordinator. High police visibility continued throughout the Site 11 informal settlement. “The local residents came out in their numbers to see what was going on and commended the police for the high level of visible policing,” said Maistry. The members were also applaud- ed for the arrests of the illegal immigrants, who residents believe have been committing crimes in the area. Thembilishle Informal Settlement formed the second stage of the opera- tion. Police engaged in the same process with patrols and stop and searches when necessary. There were 12 undocumented persons arrested for not possessing a valid passport or permit. Speaking to Maritzburg Fever, some officers claimed that there are many illegal immigrants employed by businesses in the city, thus taking employment away from the locals. “As the operation continued, people in various areas started complaining about businesses that employ undocumented persons, preventing them from getting jobs,” said Maistry. Following intelligence from membersandthecommunity,several business premises was visited to check if their employees were legal. “One business manager was arrested and charged for employing illegal immigrants in terms of the Immigrations Act,” he said. The Mountain Rise police depart- ment is dedicated to rooting out those people who are not complying with the law. While the illegal immigrants themselves are being arrested, should they be found to be employed, the business manager or owner will be arrested and charged as well. The Immigrations Act 13 of 2002, section 38, states that no person shall employ an illegal foreigner, a foreign- er whose status does not authorise him or her to be employed by such person or a foreigner on terms, conditions or in a capacity different from those contemplated in such foreigner’s status. “The employer must, in good faith, ascertain that no illegal foreigner is employed by him or her and ascertain the status or citizenship of such foreigner,” said Maistry. Station commander, Brigadier Francis Bantham, commended all the members for their good work, during the operation. “I would like to send a strict warning to all business owners not to employ undocumented persons. “The implications are serious and such business owners will be arrested and charged in accordance with the law,” she said. A spelling bee works according toknock-out, where spellers are given a list ofpre-chosen words (which will be printed inthe abovementioned titles) two monthsbefore the competition.

These words have to be learned byentrants, who will then gather atcompetitions in their areas, namelyZululand, North Coast, Durban central,Pietermaritzburg or the South Coast, to spelltheir way to glory.

The competition is open to grade 10 and

11 learners (one fromeachgrade - ie twoperschool) from previously disadvantagedschools who speak English as a secondlanguage.

AS South Africa celebrates theannual National Child Protec-tion Week (CPW) from 1 to 8

June, Bevan Clayton put the childrenfirst when he hosted his sixth annualHail Busters community event inGhost Town on Saturday.

CPW is commemorated to raiseawareness of the rights of children.SouthAfrican children live in a socie-ty with a Constitution that has thehighest regard for their rights.

Protecting children fromviolence,exploitation and abuse is not only abasic value, but also a Constitutionalobligation.

Clayton,togetherwithmembersofthe Saps, held the event recentlywhich highlights the importance ofchildren and their right to a crime-free life.

Speaking to Maritzburg Fever,Clayton said that the children areencouragedtowriteletterstohimandthe police about their living condi-tions and family lives. He offers a giftfor the winning letter.

According toClayton, these lettershave been the tip off the police needto make certain arrests and root outcrime.

“Thisyearthewinningletteraskedthe police and the community to lookafter the children whose parents goout drinking and leave them alone athometofendforthemselves,”hesaid.

Letters such as this one help thepolice identify certain issues that thechildreninthecommunityare facing,ones thatwouldhave otherwise goneunnoticed.

“Children innocently speak thetruth. They have helped the policearrest many people for crimeswhichthey noticed.”

This method has been successfulfor many years now and the event iswell supportedby the residents of thecommunity. Clayton praised themembers of the police who arededicated to his cause, especiallyWarrant Officer Shaun Knox,LieutenantColonelBrianOberholzer,Brigadier Derek Captain-Hastibeerand Lieutenant Jack Haskins.

Clayton, theownerofHailBusters,

runs this annual event and a soupkitchen for the people of Ghost TowneveryWednesday.Heplanstotaketheinitiative intoEastwood andSobantuto spread the help, and help othercommunities out.

MSUNDUZI municipal mayorChris Ndlela has called for athorough investigation into lastweek’s protest in Ward 28 in thenorthern suburbs.

Last week, parts of Northdalewere in a state of anarchy whenangryresidentsburnedtyresandused boulders to barricade

Regina Road next to KharinaSecondary School.

