The following one Article shall be added next

to Article 6-2:Article 6-3. Any foreign national (the term "for-

eign national" is defined to mean a designated

consumer under Article 2 items (1) to (3), in-

clusive, of the Designated Living Necessities

Distribution Regulation (Ministries of Finance,

Welfare, Agriculture and Forestry, and Inter-

national Trade and Industry Ordinance No. 1

of 1951) and a person who may enter into Japan^

after January 1, 1952, bearing his passport or

its substitute issued by the government of his

own country; hereinafter the same) who is a

consumer of goods for family use may purchase

sugar from any registered retailer, irrespective

of Article 6 paragraph 1.

2 Any registered retailer may sell sugar in com-

pliance with the request made by a foreign na-

tional who is a consumer of goods for family

use, irrespective of Article 6 paragraph 5.

Supplementary Provisions :1 This Ministerial Ordinance shall come into

force as'lfrom January 1, 1952.

2 Any person who is a registered dealer as of

December 31, 1951 under, Article 5 of the De-

signated Living Necessities Distribution Regu-lation shall be deemed a registered retailer until

January 20, 1952, under Article 2 paragraph 1

of the Sugar Demand and Supply Adjustment

Regulation (hereinafter referred to as the "Re-

gulation")'3 Any person who is deemed a registered re-

tailer in accordance with the provision of the

preceding paragraph and who intends to con-

tinue to engage in sugar retailing for the period

after January 21, 1952, may make an applica-

tion for granting & retailer's registered certi-

ficate within the period prior to January 15,

1952, to governor of To, Do, Fu, or prefecture

supervising the district in which the said re-

tailer's office exists.

4 Any governor of To, Do, Fu, or prefecture

shall grant a retailer's registered certificate to

an applicant in compliance with the request

made under the preceding paragraph, irrespect-

ive of the provisions of Article ll paragraphs

1 to 7 inclusive, of the Regulation and shall

giye a public notice "thereof without delay.

A retailer's registered certificate under the

preceding paragraph shall be granted on Jan-

uary 21, 1952, and shall be available until Aug-

ust 15, 1952, irrespective of the provision of Ar-

ticle ll paragraph 8 of the Regulation.

The Regulations for the Compensation of Motor

Carrier Business shall be fixed, based upon the

provisions of Article 3 of the Road Transporta-

tion Law Enforcement Order5 as follows:

The Regulations for the Compensation

of Motor Carrier Business

Article 1. Any person who desires to obtain deli-

very of the compensation under the provisions

of Article 1 paragraphs 1 to 4 inclusive of the

Boad Transportation Law Enforcement Order

(Cabinet Order No. 250 of 1951; hereinafter to

be referred to as "Order") shall, after submit-

ting application for permission of abandonment

of business, apply for the delivery of the com-

pensation concerned to the competent govern-

ment office referred to in paragraph 1 of the

same Article.

The application for delivery of compensation

referred to in the preceding paragraph shall be

annexed with the copy of application submitted

to the Minister of Transportation or the chief

of Land Transportation Bureau pertaining to the

permission of the abandonment of the business,

as well as the copy of the permit concerned

hearing certification of the Minister of Trans-

portation or the chief of Land Transportation

Bureau in cases where the permission of aban-

donment of the business has been obtained.

Any person desiring to obtain delivery of the

compensation under the provisions of Article 2

paragraphs 1 and 2 of the Order shall, after the

lapse of one year as computed from the day

of the commencement of the State motor carrier

business with fixed routes, apply for the com-

petent government office referred to in Article 2

paragraph 1 of the Order for the delivery of

the compensation concerned, for each year of

the business year of the motor carrier business

within six months after the lapse of the busi-

ness year concerned; provided, however, only

with the portion for the first delivery, applica-

tion may be submitted for the period including

one year or more by reason of the business

year.Article 2. The prices of the business fixed assets

and those of remnant matters, operating incomes

and operating expenses in the calculation of

compensation, shall be in conformity with the

following :

1. Theprices of business fixed assets shall bethe

sum assessed by deducting the corresponding

asset prices with regard to the sum disbursed

in connection with the acquisition of motor ve-

hicles, buildings, and other tangible fixed

assets, as well as the right of business and

other intangible fixed assets which areneces-

sary for the motor carrier business, as referred

to the actual matters, books and voucher do-

cuments, etc., based upon the settlement of

accounts effected by the carrier.

2. The prices of remnant matters shall be the

sum assessed with regard to the disposition

prices of tangible assests on the day *x>f the

abandonment of the biisiness.

3. The operating incomes and operatingexpenses

shall be the annual sum whichmaybedeemed

normalonthe basis of the result during the

retrospectivethreeyears from the end of the

previous business year ofjfche business year to

which the day*8 of the commencement of traffic

of the State motor carrier business with fixed

routes belongs ; provided, however, that in cases

where these provisions could not be comformed

to, the sum shall be that assessedonthebasis

of the known result.

Article 3. The annual sum of profit for seven

years under the provisions of Article 1 para-

graph 1 of the Order shall be computed by

multiplying the annual profit by 6,164 under

Hoffman system calculation.Article 4. The delivery by instalment of compen- j

sation under the provisions of"proviso to Article '

1 paragraph 3 of the Order shallbelimitedonly

to the cases where the carrier does not abandon

the whole of his motor carries business.

