BOARD OF TRUSTEES CITY OF CREEDE, COLORADO – A TOWN

November 7, 2017 REGULAR MEETING

The Board of Trustees of the City of Creede – a Town, County of Mineral, State of Colorado, met in regular session in the Creede Town Hall at the hour of 5:30 p.m. There being present at the call of the roll the following persons:

OFFICIALS PRESENT: Lori Dooley, Kay Wyley, Catherine Kim [by phone], Jeffrey Larson, Teresa Wall, Dana Brink, Frank Freer

Mayor Larson, presiding, declared a quorum present. Those members of staff also present were as follows: Clyde Dooley, Manager

Randi Snead, Clerk/Treasurer Karen Lintott, Attorney

REVIEW AGENDA Consideration of Ordinance 405 Ratifying the Transfer of Certain Portions of City Property to a Private

Party and a 2018 budget request from Merrick, Co. were added to new business. Trustee Wall moved and Trustee Dooley seconded to approve the agenda as amended. The vote was unanimous. Mayor Larson declared the motion carried.

CONSENT AGENDA The consent agenda contained the following items:

a. Consider October 3rd & October 24th, 2017 Minutesb. Review/Consent of October 2017 Check Detail Reportc. Consider November 7, 2017 Unpaid Bills Report

Corrections were made to the October 3rd and October 24th, 2017 minutes. Trustee Dooley moved and Trustee Wall seconded to approve the consent agenda as amended. The vote was unanimous. Mayor Larson declared the motion carried.

OLD BUSINESS CONSIDER MUNICIPAL COURT CONSULTANT CONTRACT

A typo was identified in the contract and corrected. Trustee Dooley moved and Trustee Wall seconded to approve the Municipal Court Consultant Contract as amended. The vote was unanimous. Mayor Larson declared the motion carried.

CONSIDER UPDATED PUBLIC PROPERTY EVENT POLICY & PROCEDURES Trustee Wall moved and Trustee Dooley seconded to approve the updated Public Property Event Policy &

Procedures as presented. The vote was unanimous. Mayor Larson declared the motion carried.

NEW BUSINESS CONSIDER CUSTODIAN & GROUNDSKEEPER JOB DESCRIPTION

“Valid Colorado Driver’s License” was added to the Recommended Minimum Qualifications section of the description. Staff was directed to pursue adding language to require disclosure of changes in Driver’s License status to supervisors for all employees to the Employee Handbook. Trustee Dooley moved and Trustee Wall seconded to approve the Custodian & Groundskeeper job description as amended. The vote was unanimous. Mayor Larson declared the motion carried.

CONSIDER GYM ROOF REPAIR QUOTE Manager Dooley provided two quotes to complete the roof repairs at the VCMF. Alcon Construction submitted a quote for $10,768.75, and James Miller submitted a quote for $4,051. Trustees discussed the differences in the scope of work of the two bids. Trustee Freer moved and Trustee Wyley seconded to accept the James Miller Roofing bid with the condition that gutters and downspouts are added to the bid, that the bid is not to exceed a total of $6,000, and that proof of insurance is provided. The vote was unanimous. Mayor Larson declared the motion carried. HOCKEY LIGHT EXPANSION UPDATE As discussed at the retreat, infrastructure was needed at Silver Park in order to expand lighting to the second pond. Recreation Director Sledd is working with a SLVREC board member and working towards getting the work in place in order to have the project completed by hockey season so long as the board would be funding the project in 2018 and felt comfortable with it. Trustee Dooley moved and Trustee Wall seconded to direct the Parks & Recreation Director to proceed with hockey light improvements at Silver Park. [At this time, Trustee Kim left the meeting.] ORDINANCE 405 RATIFYING THE TRANSFER OF CERTAIN PORTIONS OF CITY PROPERTY TO A PRIVATE PARTY Manager Dooley explained an error made in Resolution 06-08, a quit claim action, and requested ratification to satisfy the title company transferring the land to a new owner. Trustee Wall moved and Trustee Dooley seconded to approve Ordinance 405 Ratifying the Transfer of Certain Portions of City Property to a Private Party as presented. The vote was unanimous. Mayor Larson declared the motion carried. WILLOW CREEK FLUME BUDGET MODIFICATION REQUEST Manager Dooley informed the board that Merrick, Co. provided a request from Ron McLaughlin for $80,000 in the 2018 budget for Merrick to provide design consultation by Warren Harrison and onsite construction inspection from someone local. The SGM/Mays contract included $70,000 for inspection, but Ron requested an additional $80,000 for inspection for the forthcoming Merrick contract. Dooley affirmed that there was room in the project budget for the added expense and said he would find out from Ron if the expense would come out of our grant match. Since the flume project has already been budgeted, the board did not take action. MANAGER’S REPORT WILLOW CREEK FLUME UPDATE Manager Dooley updated the board on the Willow Creek Flume Project. The team is performing drone surveying currently. Yeh & Associates will be drilling four piezometers later in the month to measure and monitor groundwater throughout the process. They are trying to do as much investigation as possible before it snows. Mays & SGM will have a kick-off meeting on the design in December and have something for the board to consider in late January. In February, they will have a unit cost contract because we have not-to-exceed verbiage in our contract. In mid-February, we will execute a unit cost finish contract with not-to-exceed unit cost

