SCOPE OF WORKThe work of this Contract consists in general of the installation of 10:, 8”, 6” and 4” PVC water mains, fittings and valves to replace the existing water distribution system within the Delta Hawaii Mobile Home Park and Stoneman Avenue in Pttiburg, CA. The scope of work includes but is not necessarily limited to; furnishing all products and materials including pipe, fittings, valves, a pressure reducing valve assembly, and all incidentals to the pipe installation, backfill materials and surfacing materials; construction layout; verification of the exact location and depth of existing subsurface facilities; excavation and installation of water pipe and appurtenances; installation of water services, abandonment of existing water system, placement and compaction backfill materials; trench resurfacing; and the furnishing of all other products, materials, and construction of all other improvement work as shown on the plans and or described in the specifications.

Stung by losses in the November election, the California Legislature’s Democratic majority arrived for the first day of a new session this past Monday facing a political terrain more hostile to tax increases and other priorities of liberal lawmakers.

The Democrats’ failure to win a supermajority in either the Senate or Assembly, after capturing both just two years ago, is expected to produce a more centrist agenda and give more clout to moderate Democrats and Republicans.

The political shift probably dooms the long-proposed revision to Proposition 13. Despite the shift to the middle, that still won’t stop tax-related measures from being introduced. One that was introduced on Monday is SB 8. It is being sponsored by former Assembly Speaker Bob Hertzberg who is now a state senator. This is a measure that will be one of his biggest challenges – to gain support for stabilizing the state’s tax base.

He wants to eliminate the corporate income tax and reduce personal income tax rates, including for the wealthiest Californians, while imposing a new 5% tax on sports tickets and services such as accounting, engineering and legal work.

I fully expect many more of this ‘ilk’ to be introduced before the deadline for bill introductions in late February.

State law requires the Legislature to meet for one day in early December (which was last Monday) to convene the new session, swear in newly elected members and elect the leadership. Almost immediately after the swearing in, the Members began introducing new bills; however, the Legislature adjourned at the end of the day until Jan. 5, when the session begins in earnest.

Both houses will see some new leadership. Sen. Kevin De León (D-Los Angeles) is the new president pro tempore of the Senate, and Assemblywoman Kristin Olsen of Modesto becomes the new Republican leader in the Assembly. Assembly woman Toni Atkins remains as speaker of the Assembly, while Bob Huff remains as the Senate minority leader.

As is the custom of past sessions, there were many celebrations at the ‘watering holes’ around the Capitol. Indeed, I’m still recovering! For me, besides catching up with the continuing-on legislators, it’s a chance to meet the new ones. So too, it is a chance to catch up on the latest ‘buzz’. One interesting point I learned is that the

new Senate speaker pro tempore, Kevin De Leon, is going to be in for a serious fight to remain on as the senate leader for very long. Former Assembly speaker Bob Hertzberg is very ambitious and plans to push hard to take over as the leader as soon as possible. It will be very interesting to watch! Stay tuned!

Senate Democrats start the new session with 25 of the 40 seats in the Senate, when 27 are needed for a supermajority; Republicans have 14. The Democrats have a 52-28 majority in the Assembly.

There is one vacancy in the Senate, caused by the resignation of Democratic Sen. Roderick Wright over criminal charges, and a Democrat (my friend Assemblyman Isadore Hall) is expected to win the Dec. 9 special election.

Cal Trans Issues a Final Rule Amending its Disadvantaged Business Enterprise (DBE) Program

Cal Trans has issued a final rule amending its disadvantaged business enterprise (DBE) program at 49 CFR Part 26. The final rule improves DBE program implementation in three major areas. First, the rule revises the uniform certification application and reporting forms, creates a uniform personal net worth form for use by applicant owners, and collects data required by the Department’s surface transportation reauthorization, Moving Ahead for Progress

in the 21st Century Act (MAP-21).

Second, the rule strengthens the certification-related program provisions, which includes adding a new section authorizing summary suspensions under specified circumstances.

Third, the rule modifies several other program provisions concerning such subjects as: overall goal setting, good faith efforts, transit vehicle manufacturers, and counting for trucking companies.

Are Changes Coming to the Proposition 65 Warning Labels?

Acting on orders from the governor, a state science agency is working on proposed regulations to make those generally ignored placards more meaningful to consumers. But

not everybody’s on board.

The warnings about chemicals known to the state of California to cause cancer, birth defects or reproductive harm have been a mainstay of environmental law since voters passed Proposition 65 in 1986.

