This notice is to inform the u.s. Forest Service that between January 7 - 19, 1993, approximately 3000 lin. ft. of pipeline was damaged and washed-out in Strawberry Canyon.

The primary factors contributi ng t o t h is i nci dent were rock slides and swelling/ flooding of strawber ry creek between the lower falls and the f orest road crossi ng at strawberry Creek.

This pr esented an emergency s i t uation in which Arrowhead Water had no other opti on but to r eact immedi atel y and install a temporary fire hose line, in order to prevent any loss es or distruption to the business .

Arrowhead Water i s p r e sently moving f orward t o r eplace the damaged p ipeline and will utilize the same type and diameter pipe to maintain compliance with USFS Special Use Pe rmit.

In order to expedite the instal l a t i on of the new pipel i ne i n a timely manner, Arrowhead Water is requesting assistance from USFS to provide an emergency Letter of Approval.

Per our telephone conversation of February 2, if t his letter covers all t he necessary information required by USFS, forward a copy of thi s letter with the Lands Officer endorsement of approval to us immediately, pending the c ompletion of a USFS formal Letter of Approval.

San Bernardino National Forest, USDA - Forest Service

THIS COLLECTION AGREEMENT, made and entered into by and between Arrowhead Mountain Spring Water Company, hereinafter referred to as the Permi ttee, and the Forest Service, U.S. Department of Agriculture, hereinafter referred to as the Forest Service, under the provisions of the Cooperative Funds Act of June 30, 1914 {16 U.S .C. 498).

WITNESSETH:

WHEREAS, the Forest Service administers U. S. lands in the San Bernardino National Forest, and

WHEREAS, the Permittee has been issued a Special Use Permit for water transmission lines, water collection tunnels, horizontal wells, spring boxes and the necessary service trails to maintain the pipelines, water collection tunnels, horizontal wells, and spring boxes, dated August 2, 1978, and

WHEREAS, the Permittee has requested the Forest Service to conduct extensive administration on the Special Use Permit area in Strawberry Creek Canyon through calendar year 1995, involving numerous field reviews, inspections, reports and surveys to ensure permit compliance and resource protection, for projects including pi peline replacement and redevelopment or reconstruction of existing springs or tunnels;

NOW, THEREFORE, in consideration of t he above premises, the parties hereto agree as follows:

A. The Permittee Shall:

1. Make a voluntary advance payment, and subsequent installments, in amounts sufficient to cover the total cost of Forest Service administration of such project proposals involving this Special Use Permit. Work to be accomplished under this agreement is described in the attached Exhibit A specifying the work to be done and the cost of such work. Amounts as determined by the Forest Service will be added to these costs to cover the Forest Service business administration costs.

~ ) ., ,· •• The advance payment ($5000.00) shall be made to "USDA Forest Service". 1824 S. Commercenter Circle, San Bernardino. CA 924o8-3430. The permittee may make voluntary installments up to $5000.00 per year through calendar year 1995.

The Forest Service Shall:

1. Deposit the payments received from the permittee into a Forest Service cooperative work fund.

2. Upon receipt of funds. provide the permittee information and services as soon as practical consistent with other work priorities.

3. Provide to the permittee, upon request, a statement of estimated expenditures . When Government transaction registers are received by the Forest Service for each quarter, a corrected statement of actual expenditures will be available to the permittee, if requested.

4. Refund to permittee any amounts in excess of the cost of doing said work, or at the request of the permittee, apply such excess toward subsequent agreements.

C. It Is Mutually Agreed and Understood By and Between the Said Parties That:

1. Any voluntary contributions made under th~ terms of this agreement will in no way convey special rights or consideration to the permittee . The Forest Service cannot guarw1tee that work done in accordance with this agreement will result in decisions to concur with planned projects, as proposed.

2. No member of, or Delegate to, Congress or Resident Commisioner shall be admitted to any share or part of this agreement, or to any benefit that may arise therefrom; but this provision shall not be construed to extend to this agreement if made with a corporation for its general benefit.

3. This agreement shall become effective when accepted by the Parties hereto. and will continue from the date of execution of this agreement until terminated by a thirty (30} calendar day written notice by either party to the other; provided that unless terminated by written notice, this agreement will remain in force until expiration of the Special Use Permit authorizing the use of National Forest land.

This agreement may be revised as necessary by mutual consent of all parties through the issuance of a written amen~ent, signed and dated by all parties.

Upon termination of thfs agreement, any funds on depo~lt may be held by the Forest Se~vic~ · ~yon~ _ the t~rminat~~n ' date to meet obligations incurred prior to the - ~x~ir~tion date and/or to be applied against any further financial obligation the permittee may have with the Forest Service under the provisions of said permit.

The United States of America shall not be liable for any damage incident to the performance of work under this agreement to any depositors or landowners who are parties to this · agreement, and all such. depositors or landowners hereby eXpressly waive any and all claims against . the Uni ted 'States of America for compensation

The rep lacement of the deteriorated pipe sections within Arrowhea d 's pipeline system has been successfully eOJmpl.~te.d . The 1.992. phase of our maintena nce program is 'i n .the a r ea of the wells. Many of the we ll developments a r e · decades old and have started to deteriorate and partia lly collapse. In addition, the v alv ing and c ontrols at the well heads will be replaced .

The initial activity will be at sites 7 and 10 - 12. As with the pipeline construction, equipment and crews will be airlifted in as required, no vegetation will be c lear cut~ any new pipejvalves will be joined by mechanical means, and all old material and litter will be removed upon completion.

Please forward any concerns around the timing or ot her aspects of this project. A letter similar to the pipeline note dated 3-12-91 would be helpful to ensure al1 concerns are properly addressed.