contract. Finished design drawings are scheduled by March 9. Construction is still slated to take place in early fall once the water is at its lowest. SGM requested horizontal and vertical benchmarks for surveying and the team is using Davis’s. Dooley is working on either construction agreements or easement agreements with property owners along the flume depending on what is necessary, but that they aren’t required at this point. The team is researching geotechnical data and cement with Ron McLaughlin. We are providing a dumping area for construction in the area we’ve used for old concrete in the past as well as project traffic control. Dooley is doing paperwork with CDOT to make sure the water diversions are permitted by spring, which will include a 24” pipe down the east side of the flume. Trustees will also be reviewing the 30% complete design at the December work session and the 90% complete design at the January work session. Part of our commitment to DOLA was to use our drainage fees and other resources to maintain the repairs over the years. VICK & DRESSER BOUNDARY LINE AGREEMENT Manager Dooley received notice that the survey maps are incomplete for this project, but that the boundary line agreement would be considered once it is prepared. He is going to clarify what public hearing procedures we should use for the acquiescence process with Attorney Lintott. DUMP TRUCK DIRECTION Manager Dooley asked if the Trustees wanted to pursue repairs for the old dump truck or find a newer dump truck. He was directed to find several options for a newer dump truck and present them at the December meeting. CDPHE TEMPORARY MODIFICATION Manager Dooley informed the board that Ron McLaughlin was preparing a Preliminary Report for CDPHE due November 15, 2017 to the CDPHE. Costs for that report will be about $20,000 and if successful, will require updates to the lagoon system costing approximately $100,000 rather than construction of a mechanical plant. WATER METERS Manager Dooley informed the board that we currently require meter installation for new construction and recommend installation when water lines are uncovered during renovations and recommended that we maintain the status quo. He was directed to find the policy or legislation that required this policy for review at a future meeting. SCHOOL VAULT Manager Dooley was directed to have Attorney Lintott send a letter to Creede Schools to address the deficiency of the vault at the new school. WOODEN WALKWAY ON CLIFF STREET Manager Dooley was directed to have the wooden walkway over the flume at Cliff Street removed. ADJOURN There being no further business to come before the Board of Trustees at this time, Trustee Dooley moved and Trustee Wall seconded that the meeting be adjourned at 7:46 p.m. The vote was unanimous. SPECIAL MEETING The Board of Trustees of the City of Creede – a Town, County of Mineral, State of Colorado, met in regular session in the Creede Town Hall at the hour of 5:31 p.m. There being present at the call of the roll the following persons: TRUSTEES PRESENT: Lori Dooley, Kay Wyley, Catherine Kim, Jeff Larson,

Teresa Wall, Dana Brink TRUSTEES ABSENT: Frank Freer Mayor Larson, presiding, declared a quorum present. Those members of staff also present were as follows: Clyde Dooley, Town Manager Randi Snead, Clerk/Treasurer REVIEW AGENDA Manager Dooley added a change order Request from Mays Construction to the agenda. Clerk Snead requested that the Freer change order be tabled to December 5, 2017. Trustee Kim moved and Trustee Dooley seconded to approve the agenda as amended. The vote was unanimous. Mayor Larson declared the motion carried. NEW BUSINESS CONSIDER EXTENDING BASHAM PARK PAVILION PROJECT COMPLETION DEADLINE Attorney Lintott was available to answer questions about the Independent Contractor Agreement by phone. Trustee Dooley moved and Trustee Kim seconded to approve extending the Basham Park Pavilion Project Completion Deadline to December 28th, 2017 contingent upon a $10,000 final payment penalty if the project isn’t complete by the end of the year. The vote was unanimous. Mayor Larson declared the motion carried. CONSIDER MAYS CONSTRUCTION 11/27/17 CHANGE ORDER The change order for the installation of permanent piezometer wells was discussed at length. The trustees requested more detailed information from project engineers describing how the piezometers would benefit current and future projects for Creede and tabled this item to the December 5, 2017 meeting. ADJOURN There being no further business to come before the Board of Trustees at this time, Trustee Dooley moved and Trustee Kim seconded that the meeting be adjourned at 6:13 p.m. The vote was unanimous. FROM: Randi MAYS CONSTRUCTION INVOICES Throughout the project, invoices for the flume project will appear in your consent agenda. The billing cycle has been scheduled for the 26th through the 25th of the next month in order to facilitate this. I’ll issue checks once you’ve approved the invoice. VC VACANCIES AND BYLAWS At their work session, the VC committee and I settled on a recruitment strategy for VC, with a marketing push to recruit to all three boards in Dec., with VC apps being due in time for the March meeting. They also had no revisions to propose for the updated bylaws, so that is ready to go. TINY HOMES Ordinance 406 was recommended unanimously by the PZC 11/14/17. Prior to that public hearing, since the Ordinance is rather technical, I prepared the attached statement on the website (you can access it right from the home page) and included the whole CDC marked up with changes as well as links to the back-and-forth recommendation process used to arrive at this legislation. It was shared on social media as well. Please look through it, direct people with questions to it, and be prepared to help the public understand what we are trying to accomplish. JOB DESCRIPTIONS Deputy Clerk is ready to go, but AnnKate and I tweaked the rec descriptions enough to warrant discussion, so I moved them to the Dec. WS with the others since our agenda was so packed. RESOLUTION 2018-01 Clyde gave me the 3% increase in WSD rates for this resolution, increasing rates from $59.40/mo to $61.20. Additionally, the various rates for public works services had not been updated since 2009, so I increased them for inflation only and added a loader charge since we’ve added that equipment, hotel rates were bumped up due to sharp increases in avg hotel costs, and rec requested a daily user change based on their experiences this year.

Over the past year, the Planning & Zoning Commmission has been hard at work

discussing the complex considerations regarding the "tiny home movement." The

Commission wanted to be permissive and flexible, given our affordable housing

shortage; however, they also wanted to be practical and protective of the interests of

our community. The proposed result tries to acheive those goals.

The Ordinance itself is full of complicated language that is required to update our

development code. In layman's terms, the aim of this legislation is to permit the use

of safe and inspected tiny homes and rvs for residential use in some areas. These

units must be registered by the department of motor vehicles, and if they are being

used as a residence, they must obtain a CO from the Creede Building Department,

which will ensure livability and appropriate inspections. They may only be used on

vacant residential lots, and are only allowed as a Special Review Use in certain zones.

