The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

“Measure twice and cut once” is a good rule carpenters use to get a cut right. Getting the right information in the highly com-plex license regulations that ‘rule’ a contractor’s world is also essential. We ‘take-off’ with a mix of ‘half and half’ questions that help illustrate why contractors should consider expert as-sistance in following the rules different states require…

Q: My Company installs passenger-boarding bridges at airports. They are prefabricated steel bridges that go between the airport terminal building and the airplanes. I’ve gone through the list and definitions of the CSLB classifications and I’m thinking that we would need either the “D-21” (Machinery and Pumps) or a “C-51” (Structural Steel) license to perform this work in California. Can you give me an opinion on what you believe is the appropriate clas-sification?

A: You are halfway to the right answer! It appears that some con-tractors still are licensed for this work with a “D-21” class. How-ever, in consulting with the CSLB, that is no longer the practice. These two classifications are what they say would be appropriate for this type of work, either the “C-51” Structural Steel classifica-tion, as you suggested, or the “D-34” (Prefabricated Equipment).

Q: I previously had licenses in California and nevada and I let them both lapse. The California license has been expired since June 2012 and the nevada license expired in August 2012. Can I renew the licenses or will I be required to re-apply and re-take the exams?

A: I’ll start with the good news: you can renew your CA license and you will not be required to re-take the exams. Once a CA license expires, you have up to five years to renew the license without re-testing. nevada also allows five years to go by before you are required to re-take the exams, however the bad news is that once a nevada license has been expired for a period of six months, you can no longer renew the license and you are required to re-apply for a new license number. This will involve paying the license application fee, providing new financial information, and all individuals listed on the application will be required to get finger-printed.

Q: We are licensed General contractors with a “B”. We are consid-ering self-performing the Plumbing and HVAC trades for projects on which we are the General contractor. Does the CSLB require us to additionally have a “C-20” and a “C-36” license, or may we perform this work under our “B” license?

A: As a “B” contractor, you are able to self-perform the HVAC and plumbing work without obtaining the additional specialty classifica-tions. B&P Code Section 7057 addresses this topic and states that a “B” contractor must perform “at least two unrelated building trades or crafts other than framing or carpentry”. Plumbing and HVAC are considered two unrelated trades so you are good to go!

Contractor’s note: In a recent newsletter the CSLB reminds contractors to pull building permits to avoid license penalties. As things heat up, pulling permits is especially important for “C-20” (HVAC) contractors whose work must also meet Home Energy Rating System (HERS) tests to comply with state Building Energy Efficiency standards.

The CSLB is now working with the California Energy Commis-sion to ensure compliance through enhanced enforcement efforts to ensure that contractors are following state contracting laws, and HVAC contractors may be targeted in these stings.

SB 399 (Wright) Requires Payments to Contractors Within 30 Days If Called Out on An EmergencySo, you receive an emergency call from the State of California to fix a plugged sewer line in their 10 story building in LA that is so bad they have to send the workers home. Certainly fixing this problem would mean that you would be paid promptly, right? Guess again! We’re talking about bureaucrats here who could “give a rip!”

Amazingly, although this job was performed in early October, our contractor didn’t get paid until mid-February!! AnD, during that extended length of delay it even included the direct involvement of the top “Wonks” at the Department of General Services (DGS)!! However, without their “efforts” it would have meant that the contractor would still be waiting to get paid today! Incredibly, even though it was DGS calling the contractor out on an emergency basis, the contractor was required MOnTHS AFTER THE JOB WAS COMPLETED to provide a payment and performance bond, GL Insurance, proof of workers’ comp and much more; plus, DGS’ legal department had to spend almost a month reviewing the contract!

If ever there was a need for legislation, this is the “poster child” of need! Thankfully, it didn’t take a lot of effort to convince the Chairman of the Senate Governmental Organization, Senator Rod Wright, to serve as author of this measure which is now SB 399 which we are proudly sponsoring. The bill says that for all future emergency contracts, the agency requesting the contractor to come out immediately must approve the invoice within 15 days which, in-turn, gives the Controller’s office another 15 days to process the check. In other words, future emergency contracts starting on January 1, 2014 (assuming the bill passes through the legislative process and is signed by the governor), will have to meet this new 30 day window.

