With the Legislature set to recess for the year on September 15th, the work load has ramped- up significantly in an effort to meet the forthcoming deadlines. Of course, this also is the time of year when “gut and amends” of legislation also go into full swing, meaning that I’ve got to be extra careful to read ALL amendments going into bills to ensure that someone isn’t trying to “slip” language past me. Stay tuned over the next several weeks as things heat up to their highest levels. So what bills are in-play at the moment? Following are some highlights. Remember that with both houses of the Legislature controlled by the Democrats, it could be a lot worse in terms of onerous provisions in bills, so “count your blessings!” AB 44 (Buchanan) - AB 44 is an important measure for all contractors, public agencies and the public as well. Currently, prime contractors are not required to list the contractor’s license for their subcontractors on their bids. Consequently, many unlicensed subcontractors end up working on public works projects, because there is no way to catch them unless the public agency physically checks the licenses on their own volition, which rarely happens. AB 44 will require that primes list their subs’ contractor’s licenses. A prime will have up to 24 business hours after bid time to correct any mistakes made in the license numbers that were listed. This bill will be signed by the governor. It will take effect on July 1, 2014. AB 302 (Chau) - This bill provides a statutory definition for a “de minimis” public subsidy that does not trigger the requirements of prevailing wage law. Specifically, this bill defines “de minimis” to mean a public subsidy that is both less than $25,000 and less than 1% of the total project cost and will not apply to a project that was advertised for bid, or a contract that was awarded, before January 1, 2014. The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

Understanding the complex web of paperwork that is required of contractor’s isn’t easy. But, like a ‘house of cards’ when one piece of paper is ‘pulled from the deck’ the whole structure can fall. Who will take over your contracting business when you decide to retire? If it’s family there’s a waiver for that…

Q: Our license is currently suspended based on the fact that our Worker’s Compensation policy on file is expired. We have submitted a new certificate but the CSLB has not put it on record yet. We have several Joint Venture (JV) licenses that are also showing suspended based on no Worker’s Comp policy on file. Do we need to submit a certificate separately for each of the Joint Ventures?

A: The only time you need to submit a separate Worker’s Comp policy for a Joint Venture is if the JV has employees of it’s own. The JV licenses are showing suspended because they are tied to each of the entity’s licenses that make up the Joint Venture. Therefore, when one of those entity’s licenses suspends, the JV license goes down as well. Once the CSLB puts your new policy on record your company license and the Joint Venture licenses should become active again.

Q: I have worked with my father for 16 years. Is it still true that I can just take over his license when he is done working? I

would definitely want to retain the number. How does this all work? Thank you in advance for your help.

A: There are certain circumstances that allow you to “take over” your father’s license when he retires.

If he has a Sole Owner license, you would need to apply for a new license and request that your Dad’s license number be re-issued to you. If your intention is to obtain this license without taking the exams, you can request to waive the exams based on the fact that you have been actively engaged in the business for five out of the last seven years.If your father’s business were a corporation then you would apply to replace your father on the license as the qualifying individual.

Again, you can request to waive the exams if you can show/prove that you have been actively engaged in the business in a supervisory capacity for five out of the last seven years.

Keep in mind that you can request to waive the exams based on the facts above, but it’s not guaranteed that it will be approved. Please call us if you have any further questions or if you’d like our assistance with this process.

Q: You helped our company obtain a nevada contractor’s license last year. At the time it was a brand new company without any assets so we had to have our Officers indemnify the company in order to qualify for the license. I can see where it states in the indemnification instructions that the indemnification is good until revoked in writing. Does that mean that we can just revoke the indemnification without additional support? Or will we be required to submit financials for the company?

A: If you remove the indemnification you will be required to provide new financial documents to support your bid limit. nevada requires that financial information be kept on file at all times. While knowledge is power, knowing where to go for the answers

Adjusting to Your New Work Environment A walk through other areas of the workplace is a common occurrence, but it can also be dangerous if you don’t stay alert. This is particularly true for employees leaving their old, familiar departments and moving into new roles in other areas. New employees receive instructions regarding training and safety precautions. However, when transitioning roles to another area, it can operate very differently; procedures and equipment may be different and safety precautions may vary as well. Safety in New Surroundings Before entering another area, familiarize yourself with any special rules or procedures necessary for your safety. This might mean wearing special personal protective equipment or meeting certain regulations concerning employee actions. During the transition to your new area, be on the guard at corners and close to machinery, and watch for power and hand trucks on the move. Although equipment operators have their own safety regulations to follow, which include watching for pedestrians, be cautious and ready to move. Look both ways before stepping out into an aisle. In aisles wide enough for truck or other equipment traffic, use extreme caution. Don’t try to beat an oncoming forklift or other machinery; you could easily misjudge its speed and fall in front of it. Don’t walk while you’re looking in another direction, you could bump into another employee or a

machine. If you can’t watch where you’re walking, wait until you can. Watch out for slip, trip and fall hazards. Misplaced tools, pieces of materials or other objects pose hazards. Keep floors and aisles clear of these dangers. In addition, do not take shortcuts, regardless of how much time they save. Shortcuts are not approved routes and taking them can cause very serious injuries. At times, it may be necessary to restrict your admittance to certain areas. Whether the restrictions are temporary or permanent, don’t enter the area unless authorized to do so. Safety Precautions Stay safe when transitioning into a new work environment by remembering these basic safety precautions:

Watch out for moving equipment. Look both ways before stepping

into an aisle. Use handrails. Keep your eyes open for slip, trip

and fall hazards. Don’t take shortcuts. Stay out of restricted areas. Ask for direction regarding

unfamiliar safety guidelines.

A new work environment requires employees to keep basic safety precautions top of mind.

