HEALTH AND SANITATION CODE OF THE MUNICIPALITY OF KALIBO, AKLAN

CHAPTER I GENERAL PROVISION

Section 1 - Title: The Title of this Code is The Health and Sanitation Code of Kalibo, Aklan.

Section 2 - Definition of Terms:

1. Accreditation - This refers to the act of recognition or a method of determining that an eligible organization, institution, individual or program complies with the approved standards.

2. Advertising - refers to any representation by any means whatsoever for the purpose of promoting the sale or distribution of breastmilk substitutes /supplements and other related products.

3. Aedes Aegypti - domestic arthropods, known as a tiger mosquito; the primary vector of Dengue Fever and an important factor in outbreaks.

4. Aedes Albopictus - secondary vector and responsible for maintaining the virus in the environment.

5. Anti-TB Drugs - Refers to the powerful first line drugs: Rifampicin, Ethambutol, Pyrazinamide, Isoniazid and Streptomycin which are available program drugs in the Health Centers and Public - Private Mixed DOTS Facilities.

6. Apartment House - A building containing a number of separate residential suites. 7. Assessor - This refers to the person with expertise in the area of massage, who is

appointed by the chairperson of the Committee of Examiners for Massage Therapy (CEMT) to conduct practical assessment of the candidates undergoing DOH Massage therapy oral and practical licensure examination.

8. BCG - refers to as “Bacillus of Calmette Guerin”; a vaccine that protects against tuberculosis (TB); a chronic communicable disease that affects many organs of the body, commonly affects the lungs.

9. BFAD - refers to the Bureau of Food and Drugs of the Department of Health. 10. Boarding House - A building where selected persons for fixed periods of time are supplied

with, and charged for sleeping accommodations and meals. 11. Breastmilk Substitute - means any food being marketed or otherwise represented as

partial or total replacement of breastmilk whether or not suitable for that purpose. 12. Burial - Interment of remains in a grave, tomb or the sea. 13. Burial Grounds - cemetery, memorial park of any place duly authorized by law for

permanent disposal of the dead by the soil. 14. Certificate of Registration - This refers to a written commendation issued by the DOH-

CEMT authorizing a person to practice massage therapy as a profession charged for meals, lodging and other services.

15. Committee - This refers to the Department of Health Committee of Examiners for Massage Therapy (CEMT)

16. Condominium - a building with one or more storeys composed of multi-unit residential suites under joint ownership of occupants, each unit provided with complete sanitary facilities, utilities and other amenities contained below the liquid level line of the tank.

17. Continuing Massage Therapy Education (CMTE) - This refers to the acquisition of knowledge, skills, ethical and moral values by a massage therapist after his/her initial registration, to improve and enhance his/her technical competence in massage therapy.

18. Dengue Hemorrhagic Fever - is an acute infectious disease manifested initially with fever. 19. Dengue Infection - is a mosquito borne viral disease which may vary from a simple Dengue

Fever (DF) to a more serious Dengue Hemorrhagic Fever (DHF) and its subsequent fatal form, the Dengue Shock Syndrome (DSS) detention digestion of the suspended solid matter in the sewage through a period of one (1) week.

20. Diphtheria - is an acute contagious disease characterized by local inflammation with fibrin formation (pseudomembrane) of the mucous membrane of the upper respiratory tract (tonsils, pharynx, larynx or nose).

21. Disinterment - the removal or exhumation of remains from places of interment. 22. Dispensing - is the act with validity by a Registered Pharmacist of selling out drugs and

filling a prescription on doctor’s order on the patient’s chart; 23. DOH - refers to the Department of Health. 24. DPT - refers to as “Diphtheria Pertussis Tetanus” 25. Embalmer - a person who practices embalming. 26. Embalming - preparing, disinfecting and preserving a dead body for its final disposal. 27. EPI - refers to as “Expanded Program on Immunization 28. Exclusive Breastfeeding - means giving only breastmilk without water, liquids, teas, herbal

preparations, or other food and fluid intake for the six months of life. 29. Fever - is a common medical sign characterized by an elevation of temperature above the

normal range of 36.5 to 37.5 Celsius. 30. FHSIS - Field Health Service Information System 31. Food Establishment - an establishment where food or drinks are manufactured, processed,

stored, sold or served from the inside bottom of the septic tank to the liquid level line. 32. Funeral Establishment - any place used in the preparation and care of the body of a

deceased person for burial. 33. Gifts of Any Sort - means any form of financial, personal or commercial reward,

inducement, incentives and other favors provided directly or indirectly by manufacturers, distributors, and their representatives.

34. Health Certificate - This refers to written commendation issued by the city or municipal health officer to persons providing massage services after the same has passed the required physical and medical examinations, to include the required immunizations and the following diagnostic tests.

35. Health Facilities - means health care systems including but not limited to health centers, clinics, birthing and parenting classes venues, hospitals, maternal centers/clinics, birthing homes, barangay health stations, health and nutrition posts and lying in clinics.

36. Health Worker - a person working in a component of such health care system, both government or private, whether professional or non-professional, including volunteer workers. It also includes health workers in private practice. Traditional and other birth attendants, their assistants and other community volunteers involved in health and nutrition promotions and education shall likewise be covered.

37. Hotel - a building where transient guests are received and are supplied. 38. House sewer - The pipe line conveying sewage from the house or building to the septic

tank or to any point of discharge. 39. Infant - shall refer to a person within the age bracket of 0-12 months. 40. Infant Formula - means one of the breastmilk substitutes formulated industrially. 41. Licensed Massage Therapist - This refers to a trained person who passed the licensure

examination for massage therapists. He/she is a holder of a valid Certificate of Registration (COR) and license for massage therapists issued by the Department of Health (DOH) Committee of Examiners for massage therapy (CEMT)

42. Local Health Authority - an official or employee of the Municipal Health Office responsible for the application of prescribed health measures in the Municipality of Kalibo.

43. Lodging House - building where persons are supplied with and charged for sleeping accommodations only.

44. Massage - method wherein the superficial soft parts of the body are rubbed or stroked or kneaded for remedial or aesthetic or hygienic purposes.

45. Massage Clinic Attendant - a trained person to massage customers under the guidance and supervision of a masseur.

46. Massage Clinic - establishment where massage is administered to customers. 47. Massage Therapy - this refers to a system of assessment, evaluation and manual

application techniques used in a scientific manner taking into account the muscle locations, stress points and other anatomical considerations of the human body. It includes adjunctive external application of water, heat and cold, stretching, passive and active joint movement

within the normal physiologic range of motion as a means of promoting pain relief, injury rehabilitation or health improvement.

48. Masseur - a trained person duly licensed by the Department of Health to perform massage and to supervise massage clinic attendants.

49. Measles - an acute highly communicable disease characterized by fever, cough, colds, conjunctivitis and typical reddish spots on the mucosa of the mouth (Koplik spots).

50. Motel - a roadside hotel for motorists, usually consisting of private cabins. 51. OPV - refers to as “Oral Polio Vaccine” 52. Pertussis - an acute highly contagious disease of the respiratory tract characterized by

severe paroxysms of coughing which ends in a prolonged inspiratory whoop often followed by vomiting.

53. Poliomyelitis - a highly communicable disease caused by virus wherein 1% are recognized clinically by muscle weakness and paralysis while 99% of the cases symptoms are referable to gastrointestinal or respiratory tract or evidence of meningeal irritation.

54. Prescription Drugs - refers to drug that can only be dispensed upon a written order of a duly registered physician; dentist or veterinarian;

55. Public Laundry - a laundry established and operated for commercial purposes, open to the public, and not to an exclusive clientele

56. Public Place - means a building or place which is enclosed and or covered where many people gather or assemble as the establishment caters or give service to the public.

57. Refuse - is an inclusive term for all solid waste products consisting of garbage, rubbish, ashes, night soil, manure, dead animals, street sweepings and industrial wastes.

