Former Ross Valley Sanitary manager, Brett Richards, has been arrested in the Philippines and will be returned to Marin for prosecution. Brett Richards has been charged with nine felony counts surrounding a $350,000 loan he received from the district.

San Rafael will put a sales tax measure on the ballot in November. The measure would continue the half-cent sales tax voters approved in 2005, known as Measure S, and add on an additional quarter cent increase, creating a total three-quarter cent increase from pre-2005 tax levels.

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

Despite the obvious ‘suspense’ we step up to provide a ‘remedy’ for a contractor worried about ‘hiccups’ in applying for the LLC license. Just in time, we remind all our readers why it is critically important to keep the CSLB up to date on your business address. Failing to do so carries a potentially high price …

Q: We are in the process of obtaining a new license for an LLC. We have already applied and we anticipate that the license will be issued within a month or so (fingers crossed!). The bonds on our existing corporate license are due to expire this week. Since we don’t plan on using the corporate license anymore we are considering letting the bonds expire rather than paying to renew them, which will result in the license getting suspended. Is having a “suspended” license going to prevent us from obtaining the pending LLC license? Before we do this I just want to make sure that there are absolutely no hiccups with the pending application!A: While there are certain instances where having a suspended license could cause some problems when applying for a new license, a suspension due to lack of a bond should not cause any hiccups when obtaining the new LLC license. As another option you could just cancel the license, which would eliminate the need for a bond and also prevent you from having a “suspended” status on record.

Q: I have a question about late license renewals. My license expired last year because we moved and the renewal was never received or forwarded by the post office. By the time I realized what had happened, and drove to Sacramento to get this handled, my license had been expired for nearly three months. Everything is fine now, but I’m worried this might cause problems in the future. Is there anything I can do to get this expiration erased from my record (like what you can do with a speeding ticket)?

A: Unfortunately, I am not aware of anything you can do to have this expiration removed from your licensing records. There is no online “traffic school” that magically erases this type of problem.When you finally renewed your license at the front counter, the form they handed you should have stated: “Delinquent Renewal, Read Section 7141.5 of the Contractors License Law regarding retroactive renewals”. That would have been the time to make such a request; however, since the reason for the late renewal application was due to contractor error and not a “Board error”, it is highly doubtful they would have granted your appeal.It is incumbent upon the contractor to notify the Board in writing within 90 days of moving. As you learned, unless the CSLB has a contractor’s address of record, it is very unlikely you’ll receive these important mailings (the Post Office generally will not forward documents from the CSLB). I hate to be the bearer of more bad news, but your problems may not be over. Business and Professions Code Section 7141 states, in part: “Renewal (of a license) under this section shall be effective on the date an acceptable renewal application is filed with the board. The licensee shall be considered unlicensed and there will be a break in the licensing time between the expiration date and the date the renewal becomes effective.” In other words, during this “nearly three months,” your license was expired you may be subject to the provisions of B&P Code 7031. Among other things, this means if you were to get into a legal dispute with a homeowner or another contractor down the road, for work performed during this “unlicensed” time period, you likely will not be able recover any compensation you’re owed.

California Labor Commissioner Julie A. Su honored as top labor and employment lawyer

Oakland – California Labor Commissioner Julie A. Su has again been recognized by the Daily Journal as one of the Top 75 Labor and Employment Attorneys in California. This is the second time Julie Su has received this honor. Last year was the first time, which was also the

first time a state labor commissioner was so recognized. “Julie continues to make great strides in enforcing labor law. She has increased pressure on the underground economy by issuing more citations for minimum wage and overtime violations and improving the wage claims process to assist California workers to recover wages and other labor rights denied them,” said Christine Baker, Director of the Department of Industrial Relations.

(DIR). “She is an asset to our executive team and I am delighted that she has received the acknowledgment of the Daily Journal.”