They must be hooked up to city utilities. They may not be used as an accessory

dwelling structure on an occupied lot.

As many of you know, we adopted a new Development Code a few years ago, and have

been keeping an eye out for further adjustments it needs to be appropriate in Creede.

Throughout sorting tiny homes out, the Commission ran up against the highly

restrictive language in our Development Code regarding RV storage and all types of

other outdoor storage on private property. It was ultimately decided that those

regulations were altogether far too restrictive for Creede, as it would prevent everyone

from having campers on their property and would require elaborate screening for

other outdoor posessions. The Comission is therefore proposing removal of some of

those restrictions, thus the changes to Parking regulations, removal of outdoor

storage language,

these changes, so you can see what is being stricken or amended. Please also take a

ORDINANCE NO. 406

AMENDING THE CREEDE DEVELOPMENT CODE BY ALLOWING TINY HOMES AND AMENDING RV AND OUTDOOR STORAGE

REGULATIONS

WHEREAS, the authority for the City of Creede (“City”) to adopt regulations concerning the use and development of real property is provided by Article 65.5 Notification of Surface Development; Article 20 Local Government Regulation of Land Use of Title 29; Article 15 Exercise of Municipal Powers; Article 16 Ordinances; Article 23 Planning and Zoning; and other applicable state and federal laws and regulations; and

WHEREAS, in accordance with the requirements of C.R.S. § 31-23-304, 305, and 306, the Creede Planning and Zoning Commission (hereinafter “Commission”) held a public hearing on November 14, 2017. After considering public comments received, and testimony and materials provided by City Staff, the Commission provided a recommendation to the Board of Trustees to amend the Creede Development Code by allowing Tiny Homes and Amending RV and Outdoor Storage Regulations; and

WHEREAS, in accordance with the requirements of C.R.S. § 31-23-304, 305, and 306, and after providing proper notice, the Creede Board of Trustees held a public hearing on December 5, 2017 and considered all public comments received and all testimony and materials provided by City Staff; and

WHEREAS, the Board of Trustees for the City of Creede, a Colorado Town, finds that amending the Creede Development Code by allowing Tiny Homes and Amending RV and Outdoor Storage Regulation is in the best interests of, and will thereby promote, the health, safety and general welfare of the Creede community.

NOW THEREFORE, BE IT ORDAINED, by the Board of Trustees of the City of Creede, a Colorado Town, the following:

Section 1: Recitals Incorporated. The above and foregoing recitals are incorporated herein by reference and adopted as findings and determinations of the Board of Trustees.

Section 2: The Creede Development Code is amended by the addition thereto of a new Section 9-04-060 (b) (7) which is to read as follows:

This zoning district is intended to provide locations for a variety of workplaces and employment opportunities, including light industrial uses, research and development offices and institutions, manufacturing, warehousing and distributing, storage and a wide range of commercial and industrial operations. This district is also intended to accommodate secondary uses that complement and support the primary workplace uses, such as hotels, restaurants, convenience shopping, child care and housing. Locations for this zone require good access to major arterial streets and adequate water, sewer and power. Additionally, this district is intended to encourage the development of planned office and business parks; to promote excellence in the design and construction of buildings, outdoor spaces, transportation facilities and

Section 20: Section 9-04-190 (d) (3) is amended to read as follows:

Section 21: Section 9-04-190 (e) (1) (i) is amended to read as follows:

(i) Districts Allowed. Accessory dwelling units shall be allowed as accessory uses to principal residential uses in the following districts: R-1, R-2. Accessory dwelling units shall be allowed as special review uses in the following districts: B-1, B-2, and I.

Section 22: Section 9-04-190 (e) (1) (iii) is amended to read as follows:

(ii) Interior Requirements. An accessory dwelling unit shall contain private sanitary facilities with hot and cold running water and cooking and food storage facilities.

Section 23: Section 9-04-190 (e) (1) (iv) is amended to read as follows:

(i) Limit on Number. There shall be no more than two (2) accessory dwelling units on a lot in addition to the principal single-family dwelling.

Section 24: Section 9-04-190 (e) (3) “Outdoor Storage” is repealed in its entirety.

Section 25: Section 9-05-050 (c) is amended to read as follows:

(c) Parking Restrictions for Excess Weight Vehicles and Recreational Vehicles.

(1) The owner or operator of any vehicle weighing in excess of ten thousand (10,000) pounds, other than emergency vehicles, shall not park said vehicle on any public right-of-way or roadway except when making local deliveries.

(2) No boat, boat trailer, tractor, trailer, semi-trailer, motor home, bus or detached/dismounted camper shall be kept or parked upon any public right-of-way or roadway, except for visitation purposes not exceeding twenty-four (24) hours.

(3) No mobile home may be located for more than seven (7) days in any residential area unless it is zoned for the same.

Section 26: In Section 9-06-10 the following definition shall be added:

Non-residential camping structure means a camping unit primarily designed as temporary living quarters for recreational, camping, or travel use. The following shall be considered a non-residential camping structure:

(a) Camping trailer. A canvas (or other type of material), folding vehicle of rigid construction, mounted on wheels and designed for travel and recreation.

(b) Pickup coach. A vehicle designed to be mounted on or loaded into a truck chassis for use as a temporary dwelling for travel and recreation.

(d) Travel trailer. A towable vehicle designed as a temporary dwelling for travel and recreation.

(e) Travel trailer, self-contained. A trailer which can operate independently of connections to sewer, water and electric systems. It contains a water-flushed toilet, lavatory, shower or bath and kitchen sink, all of which are connected to water storage and sewage holding tanks located within the trailer.