58. Remains - the body of a dead person. 59. Sanitary Engineer - A person duly registered with the board of examiners for Sanitary

Engineers (RA 1364) and who heads the sanitation division or section or unit of the Provincial Health Office.

60. Sanitation Inspector - An employee of the Municipality of Kalibo who enforces sanitary rules, laws, and regulations and implements environmental sanitation activities.

61. School - An institution of learning which may be public, private or parochial. 62. Septic tank - A water tight receptacle which receives the discharge of a plumbing system or

part thereof, and is designed to accomplish the partial removal and digestion of the suspended solid matter in the sewage through a period of detention.

63. Septic tank absorption bed or drain field - An underground system of pipes leading from the outlet of the septic tank, consisting of open-jointed or perforated pipes so distributed that the effluent from a septic tank is oxidized and absorbed by the soil.

64. Septic tank effective capacity - The actual liquid capacity of a septic tank as contained below the liquid level line of the tank.

65. Septic tank Effective depth -The actual liquid depth of a septic tank as measured from the inside bottom of the septic tank to the liquid level line.

66. Septic tank Freeboard or air space - The distance as measured from the liquid level line to the inside top of the septic tank.

67. Distribution box - A small concrete receptacle between the septic tank and the drain field from which lines of drain tile extends and which acts as surge tank to distribute the flow of sewage equally to each line of drain tile.

68. Smoking - means carrying of lighted cigarettes, cigars, pipes or other smoking paraphernalia, whether it is being puffed, inhaled or smoked.

69. Tenement House - A building or portion thereof which is leased or sold to an occupied as residence by four or more families doing their cooking within the premises but living independently of one another although having a common right in the use of halls, stairways, terraces, verandas, toilets, and baths.

70. TB-DOTS - refers to the Directly Observed Treatment Short Course strategy used in managing TB patients in the country.

71. Tetanus - an acute disease induced by toxin of the tetanus bacillus growing anaerobically at the site of an injury.

72. Tonsorial and Beauty Establishments - include barber shops, beauty parlors, hairdressing and manicuring establishments and figure slendering salons.

69. Undertaker - person who practices undertaking. 70. Undertaking - the care, transport and disposal of the body of a deceased person by any

means other than embalming. 71. Vermin - A group of insects or small animals such as flies, mosquitoes, cockroaches, fleas,

lice, bedbugs, mice, and rats which are vectors of diseases. Section 3 - Functions of the Local Government of Kalibo: The Municipality of Kalibo thru the

Municipal Health Office shall have the following powers and functions:

(a) Undertake the promotion and preservation of the health of the people and raise the health standards of individuals and communities throughout the Municipality of Kalibo;

(b) Develop, administer and coordinate various health activities and services which shall include public health, preventive, curative and rehabilitative programs, medical care, health and medical education services;

(c) Upgrade the standards of medical practice, the quality of health services and programs to assure the people of better health services;

(d) Issue permits to establish and operate government and private hospitals, clinics, dispensaries, schools of nursing, midwifery, and other paramedical course, health centers, clinical laboratories and blood banks;

(e) Recommend standard rates of fees for health, medical, laboratory, and other public health services; and

(f) The Local Health Authority shall administer health functions and enforce the provisions of this Code and the rules and regulations promulgated therein.

(g) Performs such other functions as may be provided by law. Section 4 - Primary Health Care: The Local Government of Kalibo shall provide quality,

adequate and accessible primary health care services to its citizenry, complemented by upgraded health facilities and knowledgeable and competent health care providers.

Components of Primary Health Care: a. Complete and functional basic equipments b. Availability of adequate basic medicines and medical supplies c. Establishment of an effective two-way referral system d. Adequacy of health facilities

. Health facilities are always clean and orderly

. Garbage are segregated and in covered containers, in accordance with the Municipal Solid Waste Management Ordinance of Kalibo . Treatment Area/examination area have visual and auditory privacy . Appropriate storage area for supplies, drugs/medicines . Handwashing area shall always have a soap and water . There should space or corner for health education and counseling

e. Updated Field Health Service Information System (FHSIS) which is the standard recording system of the Dept. of Health

f. Compliance to manpower standard. Ratio of health workers to population: i. Physicians 1: 20,000 population ii. Nurses 1: 15,000 population iii. Midwives 1: 5,000 population iv. Sanitation Inspectors 1: 20,000 population v. Medical Technologist 1: 30,000 population vi. Dentist 1: 20,000 population

g. Accreditation to standard health regulations such as Sentrong Sigla, OPB Package, DOTS, and MCP.

h. Service provider shall possess good interpersonal relations with the clients. i. Greets client politely and makes her feel comfortable; ii. Establishes and maintains positive rapport with client by showing interest and

attention; iii. Explains the procedures in simple words; is clear and accurate and spoken in

language that the client can understand.

CHAPTER II MATERNAL, NEWBORN, CHILD HEALTH AND NUTRITION (MNCHN)

Section 5 - The Local Government of Kalibo shall implement the Maternal Newborn and Child

Health and Nutrition (MNCHN) Strategy, to minimize the risk of mistimed, unplanned, unwanted and unsupported pregnancy thereby reducing maternal, infant and neonatal deaths. The identified strategies and interventions are:

a. Prenatal, Natal and Postnatal Care b. Breastfeeding c. Newborn Screening d. Immunization

Section 6 - Role of traditional Birth Attendants (TBAs) in Maternal and Child Health

The paradigm is that “All Pregnancies Are At Risk”. Obstetrical complications can be minimized if identified early thus delivery and post-partum care assisted by skilled Birth Attendant shall be given importance.

The role of Traditional Birth Attendants (TBA’s) must only be limited to supportive care during

delivery and post-partum which are as follows:

1. As companion in the birthing facility during labor and delivery of the mother; 2. Assist the midwives in the preparation of the delivery room/equipment and

instruments in the birthing clinic; 3. Assist the midwives during the labor watch; 4. May run errands when necessary; 5. Assist mothers to initiate immediate breastfeeding; 6. To report to midwives any untoward post-partum complication.

Section 7 - The Milk Code: The Municipality of Kalibo shall exert efforts to address the provision of safe and adequate nutrition for infants and young children through promotion and support of breastfeeding. The following shall be the underlying principles of the Milk Code:

a. Exclusive breastfeeding is for infants from 0 to six (6) months. b. There shall be no substitute or replacement for breast milk. c. Appropriate and safe complementary feeding should start from six months onwards in

addition to breastfeeding. d. Breastfeeding is still appropriate for young children up to two (24 months) years of age

or beyond. e. Advertising, promotions, or sponsorships of infant formula, breastmilk substitutes and

other related products are prohibited. f. Other related products such as, but not exclusive of, teats, feeding bottles, and

artificial feeding paraphernalia are prohibited in health facilities. g. Government and all concerned stakeholders must continuously accomplish an

information dissemination campaign/strategy, and for further research on the advantages of breastmilk and the hazards of breastmilk substitutes or replacement.

h. Milk companies, and their representatives, should not form part of any policymaking body or entity in relation to the advancement of breastfeeding.

Section 8 - ASIN Law: (An Act of Salt Iodization Nationwide) The Municipality of Kalibo shall support the full implementation of ASIN Law. Iodized salt should be utilized in order to prevent the following:

a. Pregnancy wastage or spontaneous abortion and still birth b. Irreversible mental retardation c. Stunted growth d. Low IQ point at birth e. Congenital abnormalities.

Relative to the efficient implementation of the ASIN Law in the Municipality of Kalibo, Task Force ASIN shall be constituted to assure the availability and use of iodized salt.

