ELEGIBILITY CONDITION. The Contractors satisfying the following conditions: 4.1 Average annual turnover during the last 3 years, ending 31

st March of the previous financial year, should be at least 30% of the estimated cost put to tender.

AND 4.2 BSNL Enlisted Contractors.

OR 4.4 Experience of having successfully completed similar works in BSNL during last 7 years ending last day of month previous to the one in which applications are invited , should be either of the following : Three similar successfully completed works costing not less than the amount equal to 40% of the estimated cost put to tender.

OR Two similar successfully completed works costing not less than the amount equal to 60% of the estimated cost put to tender.

OR One similar successfully completed work costing not less than the amount equal to 80% of the estimated cost put to tender. NOTE: The estimated cost of one year shall be considered to evaluate the eligibility criteria.

The contractor shall submit and confirm:-

1. Chartered Accountant Certificate towards submission of income tax & Registration certificate dully attested as applicable along with application on the printed letter heads for purchase of Tender.

2. Attested copy of valid registration certificate as applicable along with application on their printed letter head for purchase of tender.

3. GSTIN REGISTRATION. EPF registration as applicable. Certificate in respect “No relative working in BSNL”.

4. The Tenderer shall submit the tender in two (2) sealed covers marked as cover 1st and 2nd. The first cover should contain the earnest money deposited the shape of Demand Draft /Pay Order of a

Schedule Bank or Nationalized Bank / State Bank guaranteed as by Reserve Bank of India drawn in favour of Accounts Officer (Cash) O/O PGMTD, BSNL Patna and the second cover should contain

the tender documents. In case 1st cover is not annexed of Earnest Money in proper form, the 2nd cover containing tenders will not be opened at all.

The Tenders will be received up to 15.00 Hrs. on 12.03.2018in the B.S.N.L Electrical Sub-Division-I, Patna and opened at 15.30 Hrs. on the same day. In case holiday is declared on the

opening day the tenders will be opened on the next working day.

Conditions and tender forms can be had from the B.S.N.L Electrical Sub-Division-I, Patna office every day, Except Sunday & Holiday, up to 16.00 Hrs of 09.03.2018on payment of Rs.

150=00+G.S.T. (Rupees One hundred Fifty +G.S.T. only) (Non refundable). Application for tenders must be received in the BSNL Electrical Sub-Division-I, Patna Office up to 08.03.2018. The tender

will be submitted in the same Sub-division from where the tender documents have been purchased.

CONDITION OF BANK GURANTEE FOR EMD IS MORE THAN Rs20,000/-

1. The BG shall be from a scheduled bank or a nationalized bank/State Bank guaranteed by Reserve Bank of India, in enclosed proforma for the prescribed

value mentioned in NIT.

2. The Bank guarantee shall remain valid for the period at least 30 days beyond the validity period of the tenders.

3. For works in Bihar the BG shall be furnished duly stamped at the rate of Rs. 15.75 (as per Indian Stamp Act).

4. For other states the Bank Guarantee shall be furnished duly stamped for Rs.15.75. or prescribed stamp duly in that state wherever is more.

5. Firm shall have to extend the validity of Bank Guarantee furnished by them if so required by BSNL.

6. The provision of Indian Stamp Act 1899 for stamp duty rate shall be applicable.

10 MEMORANDUM.

Subject: - Exemption from payment of earnest money with each tender.

The rules regarding enlistment of contractors in CPWD allow the categories of the contractors depending upon the cases in which they are registered, to deposit lump sum money in

order to enable them to secure exemption from payment of earnest money with each tender vide para 21.3 and appendix 31 of CPWD manual (volume: II edition 1980).

This facility of exemption from payment of earnest money with each tender is withdrawn with effect from 18.6.93. All tenders invited on or after 15.6.93 will be accompanied by

earnest money at the new rates being notified simultaneously.

In a press notification, the contractors have been requested to apply for refund of earnest money deposits, which will be released after obtaining clean ”no demand” certificates from

sub ordinate formation. Such cases should be got expedited and earnest money deposits released without undue delay.

In view of the above, no fresh case for security exemption from earnest money will be accepted.

The extent provision in the CPWD manual will be amended in due course.