Section 27: In 9-06-10 the following definition shall be amended:

Recreational vehicle means a vehicular type unit primarily designed as temporary living quarters for residential, recreational, camping or travel use, which either has its own motive power or is mounted or drawn by another vehicle. The following shall be considered a recreational vehicle (RV):

(a) Motorized home, motor home and/or recreational bus or van. A recreational vehicle consisting of a portable dwelling to be used for residential, travel, recreation and vacation uses, and constructed as an integral part of a self-propelled vehicle. It contains a water-flushed toilet, lavatory, shower or bath and kitchen sink, all of which may be connected to water storage and sewage holding tanks located within the vehicle but also have the ability to connect to water and sewer systems outside the vehicle.

(b) Travel trailer. A towable vehicular dwelling to be used for residential, travel, recreation and vacation uses. It contains a water-flushed toilet, lavatory, shower or bath and kitchen sink, all of which may be connected to water storage and sewage holding tanks located within the trailer but also have the ability to connect to water and sewer systems outside the vehicle.

(c) Tiny homes. A dwelling to be used for residential, travel, recreation and vacation uses which is licensed as a recreational vehicle by the Colorado Department of Motor Vehicles. It contains a water-flushed toilet, lavatory, shower or bath and kitchen sink, all of which may be connected to water storage and sewage holding tanks located within the trailer but also have the ability to connect to water and sewer systems outside the vehicle.

(d) Residential use of recreational vehicles in excess of six (6) months requires a Certificate of Occupancy from the Creede Building Department. A Certificate of Occupancy will only be issued to safely inhabitable vehicles with either a Recreational Vehicle Inspection Association plaque or a National Organization of Alternative Housing certification seal.

Section 28: In 9-06-10, the following definition shall be amended:

Recreational vehicle park means a parcel of land specifically developed for locating recreational vehicles and non-residential camping structures on lots.

Section 29: Section 9-06-220 is amended to read as follows:

Permanent Occupancy Actions Prohibited.

(a) Any action toward removal of wheels of a recreational vehicle except for temporary purposes of repair or to attach the trailer to the grounds for stabilizing purposes is hereby prohibited.

Section 30: In Section 09-09-010, General Definitions, the following definition shall be amended:

Section 31: In Section 09-09-010, General Definitions, the following definition shall be amended:

Home Occupation means an occupation or business activity which results in a product or service, is conducted in whole or in part in a dwelling unit, is subordinate to the residential use of the dwelling unit, and complies with the following standards:

(a) Does not create impacts greater than customary residential use, including but not limited to vehicle traffic, noise, vibration, and odors;

(b) Does not cause or require customers, delivery persons, or any person, to regularly enter the property on which the dwelling unit is located during normal business hour and does not cause or require any persons to enter the property during normal non-business hours;

(c) Does not employ persons who are not residents of the dwelling located on the property;

(d) Does not require alteration to the residence to satisfy applicable City, Fire or Building Codes, or County health regulations;

(e) Does not require or allow any signs to be visible from the outside of the property; and

(f) Does not change the appearance or residential character of the structure.

Section 32: In Section 09-09-010, General Definitions, the following definition shall be amended:

Off-street Parking Area means all off-street areas and spaces designed, used, required or intended to be used for the parking, storage, operation of motor vehicles, including driveways or access ways in and to such areas, storage areas for landscaping and other bulk items or public streets and rights-of-way.

Section 33: Codification Amendments. The codifier of the City’s Municipal Code is hereby authorized to make such numerical and formatting changes as may be necessary to incorporate the provisions of this Ordinance within the Creede Municipal Code. The Town Clerk is authorized to correct, or approve the correction by the codifier, of any typographical error in the enacted regulations, provided that such correction shall not substantively change any provision of the regulations adopted in this Ordinance. Such corrections may include spelling, reference, citation, enumeration, and grammatical errors.

Section 34: Severability. If any provision of this Ordinance, or the application of such provision to any person or circumstance, is for any reason held to be invalid, such invalidity shall not affect other provision or application of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. The Board of Trustees hereby declares that it would have passed this Ordinance and each provision thereof, even though any one of the provisions might be declared unconstitutional or invalid. As used in this Section, the term “provision” means and includes any part, division, subdivision, section, subsection, sentence, clause or phrase; the term “application means and includes an application of an ordinance or any part thereof, whether considered or construed alone or together with another ordinance or ordinances, or part thereof, of the City.

Section 35: Effective Date. This Ordinance shall take effect thirty days after adoption.

Section 36: Safety Clause. The Board of Trustees hereby finds, determines and declares that this Ordinance is promulgated under the general police power of the City of Creede, that it is promulgated for the health, safety and welfare of the public, and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The Board of Trustees further determines that the Ordinance bears a rational relation to the proper legislative objective sought to be obtained.

Salary: Part-time, hourly Department: Administration Supervisor: City Administrator Supervises: N/A Summary of Duties: The purpose of this position is to perform moderately complex to complex secretarial, clerical, recordkeeping, and accounting and office duties for the City of Creede under general direction of the City Clerk & Treasurer with supervision by the City Manager. Work requires initiative and independent judgment in the application of prescribed policies, procedures, and methods. Performs all other related work as required. This position is provisional and is subject to termination every six months. Depending on the needs of the City, it may be eliminated, continued on a temporary basis, or made seasonal. Essential Duties and Responsibilities: The essential functions or duties listed below and on attachments are intended only as illustrations of the various types of work that may be performed. notices; assists in training election judges. Keeps informed about changing laws. Assists City Clerk & Treasurer with record maintenance. Retains records, files records, or destroys records

according to the Colorado Municipal Record Retention Schedule. Performs records research and records organization according to the needs of staff or elected officials. Assists with records requests.

Assists City Clerk & Treasurer with the processing of liquor licensing, posts notices, and advises applicants requesting liquor licenses.