A report released in May, “State of the Division of Labor Standards Enforcement,” detailed some of the key accomplishments during her tenure as California Labor Commissioner:

• Minimum wage - over $3 million unpaid minimum wages assessed in 2012 – more than any previous year on record, and an increase of 462% from minimum wage assessments in 2010.• Unpaid overtime – more than $13 million unpaid overtime wages assessed in 2012 – more than any previous year on record, and a 642% increase from 2010.• Civil penalties - over $51 million in civil penalties assessed in 2012 against

employers for violating labor laws – more than any previous year in a decade, and a 150% increase from 2010. • Better targeting-In 2012, the Labor Commissioner’s office had the highest rate of civil penalty citations (80%) in the past decade (compared to an average citation rate of only 48% from 2002 to 2010).• Public works - over $25 million in wages assessed and civil penalties issued on public works projects in 2012 – the highest amount since 2002.• Streamlined processing - the fastest application review process for business licenses and registration applications in the past five years – 50% faster than in 2010. Su was appointed by Governor Jerry Brown in April 2011 as California Labor Commissioner

and assumed the post to lead DIR’s Division of Labor Enforcement Standards (DLSE). Prior to her appointment, Su served as the Litigation Director at the Asian Pacific American Legal Center, the nation’s largest non-profit civil rights organization devoted to issues affecting the Asian American community. In her 17 years as a civil rights lawyer, Su brought landmark lawsuits on behalf of low-wage workers in the underground economy, advocated successfully for protection of immigrant workers that paved the way for federal legislation protecting immigrant victims of crime, and initiated grassroots campaigns against sweatshop abuses. Su has taught at UCLA Law School and northeastern Law School. She is a graduate of Stanford University and Harvard Law School.

The report details the accomplishments of the

Labor Commissioner’s office in 2011 and 2012 across all of the Division’s enforcement units.

Among its wide-ranging enforcement responsibilities, the Labor Commissioner’s office adjudicates wage claims, inspects workplaces for wage and hour violations, enforces prevailing wage rates and apprenticeship standards in public works projects, investigates retaliation complaints, issues licenses and registrations for various businesses and educates the public on labor laws. •

Maintain Your Distance – Don’t Tailgate Picture this: You are driving to an important appointment and get stuck behind a driver going a few miles per hour under the speed limit. What do you do? Many drivers, some who are feeling impatient and others who do not realize they are doing it, follow the vehicle in front of them too closely. While this situation may be commonplace, it puts both you and the drivers in front of you in danger. Understanding the Danger Tailgating is an extremely dangerous practice. If there is a collision ahead, if the road is slick, or if traffic becomes heavy, everyone on the road should be prepared to stop. However, if you do not leave sufficient space, even if you are paying close attention, you will not have enough room to. Two-Second Rule Almost 10 percent of all accidents are caused by tailgating. To avoid joining those ranks, always follow the two-second rule. If you are driving on a normal road in good weather conditions, there should be at least a two-second buffer between your vehicle and the one in front of you. Here is how to calculate your distance: Pay attention to the vehicle in front of you as the driver passes a fixed point such as a mile marker or a sign post. Once the vehicle passes that point, count until you pass that same point (“one thousand and one, one thousand and two…”). Should you reach that point

before counting to two seconds, then you know you are following too closely. Slow down and try the test again with a new fixed point. Inclement Weather If road conditions are not good or if you are driving in bad weather, you should increase your distance even further. Conditions like rain, ice and snow not only make roads slippery, they also greatly reduce visibility, so you may not see a hazard farther in front of you to react in time. Gas Mileage A common misconception is that tailgating can increase the gas mileage of a vehicle, similar to when racecars “draft”; however, this is not the case. Racecars drive at speeds of 200 mph and must use a lot of energy to cut through the air. When racers ride close to the vehicle in front of them, they use less energy due to their speed. However, driving at speeds of 60 mph does not require nearly the energy to maintain the speed, and therefore, tailgating is not beneficial. Speak Up If you have any doubts about safety on the road or any other safety issue, contact your supervisor. At , your safety is our first priority.

