Winter 2003 MADD Canada’s Mission: To Stop Impaired Driving And To Support Victims Of This Violent Crime. MADD Canada was granted intervenor status in the Zoe Childs case – an important court case that will set standards for a host’s liability in serving and/or having alcohol at a party or event. As the Ottawa Citizen has described this case, “[it] could rewrite the law on the liability [negligence] that party hosts should be held to if a guest drinks too much, drives and hurts somebody.” Zoe Childs, now 23, is the Ottawa-area student who was injured when impaired driver Desmond Desormeaux hit a car she was a passenger in on New Year’s Day 1999. The impact of the crash killed Derek Dupre, 17, and injured five others in the two cars — including Ms. Childs. Ms. Childs was left paralyzed from the waist down with a severed spine. Ms. Childs and her family sued the hosts of the party attended by Mr. Desormeaux. The Childs felt the party hosts, Dwight Courrier and Julie Zimmerman, should be financially liable for her injuries. In the trial, Ontario Superior Court Justice James Chadwick ruled that Mr. Courrier and Ms. Zimmerman were partly responsible for the crash, but that if the liability law required any changes, the government, not the courts, should do it. This is the ruling that is now being appealed, and MADD Canada will be able to make its intervening statement regarding this significant public policy issue. “MADD Canada supporters should be pleased with its intervenor status on this important case,” says Professor Robert Solomon, the organization’s National Director of Legal Policy. “Our argument is that those who organize and host alcohol-related events on their property, owe some legal obligation to discourage obviously extremely intoxicated guests from driving away to the risk of all other users of the road.” “In Canada, the vast majority of alcohol consumed is in private homes and at party functions. The research, although dated, suggests that more than twice as many impaired drivers on the road are coming from the homes of friends than from licenced establishments,” says Mr. Solomon. “MADD Canada’s seeking intervenor status is simply part of its larger campaign to educate all those who host or organize alcohol-related events,” he adds. MADD Canada has published three informative booklets on the issue of a host's liability (for private functions, office parties, and parents of teens). It has also published an instructive brochure to help hosts wisely plan events where alcohol may be present. “MADD Canada believes Sobriety Checkpoints or R.I.D.E.(Reduce Impaired Driving Everywhere) Programs are veryuseful programs to stop impaired driving in our communities.These programs not only serve to detect and apprehendimpaired drivers on our roads, they send a public educationand awareness message to motorists not to drink and drive.”

MADD Canada fully supports SobrietyCheckpoints / R.I.D.E. Programs

These programs can:

• Reduce drinking and driving

• Provide an essential component to a comprehensive strategy to stop impaired driving

• Reduce alcohol-related crashes that are fatal / cause serious injuries

The goals of Sobriety Checkpoints/R.I.D.E. Programs are:

• Prevent needless deaths and injuries in alcohol-related crashes

• Deter motorists from driving while impaired, especially during holiday weekends

• Increase the awareness of the benefits of using checkpoints

• Increase the use of this life-saving deterrent / enforcement tool in areas where checkpoints are conducted

• Encourage the use of seat belts as the best protection against death and injury in an alcohol- or other drug related crash

FACTS: A 1997 U.S. research study concluded that Sobriety Checkpoint Programs are effective in apprehendingdrunk drivers. Generously funded intensive Checkpoint Programs (i.e. 156 R.I.D.E. programs per year) can beexpected to reduce alcohol-attributable crashes by about 15%. Communities realize savings in medical care, publicprogram, property damage, future earnings, and quality of life.

MADD Canadaviews this holiday season as a veryimportant occasion to both supportimpaired driving victims, as well as tounderline our message to the public:DRIVE SOBER AT ALL TIMES.

By design, our most recognizedpublic awareness campaign is also ata time of year when there is a greaterpublic focus on drinking and driving.MADD Canada’s symbol of a redribbon tied to a vehicle has come tosignify Canadians’ support for ourcampaign against impaired driving.Each year, MADD Canada rallies toincrease the public’s awareness thatdrinking and driving can have tragicconsequences, and remembers thevictims of this violent crime throughour constant efforts to eliminateimpaired driving.