I am pleased to report this measure went before the Senate Governmental Organization Committee on Wednesday of this week and passed out on a unanimous vote! It’s now on to the Senate Appropriations Committee. Stay tuned for future updates.

Update on Statewide Portable Equipment Registration Program (PERP)Owners or Operators of portable engines and certain other types of equipment can register their units under the Air Resources Board’s (ARB) Statewide Portable Equipment Registration Program (PERP) in order to operate their equipment throughout California without having to obtain individual permits from local air districts. The following sections will assist you with the PERP registration process and present facts on the Portable Diesel Engine Airborne Toxic Control Measure (ATCM).________________________________________PORTABLE DIESEL ENGINE AIRBORNE TOXIC CONTROL MEASUREAs of January 1, 2013, the Portable Engine Airborne Toxic Control Measure (ATCM) fleet standards went into effect. The ATCM requires owners of portable engines to submit a statement of compliance signed by a Responsible Official to the Air Resources Board by March 1, 2013. In addition to the statement of compliance, a summary that identifies each portable engine in the fleet and the associated emission rate (g/bhp-hr) must be included. Applications from first time applicants will not be accepted unless the statement of compliance and the fleet summary are included.

Considering Making Changes to Your Fleet?The ATCM also requires owners to ensure that the average PM emission level for their fleet does not fall out of compliance due to changes in the composition of the fleet. Buying, selling, or modifying engines could result in a fleet becoming noncompliant. PERP registrants considering adding, removing and/or modifying engines in their fleet are strongly encouraged to re-calculate their fleet average to ensure that the fleet is still compliant with the applicable

standard before submitting requests to ARB. It is recommended that you include the statement of compliance and the updated fleet summary with your requests and maintain copies for your records. IRS Issues Guidance on Tax Treatment of Cell Phones; Provides Small Business Recordkeeping Relief WASHInGTOn — The Internal Revenue Service today issued guidance designed to clarify the tax treatment of employer-provided cell phones.The guidance relates to a provision in the Small Business Jobs Act of 2010, enacted last fall, that removed cell phones from the definition of listed property, a category under tax law that normally requires additional recordkeeping by taxpayers.The notice issued today provides guidance on the treatment of employer- provided cell phones as an excludible fringe benefit. The notice provides that when an employer provides an employee with



a cell phone primarily for noncompensatory business reasons, the business and personal use of the cell phone is generally nontaxable to the employee. The IRS will not require recordkeeping of business use in order to receive this tax-free treatment.Simultaneously with the notice, the IRS announced in a memo to its examiners a similar administrative approach that applies with respect to arrangements common to small businesses that provide cash allowances and reimbursements for work-related use of personally-owned cell phones. Under this approach, employers that require employees, primarily for noncompensatory business reasons, to use their personal cell phones for business purposes may treat reimbursements of the employees’ expenses for reasonable cell phone coverage as nontaxable. This treatment does not apply to reimbursements of unusual or excessive expenses or to reimbursements made as a substitute for a portion of the employee’s regular wages.Under the guidance issued today, where employers provide cell phones to their employees or where employers reimburse employees for business use of their personal cell phones, tax-free treatment is available without burdensome recordkeeping requirements. Avoid Heat Illness When it is hot outside, your body temperature can rise to dangerous levels. Normally, your body cools itself through sweating. However, in hot and humid weather, sweating is not enough and the result can be a heat illness. Staying Cool Follow the suggestions below to stay cool when working in hot weather: • Wear loose, light-colored clothing and

some type of hat. • Adapt to working in hot conditions

gradually, especially if performing strenuous tasks.

• Take breaks in the shade when possible, and remove any outer protective gear you may be wearing.

• Avoid overexerting yourself during peak temperature periods (midday).

