FJP: We Want to Form a Coalition Government after the New Constitution

Informed sources revealed that the Freedom and Justice Party seeks to attract other parties in the new parliament to join its Democratic Alliance so that the party gains a full majority in the parliament.

The FJP seeks to form a coalition government after the new constitution is drafted. They want to change the regime type from a presidential to mixed regime.

Sources told Al-Masry Al-Youm that the FJP recently began talks with many political parties to discuss their participation in the Democratic Alliance, create agreement on the new constitution, and form a coalition government.

The FJP demanded SCAF to hand over power according to the timeline they announced earlier. They demanded them to open the door for presidential elections immediately after the first joint session of the People’s Assembly and the Shoura Council is held.

Comments on SCAF’s Safe Exit

General Hossam Seweilam, Security expert denied that the Military Council asked for a

“safe exit” saying that it has committed mistakes during running the country and can be held accountable for the transitional period. Rumors that SCAF wants privileges in the coming constitution are totally false, he added, the Council wants to protect Military budget by a secrecy clause.

Presidential hopeful, Hamdeen El-Sabbahy, stated that he supports a “fair exit” not a

“safe exit” for SCAF. “Criticizing the Council faults while running the country is important”, he added calling SCAF to prosecute those involved in killing civilians immediately.

Rule

Amnesty International revealed Monday that Military rulers in Egypt were responsible for violations worse that those committed during Mubarak’s rule.

Almost 84 civilians were killed due to severe oppression by SCAF between October and December of last year. The number of civilians who stood before military judges in one year exceeded the number of civilians exposed to military trials during 30 years of Mubarak ruling.

Malcolm Smart, Amnesty International’s Middle East and North Africa Director said that the authorities in Egypt have to carry out immediate investigations on torture and abuse cases.

"By using military courts to try thousands of civilians, cracking down on peaceful protest and expanding the remit of Mubarak's Emergency Law, the SCAF has continued the tradition of repressive rule which the January 25 demonstrators fought so hard to get rid of," said Philip Luther, Amnesty International’s Middle East and North Africa Acting Director.

HEC Files Contestation against Administrative Court Ruling

The HEC decided to hold runoffs in Daqahlia’s first constituency, after filing a contestation against the ruling handed down by Mansoura’s Administrative Court to stop the elections. The Administrative Court ruled yesterday’s morning to stop the elections in Daqahlia’s first constituency that were held last Tuesday and Wednesday.

Twenty three People’s Assembly candidates from the first, second and third constituencies in Daqahlia filed contestations to stop announcing the results of the first round and suspend runoffs.

A candidate named “Mohamed Rezq Abd El-Salam Hareedy” was mentioned on the lists of the individual candidates in the first single-member constituency despite being on the Egyptian Bloc lists in the multi-member constituency. Because of that, the Egyptian Bloc lost votes after people voted for him in the single-member constituency. In their contestation candidates also said that HEC did not follow the court’s ruling of deleting the religion filed.

Candidates also filed contestations against expatriate voting calling it “unconstitutional” for the votes were sent via mail based on information published on HEC’s website. They said those information contained mistakes which rendered the whole process invalid.

In the second constituency in Daqahila, the judge supervising the elections was replaced by another one who made grave mistakes that resulted in calculating 50,000 votes for El-Wafd party and blocked votes for The Revolution Continues list which led to mistakes in the vote counting process.

Over 50 candidates in the second constituency, who lost in the elections, filed a lawsuit claiming that one of the political currents used Salafi station supervisors from El-Azhar institutions in the district.

Muslim Brotherhood’s Final Decisions

The Freedom and Justice Party issued a statement yesterday to explain their position from the anniversary of the January 25 revolution. They demanded SCAF to issue a decree to consider the revolution’s anniversary a national holiday to honor the memory of the revolution’s martyrs. This position indicates that the MB will be present in Tahrir Square to celebrate and calm the public opinion, which will affect calls made to consider the day an opportunity to demand SCAF to hand over power immediately.