Section 9 - Expanded Program on Immunization (EPI): Free basic immunization services to infants shall be provided, which shall include the following:

(a) BCG Vaccination against tuberculosis; (b) Diphtheria, Tetanus and Pertussis Vaccination; (c) Oral poliomyelitis immunization; (d) Measles Vaccination; (e) Rubella Vaccination; (f) other basic immunization services for infants; It shall be the duty of the parents, guardian, or person having custody of the infant or child to

see to it that such infant is presented for basic immunization in all barangays of the Municipality of Kalibo. Section 10 - Garantisadong Pambata (GP) The Municipality of Kalibo shall implement the delivery of Garantisadong Pambata (GP) which is an institutionalized Preschoolers Health Campaign where package of health services and relevant health information are delivered twice a year to under 5 year-old children and their parents. This includes the following:

i. Skilled attendance during pregnancy, delivery and immediate postpartum. ii. Care of the Newborn iii. Breastfeeding and Complementary Feeding iv. Micronutrient supplementation and deworming v. Immunization of children and mothers vi. Integrated management of children and mothers

vii. Child injury prevention and control viii. Birth spacing (not less than 2 years) ix. Vitamin A supplementation for the 6-59 months old children x. Deworming of 12-71 months old children xi. Oral health education xii. Promotion of exclusive breastfeeding and complementary feeding

Section 11 - Family Planning: The Local Government of Kalibo shall support and promote the

Philippine Family Planning Program through advocacy activities, sustained participation of stakeholders in program management, use of health facilities and service providers, and utilization of other local resources.

The implementation of Family Planning Program shall be based on the guiding

principles that the Municipality of Kalibo shall: a. protect and promote the right of health of the people and instill health consciousness

among them; b. ensure that correct information and services for all methods including Natural Family

Planning are available, adhering to the standards of quality of care; c. ensure that the practice of family planning is purely on a voluntary basis, based on

freedom of conscience and respect for the sanctity of life; d. provide the necessary budgetary support to the program.

Section 12 - Pre-marriage Counselling: A Pre-marriage Counselling (PMC) Team shall be organized and composed of the following:

Team Leader: Population Officer of Kalibo Members: Pre marriage counsellors from the following government agencies:

• Municipal Health Office • Municipal Social Welfare & Development Office • Municipal Agriculture Office • Department of Education • PNP

The PMC team shall comprise a minimum of 3 and a maximum of 5 members, which shall exercise the following functions:

1. Develop and maintain a responsive mechanism to effectively implement the PMC program in the municipality of Kalibo.

2. Advocate for the effective implementation of the PMC program to ensure continued awareness and support.

3. Conduct PMC session to not more than 15 couples at a time 4. Issue PMC certificate which are signed by accredited mandatory PMC team

members.

CHAPTER III TUBERCULOSIS, DENGUE AND OTHER COMMUNICABLE DISEASES

Section 13 - Hataw Exercises: A regular Workout Program shall be implemented by The Local

Government of Kalibo.

a. Hataw Day shall be done every 4 o’clock in the afternoon of Friday. b. It shall be participated by all municipal officials and employees to instill the importance

of a healthy lifestyle. c. Hataw exercises shall also focus on creating not only camaraderie and closer

relationship among public service providers but also ensures a physically fit and healthy human resource, which is essential in the delivery of basic services to our people.

Section 14 - TB Control Program: The Municipality of Kalibo joins the government’s efforts to

institute an effective program for Tuberculosis Control through the National Tuberculosis Control Program (NTP), the directly Observed Treatment Short Course Chemotherapy (DOTS) strategy of the National Tuberculosis Control Program (NTP) (Executive Order No. 187, 21 March 2003) and shall be the main strategy for tuberculosis control in the Municipality. The five (5) component of DOTS strategy includes:

a) Direct Sputum Smear Examination shall be the initial diagnostic tool in case finding.

b) Standardized Chemotherapy in accordance with the National TB Program.

c) Recording and reporting of cases shall be on the standardized National TB Program forms to be implemented in all health centers.

d) Directly Observed Treatment Short Course shall be used as the strategy to ensure patient compliance.

e) Political commitment to ensure sustained, comprehensive implementation of National TB Program activities.

Kalibo will establish networks, inter-agency links and partnership with key stakeholders. This will

strengthen partnership with different sectors involved in the program such as government agencies, NGOs, civil society, private sector, donor institutions and other cooperating agencies for a more comprehensive NTP implementation.

The Municipal Government shall appropriate annually in the General Fund subject to availability of funds or sourced from other government participating agencies involved in the program. Disbursements shall be approved by the Municipal Mayor upon recommendation of the Municipal Health Board of Kalibo, subject to the usual accounting and auditing procedures. The said funds will be released to the Municipal Health Office and will be allocated as follows:

a) Monitoring and supervisory visit 5% b) Contingency for medicines (Category 3 drugs) and laboratory reagents 80% c) Quality assures for sputum microscopy 5% d) Capability building 5% e) Advocacy activities 5% Section 15 - Tuberculosis is a communicable disease that could lead to disabling conditions

and even death. a. The Municipality of Kalibo shall support the institutionalization of Barangay TB

Management Committee (BTBMC) as an essential strategy to improve case detection and cure rates of TB.

b. The Department of Health and the Municipal Government of Kalibo shall provide free logistics such as sputum microscopy for diagnosis and medicines to confirmed TB cases, based on DOTS (Directly Observed Short Course Chemotherapy).

Section 16 - Dengue is a viral infection transmitted by the bite of an infective female Aedes mosquito. Two Aedes species Aedes Aegypti and Aedes albopictus are knowndisease vectors. Aedes aegypti, the transmitter of the disease, is a day biting mosquito which lays eggs in clear and stagnant water found in flower vases, cans, rain barrel, old rubber tires, etc.

The following prevention and control measures shall be observed: Cover water drums and water pails at all times to prevent mosquitoes from breeding. Replace water in flower vases once a week. Clean all water containers once a week. Scrub the sides well to remove eggs of

mosquitoes sticking to the sides. Clean gutters of leaves and debris so that rain water will not collect as breeding places

of mosquitoes. Old tires used as roof support should be punctured or cut to avoid accumulation of

water. Collect and dispose all unusable tin cans, jars, bottles and other item that can collect

and hold water. Practice 4 o‘clock habit (outdoor sanitation and cleanliness) Search and destroy breeding places of mosquitoes.

Section 17 - Quarantine of Suspected SARS-Infected Persons Imposing Sanctions: For

purposes of this Ordinance, the terms hereunder mentioned shall be defined as follows: (a) SARS - Severe Acute Respiratory Syndrome also known as atypical pneumonia. It is

caused by new form of corona virus, related to the virus which causes flu. A confirmed case of SARS is one who has a fever of more than 38 degrees centigrade, develops body weakness, and respiratory signs and symptoms like cough, sore throat and shortness of breath and had travel to SARS infected countries or had close contact with a confirmed SARS victim. A suspected case is one who has lived with, cared for, or closely worked with a confirmed case and who also develops cough, sore throat and shortness of breath.

(b) QUARANTINE - Detention or isolation for the purpose of preventing the spread of epidemic diseases.

1. Quarantine of Suspected SARS Victim - Pursuant to Executive Order 201 of the President,

any individual who is identified or determined by the DOH of the local health officials to be suffering from the symptoms of the SARS virus, shall be required to undergo testing and be quarantined in either

the San Lazaro Hospital in Manila or the Research Institute for Tropical Medicine in Muntinlupa or in such other places/institutions that may be designated as quarantine areas by the DOH or the local health officials until such time that the DOH issues a SARS negative clearance.

All family members and/or other persons who have been in contact with the suspected SARS

victim shall be required to under home confinement or be quarantined in places/institution as may be designated quarantine areas by the DOH or the local health authorities until such time that the DOH issues a SARS negative clearance.

While under quarantine, suspected SARS victim shall be prevented from making personal

contact with other individuals except the medical personnel treating them, until SARS negative clearance is issued for their discharge from quarantine.

For the effective implementation of this provision, the Municipal Mayor may call on the local

PNP to ensure that the above persons shall remain in quarantine or in their area of confinement until the necessary clearance is issued by the DOH.