Mantenga su distancia - No conduzca pegado al automóvil de adelante Imagínese esto: Usted está conduciendo para hacer una entrega importante y se queda atascado detrás de un conductor que circula a unas pocas millas por hora debajo del límite de velocidad. ¿Qué hace? Muchos conductores, algunos que son impacientes y otros que no se dan cuenta de que lo están haciendo, siguen demasiado de cerca al vehículo de adelante. Si bien esta situación puede ser muy común, los pone a ambos y a los demás conductores en peligro. Cómo entender el peligro Conducir pegado al conductor de adelante es una práctica extremadamente peligrosa. Si se produce una colisión más adelante, si el camino está resbaladizo o el tráfico está congestionado, todos deben estar preparados para detenerse. No obstante, si no deja suficiente espacio, aun si presta mucha atención, no tendrá suficiente espacio para hacerlo. Regla de los dos segundos Casi el 10 por ciento de todos los accidentes son ocasionados por conducir pegados al automóvil de adelante. Para evitar unirse a esas filas, siempre cumpla con la regla de los dos segundos. Si está conduciendo en un camino normal, con buenas condiciones climáticas, debería haber al menos dos segundos de protección entre su vehículo y el de adelante. Es así cómo tiene que calcular su distancia: Preste atención al vehículo de adelante cuando el conductor pasa un punto fijo por ejemplo el marcador de millas o el poste de un cartel. Cuando el vehículo pase ese punto, cuente hasta que usted pase el mismo punto (“mil uno, mil dos…”). Si llega a ese punto antes

de contar dos segundos, entonces está conduciendo demasiado cerca del vehículo de adelante. Reduzca la velocidad e inténtelo nuevamente con un punto fijo nuevo. Tiempo inclemente Si las condiciones del camino no son buenas o si conduce con mal clima, debe aumentar la distancia aún más. Las condiciones, como la lluvia, el hielo y la nieve, no solo hacen que las carreteras sean resbaladizas sino que también reducen en gran medida la visibilidad, de modo que es posible que no note una situación peligrosa como para reaccionar a tiempo. Millaje de gasolina Algunos argumentan que conducir pegado al conductor de adelante aumenta la cantidad de millas recorridas respecto de la cantidad de gasolina que necesita el vehículo, de forma similar al “draft” de los corredores de carreras automovilísticas; no obstante, este no es el caso. Los corredores conducen a una velocidad de 200 mph y deben usar mucha energía para abrirse camino a través del aire. Cuando los corredores se mantienen cerca del vehículo de adelante, usan menos energía debido a su velocidad. Sin embargo, conducir a velocidades de 60 mph no requiere esa cantidad de energía para mantener la velocidad y, por lo tanto, no es beneficioso pegarse al vehículo de adelante. MANN EXCAVATIONIS SEEKING AN ESTIMATOR

Our company is a professional organization that has been providing all types of excavation services in the San Fran-

cisco Bay Area for over 15 years. We specialize in shoring, drilling, grading and site preparation needs. Our projects are wide and varied from excavating large hillsides and creating

lakes to digging swimming pools.

We are seeking an Estimator for our growing company. Estimator must be proficient in estimating public work for excavation, demolition, shoring and pipe work.

• Interpret architectural and structural drawings, specifica-tions, and bid documents

• Perform take offs and write RFPs, and RFIs• Review Job site conditions to determine scope, costs and

project timeline• Compile detailed scope of work inclusions, exclusions, &

clarifications for estimates• Attention to detail, strong organizational and time man-

agement skills

Job Requirements

• Previous experience with computer estimating using Dodge Pro and similar sites a plus

• Project Manager experience is a plus but Estimating is the priority

• Experience in Earthwork is also a plus• Work independently as well as part of a team and accept

feedback constructively• Ability to communicate efficiently with the owner, follow

directions and have own transportation• Local references are a prerequisite of the position