Assists City Clerk & Treasurer with website and social media maintenance. Assists City Clerk & Treasurer with Virginia Christensen Grant Administration. Answers the telephone and waits on customers at counter. Responds to questions of the public. Sorts,

Work Schedule: Part time, 20 hours per week. Flexible schedule within City office hours of Monday through Friday, 8 p.m. to 4 p.m. subject to employer negotiation. Occasionally, weekend or evening hours may be required. Work Environment: Work is performed in an office environment. Majority of work is performed in a moderately noisy work environment, with frequent interruptions. Recommended Minimum Qualifications Education and/or Experience:

High school diploma or general education degree (GED) required. Bachelor’s Degree in related field preferred. 2+ years related experience or equivalent combination of education and experience.

Knowledge, Ability, and Skill:

General knowledge of office procedures, practices, and terminology. Working knowledge of departmental operations. Knowledge of the operations of local government and the Creede/Mineral County area helpful. Knowledge of the operation of computer software applications, with knowledge of Microsoft Office, Adobe Acrobat, and Quickbooks preferred.

Boundary Line Agreement

This Boundary Line Agreement (“Agreement”) is made by and between Harold Guy and Marilyn D. Dresser and Sharon Vick (“Applicants”) and the City of Creede, a Colorado municipality (“City”) (individually referred to as “Party” and collectively as “Parties”).

RECITALS:

A. The Applicant’s desire to adjust their property boundaries and replat the parcels of property they have occupied over the years in order to resolve certain encroachments and establish property boundaries which are reasonable and practical for the use of the properties.

B. Harold Guy and Marilyn D. Dresser are the owners of the North 35 feet of

Lots 6, 7, and 8, Block 6, South Creede, City of Creede, located in the NE ¼ Section 36, Township, 42 North, Range 1 West, New Mexico Principal Meridian, Mineral County, Colorado. The property they have occupied over the years includes a fenced portion of property platted as La Garita Avenue.

C. Sharon Vick is the owner of the North 35 feet of Lots 6, 7, and 8, South of the

North 35 feet of said Lots, in Block 6, South Creede, City of Creede, located in the NE ¼ Section 36, Township, 42 North, Range 1 West, New Mexico Principal Meridian, Mineral County, Colorado. The property she has occupied over the years includes a fenced portion of property platted as La Garita Avenue.

D. The City recognizes the Applicant’s situation and is desirous of working with

the them to resolve their boundary concerns.

E. The Applicant’s recognize the City’s situation and understand the property the City is considering conveying to them is “Subject to any and all existing easements of whatsoever nature for the health, safety, and welfare of the community.

F. The intent of this Agreement is to facilitate the Parties’ abilities to evaluate

and execute the steps necessary to adjust property boundaries according to provisions provided in Colorado State Statute (§ 38-44-112).

The Parties agree to the following steps.

1. The Applicants paid all expenses associated with having their properties surveyed.

2. The Board of Trustees heard and discussed the Boundary Line Agreement at

their November 7th, 2017 meeting and were presented with the final drafts of the surveys at their November 21, 2017 work session.

3. Once this agreement is approved and signed by the Parties, the City will prepare an ordinance and Quit-Claim Deeds authorizing the Board of Trustees to:

a. Vacate and convey by quit-claim deed that portion of La Garita Avenue as

described in “Exhibit A”, to Harold and Marilyn Dresser and;

b. Vacate and convey by quit-claim deed that portion of La Garita Avenue as described in “Exhibit B”, to Sharon Vick.

4. The City will send via first-class postage, letters to property owners within

three hundred (300) feet of the boundary line adjustment described hereinabove and cause notice to be published in the local paper announcing a public hearing for the ordinance authorizing the street vacation and property transfers for the Board of Trustees January 2, 2018 meeting.

5. The City will prepare two separate resolution’s for re-plating the properties as Tract 4-R and Tract 5-R, Block 6, South Creede respectively for the Board of Trustees January 2, 2018 meeting.

6. Once the ordinance and resolutions are approved by the Board of Trustees, the ordinance and deeds will be signed and recorded and then the resolutions and maps (one Mylar and three 24” x 36” paper maps plus one 11” x 17” paper map) will be signed and recorded by the Mineral County Recorder.

7. All the steps of this Agreement are contingent on prior steps being approved

by the Board of Trustees and the City will not be responsible for reimbursing any of the Applicants’ expenses associated with this application.

8. This Agreement supersedes all prior negotiations between the Parties

concerning matters addressed herein and shall not be modified except in writing executed by each of the Parties.

9. The mutual approval of this plan does not entitle or vest the Applicants with

any construction or building rights without prior City approval.

Virginia Christensen Advisory Committee Bylaws PURPOSE & PROCEDURE. The Virginia Christensen Advisory Committee (VCAB) serves at the pleasure of the Board of Trustees in an advisory capacity. The meetings and discussions necessary to provide the recommendations for distribution of funds from the Virginia Christensen Trust to the Board of Trustees are to be determined by the VCAB approved by the Board of Trustees prior to the meeting. The Board of Trustees shall budget distributions for the upcoming year as a part of their annual budget. The Board of Trustees shall have authority to schedule additional funding rounds, cancel any given funding round, and change the regular funding cycle dates at their discretion. Generally, applications for a given funding round will be due on or near April 15th of each year. The Board of Trustees may at its discretion cancel a particular round of funding. In such case, the Board of Trustees will notify the Virginia Christensen Advisory Committee in writing at the earliest convenient time and in no case less than two weeks prior to the scheduled funding round. DUTIES. The Virginia Christensen Advisory Committee is an advisory body to the Board of Trustees in the matter of applications submitted for funding from the Virginia Christensen Trust. The duties of the Advisory Committee include, but are not limited to, Recommend any changes to procedure, criteria for the application form, applicant requirements, and other

screening criteria subject to approval by the Board of Trustees Review of submitted applications for accuracy of the financial information, and other requested data Conduct a presentation meeting to review the applications with the applicants and conduct questions and

answers to further clarify any portion of the application Provide some form of guidance, answers to the application process, or workshops to assist applicants

completing the application form for submittal Make recommendations to the Board of Trustees in writing within two weeks of the Advisory Committee

meeting determining their recommendations regarding the applications, whether recommending funding and the amount, or rejecting a given application

Other duties as requested by the Board of Trustees related to the review, screening and recommendations process concerning applications to the Virginia Christensen Trust fund.