The goal is to provide “more useful information to the public about what they are being exposed to and how they can protect themselves,” said Sam Delson, a spokesman for the Office of Environmental Health Hazard Assessment. Perhaps the most controversial part of the proposal would require special, more detailed warnings for 12 chemicals out of the more than 800 already on the office’s Proposition 65 list.

The new category, already dubbed the “dirty dozen” by some critics, includes “the most common, most prevalent, most significant hazards to public health and most recognizable,” Delson said.

Among them: arsenic, benzene, cadmium, formaldehyde, lead, mercury and tobacco smoke.

The others are acrylamide, a byproduct of roasting or frying starchy food such as potatoes; chlorinated tris, a flame retardant; 1,4-dioxane, an industrial solvent and ingredient in some paints and cosmetics; phthalates, a plastic softener found in some cosmetics and beverage containers; and toluene, a component of household aerosols, nail polish and paints.

Business associations and lobbyists don’t like the special treatment. More than 80 groups including the California Chamber of Commerce and the Vinyl Institute filed negative comments with the state. According to Anthony Samson, a chamber lobbyist, the current draft has three strikes against it:The “sheer cost” for businesses to comply, the likelihood of alarming consumers more than informing them and the possibility of increased litigation.

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

Will the California State Contractor’s Board go ‘dark’ next year? It all depends on the Legislature’s decision based on the ‘highlights’ of accomplishments for contractors and consumers in California…

In November, the CSLB delivered its “Sunset Review Report” to the State Legislature and Governor. Most Consumer Boards and Commissions have a “sunset” date (currently January 1, 2016 for the CSLB), whereby they would cease to exist (i.e. sunset) unless the State Legislature extends their date of operation.

As part of this process, these Boards go through a periodic review and produce a comprehensive report on where they’ve been, where they are currently and where they hope to be (or anticipate) going in the upcoming years. Basically, it is a report justifying the continuation of the Contractors Board.

Among the Board’s many stated accomplishments highlighted within this 346 page report are: 1) Veterans Assistance where the CSLB offers a Veterans Application Assistance Program for troops transitioning from military service to civilian employment.

2) Sponsored legislation requiring Workers’ Compensation Recertification to help prevent under-reporting of employees when securing workers’ compensation insurance. An active licensee with an exemption from workers’ compensation insurance must either recertify the exemption or provide a current and valid Certificate of Insurance at the time of renewal.

3) Established a Complaint Disclosure Program with Partnering Government Agencies whereby the CSLB will disclose on its website any disciplinary action against contractors by partner state agencies.

4) Implemented an Underground Economy Program to take timely disciplinary action against contractors found during the mediation process to be participating in the underground economy.

5) To increase Building Permit Compliance, the CSLB developed a complaint form with input from building officials, industry groups, and other partner agencies so anyone with knowledge of a construction site that lacks a building permit can use the online form to file a complaint with board.

6) The CSLB’s Statewide Investigative Fraud Team (SWIFT) began partnering with state and local government agencies in 19 different counties as part of its District Attorney Office Partnership for License and WC Violations. For those contractors playing by the rules, these programs should be welcome.

The CSLB report also urges the Legislature and Administration to “support efforts to modernize and streamline laws and regulations related to contracting in California to help ease complicated requirements for contractors and confusing language that prevents consumers from making informed choices.” This includes a statement regarding how the application of B&P Code Section 7031(b) by the legal profession (including the courts) is overly broad. As an example, “If there is a break in licensure,

even for one day, attorneys representing public agencies, prime contractors, commercial and/or industrial project owners, and consumers use the lapse as the basis to seek recovery of all compensation paid on a project, as though the contractor had been “unlicensed” for the entire term of the contract”. The same “unlicensed” interpretation is being applied to cases where a contractor has maintained a valid license in a classification for which the license was issued but, during the course of construction, performed a small amount of work that may later be deemed to have been “out-of-class”. Significantly, the terms “duly licensed” (as used in subdivision (a) and “unlicensed” (as used in subdivision (b) are not defined in the Contractors’ State License Law, but are decisive terms under Section 7031.

The Report goes on to say, the application of this statute in this manner may facilitate “unjust enrichment” to public agencies, prime contractors, and/or commercial/industrial project owners, which is an “unacceptable outcome within the spirit of the law.”