2. Other Preventive Measures Against the Spread of SARS - In order to prevent the entry and

spread of SARS in the community, the municipal mayor shall adopt measures against the spread of SARS to include but not limited to the following:

a. The conduct of massive information drives to raise the consciousness of the constituents on

SARS and how it could affect their day-to-day activities.

The information drive may be in the form of fliers, leaflets and other information materials on SARS prevention for distribution to the public through the help of Barangay health workers, other officials and members of the Barangay, public and private school teachers, officials and members of the Sangguniang Kabataan, and members of non-government organizations in the area. Owners of cinemas may also be requested to allow the showing of infomercials on SARS prevention measures for a certain period, as maybe agreed upon.

b. Mandatory requirements to all personnel and staff of public and private hospitals to wear personal protection equipment such as masks and apparel while on duty.

c. Mandatory requirement to all owner/proprietors/administrators or private establishments, including private hospitals, to formulate their own safety measures to protect their employees and the general public from the threat brought about by SARS and inform the municipal government of their SARS prevention plan.

d. Mandatory requirement to crematoriums and/or funeral and embalming establishments to

provide for the immediate cremation/burial of any person confirmed or suspected to have died of SARS. These establishments are further required to coordinate with the DOH and/or local health authorities in formulating measures for the safe handling of the remains of persons confirmed or suspected to have died of SARS.

e. The conduct of clean-up drive in the barangays, regularly but not less than once a week, to

include households, esteros, rivers and riverbanks, drainage, streets, alleys, pathways and other public places. All Barangay officials shall be required to take the lead in the massive clean-up operations in the barangays.

The Municipal Mayor may promulgate or issue such other rules and regulations consistent with

this Ordinance. 3. Funding – The appropriate funding needed for the implementation of this Ordinance shall be

taken the funds of the Municipality, the Calamity Fund of the Municipality may be utilized subject, however, to existing guidelines prescribed under the rules and regulations and other issuances implementing Republic Act No. 8185, govering the allocation and utilization of the local calamity fund.

4. Sanctions - Any person who violate the requirement for home confinement as provided for in

the second paragraph of Section 4 hereof, shall be subject to forced confinement in any of the quarantine areas designated by the DOH, until the necessary clearance is issued by the latter.

Any Crematorium or funeral or embalming establishments offering cremation services who

refuse to cremate any person confirmed or suspected to have died from SARS shall be subject to closure and cancellation of their Business and Mayor’s permit. In addition, the owners, proprietors and/or managers of the said establishments shall be penalized with a fine of not exceeding two thousand pesos (P2, 000.00) or an imprisonment for a period not exceeding six months or both in the discretion of the court.

CHAPTER IV LIFESTYLE ASSOCIATED & OTHER COMMUNICABLE AND NON-COMMUNICABLE DISEASES

Section 18 - Promotion of Healthy Lifestyle: In order to prevent lifestyle associated illnesses

such as Diabetes Mellitus, Hypertension, Malignancies such as Lung Cancer, Cardiovascular & other endocrine disorders, the promotion of healthy lifestyle to its citizenry shall be conducted.

Section 19 - Anti Smoking Campaign: The Local Government of Kalibo shall implement the

prohibition of smoking in public places, passenger buses, jeepneys, and other vehicle for hire operating in the Municipality.

a. Medical findings have shown that smoking pollutes the air and frequent inhalations and exposure to cigarette smoke is hazardous to health.

b. The ill effects of smoking have been scientifically proven as the cause of lung cancer, emphysema and other lung diseases.

c. To protect the health of the citizenry specially the young people, smokers and non-smokers, smoking must be regulated, and if necessary, smoking areas should be specifically designated and provided in enclosed or covered places and/or buildings;

d. Public places and other areas where smoking is prohibited are the following:

i. Within the rooms and premises of schools - elementary, secondary, tertiary and graduate levels;

ii. Within the building of public and private hospitals; iii. Inside the cathedral, churches or chapels iv. Inside elevator, hotels, inns, apartels; v. Theatres, cinema and movie houses; vi. All government offices within the Municipality of Kalibo; vii. Assembly halls, function rooms, conference hall, gyms, sports complex; viii. Banks, both government and private; ix. Restaurants, bars, disco houses, dance halls, beer/pub houses, cocktail

lounges and karaoke bars; x. Department stores, supermarkets, shopping malls, shopping center;

Passenger buses, jeepneys, taxis, multi-cabs, tourist buses coaster, L-300/TX, tricycle and other vehicles for hire.

Section 20 - No Prescription, No Dispensing of Anti-Tuberculosis Drugs: The Municipality of Kalibo fully supports the National Government in its effort to institute program implementation in dispensing of Anti-TB Drugs with appropriate prescription from duly licensed and registered physician;

Section 21 - Acts Penalized. 1. Selling or dispensing of Anti-TB Drugs without the corresponding Prescription Form

Physician.

2. Distribution of Anti-TB Drugs to TB patient/s whether with or without consideration, without corresponding advise from Physicians or Pharmaceutical Company.

Section 22 - Administrative Fine: Without prejudice to the fines provided under the National

Laws, any person violating the provision of this Ordinance shall be penalized with a fine of: For the 1st Offense - a fine of Php 1,000.00

For the 2nd Offense - a fine of Php 2,000.00 warning of cancellation of License or permit to operate

For the 3rd Offense - a fine of Php 2,500.00 and revocation of License or permit to operate.

CHAPTER V LOCAL HEALTH BOARD

Section 23 - Local Health Board: The Municipality of Kalibo shall constitute a Local Health

Board that shall identify priorities, plans, recommend and monitor the administration of health programs in accordance with the prescribed rules and functions.

1. Functions of the Local Health Board:

a. To propose to the Sanggunian Bayan, in accordance with standards and criteria set by the Department of Health, annual budgetary allocations for the operation and maintenance of health facilities and services within the Municipality of Kalibo;

b. To serve as an advisory committee to the Sanggunian Bayan for, and application of local appropriations for public health purposes; and

c. Consistent with the technical and administrative standards of the Department of Health, create committees which shall advise local health agencies on matters such as, but not limited to, personnel selection and promotion, bids and awards, grievance and complaints, personnel discipline, budget review, operations review, and similar functions.

2. Composition of the Local Health Board (LHB) of the Municipality of Kalibo:

CHAPTER VI WATER SUPPLY

Section 24 - Prescribed Standards and Procedures Standards for drinking water and their bacteriological and chemical examinations, together with

the evaluation of results, shall conform to the criteria set by the National Drinking Water Standards. The treatment of water to render it safe for drinking, and the disinfection of contaminated water sources together with their distribution systems shall be in accordance with procedures prescribed by the Department of Health.

Section 25 - Jurisdiction of the Municipal Health Office The approval & subsequent issuance of Permits/Clearance/Certification by Local Health

Authority is required in the following cases: (a) Sites of water sources before their construction; (b) Delivery of water to consumers from new or recently repaired water systems such as

transport of refilled water containers; (c) Operation of a water system after an order of closure was issued; (d) Plans and specifications of water systems of subdivisions and projects prior to the

construction of housing units thereat; and (e) Certification of potability of drinking water.

Section 26 - Types of Water Examinations Required: The following examinations are required

for drinking water:

(a) Initial examination: The physical, chemical and bacteriological examinations of water from newly constructed systems or sources are required before they are operated and opened for public use.

(b) Periodic examination: Water from existing sources is subject to bacteriological examination shall be done every month, while chemical and other applicable examinations shall be conducted every 12 months.

Section 27 - Laboratory Examinations and Submission of Water Samples The examination of drinking water shall be performed only in private or government laboratories

duly accredited by the Department of Health. It is the responsibility of operators of water systems to submit to accredited laboratories water samples for examination in a manner and at such intervals prescribed.