SUBJECT:- Special conditions for reimbursement of levies/taxes arising of the l6th constitution Amendment 1982.

Tendered rates are inclusive of all taxes and levies payable under the respective statutes. However, pursuant to the constitution (46th

amendment) act, 1982 if any further tax

or levy is imposed by stature, after the date of receipt of tenders, and the contractors there upon necessarily and properly pays such taxes /levies, the contractors shall be

reimbursed the amount so paid, provides such, payment of any, is not in the opinion of the Superintending Engineer (whose decision shall be final and binding) attributable to

delay in execution of work within the control of the contractor.

The contractor shall keep necessary books of account and other documents for the purpose of this condition and may be necessary and shall allow inspection of the same by

duly authorized representatives of the government and further shall furnish such other information/documents as the Engineer-in-Charge may require.

The contractor shall, within a period of 31 days of imposition of any further tax or levy pursuant to the constitution (46th

amendment act 1982), give a written notice thereof

to the engineer-in-charge what the same is given pursuant to this condition, together with all necessary information relating thereto.

NOTICE INVITING TENDER

Item rate/ percentage rate tenders are invited on behalf of the Bharat Sanchar Nigam Limited from approved and eligible contractors of DOT/BSNL and those

of appropriate list of CPWD, MES, Railways and Bihar State PWD for the work of: - Replacement of service line wire for Pump room and associated

Electrical Works in staff Quarter at Main TE Rajgir in SDE(G) Biharsharif Under Patna SSA

The work is estimated to cost Rs. 11,705.00, this estimate, however, is given mere as a rough guide.

1.1 Tenders will be issued to eligible contractor of DOT/BSNL as well as non DOT/BSNL according to the eligibility condition

2. CRITERIA OF ELEGIBILITY FOR ISSUE OF TENDER DOCUMENTS : As per NIT

The contractor shall submit confirm:-

i. Chartered Accountant Certificate towards submission of income tax & Registration certificate dully attested as applicable along with application on the printed letter heads for purchase of

Tender.

ii. Attested copy of valid registration certificate as applicable along with application on their printed letter head for purchase of tender.

iii. GSTIN REGISTRATION. EPF Registration as applicable. Certificate in respect “No relative working in BSNL”.

iv. The earnest money deposit in prescribed form.

v. The department reserve the right to accept or reject any tender without assigning any reasons.

3. Agreement shall be drawn with the successful tenderer on prescribed form No. 7/8 which is available as a Govt. of India Publication. Tenderer shall quote his rates as per various

terms and conditions on the said form, which will form part of the agreement.

5. Receipt of applications for issue of forms will be stopped by 16.00 hrs. On 08.03.2018, two days before the date fixed for opening of tenders. Issue of tender forms will be stopped on

09.03.2018two day before the date fixed for opening of tenders.

Tender documents consisting of plans, specifications, the schedule of quantities of the various classes of work to be done and the set of terms and conditions of contract to be

complied with by the contractor whose tender may be accepted and other necessary documents can be seen in the office of the Sub-Divisional Engineer (E), BSNL Electrical Sub-

Division-I, Patna between hours of 10.30.00 AM and 3.30 PM every day except on Sundays and Public Holidays. Tender documents, excluding standard form, will be issued from the

office, during the hours specified above, on payment of Rs. 150.00+G.S.T. (Non refundable) in cash.

6. The tenderer must produce a Chartered Accountant Certificate towards Submission of Income Tax as modified under Central Board of Direct Taxes vide no. 153/191/2002-TPL dated

13.02.2003 and Directorate letter no. 5-2-72/EW-2003 dated 30.05.2003 as amended from time to time before tender papers can be sold to him.

Tenders, which should always be placed in sealed envelope, with the name of work and due date written on the envelopes will be received by The SDE (E)-I, Patna on and will be

opened by him or his authorised representative in his office on the same day at 03.30 PM.

12 7. The tender shall be accompanied by earnest money, (unless exempted) of Rs. 234.00 in cash/DD/receipt Treasury Challan /Deposit at Call receipt of a Scheduled Bank issued in

favour of Accounts officer (Cash) O/O The PGM TD, BSNL, Patna the amount being credited to_______________. A contractor exempted from depositing earnest money in

individual cases, shall attach with the tender an attested copy of the letter exempting him from depositing earnest money and shall produce the original when called upon to do so.