• Drink liquids frequently, even if you don’t feel thirsty - at least eight ounces every 20 to 30 minutes. Choose water, fruit juice or sports drinks and stay away from liquids containing caffeine, which can dehydrate you.

Recognizing the Symptoms There are three forms of heat illness, each with its own distinct symptoms: • Heat Cramps – severe muscle spasms

in the back, stomach, arms and legs, which are attributed to the loss of body salt and water during periods of heavy perspiration

• Heat Exhaustion – heavy sweating, cool or pale skin, nausea, headache, weakness, vomiting and fast pulse

• Heat Stroke – high body temperature, sweating stops, red and often dry skin, rapid breathing and pulse, headache, nausea, vomiting, diarrhea, seizures, confusion or unconsciousness

Providing Treatment It is essential to treat heat illness as soon as possible. If you are feeling any of the above symptoms, inform a co-worker and ask for help. If you suspect that a fellow worker has any of these conditions, follow the first-aid suggestions below: • Heat Cramps – Move the victim to a

cooler area and allow them to drink approximately six ounces of water every 15 minutes. Follow up with a medical examination.

• Heat Exhaustion – Move the victim to a cooler area and keep them lying down with their legs slightly elevated. Cool their body by fanning and applying cool, wet towels. If conscious, allow the victim to drink approximately six ounces of water every 15 minutes. Follow up with a medical examination.

• Heat Stroke – You or a bystander should immediately call an ambulance. Meanwhile, move the victim to a cooler area, remove their outer clothing, immerse them in cool water or apply cool, wet towels or cloths to the body. Do NOT give them liquids. If medical help is delayed, call the hospital for further instructions while waiting. Heat stroke is life-threatening, so it’s important to move quickly!

Safety Reminder The risk of heat illness increases with age, poor diet, being overweight, insufficient liquid intake, poor physical condition and/or when taking medication. Never take salt tablets without your doctor’s approval. Be aware of weather conditions when you will be working outside so that you can be prepared with appropriate clothing and beverages. If you are working outside and start to feel any adverse symptoms, inform your supervisor and take a break.

Heat illness can be a serious threat. Your best defense is to learn how to stay cool when the weather heats up.

Gates Cooperative Construction Manager (Sausalito)

The Gates Cooperative is a 38 member organization of houseboat owners that are seeking permanent legal berths. These berths are to be located in the County approved expansion of the adjacent Waldo Point Harbor. In order to occupy the new berths, each houseboat must be brought to code standards established by the County. The Gates Cooperative, along with its institutional partners, the County of Marin, Marin Housing Authority, and EAH Inc. (Project Team) is seeking a Construction Manager to oversee the rehabilitation or replacement of the member-owned boats. Under the direction and supervision of Marin Housing Au-thority, the Construction Manager will:

1. Meet regularly with the Project Team, the Gates Co-op member-ship and the Waldo Point Harbor Construction Manager

2. Review the relevant existing documents and history of the project3. Consult regularly with the Project Financial Manager on the

overall project budget4. Develop construction budgets for individual Co-op households in

coordination with the Project Financial Manager and each owner5. Seek collective purchasing agreements, identify potential con-

struction donations and other cost savings mechanisms6. Prepare written recommendations that will enhance the design,

constructability, and cost and time efficiency of the individual houseboat plans, in coordination with the Co-op Project Architect and owner

7. Review the plans for compliance with codes as determined by the County Building Inspector and plan check comments

8. Identify the contractor pool and manage the bidding process 9. Develop a construction schedule with the Project Architect and in

coordination with Waldo Point Harbor’s construction manager10. Monitor construction process; verify work completed for pur-

poses of contractor applications for payment11. Review requests for change orders and submit to Project Finan-

cial Consultant for approval

QUALIFICATIOnS: 1. Minimum 10 years’ experience in project estimating and construc-tion2. Experience with houseboat construction preferred3. Proven budget management skills4. Good communication skills, both verbal and written5. Experience with computers, particularly Excel