The protest is said to haveeruptedafterresidents’electrici-ty was disconnected, despiteclaims that those residents hadpaid for it.

Addressing a full councilmeetingrecently,Ndlelasaidthatthe office of the speaker is facili-tating a meeting between thedelegation of the aggrieved

parties to unpack the grievancesandtogivefinerdetailsastowhathad lead to that protest.

“There are very seriousallegations made by one of thecouncillors, which I am not in aposition to unpack, because wewant to hear the other side of thestory. Someof theallegationsaresuggesting that there may besome involvement of some of usin misleading that particular

community which lead to thedemonstrations. We want to gettothedeeprootofthecauseofthisprotest because already, thereare allegations leveled againstthe ruling party by one of thecouncillors. That councillor wasnot in aposition to giveusnamesbut we will investigate.

“If heads are to roll then wewill leadthatparticularprocess,”said Ndlela.

THE R4.5 billion MsunduziMunicipality budget for2014/ 2015was passed at a

recent full council meeting at theCity Hall.

Addressing full council,MsunduzimayorChrisNdlelasaidthatpoverty, inequalityandunem-ployment still affect the lives ofmany people.

“We are facing the stark realityof children living and sleeping onthe streets. Their daily challengesof being reduced to begging tomake a living are the testimony ofan unfinished job. Families wholive in shacks with no runningwater, sanitation and electricityare a reminder that the pastcontinues to haunt the present,”said Ndlela.

Tariffs and service deliveryCome the new financial year in

July, electricity will increase by

7.39%, water by 8.7% and sanita-tion and refuse by 5.6%.

“Affordability was taken intoconsideration for tariff andproperty rate increases. Tariffsneed to remain or move towardsbeing cost effective and take intoaccount the need to addressinfrastructure backlogs,” saidNdlela.

He stressed the importance ofservice delivery, saying thatMsunduzi employees need to‘shape up or ship out’.

The municipality has put asideR60million to address challengesof critical vacant posts

“We are hoping that this willcontribute immensely towardsaccelerating service delivery tothose who need it most and neediturgently.Infillingtheseposts,wewill not compromise on the issuesof skill and capacity,” said Ndlela.

theft, illegal connections andtechnical losses caused by theageing infrastructure.Hesaid thatcable theft and illegal connectionsare the biggest contributingfactorstopoweroutagesinthecity.He said that the municipality willensure that in the cold monthsahead, electricity supply remainsuninterrupted.

Opposing the budget and IDPAfter holding a five-minute

caucus following Ndlela’s budgetspeech, the Democratic Alliance(DA) councilors opposed theadoption of the budget and theIntegrated Development Plan(IDP) for 2014/ 2015.

DA spokesperson on thefinanceportfolio,DaveRyder, saidthat their major concern is thatthey have not seen the finaldocumentation to satisfy them-selves.

“We have tomake sure that weareabsolutelyhappywithwhatwe

might be approving. We areunable to support this budget andIDP on the basis that we haven’thad sufficient opportunity tothoroughly look at this documen-tation.”

NdlelasaidthattheDAreservesall the rights to support or not tosupport any motion.

“When we did a workshop onthese documents, the DA was notrepresented. We need to under-stand that when we run govern-ment, new as I am in government,wearenotheretomakeeachotherhappy. Therefore the wholequestion of absolute happiness asraisedbyRyder isneitherherenorthere. We will not be able to workif we are here to make each otherhappy. We should spell that outcategorically,” said Ndlela.

Ryder’smotionofnotacceptingthe budget received 11 votesagainst39voteswhichwerefortheadoption of the budget and IDP.

WITH the euphoria and adrenaline rush of thevoting behind South Africans, the moment ofreckoninghasdawneduponpoliticalparties toevaluate their policies in the context of theirperformance in this election.

TheANC’smajority is continuallydeclining.Theyslipped from70%(2004) to66%(2009) to63% in 2014.

The DA share of votes increased from 16%in the last election to 22%. The EconomicFreedom fighters, with Julius Malema as thecommander-in-chief, has done exceptionallywell, offering something different but appeal-ing especially to the young disillusioned voterswhoareunemployedand the landlesswantinghomes.

The challenge now lies in delivery of thesepromises. Parliament is no longer going to bea place where ministers fall off to sleep.