Copies of other drawings and documents pertaining to the works will be opened for inspection by the tenderers at the office of the above-mentioned officer.

8. Tenderers are advised to inspect and examine the site and its surroundings and satisfy themselves before submitting their tenders as to the nature of the ground and sub soil (so far as is

practicable), the form and nature of the site, the means of access to the site, the accommodation they may requisite and in general shall themselves obtain all necessary information as to

risks, contingencies and other circumstances which may influence or affect their tender. A tenderer shall be deemed to have full knowledge of the site whether he inspects it or not and no

extra charges consequent on any misunderstanding or otherwise shall be allowed. The tenderer shall be responsible for arranging and maintaining at his own cost all materials, tools and

plants, water, electricity access, facilities for workers and all other services required for executing the work unless otherwise specifically provided for in the contract documents.

Submission of a tender by a tenderer implies that he has read this notice and all other contract documents and has made himself aware of the scope and specifications of the work to be

done and of conditions and rates at which stores, tools and plant, etc. will be issued to him by the Government and local conditions and other factors having a bearing on the execution of

the work.

9. The competent authority on behalf of BSNL does not bind itself to accept the lowest or any other tender, and reserves its right to reject any or all of the tenders received without the

assignment of a reason. All tenders, in which any of the prescribed conditions are not fulfilled or are incomplete in any respect are liable to be rejected.

10. Rates shall be quoted both in words and figure. No conditions are attached with the offer being submitted. Tenders with any condition i/c that of conditional rates shall be rejected.

11. Conversing whether directly or indirectly, in connection with tenders is strictly prohibited and the tenders submitted by the contractors who resort to canvassing will be liable to rejection.

12. The competent authority on behalf of President of India reserves to himself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at

the rate quoted.

13. The contractor shall not be permitted to tender for works in the DOT Circle (responsible for award and execution of contracts) in which his near relative is posted as Divisional Accountant

or as an officer in any capacity between the grades of Superintending Engineer and Assistant Engineer (both inclusive). He shall also intimate the names of persons who are working with

him in any capacity or are subsequently employed by him and who are near relatives to any gazetted officer in the Department of Telecommunications or in the Ministr5y of Urban

Development. Any breach of this condition by the contractor would render him liable to be removed from the approved list of contractors of this Department.

14. No Engineer of gazetted rank or other Gazetted officer employed in Engineering or Administrative duties in an Engineering Department of the Government of India is allowed to work as a

contractor for a period of two years after his retirement from Government service, without the previous permission of the Government of India in writing. This contract is liable to be

cancelled if either the contractor or any of his employees is found any time to be such a person who had not obtained the permission of the Government of India as aforesaid before

submission of the tender or engagement in the contractor‟s service.

15. The tender for the works shall remain open for acceptance for a period of ninety days from the date of opening of tenders. If any tenderer withdraws his tender before the said period or

makes any modifications in the terms and conditions of the tender which are not acceptable to the department,

then the Government shall, without prejudice to any other right or remedy, be at liberty to forfeit 50% of the said earnest money as aforesaid.

16. The Notice Inviting Tender shall form a part of the contract document. The successful tenderer/contractor, on acceptance of his tender by the Accepting Authority, shall within 15 days

from the stipulated date of start of the work sign the contract consisting of:

a) The notice inviting tender, all the documents including additional conditions, specifications and drawings, if any, forming the tender as issued at the time of invitation of

tender and acceptance thereof together with any correspondence leading thereto.

Participation of near relatives of the BSNL employees

All near relatives of BSNL Employees either directly recruited or on deputation are prohibited from participation in tenders and execution of works in the

different units of BSNL., The detailed guidelines in this regard are given in the following paragraphs :-

I) The near relatives for this purpose are defined as:

a) Members of a Hindu Undivided family.

b) They are Husband and wife.

c) The one is related to the other in the manner as father, mother, son(s) & son‟s wife (daughter in-law). Daughter (s) & daughter‟s husband (son-in-law).

Brother (s) & brother‟s wife sister (s) & sister‟s husband (brother-in-law).