While the original bill had significantly more hurdles for contractors to bear, this version is far better; however, an additional amendment to require public agencies to approve change orders to factor in the increases would have been much more preferable. Unfortunately, the pressure from the public agencies kept that amendment from happening. This bill will likely be signed.

AB 1336 (Frazier) - This bill extends the deadline from 180 days to 18 months, for the Labor Commissioner to serve a civil wage and penalty assessment against a public work contractor or subcontractor, or both. This bill also extends the deadline from 180 days to 18 months, as specified, for a joint labor-management committee to bring an action against an employer that fails to pay the prevailing wage to its employees. This bill revises and recasts remedies that may be awarded by a court in these joint labor-management committee actions. This bill authorizes the court to award interest, liquidated damages, and injunctive relief in these actions. Yep, another State Building Trades bill. While I’m still far from happy with it, just realize that the original bill would have allowed the deadline to extend up to 3 years instead of the 18 months that’s now in the bill! Again, I expect the bill to be likely signed.

SB 7 (Steinberg) - Prohibits the reception or use of state funding or financial assistance for construction projects by charter cities that allow contractors to not comply with the state’s prevailing wage law on any public works contract. This too is sponsored by the State Building Trades and will be signed into law.

SB 399 (Wright) – This is our sponsored bill that would require state agencies who call a contractor out on an emergency basis to pay 10% interest above prime if the payments to the contractor are not made within 45 days. The bill will be on the Assembly Floor next week and then will go back for concurrence in the Senate. The Department of General Services just came

out in opposition. I have some clarifying

amendments I will be taking next week. Hopeful that this will be signed into law!

SB 404 (Jackson) – This is a bill that I teamed-up with the California Chamber on to oppose. It was held in the Assembly Appropriations Committee the other day on suspense, meaning that due to its costs, it may be dead (hope upon hope), but won’t officially know until next week. This measure makes it virtually impossible for employers to manage their employees and exposes them to a higher risk of litigation by expanding the Fair Employment and Housing Act (FEHA) to include a protected classification for any person who is, perceived to be, or associated with an individual who provides medical or supervisory care to a listed family member.SB 404 proposes to include “familial status” as a protected classification under the FEHA to prevent discrimination on such basis. The term “familial status” is broadly defined as:1. any individual who provides “medical or supervisory care” to a child, parent, spouse, or domestic partner; 2. any employee who is “perceived” as someone who provides medical or supervisory care to a child, parent, spouse, domestic partner, or in-law; or 3. any person who is “associated” with a person who provides medical or supervisory care to a child, parent, spouse, domestic partner, or in-law.The term “medical” care is undefined and therefore could be liberally interpreted to include such tasks as administering over-the-counter medication once a day or even driving a listed family member to a doctor’s appointment on a quarterly basis. Moreover, “supervisory” care is also ambiguous and would expand this proposed classification to employees who are not actually providing any care to a covered family member, but rather “supervising” the care the family member receives.

Furthermore, SB 404 applies to anyone who is perceived to provide familial care or associated with someone who provides familial care. Such a broad application of a protected classification will essentially encompass almost all employees in the

workforce and, therefore, will hamper employers’ ability to manage their business, as any adverse employment action an employer takes against an employee could potentially be challenged as discriminatory on the basis of “familial status.”

Burdens Small BusinessesThis burden that SB 404 creates will have an impact on small businesses as well as large ones. The FEHA applies to any employer who has five employees or more. Accordingly, SB 404 will subject these small businesses to potential costly litigation based on the allegation that an employee who suffered an adverse employment action provided familial medical or supervisory care, was perceived as providing such care, or was associated with someone providing such care.

Employees Already ProtectedCalifornia already protects employees from discrimination on the basis of sex, pregnancy, medical condition, mental disability, or physical disability. Similarly, California provides employees with leave to care for the serious medical condition of family members, which may be compensated through California’s Paid Family Leave Act. Additionally, California requires “kin care” that mandates an employee be allowed to use at least half of any accrued sick leave to care for family members. These various leaves and protections are in addition to those provided by federal law. Given these existing protections, there is simply no basis to include the broad protected classification under California law as proposed by SB 404, other than to increase litigation opportunities.

Costly LitigationApproximately 19,500 discrimination claims were filed in 2010 with the Department of Fair Employment and Housing under FEHA, which was 1,000 complaints more than in 2009. notably, more than 4,000 of these complaints were dismissed due to lack of evidence of any violation. Adding this new expansive classification to FEHA will only cause such cases to dramatically increase, thereby burdening the state agency as well as California employers with costly litigation.

MANN EXCAVATIONIS SEEKING AN ESTIMATOR

Our company is a professional organization that has been providing all types of excavation services in the San Fran-

cisco Bay Area for over 15 years. We specialize in shoring, drilling, grading and site preparation needs. Our projects are wide and varied from excavating large hillsides and creating

lakes to digging swimming pools.

We are seeking an Estimator for our growing company. Estimator must be proficient in estimating public work for excavation, demolition, shoring and pipe work.

• Interpret architectural and structural drawings, specifica-tions, and bid documents

• Perform take offs and write RFPs, and RFIs• Review Job site conditions to determine scope, costs and

project timeline• Compile detailed scope of work inclusions, exclusions, &

clarifications for estimates• Attention to detail, strong organizational and time man-

agement skills

Job Requirements

• Previous experience with computer estimating using Dodge Pro and similar sites a plus

• Project Manager experience is a plus but Estimating is the priority

• Experience in Earthwork is also a plus• Work independently as well as part of a team and accept

feedback constructively• Ability to communicate efficiently with the owner, follow

directions and have own transportation• Local references are a prerequisite of the position