The FJP said they have already created a draft for the new constitution and they are waiting for the first joint session of the People’s Assembly and the Shoura Council to select the members of the Constituent Assembly. According to the statement, the FJP will launch a dialogue with all political parties and forces inside and outside the parliament to reach a compromise on the method of forming the Constituent Assembly.

Despite of the fact that Saad Al-Katatni declared during his visit to the parliament that the military institution will not have any privileges in the new constitution; however he said, “The Armed Forces have some privileges, especially in arms agreements and in taking the decision of going into war or signing peace agreements.”

The statement also mentioned that the MB agreed on the presidential candidate they are going to support in the coming presidential elections.

They confirmed the importance of SCAF’s commitment to hand over power according to the timeline created. The MB agreed with SCAF on handing over power by June 30, 2012.

The Time of Retribution Has Come

The ousted president Hosni Mubarak will stand before Cairo’s Criminal Court for the second day in a row to listen to the pleading of civil-rights lawyers over charges of killing protesters and wasting public funds.

The pleadings of civil-rights lawyers were intense yesterday. Sameh Ashour, Lawyers Syndicate Chief, began his speech by demanding the court to apply the maximum penalty against Mubarak. “We are not examining an average murder case or a single crime scene,” said Ashour. He confirmed that Mubarak carefully selected leaders who agree that his son, Gamal, assumes power after him.

He based his pleading on two speeches Mubarak gave during the January events. He said in his first speech Mubarak said the government was committed to carry out his orders and protected protesters at the beginning of the demonstrations to protect their right in demonstrating peacefully. Ashour explained that Mubarak specified protecting the right of protesters only before demonstrations developec into a revolution. He considered that this is a matter that confirms Mubarak was inciting his security forces to commit crimes against protesters. He also said that the decision to cut off all means of communication on January 28 proves the intention to use force against protesters.

Another lawyer, Amir Salem, demanded charging former General Intelligence Chief Omar Soliman and Field Marshal Mohamed Hussein Tantawi with perjury. He also demanded

Page 17: News Coverage prepared for: The European Union …eeas.europa.eu/archives/delegations/egypt/documents/semc/...1 News Coverage prepared for: The European Union delegation to Egypt “This

17

the court to charge Mubarak with treason because he knew peaceful protesters were being killed and he agreed to that. According to him, Al-Adli issued orders to security forces to use live bullets against groups of protesters. The violence that took place during the January revolution was prepared in advance which constitutes a criminal behavior related to premeditated murder, he said.

During his pleading, Khaled Abu Bakr said that former minister of interior Habib Al-Adli said in his testimony that he was in constant contact with the former president throughout the events and that he informed him that four protesters were killed by live bullets in Suez. “What did the first defendant do when he knew that his people were being killed? How can we try Gamal Mubarak for illegitimately owning a villa when he assumed the most important economic positions in the country?” Abu Bakr asked. Abu Bakr also referred to the testimony of one of the eyewitnesses, Hussein Moussa, who said that General Ahmed Ramzy gave orders to provide security forces with arms and bullets, and that his instructions were “Kill those young people and do not hesitate.”

“Mubarak Sons” exchanged accusations in front of the Police Academy over the bribes some of them receive. Some of them attacked one of Al-Tahrir journalists by pointing spray to his eyes. CSF forces were heavily present and they separated between the families of martyrs and victims of the revolution and Mubarak sons to prevent possible clashes. Protesters held signs demanding the execution of Mubarak, his sons and Al-Adli, chanting: “Retribution.. He killed our children with live bullets.” Some clashes occurred when Mubarak’s plane landed in the academy between Mubarak sons and other supporters of the former president.

You can think of your paradigm as a "cookie cutter" than recognizes things as a specific pattern and files them away.