Participate in any discussion or presentation of the Virginia Christensen Trust Investment Fund performance. At no time is the Board of Trustees bound to the recommendations of the Virginia Christensen Advisory Committee, and can, in its own judgement, make distribution of funds from the Virginia Christensen Trust as they deem appropriate. Members of the Board of Trustees are encouraged to attend any and all Virginia Christensen Advisory Committee meetings. Members of the Virginia Christensen Advisory Committee are encouraged to attend any and all Board of Trustees meetings, especially the budget meetings at which annual distributions are decided and those where recommendations made by the Advisory Committee are under consideration for final determination by the Board of Trustees. MEMBERSHIP. The VCAB shall be composed of not less than five (5) or more than seven (7) members appointed by the Board of Trustees. All members of such commission shall be registered electors of Creede or Mineral County. Four (4) members of the VCAB shall constitute a quorum for the transaction of business, but in the absence of a quorum, a lesser number shall adjourn any meeting to a later time or date. In the absence of all members, any staff member shall adjourn any meeting to a later time or date. The term of office for a member shall be four (4) years on an overlapping tenure. Vacancies are filled by selection of candidates submitting a letter of interest for a vacancy by the Board of Trustees. Current members are welcome to submit letters of interest to the Board of Trustees to serve for another term. A member of the VCAB may be removed by the Board of Trustees pursuant to Removal from Office. The VCAB shall select its own chairperson and vice chairperson from among its members. The chair or, in the absence of the chair, the vice chair, shall be the presiding officer of its meeting. In

the absence of both the chair and the vice chair from a meeting, the members present shall appoint a member to serve as acting chair at the meeting. All members of the VCAB shall serve without compensation for their services.

REMOVAL FROM OFFICE. A member of the VCAB may be removed for misconduct, conduct unbecoming of a city official, violation of the state or local code of ethics, inefficiency, or with unexcused absence from two of three consecutive regularly scheduled meetings. Prior to removal, the Board of Trustees shall conduct a hearing and shall provide written notice to the VCAB member stating the grounds for removal at least three (3) days prior to the hearing.

VACANCIES. A vacancy on the VCAB shall occur whenever a member of the VCAB is removed by the Board of Trustees, dies, becomes incapacitated, or resigns. In the event a vacancy occurs, the Board of Trustees shall appoint a successor to fill the vacancy and serve the remainder of the term of the former member.

STAFF. The City Manager or City Clerk shall serve as the staff of the VCAB and shall provide the service of recording recommendations and official actions, who shall also act in the capacity of liaison between the Board of Trustees and the VCAB and administrator for the VCAB for the purpose of receiving applications, providing research, and issuing and other material for consideration by the VCAB.

MEETINGS. Meetings will be generally be scheduled approximately two weeks after applications are due. Staff will assemble application packets and distribute agenda and packet material to VCAB members no later than 10 days prior to the regularly scheduled meeting. Meetings will generally include presentations from applicants, scoring and discussion, and recommendation of funding to the Board of Trustees. Failure of any member to attend presentations will preclude them from participation in scoring applications or making funding recommendations. Occasionally, work sessions or special meetings for Virginia Christensen business may be necessary, and will be scheduled by staff as required. As a Committee appointed by the Board of Trustees, the Virginia Christensen Advisory Committee is considered part of the City of Creede official body. As such, all meetings of the Virginia Christensen Advisory Committee are subject to Colorado Sunshine laws, and therefore are open to the public at all times. Further, the committee is expected to follow the City of Creede Agenda Policy and Rules of Procedure during meetings, and members are expected to adhere to the City of Creede Code of Ethics and Conduct.

Grant Project Status

The 2018 CDA (Colorado Department of Agriculture) grant for noxious weed control is well underway, and will be receiving a review from the CDA during the CWMA (Colorado Weed Management Association) annual conference next week, Dec. 6th- 8th. The final grant is due on Dec. 15th, one month earlier than previous years. I will be coordinating with the CDA, CWMA, and neighboring counties to make sure this grant/partnership with the City of Creede meets all of the expectations/requirements of the State. The future partnership with the City of Creede will require matching funds (1:1), I propose a match of $6000.00. The proposed match would create a tentative budget of $12,000 to help the City of Creede comply with the Colorado Noxious Weed Act, CRS Title 35-5.5. Mineral County has done an initial inventory of noxious weeds within city limits and has found 40.5 acres of infested noxious weeds, which does not include ROWs within the city. Species of concern include, Yellow toadflax, Canada thistle, Russian knapweed, Chinese clematis, and Black henbane. The total cost in labor for the 40.5 acres @ $200/A equals $8,100. Cost for chemical will vary based on the density of infestation, our calculations are based on maximum use rates. The chemicals/application rates used will be, but are not limited to Milestone (7oz/A) and Telar (1.5oz/A) for a cost of $2,306.47, options may include Tordon (2qt/A) and Plateau (12oz/A). Chemical and labor for 40.5 acres of mitigation will be around $10,406.47. Project deliverables will include, but are not limited to; creation of City of Creede IPM, treatment of 40.5 acres of inventoried noxious weeds to be done between May-October of 2018, maps of affected areas, and at least 4 educational opportunities within Creede with attendance records. Control of noxious weeds along ROWs (streets and alleys) will be controlled by spot spraying either by ATV or backpack sprayer. The county will charge the City of Creede $65/hr, plus the cost of chemical to control ROWs. Deliverables will include an inventory and map of infestations, total affected area treated will depend on budget restraints after the initial project has been completed. A 5% administration fee will apply to the grant awarded to the City of Creede for administration costs incurred by the county. The control, suppression and eradication of noxious weeds is difficult and takes time. However, with the City’s participation and ongoing efforts by Mineral County, we can help protect and promote the natural resources within our county.