For the Knox family, the redribbon has special meaning. On ourfamily vehicles, we fly red ribbonsall-year-long as a tribute to our son,Mike, who was killed by an impaireddriver. We fly our red ribbons toremind people about the dangers ofdrinking and driving, and the often,tragic consequences of mixing the twoactivities. We know there is no reasonwhy there still needs to be victims ofimpaired driving in our country - wewant Canadians to come to know thisfact. The death and injuries caused byalcohol-related crashes can be, andmust be stopped.

The 2003 Project Red RibbonCampaign will run from November1, 2003 to January 5, 2004. MADDCanada’s volunteers put a lot of effortinto delivering the message “Don’tdrink and drive” through thiscampaign. Annually, we distributeover 4 million red ribbons! Our yearlycampaign’s success is really a

testament to the thousands ofvolunteers from coast-to-coast whoparticipate in Project Red Ribbon.

I think the most important elementabout our campaign is the publicdisplay of flying red ribbons - wherepeople make it known that they arepersonally committed to drive safeand sober.

Also, as is in our family’s case, thered ribbon is a tribute to honour aperson and to honour all of those whohave been killed or injured inimpaired driving crashes. So,attaching a ribbon to your vehicleserves as a constant message topeople on the roads to drive safe andsober during the holidays. I also findthat the red ribbon is so closelyidentified with sober driving that,today, there are more and moreCanadians who are flying red ribbonsyear-round.

The MADD Canada campaignthrough the Christmas and New Yearcelebrations is about concernedCanadians asking all Canadians to beresponsible and not drink and drive.Again, the volunteers at the Chapterlevel are the heart of the campaignand they do a tremendous amount ofwork. This year, over 55 MADDCanada Chapters will be launchingProject Red Ribboncampaigns intheir local communities. ManyChapters have plans to distribute redribbons in malls, at events, parades,and with police at R.I.D.E./SobrietyCheck-points. There are many specialevents being held by Chapters – and Iwant to thank all those volunteerswho are participating and getting ourimportant message to the public.

I also want to thank Canadians –including our Corporate Sponsorsand Supporters – who are suppor-ting our Project Red Ribbonawareness drive. You can supportthe Project Red Ribboncampaign bysimply tying a red ribbon to your

vehicle – and by making thatcommitment to drive sober throughthe holidays and throughout theyear.

When you go out to social eventsthrough the holidays, or are hosting asocial event, please think abouttransportation and be a responsiblehost. Do not let your friends andfamily drive after they have beendrinking. As a host, be sure yourguests who are driving are notimpaired – have non-alcoholicbeverages and extra food for thosewho are driving.

Next National President is an active Maritimer

Karen Dunham of Saint John, New Brunswick willbe MADD Canada’s National President commencingSeptember 2004.The mother of three sons, Karen hasbeen adversely impacted by the crime of impaireddriving – and the Dunham family continues to cope withthe everlasting effects of a fateful day in September1999.

The community of Saint John has come to know bothKaren Dunham and Denise Green, who have been tirelessvolunteers for MADD Canada ever since their sons wereinvolved in a horrific crash caused by an impaired driver.Both boys escaped the 1999 crash with their lives – andfor the rest of their lives will suffer the effects of theirrespective brain injuries. And, to ensure this tragedydoesn’t happen to other families in their community, bothKaren and Denise have been instrumental in re-establishing the MADD Saint John Chapter.

Mrs. Dunham often tells the story of supporting alocal drive sober, drive safe campaign and tying a redribbon on her car back in 1997. At the time, she wassymbolically showing her respect for victims of impaireddriving crashes – and then, almost two years later, shewould become all too familiar with what horror and painthis senseless crime brings into a person’s life.

Karen Dunham states: “Impaired driving is a horriblecrime that can have serious consequences. With animpaired driving crash, families, relatives, friends andpeople within your community are emotionallydevastated and the victims are robbed of normal happylives. Innocent people are killed and seriously injured –and the lives of the loved ones are never the sameafterward. Drinking and driving is a selfish act that canresult in irreparable harm and grief. In our family’s case,not a day goes by that we don’t think about what is andwhat could have been.”