Article 5. The sum to be delivered for eachbusi-

ness year in the cases of delivery by instalment

of compensation shall be delivered in the sum

calculated under the provisions of Article 3, and

in the cases where the sum under the provisions

of Article 1 paragraph 2 of the Order is added,

the average sum of the amount thus added.

Article 6. The right of obtaining delivery of

compensation shall not be transferable.

Supplementary Provisions :

1 This Ministerial Ordinance shall come into'

force as from the day of its promulgation, and

apply as from July 1, 1951.o

2 The Regulations for the Compansation of Mo-

tor Carrier Business (Ministry of Transporta-

tion Ordinance No, 13 of 1948) shall be abolished.

The Regulations for Accident Report of Motor

Vehicles shall be established, based upon the pro-

visions of Article 25 of the Road Transportation

Law (Law No. 183 of1951) as well as Article 101

paragraph 1 of the Vehicles for Road Transpor-

tation Law (Law No. 185 of 1951), as follows:

(Application of this Ministerial Ordinance)

Article 1* As regards the report concerning ac-

cidents to motor vehicles, the stipulations in

this Ministerial Ordinance shall be conformed

to.(Definitions)

Article 2. In this Ministerial Ordinance, "acci-dent" shall mean the accident to motor vehiclescoming under any of the following items:(1) When any motor vehicle overturned or

caught fire (including the fire of goodsloaded) ;

(2) When there was any death or casuality(referring to a person who sustained an in-jury requiring more than 30 days for recuper-ation,there from, or who was crippled as theresult of the accident);

(3) When the total amount of the damage in-flicted upon the motor vehicle concerned,goods loaded, buildings and other matters,

exceeds ¥ 500,000;(4) When, through the breakage or falling off

of steering system, brake system, frame, axleor wheel (excepttires), the motor vehicle could

not be operated.(Presentation of Reports)

Article 3. With any motor carrier, in caseswhere the motor vehicle used by such a carrierwas involved in the accidents referred to ineach item of the preceding Article, and withany user of a private motor vehicle who shallappoint a maintenance and repair supervisorprovided for in Article 50 of the Vehicles forRoad Transportation Law, in cases where themotor vehicle used by such a person was in-volved in accident referred to in item (4) ofthe preceding Article, the motor carrier or usershall submit to the Minister of Transportationthrough the Governor of To, Do, Fu or Prefec-ture having jurisdiction over the locality of

the abode of use of such motor vehicles (here-inafter to be referred to as "governor of To,Do, Fu or prefecture"), three copies of accidentreport of motor vehicles (in accordance withthe annexed form, hereinafter to be referred

to as "report") bearing entry of the matters

enumerated hereunder, within seven days from

the day of accident:

(1) Category of accident;

(2) Date and weather when the accident occur-

red;

(3) Place where the accident occurred;

(4) Name or title and address of user of the

motor vehicle concerned;

(5) With business motor vehicles, the kind of

motor carrier business to which the motor

vehicle belongs ;(6) Name of maintenance and repair super-

visor;(7) Name and locality of the abode of use of

the motor vehicle concerned;(8) Summary of the motor vehicle concerned;

(9) Road condition;(10) Degree of damage sustained;(ll) Circumstances then and disposition there-

of;(12) Cause of the accident;(13) Name, age and years, of experience of the

crew of the motor vehicle concerned;(14) Opinion of the user of motor vehicles or

maintenance and repair supervisor.2 The Governor of To, Do, Fu or prefecture

shall, when the report has been accepted, trans-

mit it without delay to the Minister of Trans-portation through the chief of Land Transport-

ation Bureau.(Interim Report)

Article 4. Motor carriers shall, in cases whereany accident coming under Article 2 item (2)occurred to the motor vehicle used by him, sendand interim summary report on the accident tothe governor of To, Do, Fu or prefecturethrough telephone, telegram and other suitablemeasures, besides conforming to the provisions

referred to in Article 3 paragraph 1.(Warnings against Accidents)

Article 5. The Minister of Transportation or thechief of Land Transportation Bureau shall,when deemed necessary on the basis of report,fix the measures for the prevention of accidents,and circulate the information to motor vehicleusers, motor vehicle.repair business operator and

other interested persons.

(State Motor Carrier Business)Article 6. As regards the reports of accidents to

business motor vehicles of motor carrier bus-

iness operated by the State, the report thereon

and interim summary report on the accident

shall be submitted to the Minister of Trans-

portation, irrespective of the provisions of Arti-

cle 3 paragraph 1 and Article 4.

Supplementary Provision :

This Ministerial Ordinance shall come into force

as from the day of its promulgation.

How to Fill in the Form(1) In Items (1) and (8), correspondingletters

in/ the remark shall be enclosed with O>(2) In "others" of "Material Damage", total

amount including the indemnity expenses,medical expenses incurred by the motor vehi-cle user and consolation money shall be en-tered;

(3) In Item (ll), sketch of thespotofaccidentshall be annexed;

(4) In Items (ll) to (14) inclusive, in caseswhere matters cannot be fully entered in thecorresponding column, additional paper shallbe used;

(5) In Item (14) maintenance and repair super-visor shall enter, as regards the inspection,maintenance and repair of motor vehicles aswell as the improvement of garage controlwhich are matters concerned with maintenan-ce and repair supervisor, and as to the mat-ters connected with motor vehicle user, suchas service regulaftons of crew etc., by the

motor vehicle user, concerning the cause ofoccurrence of the accident concerned;

(6) The column asteriked shall not be filled in;