II) As per Government of India‟s CCS Conduct rule 4, no Government servant shall in the discharge of his official duties deal with any matter or sanction any

contract to any company or for any other person if any member of his family is employed in that company or firm or under that person or if he or any

member of his family is interested in such matter or contact to his official superior. This clause is applicable to all BSNL employees and in view to this as

soon as any BSNL employee becomes aware of the above aspect, he must intimate this to the prescribed authority. For non executive employees this

authority is SSA Head/Circle Head/Chief Engineer Chief Arch. / Corporate office under whom he is posted. For executive employees (at present some of

them are called as Gazetted officers) the prescribed authority for this purpose is Circle Head/Chief Engineer/Chief Archt. Corporate office under whom he is

posted.

III) (a) The company or firm or any other person is not permitted to tender for works in BSNL Units in which his near relative(s) is (are) posted. The unit is

defined as SSA/Circle/Chief Engineer /Chief Archt. /Corporate office for non executive employees and all SSA in a circle including circle office /Chief

Engineer/Chief Architect/Corporate office for executive employees (those called as Gazatted officers at present). Therefore, it has been decided by the

competent authority that a clause must be added in the tender and other related documents that the tenderer should give a certificate that none of his /her such

near relative is working in the units as defined above where he is going to apply for tender/work. In case of proprietorship firm certificate will be given by

all the partners and in case of limited company by all the Directors of the company. Any breach of these conditions by the company or firm or any other

person, the tender/work will be cancelled and earnest money/security deposit will be forfeited at any stage whenever it is so noticed. The department will not

pay any damages to the company or firm or the concerned person. The company or firm or the person will also be debarred for further participation in the

concerned unit.

(b) In respect of case where the tender notice /work related orders have been issued and are waiting for submission the concerned unit should issue

corrigendum for inclusion of above clause. However, here tender/work related documents have been opened and are waiting for finalization the certificate

may be taken from the company or firm or any other concerned person giving details of the relatives employed in the jurisdiction of the tender. The company

or firm or the person concerned will not be debarred in this case but his work will be kept under proper watch to avoid any further complaint. Further, the

relative will not be involved in the decision making and execution of the work.

(c) Where the tenders or the work are already in operation (or awarded ) the tenderer may be requested to give details of relatives employed in the jurisdiction

of the tender in such cases the tenderer will be allowed to continue the work but special watch may have to be kept about his performance to avoid any

complaint. The concerned relative will not be involved in execution and settlement of claims of the contractor.

SPECIFICATION FOR THE WORK PROVIDING E.I. & FANS 1. The work shall be carried out as per current department specifications for electricity works as amended time to time & also as per Indian Electricity Rules as amended up

at date.

2. A qualified supervisor shall supervise the work.

3. The lay out of the will be given Engineer – in – charge or his duly authorized representative at site of work.

4. The following wiring shall be done in separate circulates.

5. The earthing shall be done in presence of Engineer – in – charge or his duly authorized representative.

6. The sample of all the materials, fittings, accessories IC switch gears etc. shall be got approved from the Engineer – in – charge before using the same on the work. The

rejected materials shall be removed immediately from the site of work.

7. The contractor will have to give the following test results at his own cost & risk.

(a) Earthing Test,(b) Polarity Test,(c) Insulation Test (d) Earth continuity Test of the recessed conduit.

8. (i) All wiring diagrams shall be deemed to be drawings with in the meaning of the terms as used in clause –II of the condition of contract. (ii) All wiring diagrams shall

indicate clearly in plan, the main switchboard, The distribution fuse board the run of various main, sub main & the position of the points with their classification &

controls, all circuits shall be indicated & numbered in the wiring diagram and all points shall be given the same number as the circuits to which they are electrically

connected, Distribution board shall also be electrically indicate the circuits numbers controlled by them.

9. Extract from the specification for electrical work (Internal & External 2007) regarding completion plan.

(i) Completion plan & completion certificate.

(ii) The work shall be carried out in accordance with the drawings enclosed with the lender & also in accordance with the modification there to from time to time

approved by the Engineer in-charge.

10. For all works costing more than 10,000/- completion certificate after completion of work as given in Appendix “D” shall be submitted to Engineer In-Charge.

Completion plan drawn to a suitable scale in tracing cloth with ink indicating the following along with three blue print copies of the same shall also be submitted.