30 FJP Candidates Compete in Runoffs Today and Tomorrow

The runoff of the third round of the parliamentary elections will begin Tuesday January 10, 2012. The Freedom and Justice Party (FJP) has 30 candidates running for individual seats. Election rerun will also take place in numerous governorates after voting was canceled by the Higher Administrative Courts. In the North Cairo district, 12 candidates will compete for seats on both the individual and party-list seats.

In Aswan, the runoff will be between 4 candidates on the electoral list, and in Assuit 4 candidates will run for individual seats in the second and third districts. Four individual candidates will compete in the runoff in Sharqiya in the second and fifth district, while in

38

Alexandria, 2 candidates will compete for the individual seats in the third district in Maharem Beh. The (FJP) confirms it fully trusts that the Egyptian people will actively participate in the runoffs with as much enthusiasm as they have shown during the earlier phases in order to complete the peaceful democratic experience of the parliamentary elections. Furthermore, the party confirms that the elections in the first district in Dakahlia will be held as scheduled after an appeal filed by the HEC to continue the elections in the district was accepted.

FJP: Advisory Council Limited to Aiding SCAF, Will Not Override Elected Parliament

With the imminent end of the third phase of the Egyptian People’s Assembly elections, which highlighted the confidence accorded by the masses to the Freedom and Justice Party (FJP), we appreciate the great Egyptian people and the tremendous trust, responsibility and obligation they placed on us at this critical stage in the life of the nation, and we emphasize the following:

1 - The FJP calls for everyone to focus on the role of Parliament in the next phase; and values the roles played by all other parties, and vows to seek – together with its partners in parliament – to develop an urgent legislative and regulatory plan, so the People’s Assembly should begin to play its part, immediately, with the efficiency expected by the people in this precarious phase of the nation’s life.

2 – The FJP also confirms its position with regard to the Constituent Assembly (CA) tasked with drawing up the new Constitution, as previously declared through the Democratic Alliance. The FJP also underlines the need for the CA to represent every component of the Egyptian people, all classes, groups and walks of life. The party will debate this with all political parties and stakeholders inside and outside of Parliament, to reach a consensus formula for the selection of the CA immediately after the joint session of the People's Assembly and the Shura Council. In this regard, the FJP affirms that all the efforts made by all parties to develop ideas for issues under discussion, as well as any visions for the new constitution, are positive inputs that serve to broaden the dialogue about it, and can by all means be sent to the People’s Assembly to benefit from them.

3 – The FJP emphasizes that the role of the Advisory Council – according to its founding resolution – is confined to providing advice to the Supreme Council of the Armed Forces (SCAF) on crises and other issues, and should not be expanded beyond that, so as not to cause chaos and confusion in the political arena as it crowds and conflicts with the roles, functions and powers of other state institutions, especially the elected parliament.

Page 39: News Coverage prepared for: The European Union …eeas.europa.eu/archives/delegations/egypt/documents/semc/...1 News Coverage prepared for: The European Union delegation to Egypt “This

39

4 - The FJP also vows to work diligently during the remaining period of the transition phase for fruitful cooperation and integration with and respect for the powers and competencies of SCAF, the elected parliament and the interim government, in order to complete the move over to the new political system with the presidential elections and the new constitution.

5 – The FJP emphasizes the importance of all Egyptians celebrating the first anniversary of the January 25 Revolution, for which a decree should designate a national holiday so this would be the first celebration of the revolution in honor of the souls of the martyrs, with emphasis on the need for retribution for their blood and compensation for their families, as well as care for the wounded. This should also be an occasion to mobilize the Egyptian people to support the revolution, to emphasize its demands, to complete its march, to be proud of its achievements, and to insist on achieving goals that have not been attained yet, particularly the completion of full transfer of power to the elected civilian authority without guardianship or tutelage.

6 - The FJP stresses the importance of SCAF’s commitment to the timetable set for the transfer of power, especially the commencement of the presidential election after the joint session of both houses of parliament and in parallel with the work of the CA drawing up the new constitution, in accordance with the constitutional and legal principle based on the referendum and the constitutional declaration.