The EFF has probably given new life to themulti-party concept by bringing discontentedvoices into parliament and the provinciallegislature.

They carry the hopes and aspirations of ap-proximately 1.2 million voters who haveendorsed their election manifesto or partsthereof.

Theiremergenceonthereconfiguredpoliti-cal landscape is going to herald exciting timesahead.

The Nkandla debacle was not an issue forthe electorate in many provinces where theANC secured an overwhelming majority.

In Gauteng, it may have swung the voterstowards the DA. The E-Tolling systemhas alsocaused major discontent and added expensesfortheresidentsofGauteng,resultingindeclin-ing votes for the ANC.

Trying times are looming on the horizon astheANCchartersaplantoaddresstheinequali-ties facing our nation. This can be achieved ifcorruption is eliminated from the system andthe relevant personnel, with requisite skills,are placed in key areas such as finance.

In the last financialyear, theauditorgeneralstated that R170 billion was lost throughcorruption and unauthorised expenditure.

If theANC is serious about eliminating theftof taxpayers money in any form what so ever,theyneedtointroducelegislationthatwill“fire”civil servants if caught stealing.

The way forward after 2014 elections

WITH regards to the article“Customers slowly embrace paidparking” in the Maritzburg Fever

on 30 April, I have to make my point aboutchanges that have been made with theunderground parking area.

A large area has been fenced off withpalisade fencing. On inquiring with theworkers, I was told that this area is for thetenants parking - close to the entrance.

My objection to this area being used fortenantsparking is that it is soclose to the liftsand escalators, and now the shoppers haveto park further away. Surely the tenantsparking should have been placed at the farend as they are parked for most of the day?

Are the shoppers not important to themall? What about elderly people?

They now have to walk even longerdistances to their parking?

Your article states that dedicated tenantsparking facility frees up additional parkingfor shoppers. This I findhard to believewithwhat I have seen. Tenants parking is a largearea.

Large shopping malls in Gauteng put thetenants parking away from the shoppers,and do not inconvenience the shoppers bymaking them park further from the lifts andescalators.

Hopefully other shoppers will agree withme,andperhapsmallmanagementwillhavea rethink on this point.

Currently, the area that the tenant bays occupyis only a small percentage of the overall parkingavailable at Liberty Midlands Mall.

The tenant parking area was designed so as notto interfere with public entry into the Mall andallows easy access for shoppers to all entrancesunderground, including the elevators and liftssituated near the north, west and south entrances.

Tenants can opt, at a cost, for a pre­reservedleased parking area in the basement, an optionwhich has always been available to tenants.

However, previously, the parking bays werereserved only by a ‘reserved sign’ and it came toour attention that shoppers were occupying thesebays.

Assuch,theMalldecidedtocordonoffthesamedesignated area, which is now only more visible toshoppers and should not impose on their shoppingexperience at all.

THEdeKock sisters, Amelia (11) andTalita (8), have raised over R1 000 bymaking rhino bracelets and will bedonating the money to the Save theRhino fund.

“We started with the fundraisingbecauseweloveanimalsandwewantour children to get the opportunity tosee the rhinos too,” said theirmother,Liezel de Kock.

The girls started inNovember lastyear and have sold their bracelets tofamily, friends, at their school and

anywhere they can.They are also based at the

Dunrobin Market at the end of eachmonth and Lindsay’s in Hilton.

The bracelets sell at R10 a pieceand come in a variety of sizes andcolours.Thefullamount isdonatedtothe rhino fund.

De Kock said that her youngestdaughter looks up to Ian Player, whoiswellknownasaninitiatorandteamleader of an innovative projectOperation Rhino.

“Ian Player also supported us andsent us a letter. That has been our biginspiration,” she said.

IHAVE been livingwithmy partnerformany years, does thatmakemea common law spouse?Basically - no.There is common belief that if

people cohabitate for a long period oftimetheyenjoythesamemaritalrightsas spouses in a marriage.

In South Africa however, commonlawmarriage is not recognised - livingtogether does not equate to a defaultmarriage.

There is however a principle ofuniversal partnerships which affordsthe cohabitees to claim a share of thepropertyacquiredduring theperiodofliving together. A universal partner-ship is an express or tacit agreementbetween two parties living together toshare responsibilities and obligationsin a permanent relationship withoutever tying the knot.