Section 28 - Other Protective Measures To protect drinking water from contamination, the following measures shall be observed: (a) No artesian, deep or shallow well shall be constructed within 25 meters from any

source of pollution. (b) No person charged with the management of a public water supply system shall permit

any physical connection between its distribution system and that of any other water supply, unless the latter is regularly examined as to its quality by those in-charges of the public supply to which the connection is made and found to be safe and potable.

(c) The installation of booster pump to boost water direct from the water distribution line of a water supply system, where low-water pressure prevails is prohibited.

Section 29 - Sanitary Requirements for the Development of Drinking Water Supply System.

(a) Drinking Water Site Clearance Requirements: Persons or entities intending to develop

water supply system shall submit the initial requirements to the local health office, such as application form, water permit issued by the Metro Kalibo Water District, Sanitary survey among others.

(b) After the result of the sanitary survey has been evaluated and found to be satisfactory, a drinking water site clearance shall be issued by the local health authority.

(c) The issuance of Certificate of Potability of drinking water shall be based on the result of the water analysis.

Section 30 - Sanitary Requirements for the Operation of Retail Water System or Refilling

Station. (a) No person or entity shall operate a Retail Water System (RWS) or Refilling Station for

commercial purposes without securing a sanitary permit from the municipal health office.

(b) The Sanitary Permit shall be posted in a conspicuous place of the establishment for public information and shall be available for inspection by authorized health and other regulatory personnel.

(c) There shall be an adequate supply of water for the operation and maintenance of the establishments and its facilities.

(d) Adequate and clean toilet facilities shall be provided for personnel use. (e) All refilled water shall be transported in sanitary transporting facilities inspected and

approved by the Local Health Office.

Section 31 - Sanitary Requirements for Water Vending Machines and Dispensers (a) No person shall operate a Water Vending Machine or Dispenser for commercial

purposes without securing a Sanitary Permit from the Municipal Health Office. (b) Cups used in commercial water vending machines or dispensers shall be for single

used only. (c) A refuse receptacles shall be located adjacent the vending machine dispenser.

Section 32 - Ice Cream Manufacture: All persons involved in the manufacture of ice cream for

sale to the public must first secure a Permit from the Mayor upon presentation to him a Medical Certificate from the Rural Health Physician that he is physically fit to engage in the business. Ice cream vendors who shall have been given permit to manufacture and sell ice cream to the public shall always actually prepare his ice cream under the regulatory supervision of the Rural Health Physician or his duly authorized representative.

CHAPTER VII

FOOD ESTABLISHMENTS

Section 33 - Sanitary Permit (a) No person or entity shall operate a food establishment for public patronage without

securing a permit from the Local Health Office. (b) Every Sanitary Permit shall be posted in a conspicuous place of the establishment. (c) Fees: The fees for the application of permits and certificates shall be in such amounts

as the Municipality of Kalibo may impose. (d) Record of Permits/Certificates: The Municipal Health Office of Kalibo shall keep a

record of permits/certificates issued to all establishments. Section 34 - Health Certificates No person shall be employed in any food establishment without a Health Certificate issued by

the Local Health Authority. This Certificate shall be issued only after the required medical and laboratory examinations are performed.

Section 35 - Quality and Protection of Food: All food must be obtained from sources

approved by the Local Health Authority. In this regard, the following requirements are applicable: (a) Meats, meat products and fish shall be procured from sources under sanitary or

veterinary supervision. (b) All meat and fish shall be properly cooked before serving.

(c) No meat products, fish, vegetables and other food sources shall be procured from sources or areas known to have been affected by water pollution such as fish kill red tide and oil spill.

(d) All perishable and potentially hazardous foods shall be stored at 2-8°C or below. (e) Raw fruits and vegetables shall be thoroughly washed before they are consumed.

Section 36 - Structural Requirements: Food establishments shall be constructed in

accordance with the sanitation standards for: a. Construction and maintenance of premises b. Water, Hand-washing and Toilet Facilities c. Solid and Liquid Waste Management d. Wholesomeness and protection of food e. Personnel Hygiene f. Sanitary condition of appliances and utensils g. Vermin and disease control Section 37 - Evaluation of Food Establishment: It shall be the duty of the Local Health Authority to conduct an inspection and evaluation of

every food establishment. The Inspector shall record his findings on an Inspection Form provided for the purpose and shall

furnish copy of the report to the owner of the food establishment, or duly authorized representative. Whenever an Inspection Form issued indicates non-compliance items, the Inspector shall notify

the owner of the establishment or its duly authorized representative of the correction to be made and indicate a reasonable period for its compliance. If upon re-inspection, the Inspector finds the correction has not been complied, the Sanitary Permit shall be revoked.

(a) Revocation of Permits: The Local Health Authority shall revoke the permit if the two

notices had not been complied with, or that the failure to comply therewith is not excusable.

(b) Suspension of Permits: Whenever the Local Health Authority finds unsanitary or unhealthy conditions in the operation of a food establishment which in his judgment constitute a substantial hazard to the public health, he/she may order the immediate suspension of the permit.

(c) Power of Entry: Sanitation Inspector upon presentation of proper credentials may at all reasonable times enter any premises engaged in the manufacture, preparation or packing of any article of food for sale.

CHAPTER VIII

MARKETS AND ABATTOIRS

Section 38 - Prescribed Standards of Construction: The construction of Markets and Abattoirs shall conform to standards prescribed by the

Department. These standards shall be set along the following guidelines: 1. Suitability of site insofar as elimination of nuisance condition and prevention of

contamination are concerned; 2. Availability of ample water supply for cleaning; 3. Accessibility of adequate drainage facilities; 4. Durability of construction to protect vendors and customers from any hazard and

exposure to the elements; and 5. Facilities for sanitation maintenance, such as cleaning and elimination of harbourages

of vermin. Section 39 - Responsibility of the Local Health Authority (a) On Markets

1. Make periodic inspections to ascertain the maintenance of adequate sanitary conditions of markets and their premises;

2. Supervise and control the proper care and use of market stalls; 3. Prohibit the construction of living quarters within any market and its premises; 4. Enforce the ban on construction of partitions, sheds or booths within the market

area.

(b) On Abattoirs 1. Supervise the maintenance of adequate sanitation in abattoirs and their premises;

2. Enforce the requirements on the examination of meat as provided in existing laws; 3. Permit the slaughter of animals for public consumption in other designated areas

in certain exigencies, provided public health is adequately protected; 4. Supervise the sanitary disposal of all abattoir wastes; 5. Ensure that only healthy animals shall be slaughtered, and that the method of

slaughtering, the techniques of dressing and the storing, handling and transporting procedures are in accordance with prescribed standards.

CHAPTER IX

PUBLIC LAUNDRY

Section 40 - General Requirements: The construction and operation of a Public Laundry shall be governed by the following requirements:

(a) Structural Requirements

1. The site should be distant from sources of nuisance. 2. Only durable construction materials shall be used. 3. Smooth and water-tight materials shall be used for flooring. 4. All work rooms shall be properly ventilated 5. Adequate drying facilities shall be provided and articles for drying protected from

sources of contamination. (b) Sanitary Requirements

1. Laundry supplies in both liquid and solid state shall be properly stored, prepared and handled. Containers of chemical shall be properly labelled.

2. Employees shall be provided with potable drinking water, toilets, bathing and washing facilities.

3. Employees shall be provided with lockers for their working garments and street cloths.

4. The plant and its premises and equipment shall be maintained clean and sanitary at all times.

CHAPTER X

SCHOOL SANITATION AND HEALTH SERVICES

Section 41 - The Physical Environment: In the design and construction of the School Plant, the following factors shall be considered:

(a) Site: Traffic hazards are to be avoided but not to the point of sacrificing accessibility to public transportation. It shall be distant from sources of nuisances.

(b) Grounds: The acreage shall be large enough to permit playgrounds, athletic fields and school gardens.