(a) General layout of overhead lines.

(b) Location of each support stay, straight length of each span number of spans provided with guard earth number of & each line conductor, joints in conductor

size of earth continuity wire lighting protective devices bracket/entry fuses etc.

(c) For the cable work done if any layout of power cable size, number of cores & length.

(d) Details of voltage & system of supply, height of support configuration spacing of average sag, total routs length, scale of the drawing etc. in a tabular form.

(e) Name of work, job number accepted tender referred, date of completion, name of division / sub – division name of contractor.

(f) In the case of works costing less than Rs. 10,000/- the completion plan shall be prepared by the department & signed by the ____________________ final

payment is made.

(g) Any damage to the building during the execution of the work shall have made good by the contractor to his own cost & risk, if he does not do it himself with

reasonable time determined by the executive Engineer (E) then the same will be got done at his cost, Departmentally after giving notice to his.

16 (h) The cost of ceiling rose/connection included in light point/fan point, if not provide recovery shall made.

11. The runs of various circuits wiring at various places should be kept minimum by taking the short lest to the extent possible. This has to be conduits are not laid there in.

12. In making connection if & IS switches, plug on other terminal stand of conductor lead shall be out to facilitate on entry of contractor into a terminal such connections

shall be made through contractor & by size of electrically equivalent copper conductor suitable insulated for which extra amount shall be paid.

13. One Rupees per empty box for ceiling fans & fittings supplied by department will be recovered from the contractor irrespective of the size of the box.

14. In case of any damage of the materials supplied by the Departmental free of the cost & recovery will be made from the contractor at the stipulated against each item or

market rate which ever is higher.

15. If any conduit is laid before the award of this work the recovery for the same will be made from the contractor at the SR-2007 plus than abatement of Sub head-I of this

tender.

16. Before laying of conduit pipes of wiring one coat each of red oxide and the white enamelled paint shall be given to the pipes. After laying the conduits in surface/one

coat of enamelled paint matching with the surrounding shall be given by the contactor.

17. The switch plate to be provided shall be with hylum sheet matching with the surrounding wall of bldg.

18. After wiring the sleeves shall be inserted in wires for indicating the phase neutral and earth following the column coded RED-BLACK and Green respectively.

19. The following makes of metal clad switches with rewireable fuses metal clad switches with HRC fuses. The contractor the category number for respective item as

mentioned in the schedule should use TPDS with HRC as selected category.

Special condition for EA repairing work

1) The overhauled engine will carry warranty for a period of 6 Months or 1550 hrs of engine operation whichever is earlier from the date of commissioning of the

engine.

2) Engine shall be tested on Exchange load.

3) Engine shall be guaranteed for 6 months after overhauling and testing.

4) The overhauling of Engine includes dismantling assembling, test run & testing on load etc. complete as required.

5) The spares of engines shall be procured from the engine manufacturer or their authorized service dealer for these capacities of engines.

6) The certificate of purchase indicating receipt no., items and quantity from engine

manufacturer and their report, shall be submitted for the proof of genuineness of spares

along with the bill

7) The similar certificate of purchase from engine manufacturer for engine spares of extra

items shall be submitted along with the bill.

CENVAT CREDIT In order to avail CENVAT credit as per CENVAT Credit Rules 2004, BSNL, who is an output service provider, is entitled for duty credit. In order to

avail the CENVAT credit, the contractor has to furnish an invoice favouring BSNL indicating the following at the time of delivery:-

Basic value of goods excluding the excised duty and education cess on ED.

Excise Duty and Education Cess on excise duty

Sales tax and any other duties and taxes.

Packing forwarding, insurance and other levies.

The agency shall pay the Service Tax at the prevailing rate together with Education Cess to the Excise Department and submit the proof of the last paid bills for

claiming CENVAT credit. If the contractor fails to pay the due service tax together with Education Cess the same shall be paid by BSNL to the concerned Excise

Department and the corresponding amount along with compensation amount equal to 10% of the amount paid to the Excise Department shall be deducted by

BSNL from the contractor bill.

Note:- Rate includes all taxes and duties except GST. GST to be shown separately. GST if any paid by the contractor will be reimbursed on submission of valid

documents in respect to payment of the same to the concerned authority.