This, however, does not mean thatthe parties involved enjoy automaticrights. When one of the parties

(partners) passes away without leav-ing a will, the surviving partner doesnotautomaticallybecomethebenefici-ary nor have maintenance paid tothem.

Thesurvivingpartnermustprovetothecourtthathe/shewasindeedinthisrelationship, and that he/she is owedsomething.

In two recent judgements, therequirements for a recognised part-nership were set out.

The requirements were applied inboth cases and the universal partner-ships were recognised as they eachfulfilled the following requirements:1.Each party brought something into therelationship.2.The partnership continued for their jointbenefit.3.The object of acquiring the property wasto make profit.

A written contract between theparties in a universal relationship willforce a court to recognise and enforcethe terms of the agreement therein.

To protect each partners interests,cohabitees are advised to instruct anattorney to draft a universal partner-ship agreement, clearly enunciatingthetermsoftheagreementwhichmustencompass the following:>> Division of their property>> Duty and support to each other>>The right to share in each others propertyduring the term of the relationship>> Terms regarding termination>> The right to inherit from each other’sestate should either party die without a willin place.

Itisalsostronglyadvisedthatavalidwillbedrawnupbybothpartiestogov-ern and protect the succession of par-ties. Any children conceived in a uni-versal partnership are catered for inthe Childrens Act No 38 of 2005. Itprovides that a father of a child who isnot married to the child’s motheracquires rights and responsibilities tothat child. These include, amongstothers, maintaining contact, acting asguardian, and contributing to themaintenance of the child.

Kerooshan Pather (20) had when hebegan his organization, KITProductions, in February this year.

Pather, a part-time deejay, iscurrentlystudyingtravelandtourismat Damelin College, and runs theorganizationonaSaturdayafternoonfrom his home in Lahore Road,Northdale.

Hismaingoal is toget theyouthoffthe streets and encourage them tooccupy their free time doing some-thing productive, rather than getinvolved in social ills.

“My aim is to get them to dosomethingproductivewith their timebecause, as youth, we are the future.There are so many children gettinginvolved in drugs and alcohol whichsometimes results in them losing

their lives, either in accidents or bycommitting suicide,” said Pather.

Children between the ages of 15and 20 are encouraged to join KITProductions at no cost.

Patherrunstheprogrammefortheyouthwithhisallowanceandwiththehelp of his parents when possible.

LanceVeenstraapproachedmeatthe end of 2011 and asked if Iwould be interested in starting aninitiativewherebywewouldintro-duce the Grade one’s and two’s atCordwalles to rugby as a wholeand develop their basic skills sothat when they started formalrugby in Grade three, they wouldalready be familiar with theconcept of rugby.

“Through Cordwalles’ alreadystrong outreach link withAshdown School, it seemed anatural progression to getinvolved with them and see if wecould not help expose some of theboys at Ashdown to rugby.”

These are the heart-warmingwords of Cordwalles teacher andcoach Rory Bremner, the formerMaritzburg College and PMBVarsity first XV scrumhalf.

The Rugby Cubs initiative ispart of Cordies’ (as the school isfondly known) outreach relation-ship with Ashdown Primary,which is in operation on manylevels - academic, cultural andother.

Once training is done, the boysare transported back to Ashdownin the Cordies bus.

“Our main outcome that wehope to achieve is the opportunityto expose young boys to thewonderful game of rugby whenordinarily, they probably wouldhave never had the chance toexperience it,” said recentlyqualified teacher Bremner.

“Itisafun,safeenvironmentforthem and something differentfrom their normal daily routineand at a young age we are able toidentify those with potential andhelp to develop them further.”

SOUTH Africa’s most beautifulroad race, the SPAR Women’s10/5km, will once again entice

thousands of capital runners out ontothe roads on Sunday, 22 June inPietermaritzburg.

The start and finish of this year’sracewillbeinTheAlexandraParkOvalCricket Grounds precinct.

The route takes runners throughthe picturesque setting of AlexandraParkandpromises toattractover4000participants.

The route for the 2014 editionremainsthesameaftercomplimentaryreports fromthetoprunnerswhocom-peted last year.

“Jenna Challenor, who blitzed herway through the race, only hadcomplimentary things to say about theroutesowehavedecidednot tochangeit.