Regarding her new national position, Mrs. Dunhamsays: “I feel very honoured to have been selected as thecountry’s voice for such a significant message. I am amother of a surviving victim and the reality of impaireddriving is something our family must live with every day.There are on average four Canadians killed and another200 Canadians seriously injured each day as a result ofimpaired driving. Clearly, this crime affects far too manyinnocent people and impacts far too many families.”

“I look forward to providing a strong voice for allvictims and their families, and to bringing to the nationalstage my experience and understanding as a mother of a

son who must cope with the tragic outcome of drinkingand driving,” says Mrs. Dunham.

In making the announcement of MADD Canada’sfuture president, current National President Louise Knoxsaid, “Karen is a very caring and compassionateindividual, a person who has given of herself in SaintJohn. MADD Canada is very fortunate to have such arepresentative as our next National President. I know shewill be strong, effective and compelling in her pursuit ofour mission to stop impaired driving and to support thevictims of this violent crime.”

Karen Dunham is an entrepreneur with a home basedbusiness. She volunteers for many community causes,including the Salvation Army, Neighbourhood Watch,the Heart and Stroke Foundation, and minor hockeyprograms in Saint John. Karen’s husband, Greg, is aSaint John police officer.

2003 Citizens of Distinction Award –Prevention/Education CategoryJohn Banovich, White Rock, British Columbia

A director/cinematographer, John Banovich’s passionand dedication to stop impaired driving is obvious ineverything he does. In 1997, John was a victim of animpaired driver, unable to work for many months andhas endured 60 reconstructive surgeries. In spite of thepain and ongoing therapy sessions, John volunteers todo countless personal appearances to speak to hundredsof high school students about the dangers of impaireddriving. He’s been instrumental in producing hard-hitting, award-winning public service announcements, atno charge to MADD Greater Vancouver and continuesto deliver MADD Canada’s message in all areas of hislife.

These prestigious awards are presented to individualswithin MADD Canada who demonstrate volunteerismby a self-sacrificial giving of their time and talents, inpursuit of our mission and without expectation ofreward.

Denise Dubyk took an outstanding leadership roleand through determination, resilience and vision madethe Calgary Chapter a reality. Although many people

had tried before, Denise Dubyk wasfinally successful in founding the Chapter. Devastatedby the loss of her son-in-law, Darryl, she knew first-hand the importance of having a MADD Chapter tosupport victim families. As President, she quickly beganforming an alliance with the media, police and other keyofficials in the Calgary area. She’s written countlessletters to MLAs, MPs and Crown Prosecutors. Shecampaigned to have red ribbons tied on police, firedepartment and EMS vehicles for Project Red Ribbon.And she stil l f inds time to support victims andaccompany them to court. Denise is also this year’srecipient of the Western Region Award.

Cst. Stone has been described as one of the mostdedicated and hard working officers on that service.Currently in Traffic Management, he is an intoxilyzertechnician and Collision Reconstructionist. He has a100% conviction rate for fatal motor vehicle accidentsinvolving impaired drivers. Pro-active in reducingimpaired driving, he made a prohibited driving listavailable to road officers that included charged persons,and repeat impaired driving offenders to assist officersin road stops. He has done countless media interviewskeeping the dangers of impaired driving in the public’sminds. In his spare time he volunteers as the Vice-President of MADD Durham Region and has willingly

New this year, this award was established to recognizeVictim Services Volunteers within MADD Canada whoexemplify compassion, dedication, diligence, caring,empathy and respect for those who have suffered a lossdue to an impaired driving crash. These individualsvolunteer their time to support victims of impaireddriving, as well as advocate on their behalf. Expectationsare exceeded to ensure victims and their families receivethe emotional, practical, and legal assistance they deserve.

NATIONAL AWARDMarie Kean, MADD St. Thomas Chapter

Marie Kean is a woman who is opposed to receivingrecognition or acclaim for the work she does. MarieKean has been described as “an amazing and very speciallady who will stop at nothing to see that all victims ofimpaired driving are treated with the utmost respect anddignity.” Some have said that she gives freely of herselfand expects nothing in return.