By following a few basic guidelines, you can prevent slips, trips, and falls. Slipping on a wet spot on the floor, tripping over an object in the walkway, or falling from a ladder – such accidents happen more often than we realize. They can also result in severe injuries. Neatness counts It is everyone’s responsibility to keep work areas clean and safe. During the course of the work day you might find yourself tripping over or walking around boxes, electrical cords, or tools in an area that was previously clear. This makes it difficult for you to do your work safely and efficiently. If you see such a problem, correct it right away because it might cause an injury to the next person who comes along – or to you if you pass that way again. Everyone should watch for, report, and, when possible, correct slip, trip, and fall hazards. Housekeeping Good housekeeping is an integral part of every organization’s safe work policy. Walkways and workstation floors must be kept free of clutter and debris. Accidentally spilled liquids and other slippery materials must be cleaned up immediately. Housekeeping is not just a rainy-day task or a once-a-month chore; it is a job that must be done hour by hour. Accident prevention fundamentals • Clearly mark walkways through busy areas with paint or railings. Ensure that

walkways are sufficiently wide and well lit. Provide enough light in all work areas. • Do not allow carpets or mats to bunch up or fold and create a trip hazard. • All walking surfaces must be free of irregularities such as holes and depressions.

Repair such floor damage immediately. • Keep floors clean and dry. If the work results in wet floors, install adequate drainage

and cover floors with one of the many available styles of non-skid surfacing. Workers must wear slip-resistant footwear in damp areas.

• Do not run in the workplace.

• Keep stairways and ramps in good repair and free of obstructions. Install non-skid surfacing on the stair treads. Ensure that handrails are properly installed and extend past the top and bottom steps. Mark the first and last steps clearly, such as with yellow stripes.

Incident investigation If a slip, trip, or fall incident does occur, the employer must conduct a complete investigation into the cause(s). Document all aspects the incident and investigation. Was there an unsafe act? Was there an unsafe condition? Determine the causes, identify and implement solutions, and follow-up to ensure that the situation that caused the incident no longer exists.

Prevención de resbalones, tropiezos y caídas

Siguiendo algunas pautas básicas, puede evitar resbalones, tropiezos y caídas. Resbalar en una parte mojada del suelo, tropezar con un objeto en el pasillo o caer de una escalera de mano son accidentes que ocurren con más frecuencia de lo que pensamos. También pueden resultar en lesiones graves. El orden es importante Es la responsabilidad de todos para mantener las áreas de trabajo limpias y seguras. Durante el transcurso de la jornada de trabajo, puede que se encuentra tropezar con o caminar alrededor de las cajas, cables eléctricos o herramientas en un área que antes era desobstruida. Esto hace que sea difícil para realizar su trabajo de manera segura y eficiente. Si usted ve un problema, corríjalo de inmediato, ya que podría dañar a la siguiente persona o a usted si pasa de esa dirección otra vez. Todos deben estar atentos, informar y, cuando sea posible, corregir los riesgos de resbalones, tropiezos y caídas. La limpieza La buena limpieza es una parte integral de la política de trabajo seguro de cada organización. La limpieza no es sólo una tarea cuando no hay nada más que hacer o que se cumple una vez al mes, sino que es una tarea que se debe hacer cada hora. Fundamentos de prevención de accidentes • Marque claramente los pasillos en las áreas atareadas con pintura o barandillas.

• Todas las superficies de tránsito deben estar libres de irregularidades tales como agujeros y depresiones. Repare los daños en los pisos inmediatamente.

• Mantenga los pisos limpios y secos. Si el trabajo resulta en pisos mojados, instale un drenaje adecuado y cubra los pisos con una superficie antideslizante. Hay muchos estilos disponibles. Los trabajadores deben utilizar el calzado antideslizante en zonas húmedas.

• Nunca corra en el lugar de trabajo. • Mantenga las escaleras y rampas en buen estado y libre de obstrucciones. Instale

superficies antideslizantes en los peldaños de las escaleras. Asegúrese que los pasamanos se instalen correctamente y se extiendan más de los peldaños superiores e inferiores. Marque el primer y último peldaño claramente, por ejemplo usando rayas amarillas.

Investigación de incidentes Si un resbalón, un tropezón o una caída ocurre, el empleador debe realizar una investigación completa de las causas. Gas Powered Blowers are prohibited in the City of Mill ValleyGas-powered leaf blowers contribute to noise pollution, emitting tones at levels that could lead to hearing damage.

They also contribute to air pollution, causing smog and breathing problems such as asthma.

Mill Valley Municipal Code 7.16.090 states:

“It shall be unlawful for any person to operate a gas-powered device to blow leaves, dirt or other debris off sidewalks, driveways, lawns or other surfaces within any area of the City.”

Please discontinue the use of any gas powered blower in the City of Mill Valley immediately.

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.

For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.

The BA is a central part of the Estimating Team and is primarily responsible for acquiring, preparing and submitting bid documents. The BA is the liaison between Owners and the Estimators where bid documents and procedures are concerned as well as be-tween Estimators and the Bid Runner on bid days.
