2016 VTG Contract

• Aims to include the requirements of the Standards for Registered Training Organisations 2015

• Now includes definitions on Amount of Training and Volume of learning

• Strengthened definition of material breach

Material breach

• Material Breach means… iv) specific requirements for all Training Services including the requirements for the provision of the Training Services at Clause 4.1 and 4.2, Pre-Training Review, Training Plan, and Evidence of Eligibility, Evidence of Concession/Waiver/Exemption, Evidence of Participation, in relation to each Eligible Individual; … d) breaching clause 3.3(d);(students under 17) e) using a subcontractor in breach of any part of Clause 5; f) failing to accurately report data in accordance with Clause 11.4 of Schedule 1; and

Volume of Learning

• The volume of learning includes all teaching and learning activities such as guided learning (classes, lectures, tutorials, online or self-paced study), individual study, research, learning activities in the workplace and assessment activities. The amount of training provided by your RTO is part of the overall volume of learning and relates primarily to formal activities including classes and other activities as well as workplace learning.

Amount of Training

• amount of training must be consistent with the requirements of training packages and enable each learner to meet the requirements for each unit of competency in which they are enrolled

Influenced by the:

• existing skills, knowledge and the experience of the learner

• mode of delivery; and

• number of units and/or modules being delivered

VRQA Guidelines for VET Providers

• Guideline 1: has not changed.

Guidelines 2 – 5: have been replaced by the following:

• Guideline 2: Transparency and oversight of third parties

• Guideline 3: Trainer and assessor qualifications

• Guideline 4: Delivery of training and assessment services

• Guideline 5: Annual declaration of compliance.

The Australian Consumer Law (ACL)

The ACL applies to all education and training services, including:

• advertising, marketing and promotion

• soliciting and taking enrolments

• training delivery

• student assessment

• handling of complaints by training providers

• requests to cancel a student’s enrolment.

The ACL also applies when these services are provided by third parties on behalf of a training provider.

Misleading, deceptive and unconscionable conduct

It is illegal to falsely or misleadingly represent the:

• price of a service

• quality of the service

• need for particular services.

• Examples might include misleading advice about:

• the benefit of doing a course, including eligibility for further funding entitlement, study or employment prospects

• Clear and transparent fees and charges.

Door-to-door sales, telemarketing and shopping centre/footpath sales

• a 10 business day cooling-off period, during which the contract can be cancelled without payment or penalty – targeted at VET Fee Help

• restrictions on the days and hours when approaches can be made

• obligations on the part of the salesperson

• VTG require the candidate to be given information that they can digest before enrolling! – effectively a cooling-off period

Third Party Arrangements

A third party provides services:

• training,

• assessment,

• related educational and support services and/or any activities related to the recruitment of prospective learners.

HESG changes their mind on Third Parties

• No roll over of process from 2014 & 2015

• Third Party arrangements – genuine, specified and limited

• Contracted RTOs who subcontract to another contracted RTO is not required to seek approval but must notify the Department within 30 days

• Pre-Training Review MUST NOT BE Subcontracted!

VTG Quality Charter The VTG Quality Charter describes the RTO’s responsibilities to students, including: • Assisting them to value and understand their training

environment • Supporting the student to make an active and informed

choice about their course of study and whether this is the right RTO

• Making sure their training program is suitable for their needs • Making sure their training program meets regulatory

standards and is delivered by experts in a manner appropriate for their individual needs

• Making it easier for students to provide feedback to the RTO on their training experience.

Evidence that the training duration and

intensity is appropriate for the qualification

and students

PUSH HOURS • Program Unique Supervised Hours are the total

hours an RTO has scheduled an instructor to engage with a student while they complete a specific program, regardless of the type of delivery.

• Supervised teaching can include phone or electronic supervision or supported online learning.

• Hours which the instructor provides online support to the student should also be included in the Program Unique Supervised Hours.

Reporting PUSH Hours

• PUSH hours should be reported as they would be viewed from the Training plan or student’s perspective.

• PUSH hours should be in line with the hours reported on the Training Plan and provided to the student before they commenced the training.

• Changes to the PUSH hours reported will occur when the training plan changes.

• Auditable Register of Trainer/Assessor

Other

• An approved provider list for RTOs delivering trainer/assessor qualifications will be created, with only RTOs on this list being eligible to deliver these qualifications under the VTG. Approval process is yet to be confirmed

• Training that is inconsistent with the packaging rules or vocational intent of the course.