RESOLUTION No. 2017-15

A Resolution to adopt and appropriate a 2017 Revised Budget A resolution summarizing revenues and expenditures for each fund and adopting a budget for the City of Creede, Colorado, for the calendar year beginning on the first day of January, 2017 and ending on the last day of December, 2017. WHEREAS; A proposed budget for 2017 was prepared for the Town Board’s consideration, December 6th 2016 and; WHEREAS; upon due and proper notice, published or posted in accordance with the law, said adopted budget is open for inspection by the public and given the opportunity to file or register any objections to said adopted budget, and; WHEREAS; whatever increases may have been made in the expenditures, like increases were added to the revenues so that the budget remains in balance, as required by law. WHEREAS, the General Assembly has found, determined, and declared the self- Government by election is more legitimate and better accepted as voter participation increases: and WHEREAS, the General Assembly further found, determined, and declared that mail ballot elections are cost effective and have not resulted in increased fraud; and

RESOLUTION OF ANNUAL DESIGNATIONS AND 2018 FEE SCHEDULES

WHEREAS, it is the duty of the Trustees of the City of Creede, a Colorado town, to make certain designations of official status of depositories, newspaper (s) for city publications, and posting places for city meetings for the calendar year 2018. This is done by resolution annually to become effective the first day of the following year. WHEREAS, the Trustees of the City of Creede, a Colorado have deemed it necessary to impose rates and fees to cover the costs of administration, maintenance, service and similar costs for services provided by the City for the calendar year 2018. Section 2. The following fees shall be assessed and effective January 1, 2018: Record request fees: Public records requested in person or by US mail are $0.25/per page. Records requested electronically or for viewing only are free of charge. Time expended in connection with the research and retrieval of public documents will be free of charge for the first hour required and will be charged at a rate of $30.00 per hour for any time spent in excess of one hour. November 28, 2017 Gym Floor Cover Proposal

Creede Parks and Recreation

After searching through different types of floor covers, I have found that a vinyl, roll out cover seems the easiest and most efficient to purchase, install and store. Al has used this type in the past, and said they are durable and provide great protection.

Prices for these vinyl covers range from each company. I was only able to find estimates without speaking to a representative, and in some cases, having someone come look at our space. With my measurements, we have approximately a 98’x56’ space to cover to ensure that the court floor is not damaged during events at the gym.

The prices range from 0.59 cents to 0.88 cents per square foot, depending on the weight of the vinyl. In the purchasing guide, an 18oz weight is recommended for covers being used less than 6 times per year. At the moment, we would fall in this category. There are heavier weights offered for covers used 7-13 times per year, 13-20 times, etc.

Cover: 18oz vinyl @ $0.59/sf x 5488 sq ft = $3,237.92 Cover Storage cart: $2,099.00 Cover placement tape (case): $100.00 (this would last quite a while) Shipping cost: $975.00 (dependent on shipping method) Total: $6,190.00

This price is as best of a guesstimate as can be found without actually ordering the product. I do not expect the price to fluctuate more than $2,000.00, even if the heaviest weight, or different company is chosen.

There are other types of covers available that are less expensive, although not significantly. The other available types were not chosen due to difficulty to store or clean, or because of negative reviews from other users in our situation.

ORDINANCE NO. 407

AN ORDINANCE AMENDING THE PENALTIES FOR VIOLATION OF ORDINANCES OF THE CITY OF CREEDE, A COLORADO TOWN

WHEREAS, the Board of Trustees seeks to preserve and facilitate the safety, health and well-being of the community;

WHEREAS, Creede does not operate a municipal jail in which to house violators of Town ordinances;

WHEREAS, the cost of housing and transporting violators of municipal ordinances to other jurisdictions which maintain jail facilities has become cost-prohibitive;

WHEREAS, the Town seeks to balance the needs of the community for effective policing and punishment of violators of Town ordinances with the cost to the citizenry of same;

WHEREAS, the Board of Trustees has determined that a more effective use of resources to enforce Town ordinances is through increased fines.

NOW THEREFORE, be it ordained by the Board of Trustees of the City of Creede, Colorado, that the Creede Municipal Code shall be amended in the following manner:

Section 1. Section 1-4-20 is repealed in its entirety and readopted to read as follows:

Any person who is convicted of a violation of any provision of this Code for which a different penalty is not specifically provided shall be punished by a fine of not more than two thousand dollars ($2,000). In addition, such person shall pay all costs and expenses associated with the case, including attorney’s fees.

Section 2. Section 1-4-30 is repealed in its entirety and readopted to read as follows:

Every person who, at the time of commission of the offense, was at least ten (10) but not yet eighteen (18) years of age and who is subsequently convicted of or pleads guilty or no lo contendere to a violation of any provision of this Code shall be punished by a fine of not more than two thousand dollars ($2,000) per violation or count. In addition, such person shall pay all costs and expenses associated with the case, including attorney’s fees.

Section 3. Section 2-4-170 is repealed in its entirety and readopted to read as follows:

The Municipal Court shall have the power to compel attendance of witnesses and to punish for contempt of court. Where the Court finds any person to be in contempt, the Court may impose a fine on the contemnor not to exceed one thousand ($1,000) per violation.

The codifier of the City’s Municipal Code is hereby authorized to make such numerical and formatting changes as may be necessary to incorporate the provisions of this Ordinance within the Creede Municipal Code. AN ORDINANCE REPEALING AND REVISING CERTAIN PROVISIONS OF THE CITY OF CREEDE, A COLORADO TOWN, MUNICIPAL CODE

WHEREAS, the Board of Trustees seeks to preserve and facilitate the safety, health and well-being of the community;

WHEREAS, certain provisions of the Creede Municipal Code conflict with Colorado State law as it pertains to the de-criminalization of personal use and possession of marijuana/cannabis;

WHEREAS, the Board of Trustees has, pursuant to Ordinance No. 407, removed incarceration as a penalty for violations of any and all Town ordinances.

