October 22, 1943, A part of the Ordinance for the Regulation of

Insurance Soliciting /

Article 1. The application for registration as provided^ for in Art. 3, Par. 2 of the Law concerning the

Supervision of Insurance, Soliciting (Law No. 171of 1948 : hereinafter referred to as the Law) shallfollow the Form No., 1.

Article 2, A life insurance solicitor or non-life insur-ance agent, may make the application by idsconsignor-insurance company on his behalf, fofthe registration in accordance with the provisionsof Art. 3, Far* 2 of the Law.

' VX.Article 3. Tfee provisions of the preceding <two Arti-cles shall apply mutatis'mutandis for the' regist-ration of an officer or employee of a life insurancecompany who engages in soliciting (for the Com-pany concerned) as provided for in Art-^21 of thelaw.

Article 4. The stockholders or contributors as pro-vided'for in Art. 3, Par. 4, Item, 3 of <the.LawShall be the stockholders* holding one-tenth: orover of the capital stock of the applicant con-cerned or the contributors holding their sharesrepresenting -one-tenth or over of the total amountof the contribution.

Article 5. "Vifhen' a non-life insurance agent has- received premiums for the cosignor-insurance

, company, he 'shall, without delay, remit them -to"the consignor-insurance company or'deposit them

in the government post-offices, banks, or other$ institutions handling deposits or savings. lf^ 2. As for the 'deposits or#savings of the preceding

, paragraph, separate account shall -be opened, foreach different consignor-insurance company. Pro-vided that, the same shall not apply to caseswhere, in regard to a non-life insurance agentcommissioned by two or more insurance companies,designation is made fry the Minister of Finance.

3. The deposits or savings of Paragraph 1 shall,be placed in accounts separate from the other

)t w deposits or savings held by the non-life insuranceagent concerned.

Article 6. The deposits or savings of the precedingArticle shall not be used, except the cases stipulated under any one of the following items:

1. Where an amount is drawn out for the pur-pose of remitting the cash to the company bywhich he is commissioned ;

2. Where an amount in drawn out for thepurpose of refunding the premiums to thepolicyholders ;

3. Where an amount is drawn out for thepurpose of applying the same for the commis-sionsf remunerations or other compensations

m due to the non-life insurance agent;4. Where an amount is drawn, out,as the interest

on the deposits or savings;5. I§i other cases acting upon the instructions

of the insurance company by which fye- is com-missioned.

Article 7. -In regard to,, the premiums, etc. receivedfor the consignor-company, a non-life insuranceagent shall keep a full detailed statement of in-come and outgo as provided by Form No. '2.

Article 8.. In the ledger provided, fpr under -Art. 13of the Law sliaU be entered the following parti-culars : % s -

1. The full name, firm name or designation -ofthe life insurance solicitors or non-life insur-

v ance agents; ' v

2. The residence or place of the business officeof the life Insurance solicitors or non4ife insur-ance agents ;

3. The date on 'which they are compaissine&;4. _ The kinds of insurance business handled by

the non-life insurance agents.Article'9. When a life insurance solicitor or non-life

insurance agent' is commissioned or dischargedfrom the commissions, the consignor-insurance

/ ^ company shall, without delay, make necessary,entries in- the ledger of' the preceding Article, ©rstrike oft- this entries therein and moreover reportto that effect to the Minister of -Finance.

Article 10. The consignor-insurance company, shalldeliver •Ean, identity 'paper to each insurancesolicitor. - v' i "*

Article ll. The sum-total-of the premiums, of Art.'17, Par. 2 of the taw shall be computed as fromthe day on which the Law is put* into force.

Article 12. The certificate of Art. 19 o£ the Law-shall be the certificate as provided ''for underArt. 8 of the Insurance Business Law (Law No.41 of 1939).