(c) Building: Preferably it shall be constructed of strong and durable materials and designed along functional lines. For the prevention of fire hazards, the requirements of the local fire department shall be observed. Sufficient ventilation shall be provided. Wall and ceiling finishes should be chosen so as to give optimum lighting with minimum glare. For flooring, suitable materials shall be used which will give maximum durability without creating a slippery surface.

(d) Sanitary Facilities: The school population shall be provided with potable water, and sanitary toilets. The disposal of waste shall conform with the Municipal Ordinance Number 2009-004 “The Ecological Solid Waste Management Code of Kalibo”.

Section 42 - The Emotional Environment: For the promotion of emotional health of the school

population the following requirements shall be observed: (a) Suitable Location: The school site shall be located away from disturbances and places

which give undesirable influence. (b) Recreational Facilities: The school must have safe and attractive playgrounds and

adequate facilities for suitable sports and games.

Section 43 - Health Services: Trained personnel and adequate facilities should be available so that students may be afforded the following health services:

(a) Periodic Physical and Medical Examination; (b) Periodic Immunization; (c) Medical and Dental treatment; (d) Treatment for common emergencies; and (e) Counselling and Guidance.

CHAPTER XI INDUSTRIAL HYGIENE

Section 44 - Sanitary Requirements for Operating an Industrial Establishment: The

following sanitary requirements shall be applicable to industrial establishments:

(a) No person, firm, corporation, or entity shall operate any industrial establishment without first obtaining a sanitary permit from the local health authority.

(b) Industrial establishments shall be allowed to operate only in places or zones assigned for the kind of industry by existing zoning laws, ordinances, or policies.

(c) Adequate potable water supply shall be provided to employees. (d) Sewage disposal shall be by means of a municipal sewerage system. Adequate and

conveniently located toilet and bath facilities shall be provided for each sex. (e) All wastes incident to the operation of the industrial plant shall be collected, stored,

or disposed of in a manner to prevent health hazards, nuisances, and pollution. (f) An abatement program for the control of vermin shall be maintained. (g) Adequate restrooms and mass halls shall be provided for employees. (h) All places of employment and all workrooms, including machinery and equipment,

shall be kept clean and sanitary. Section 45 - Responsibilities of the Employer and Employees: The following are the

responsibilities of the employer and employees in industrial establishments:

(a) Employer responsibility 1. Provide and install control measures and protective equipments; 2. Inform affected employees regarding the nature of the hazards and methods of

control measures and protective equipment; 3. Make periodical testing of the hearing of all employees in noisy areas of operation; 4. Adopt measures so that the noise produced is within allowable limits so as not to

affect neighboring offices, buildings or establishments; 5. Provide personal protective equipment and/or protective barriers when they are

necessary.

(b) Employee responsibility 1. Observe strictly protective control measures which are prescribed; and 2. Use equipment provided for them properly.

Section 46 - Personal Protective Equipment: Personal protective equipment and/or protective barriers shall be provided whenever

substances, radiations or mechanical irritants are encountered in a manner capable of causing any pathological change or injury or impairment in functions of any part of the body through skin and/or mucous membrane absorption.

Section 47 - Health Services: Medical services shall be provided to all employees in

accordance with existing laws and rules and regulations.

CHAPTER XII PUBLIC SWIMMING OR BATHING PLACES

Section 48 - Sanitary Permit: No public swimming and bathing places shall be operated for

public use without a Sanitary Permit issued by the Local Health Authority of the Municipality of Kalibo.

Section 49 - Protection of Customers: To protect the health and safety of persons who use them, the establishment shall observe the following:

1. Correct sanitary practices for persons swimming or bathing to prevent the transmission

of communicable diseases; 2. Correct sanitary procedures for personnel working in those places to maintain their

adequate sanitation and cleanliness of accessories used by customers; 3. Adequate number of trained personnel and necessary equipment needed for life-saving

and rescue work; 4. Post conspicuous signs to warn the public of the presence of artificial or natural hazards;

and

Section 50 - Responsibility of the Local Health Authority: The Local Health Authority concerned shall:

1. Inspect the state of sanitation of public swimming or bathing places; 2. Ascertain if their personnel are examined regularly for the presence of any infections or

contagious disease;

CHAPTER XIII REST AREAS, BUS TERMINALS, BUS STOPS, AND SERVICE STATIONS

Section 51 - Rest areas, bus terminals, bus stops and service station areas with one or more

permanent sheds, buildings and service facilities for motor vehicles shall be provided with sanitary facilities for the convenience and personal necessities of the travelling public.

(a) Rest areas, bus terminals, bus stops and service stations shall be established with ample area to prevent overcrowding of motor vehicles and travellers.

(b) They shall be provided with adequate ventilation and lighting and away from sources of nuisance.

(c) Safe and adequate water supply shall be provided. (d) Excreta and sewage collection and disposal shall be provided. (e) Refuse collection and disposal shall be in accordance with the Solid Waste Management

of Kalibo. (f) Comfort rooms: Adequate number of comfort rooms shall be provided as well as

auxiliary facilities such as hand washing areas. (g) Waiting sheds for commuters shall be of adequate size to comfortably accommodate a

minimum of thirty (30) persons. Floors shall be of smooth concrete finish and adequate sitting facilities provided for.

CHAPTER XIV

DANCING SCHOOLS, DANCE HALLS AND NIGHT CLUBS

Section 52 - General Provisions: The following provisions are applicable to dancing schools, dance halls and night clubs:

(a) It shall be operated and opened for public patronage only when a sanitary permit is issued by the local health authority.

(b) Premises shall be kept clean and sanitary at all times. (c) Patrons shall be provided with adequate potable water and toilet facilities in accordance

with prescribed standards. (d) There shall be no private rooms or separate compartments for public use except those

used for lavatories, dressing rooms, bars and kitchens.

CHAPTER XV TONSORIAL AND BEAUTY ESTABLISHMENTS

Section 53 - Definition of Terms: As used in this Chapter, the term "Tonsorial and Beauty

Establishments" include barbershops, beauty parlors, hairdressing and manicuring establishments and figure-slendering salons.

(a) Requirements. These establishments are subject to the following requirements: 1. A sanitary permit shall be procured from the local health authority before their operation. 2. They shall be maintained clean and sanitary at all times. 3. No person shall be employed to service customers without a health certificate issued by

the local health authority.

(b) Correct Sanitary Practices. The following sanitary practices shall be observed. 1. Working personnel shall wash their hands with soap and water before servicing

customers. 2. They shall wear clean working garments. 3. They shall not smoke nor eat while working. 4. Garments, materials and other devices used in the operation of their business shall

be cleaned and disinfected before and after their use. 5. Customers shall be supplied with clean and fresh towels, drapes and other linen as

necessary. 6. Precautionary measures to prevent disease transmission shall be observed when

serving customers showing any form of dermatoses.

CHAPTER XVI MASSAGE CLINICS AND SAUNA BATH ESTABLISHMENTS

Section 54 - Sanitary Requirements The following requirements shall be enforced:

Requirements for Massage Clinics or Establishments: a) No massage Clinic/establishment shall be established, operated, maintained without a

“Sanitary Permit” issued by the Rural Health Physician or his duly authorized representative; such sanitary permit to be valid for one (1) year from date of issuance and renewable every year thereafter.

b) Physical set-up: 1. The rooms shall be provided with sliding curtains instead of the ordinary doors or

swinging doors; 2. Facilities for washing and disinfecting the hands of attendants and masseurs and

other equipment shall be available at all times; 3. Sanitary toilet facilities should be easily accessible to clients and patrons; 4. The premises at all times should be maintained in sanitary condition. 5. Clean sheets and towels should be provided. 6. The reception and office rooms shall be properly lighted and ventilated. 7. Every massage room shall be adequately ventilated, provided with a sliding curtain

at the entrance and equipped with a suitable and clean massage table. 8. Sanitary and adequate hand washing, bath and toilet facilities shall be available. 9. Customers shall be provided with soap, clean towels, sanitized rubber or plastic

slippers. 10. Masseur and masseur attendant shall wash their hands with soap and water before

and after massaging a customer. 11. The establishment and its premises shall be maintained clean and sanitary at all

times.