Marie takes her time with those she is supporting. Shemakes the effort to give a personal phone call on the birthdate and anniversary dates of every victim and theirfamily members. She has become a source of knowledgeregarding victims’ rights in the criminal justice system,and takes personal time to monitor what is happening inher local courts. In addition to the National Award, MarieKean was the recipient of the Ontario West RegionAward.

2003 MADD Canada National Youth Award Becky Quirt is a Gravenhurst, Ontario resident

attending Wilfred Laurier University in Waterloo. Herdefining statement is “Impaired drivers kill so manypeople each year. People die because of the stupidity andselfishness of others. It is not fair and the governmentneeds to tackle this issue. These deaths are preventableand I would like to help stop more people from dying.”Well, Becky didn’t just talk the talk, she took action. Lastyear, Becky contacted 27 politicians and had letters to theeditor published eight times, driving home the messagethat Canada’s youth is demanding change and impaireddriving deaths and injuries are preventable.

MADD Canada will make a difference in the lives of young Canadians by helping with their education…

The MADD Canada bursary will help a Canadian student incollege or university whose parent or legal guardian has died as aresult of an impaired driving crash. A bereaved victim mayexperience many challenges including: a fear of the unknown,the risk of possible regrets, a loss of purpose and direction in life,high stress levels, financial insecurity and communicationbarriers that affect supportive parenting. Multi Media Program empowers youths tomake healthy decisions about alcohol

Starting November 3rd, MADD Canada will be on theroad with two new multi media assembly presentationsentitled FACE and STREETSMARTS. Unlike other years,it will be a MADD Canada staff person who will bepresenting our assembly shows to schools across Canada.This person will be travelling in a vehicle that wasgenerously loaned to us by Suzuki Canada Inc.

Supported by our National Sponsor, Allstate InsuranceCompany of Canada, FACE empowers young people tomake smart, healthy decisions about alcohol, learn fromtheir mistakes and treat every day as a chance to start over.The 35-minute show focuses on teaching secondary studentsabout the importance of making healthy choices, avoidingalcohol and other drug use, and understanding the risks andresponsibilities they face as new teen drivers. The assemblyencourages youth to think critically, stand up for what’sright, protect themselves and their friends, and hold oneanother accountable.

Brad Dixon succeeded Kathie Macmillan as MADD Canada’s Chairman at the recentNational Board of Directors meeting in September. Brad has had a lengthy professionalassociation with both MADD Canada and MADD US and he joined the National Board ofDirectors of MADD Canada in February of 1997. He has provided an invaluable voice ofreason in his roles on the National Board. Brad has served as Chair of the Public PolicyCommittee, a member of the Victim Services Committee and of the Finance and ResourceDevelopment Committee, and is a member of the Executive Committee.

Brad is a partner in the Vancouver office of the national law firm, Borden Ladner Gervais.He practices in the area of civil litigation, including corporate and commercial disputes. Heand his wife, Laura, have two children, Gillian and Matthew.

At the same Board meeting, Senator Marjory LeBreton was appointed Vice-Chairperson.Kathie Macmillan remains on the National Board as Past Chairperson, having served as theChair for a two-year period. Dr. Robert Mann of the Centre for Addiction and Mental Healthattended his first Board meeting as a Director.

The September Board meeting also saw two Directors attend their last meeting after longand distinguished services for MADD Canada. Both Ken Tanenbaum and SandraHendersonwill be missed at the National Board level.

$500 will train one youth to develop solutions to substance abuse, impaired driving, and underage drinking intheir community.

$675 will sponsor one of MADD Canada’s high school education programs for approximately 500 youth.

$600 will train one volunteer to provide support to people who have lost loved ones and/or have sustainedinjuries from an impaired driving crash.

$1,000 will sponsor a sobriety roadside checkpoint in one community.

$20,000 will establish an endowment fund for an annual educational bursary. This bursary will be given to astudent in college or university who has lost a parent or guardian in an impaired driving crash.