NOW THEREFORE, be it ordained by the Board of Trustees of the City of Creede, Colorado, that the Creede Municipal Code shall be amended in the following manner:

Section 1. The penalty as contained in Section 5 of Ordinance No. 375 entitled “An Ordinance Prohibiting The Operation of Marijuana Cultivation Facilities, Marijuana Product Manufacturing Facilities, Marijuana Testing Facilities or Retail Marijuana Stores within the City of Creede, Colorado, is repealed in its entirety and readopted to read as follows:

Any person, corporation, company, partnership, business association or organization convicted of violating the terms of this ordinance shall be subject to a fine not exceeding one thousand dollars ($1,000). Each day of continued violation shall be considered a separate offense.

Section 2. Section 10-8-100, entitled “Possession of cannabis” is repealed in its entirety.

Section 3. Recording and Authentication. This ordinance, immediately upon its passage, shall be authenticated by the signatures of the Mayor and City Clerk, recorded in the Town Book of Ordinances kept for that purpose, and published according to law.

Section 4. Publication and Effective Date. This ordinance shall take effect thirty (30) days after publication following final passage.

WHEREAS, the Board of Trustees seeks to preserve and facilitate the safety, health and well-being of the community;

WHEREAS, the Board of Trustees seeks consistency and uniformity with the laws of the State of Colorado pertaining to employment;

WHEREAS, existing provisions within the Creede Municipal Code pertaining to appointed officers are internally inconsistent and the Board of Trustees seeks to clarify such provisions.

NOW THEREFORE, be it ordained by the Board of Trustees of the City of Creede, Colorado, that the Creede Municipal Code shall be amended in the following manner:

Section 1. Section 2-3-10 (b) is repealed in its entirety and readopted to read as follows:

Vacancies shall be filled by appointment of the Board of Trustees.

Section 2. Section 2-3-40, entitled “Salaries and compensation of officers” is repealed in its entirety and readopted to read as follows:

The Board of Trustees shall fix the compensation of all officers of the City. The Mayor shall execute written contracts with each officer which enumerates said compensation and may detail duties of the appointed position as determined by a majority vote of the Board of Trustees.

Section 3. Section 2-3-50 is repealed in its entirety and readopted to read as follows:

Any officer appointed by the Board of Trustees shall serve at the pleasure of the Board and may be removed from office or suspended, with or without pay, by a majority vote of all Trustees.

Section 4. Recording and Authentication. This ordinance, immediately upon its passage, shall be authenticated by the signatures of the Mayor and City Clerk, recorded in the Town Book of Ordinances kept for that purpose, and published according to law.

Mays Construction change order – Update I sent you all the email thread I had with Kyle at Mays construction after our

meeting earlier this week and the response from Warren. I got a call from Warren last Friday and it doesn’t appear he and Merrick are going

to be able to work out an agreement. Warren and I talked about him contracting with us for the consulting work and then maybe rely on Merrick for the inspection. I asked Warren to get back with me with any thoughts I could present to the Trustees. Waiting ……

Willow Creek Flume Rehabilitation – Update Attached is the latest notification we’ve prepared for the public.

Letter of Map Revision – Update We received the attached letter from the National Flood Insurance Program

concerning our LOMA application. I talked with Alandren and Vincent with BHI last Friday and FEMA wants a new

hydrology study and they also want the levy (lower retaining pond) to be certified as being structurally sound. Alandren will send us a proposal and quote on both tasks we’ll need to discuss to keep this application moving forward.

I can’t help but wonder if we shouldn’t partner with them in some way as we rehabilitate our flume.

Vick and Dresser Boundary Line Agreement – Direction This Boundary Line Agreement is listed separately on the agenda and with your

approval I’ll start the attached schedule.

Temporary Modification – Update Ron prepared the comprehensive report I sent you all earlier and submitted it to the

State. The State would like to meet us in January if possible. Ron and Karen are trying to schedule a time when they both can meet with the Trustees to discuss some options on how to proceed. Getting something scheduled in December is going to be tough because of the holiday, but they are trying and I’ll let you know.

Water Rights/Annual Report Attached is the annual water rights report we send to the State every year and the

supporting spreadsheets Robert and I keep track of throughout the year.

Holy Moses Replat/Boundary Adjustment – FYI Last Thursday Vickie Kulyk brought in the paper work and fee to have the boundary

of her and Nick’s property on Main Street straightened out and replatted. All of the properties in Block 25, Creedmoor were approved for replatting in February of 2007. This

is the last property in Block 25, Creedmoor to go thru the process. I’ll present this to the Planning Commission next week and have a schedule for you at our December 12 meeting.

Morton, McLean, and City Property – Update Dan Russell is still working on the survey for these properties as well as a minor

adjustment on Lee Peterson’s property.

Rebecca & Caleb Simon – Update Rebecca and Caleb have sold their property in North Creede to Todd Mayer and he

is sorting some of the details out with Toby to keep this project going.

Walking bridge removal – Update We’re still waiting for Dick’s schedule to lighten up so we can hire him to remove

the pedestrian bridge behind the hotel. We’re still hoping to get this done around the second week in December.

Leasing Water – FYI Richard Mehren, our water attorney has reached out to a couple people who may

help us find out of there is a market for leasing water. Richard also sent the most recent attachments concerning our latest augmentation ruling and water accounting form. CDOT is having a private contractor perform some traffic counts on bridges in town as well as Mineral County. They plan to have the counting devices in place sometime the week of December 4th for approximately 48 hours.