Section 55 - Personnel: The following requirements shall be enforced: (a) Massage Therapist

1. The person must have a certificate as a registered masseur, issued by the Committee on Examiners for Massage Therapist of the Department of Health.

2. He must possess an up-to-date health certificate issued by the local health authority. 3. The person shall wear a clean working garment when attending to customers or

when supervising massage clinic attendants.

(b) Massage Clinic Attendant 1. The person shall be properly registered and authorized by the local health authority to

work as massage clinic attendant after compliance with the following requirements: a) The Satisfactory completion of a training course or study given by a government

office, school or hospital, which is duly authorized and recognized by the Department of Health; and

b) Health certificate issued by the local health authority.

2. The person must wear clean working garments when attending to customers.

Section 56 - Inspection: All massage clinics and other related establishments shall be open for inspection any time of the day or night, and with respect to health requirements of employees and sanitary conditions, inspection thereof shall be the sole responsibility and under the jurisdiction of the Rural Health Physician or his duly authorized representative; on the other aspects, however, inspection maybe done by the Municipal Task Force for Public Safety.

CHAPTER XVII

HOTELS, MOTELS AND APARTMENTS, LODGING, BOARDING, OR TENEMENT HOUSES, AND CONDOMINIUMS

Section 57 - General Provisions: The following are required for the establishments defined in

the preceding Section: (a) No establishment shall be operated and opened for public patronage without a sanitary

permit issued by the local health authority. (b) Any extension or additional construction in an establishment shall require a sanitary

permit before it could be operated. (c) All establishments shall provide their patrons with adequate water supply, toilet and bath

facilities in accordance with prescribed standards. (d) Establishments and their premises shall be kept clean and sanitary at all times. (e) Periodic insect and vermin control measures shall be undertaken to eradicate vectors of

diseases.

(f) Animals, fowls and pets shall be housed in appropriate kennels or cages separate from living quarters.

(g) No person shall be employed in establishments without first procuring a health certificate from the local health authority. .

CHAPTER XVIII PORT, AIRPORT, VESSEL AND AIRCRAFT SANITATION

Section 58 - Port and Airport Sanitation: In ports and airports, the following sanitary

requirements shall be applied: (a) Every port and airport shall be provided with potable drinking water and wholesome food

supplied from sources approved by the local health authority. (b) The drinking water and food shall be stored and handled in a manner to ensure their

protection against contamination. The local health authority shall conduct periodic inspections of equipment, installations and premises.

Section 59 - Vessel Sanitation: The provisions of Quarantine Regulations shall be applied and

enforced.

Section 60 - Aircraft Sanitation: The requirements in the Guide to Hygiene and Sanitation in Aviation of the World Health Organization shall be applied and enforced.

CHAPTER XIX VERMIN CONTROL

Section 61 - General Requirements

(a) A vermin abatement program shall be maintained in places by their owners, operators or administrators.

(b) The procedure and frequency of vermin abatement program shall be determined and approved by the Local Health Authority.

CHAPTER XX SEWAGE COLLECTION AND DISPOSAL, EXCRETA DISPOSAL AND DRAINAGE

Section 62 - Definition of Terms: As used in this Chapter, the following terms shall mean: (a) Septic tank - A water tight receptacle which receives the discharge of a plumbing system or

part thereof, and is designed to accomplish the partial removal and digestion of the suspended solid matter in the sewage through a period of detention.

(b) House sewer - The pipe line conveying sewage from the house or building to the septic tank or to any point of discharge.

(c) Septic tank absorption bed or drain field - An underground system of pipes leading from the outlet of the septic tank, consisting of open-jointed or perforated pipes so distributed that the effluent from a septic tank is oxidized and absorbed by the soil.

(d) Effective capacity of a septic tank - The actual liquid capacity of a septic tank as contained below the liquid level line of the tank.

(e) Effective depth of a septic tank -The actual liquid depth of a septic tank as measured from the inside bottom of the septic tank to the liquid level line.

(f) Freeboard or air space of a septic tank - The distance as measured from the liquid level line to the inside top of the septic tank.

(g) Distribution box - A small concrete receptacle between the septic tank and the drain field from which lines of drain tile extends and which acts as surge tank to distribute the flow of sewage equally to each line of drain tile.

(h) Approved excreta disposal facilities - shall mean any of the following: 1. Flush toilets properly connected to a community sewer; 2. Flush toilets connected to a septic tank constructed in accordance with the prescribed

standard. (i) Septic privy - where the fecal matter is placed in a septic tank containing water and

connected to a drain field but which is not served by a water supply under pressure.

Section 63 - Disposal of Septic Tank Effluent: The effluent from septic tanks shall be discharged into a sub-surface soil, absorption field where applicable or shall be treated with some type of a purification device.

Section 64 - Sanitary Privies: The privy recommended for use is the sanitary privy. It shall conform with the following minimum requirements:

(a) It shall consist of an earthen pit, a floor covering the pit, and a water-sealed bowl. It shall

be so constructed in order that fecal matter and urine will be deposited into the earthen pit which shall be completely fly-proof.

(b) The pit shall be at least one meter square. (c) The floor should cover the pit tightly to prevent the entrance of flies. It shall be

constructed of concrete or other impervious material. (d) The water-sealed bowl shall be joined to the floor so as to form a water-tight and insect

proof joint. (e) A suitable building shall be constructed to provide comfort and privacy for the users of

the privy.

Section 65 - Drainage (a) Responsibility of the Municipality of Kalibo. It shall be the responsibility of the

Municipality of Kalibo to provide a satisfactory system of drainage in order to prevent nuisance to the community and danger to public health.

(b) Connection to the municipal drainage system: Buildings or premises producing waste water may connect to the municipal drainage system in areas where it exists.

Section 66 - Special Precaution for Radioactive Excreta and Urine of Hospitalized Patient

(a) Patients given high doses of radioactive isotope for therapy should be given toilet

facilities separate from those used by "non-radioactive" patients. (b) Radioactive patients should be instructed to use the same toilet bowl at all times and to

flush it at least 3 times after its use.

CHAPTER XXI REFUSE DISPOSAL

Section 67 - The Municipality of Kalibo, which is composed of 16 barangays shall provide an

adequate and efficient system of collecting, transporting and disposing refuse in their areas of jurisdiction.

Section 68 - The following requirements for refuse disposal shall be enforced: (a) Occupants of buildings and residences shall; provide a sufficient number of receptacles

for refuse. Refuse in receptacles shall be protected against vermin and other animals. (b) Refuse shall be disposed in accordance with the Municipal Solid Waste Management. (c) Refuse shall not be thrown in any street, sidewalk, yard, park or any body of water. It

shall be stored in a suitable container while awaiting its final disposal. (d) Streets shall be kept clean by occupants or owners of properties lining the street from

the line of the property to the middle of the street and from one property to the other. (e) Parks, plazas and streets adjacent to public buildings shall be kept clean by the local

government concerned.

CHAPTER XXII NUISANCES AND OFFENSIVE TRADES AND OCCUPATIONS

Section 69 - Definition of Terms: As used in this Chapter, the following terms shall mean and

include: (a) Nuisance - Anything that injures health, endangers life, offends the senses or produces

discomfort to the community.

Section 70 - Types of Nuisances: The following shall be considered nuisances: (a) Public or private premises maintained and used in a manner injurious to health; (b) Breeding places and harborages of vermin; (c) Animals and their carcasses which are injurious to health; (d) Accumulation of refuse; (e) Noxious matter or waste water discharged improperly in streets; (f) Animals stockage maintained in a manner injurious to health; (g) Excessive noise; and (h) Illegal shanties in public or private properties.

Section 71 - Small Scale Piggery. a. Its operation shall be subjected to the condition that it will be maintained clean and sanitary

at all times and would not create nuisance, emit obnoxious odor or offensive to the senses. b. The facilities shall be subjected to existing requirements of location clearance or zoning of

the locality. c. A Sanitary Permit issued by the Local Health Authority is required before operating a small

scale piggery. Section 72 - Piggery Farm.

a. Piggery farms shall be required to secure Location Clearance from Municipal Zoning

Authority. b. A Sanitary Permit issued by the Local Health Authority is required before its operation. c. Site Location

i. Piggery farms shall be located in areas designated by Local Zoning Authority. ii. Flood-prone areas and other environmentally critical areas like watersheds, source

of water supply shall be avoided. iii. Site shall be planted with trees and vegetables crops to protect the animals from

strong winds and minimize the odor coming from the farm. iv. It shall be located at least 500 meters away from built-up areas (residential,

commercial, institutional and industrial). v. It shall be located 500 meters away from national roads/or highways. vi. It shall be located away from the path of immediate urban expansion up to 10 years.

d. It shall be the responsibility of the owner to maintain at all times the cleanliness and sanitation of farm.

e. Adequate supply of potable water shall be provided. f. Waste shall not be allowed to accumulate in the premises and shall not produce nuisance. g. The accumulation and disposal of refuse shall be in accordance with the solid waste

management of the Municipality of Kalibo. h. It shall have a septic tank.

Section 73 - Poultry a. Its operation shall be subjected to the condition that it will be maintained clean and sanitary

at all times and would not create nuisance or in a manner injurious to the health of the people.

b. A Sanitary Permit issued by the Local Health Authority is required before operating backyard poultry.

Section 74 - Responsibilities of Owners, Managers or Operators of Piggery and Poultry: The Owners, managers or operators of establishments shall:

(a) Secure a sanitary permit from the local health authority before establishing and operating their business or trade;

(b) Remove daily all injurious by-products and wastes; (c) Prevent the escape of industrial impurities and adopt methods to render them

innocuous; (d) Maintain working establishments and their premises clean and sanitary at all times; (e) Store all materials properly to prevent emission of noxious or injurious effluvia.

CHAPTER XXIII

DISPOSAL OF DEAD PERSONS

Section 75 - Burial Grounds Requirements: The following requirements shall be applied and enforced:

(a) It shall be unlawful for any person to bury remains in places other than those legally

authorized. (b) No house shall be constructed within 25 meters distance from any burial ground. (c) No burial ground shall be located within 50 meters from either side of a river or within 50

meters from any source of water supply. (d) Must comply with other sanitation standards for burial grounds such as site, fence, sewage

disposal and drainage among others.

Section 76 - Burial Requirements: The burial remains are subject to the following requirements:

(a) No remains shall be buried without a Death Certificate. This Certificate shall be issued by

the attending physician. In extreme emergencies and if there is no physician in attendance, the Death Certificate shall be signed by the Mayor.

(b) Shipment of remains abroad shall be governed by the rules and regulations of the Bureau of Quarantine.

(c) The cost of burial of a dead person shall be borne by the nearest kin. If the kin is not financially capable of defraying the expenses or if the deceased had no kin, the cost shall be borne by the municipal government.

(d) The burial of remains in municipal burial grounds shall not be prohibited on account of race, nationality, religion or political persuasion.

(e) Except when required by legal investigation or when permitted by the Local Health Authority, no unembalmed remains shall remain unburied longer than 48 hours after death.

(f) When the cause of death is a dangerous communicable disease, the remains shall be buried within 12 hours after death. They shall not be taken to any place of public assembly. Only the adult members of the family of the deceased may be permitted to attend the funeral.

Section 77 - Disinterment Requirements: Disinterment of remains is subject to the following

requirements: (a) Permission to disinter remains of persons may be granted after a burial period of five years. (b) In all cases of disinterment, the remains shall be disinfected and placed in a durable and

sealed container prior to their final disposal. (c) The Municipality of Kalibo shall provide a common grave made of concrete materials for

disinterment of unattended remains. (d) The caretaker of the cemetery shall keep a record of unattended remains prior to disposal at

the common grave.

Section 78 - Funeral and Embalming Establishments: These establishments are subject to the following requirements:

(a) Requirements prescribed herein shall be applied and enforced to funeral chapels,

embalming establishments and morgues. (b) Sanitary Permit: No establishment mentioned in the preceding paragraph shall be operated

without a sanitary permit issued by the Local Health authority. (c) Sanitary requirements for funeral establishments:

For embalming and dressing rooms 1. They should be constructed of concrete materials with sufficient space. 2. The floors and walls shall be made of concrete or other durable solid materials. 3. Ventilation and lighting should be adequately provided. 4. Embalming shall be performed on a table made of a single marble slab or other equally

solid materials. It shall be so constructed that all washings and body fluids shall flow to a drain connected to the waste piping system or septic tank solely for embalming purposes.

5. Embalming and assistants shall use apron, mask, rubber gloves and other personal protective equipments when working.

6. Washing facilities with soaps, detergents and germicidal solutions shall be provided.

Section 79 - Licensing and Registration Procedures: The licensing and registration of undertakers and embalmers are subject to the following requirements:

(a) Issuance of license to practice

1. Any person who desires to practice undertaking or embalming shall be licensed to practice only after passing an examination conducted by the Department of Health.

2. Licensed undertakers or embalmers shall display their licenses conspicuously in the establishments where they work.

Section 80 - Responsibility of the Local Health Authority. The Local Health Authority shall: (b) Issue permits to inter, disinter or transfer remains; (c) Apply prescribed measures when cause of death is due to a dangerous communicable

disease; (d) Keep records of death occurring within his area of jurisdiction

Section 81 - Responsibility of Local Government Unit of Kalibo. The Municipality of Kalibo shall:

(a) Reserve appropriate tracts of land under their jurisdiction, for cemeteries; (b) Utilize judiciously grants, gifts, bequests of property or financial donations for the

establishment or improvement of cemeteries; and (c) Close cemeteries under their jurisdiction subject to the recommendation of the Local Health

Authority.

CHAPTER XXIV FINAL PROVISIONS

Section 82 - Penal Provision (a) Unless otherwise provided in any Chapter or Section in this Code, any person who shall

violate, disobey, refuse, omit or neglect to comply with any of the rules and regulations promulgated under this Code shall be guilty of misdemeanor and applicable penalties shall be imposed.

(b) Any person establishment/corporation who shall interfere with or hinder, or oppose any officer, agent or member of the Department or of the bureaus and offices under it, in the performance of his duty as such under this Code, or shall tear down, mutilate, deface or alter any placard, or notice, affixed to the premises in the enforcement of the Code and/or found guilty shall be imposed following penalty:

1st offense - P 500.00 2nd offense - P 1,000.00 3rd offense - P 2,500.00 and imprisonment of not less than three (3)

days and not more than six (6) months or both upon the discretion of the Court

Section 83 - Compromise Penalty: In the event that violator/s opt not to be prosecuted in

Court, he/she my pay an Administrative Fine of Two Thousand Five Hundred Pesos (P2,500.00). In the event however that violators becomes a Recidivist the violator shall suffer the maximum penalty of imprisonment corresponding provided for in this Code.

Section 84 - Separability Clause: In the event that any section, paragraph, sentence, clause,

or word of this Code is declared invalid for any reason, other provisions thereof shall not be affected thereby.

Section 85 - Repealing Clause: All laws, as well as pertinent rules and regulations thereof

which are inconsistent with the provisions of this Code are hereby repealed or amended accordingly.

Section 86 - Effectivity: This Code is hereby made part of the law of the land and shall take effect after 15 days following implementing publication and/or compliance of provisions provided for by RA 7160. ENACTED, December 01, 2011.”
