As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 7. The Committee suggested to prepare Data Bank for the teachers. 8. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier.

Meeting of the Eastern Regional Committee (ERC), National Council for Teacher

Education (NCTE) was convened on 18th – 19

th August, 2015 at Conference Hall, ERC, NCTE, 15,

Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were

present at the time of the 193rd

ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them

about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the

permission of Chairperson, Dr. Prabhu Kumar Yadav (Convener) presented the Agenda before the Committee

for its due consideration and appropriate decision.

ATTENTION!

1. The committee unanimously decided that the institution may reply in response

to the decision of the committee uploaded on the ERC website without waiting

formal letters from the office of ERC. The replies so received will also be

considered by the committee.

2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per

programme. (See ERC website for detail).

3. The institution need to submit list of 10 schools for internship and school

based activities duly approved by District Education Officer.

4. Institutions must give the affidavit for consent / willingness for number of

units either one or two if it was not submitted earlier.

5. The institution shall comply with the additional facilities required (additional

built-up area, additional staff, additional funds etc) for the SECOND UNIT

as prescribed in NCTE (Recognition Norms and Procedure) Regulations 2014

before 31.10.2015.

6. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any

course or training in Teacher Education without obtaining recognition or

permission under this Act, the qualification in teacher education obtained

pursuant to such course or training or after undertaking a course or training in

such institution, shall not be treated as a valid qualification for purposes of

employment under the Central Government, any State Government or

University, or in any school, college or other educational body aided by the

Central Government or any State Government.

7. The Committee suggested to prepare Data Bank for the teachers.

8. The institution needs to install Fire Safety equipment and submit the Fire

Safety Certificate if not submitted earlier.

Regulations and guidelines issued by NCTE Hqrs. VTR, the Committee discussed the matter in detail and

observed as under:

(i) The letter of intent under clause 7(13) was issued on 20.02.2014.

(ii) 1st Show Cause Notice U/S 14(3)(b) was issued on 01.03.2015.

(iii) A Clarification letter to the institution was issued on 20.05.2015.

(iv) The institution has not submitted the reply of letter of intent U/C 7(13) issued on 20.02.2014

till date.

In view of the above the Committee decided as under:

The recognition of the institution for B.Ed. Course is refused due to non-submission of the reply.

3. 193.6.2

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules,

Regulations and guidelines issued by NCTE Hqrs. VTR, the Committee discussed the matter in detail and

observed as under:

(i) Letter of intent was issued on 22.04.2015 as per decision of 185th

Meeting. The institution was

directed to submit the reply within 60 days. No reply received from the institution till date.

In view of the above the Committee decided as under:

The second reminder may be issued to the Government with a copy to the institution to submit the reply

within 30 days. If not received on time, it would be presumed that the institution is not interested to run the course. Copy to Govt. of Assam Deptt. of Education for information and necessary action.

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules,

Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and

observed as under:

After constitution of VT the institution is requested to extend the time limit of inspection for 60 days.

The ERC decided to give 30 days’ time to the institution in 186th

ERC Meeting. No reply has been

received from the institution till date.

In view of the above the Committee decided as under:

The Recognition of the institution for B.Ed. Course is refused.

5. 193.8.2

Saraswati School of Education, Plot No.-642, Vill./ P.O.-Kalikapur,

Tehsil/Taluka-Kalikapur, Town/City-Sonarpur, Dist.-South 24 Parganas,

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules,

Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and

decided under:

Both the VT members Dr. D.K. Mohanty and Prof. Muzamil Hassan are directed again to visit the

institution within 20 days as per their telephonic request.

ER-193.12(i) Misc. Cases-I

6. 193.12(i).1 A.S. College, Deoghar, PO/Dist.- Deoghar, Jharkhand-814112 (B.Ed.)

(Constituent College) (S.K.M. University) (Code No. APE00439)

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules,

Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and

observed as under:

The institution A.S. College Deoghar, District- Deoghar, Jharkhand is a constituent unit of S.K.M

University. As per the decision of 188th

ERC Meeting held on 19-20 may 2015, the Committee considered the

Appeal Order dated 05.05.2015 and as decided by ERC, an inspection letter to the institution as well as VT

experts will be issued and such letter was issued on 07.07.2015.

(i) The VT pointed out that the number of teachers are only 05.

(ii) The Multipurpose hall is under construction.

(iii) The building completion certificate has also not submitted.

(iv) The ERC in its 191st meeting considered the letter dated 26.05.2015 received from the

Director of Higher Education, Govt. of Jharkhand committed that all such requirements along

with appointment of full time faculty will be complied with as per the new Regulation 2014

by 31st October 2015. As decided by the ERC, recognition of the institution continued vide

order No.34580 dated 07.08.2015.

(v) In the meantime the CD of the VT report was found broken at the time of opening the envelop

of the VT report.

(vi) Further the Director of Higher Education vide their letter dated 26.05.2015 committed that all

such requirements along with appointment of fulltime faculties will be completed as per new

Regulations etc 2014 by 30th

October 2015.

In view of the above the Committee Decided as under:

(i) As the CD is found broken at the time of opening the envelop, the principal of the institution may be

requested to submit another CD for information of the Committee.

(ii) Recognition of the institution be continued. Review of the status of the institution after 31st Oct.

2015 about the Teaching Staff and their salary, Multipurpose Hall and other deficiencies will be

taken up as per Regulation 2014.

7. 193.12(i).2 K.K.M. College, Pakur, Jharkhand-816107 (B.Ed.) (Constituent College)

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules,

Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and

observed as under:

The institution was granted recognition by ERC, NCTE on 07.09.2005 with an annual intake of 100 from

the academic session 2005-2006.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015 and

as decided by ERC, inspection letter to the institution as well as VT experts were issued on 07.07.2015.

(i) As per VT report the multipurpose hall is under construction.

(ii) The teaching faculties are not appointed as per NCTE norms.

The ERC in its 191st meeting considered the letter dated 26.05.2015 received from the Director of Higher

Education, Government of Jharkhand committed that all such requirements along with appointment of

fulltime faculty well be complied with as per new Regulation 2014 by 31.10.2015 and as decided by ERC,

recognition of the institution continued vide order No. 34584 dated 07.08.2015 with a condition that

“status of the institution will be reviewed after 31.10.2015 as per Regulation 2014.”

In view of the above the Committee decided as under:

Recognition of the institution be continued.

Status of the institution will be reviewed after 31st Oct. 2015.

8. 193.12(i).3 Ranchi College, Ranchi, Morabadi, Dist.- Ranchi, Jharkhand-834008 (B.Ed.)

After considering the records available in the file, and relevant provisions of the NCTE Act 1993,

Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and

observed as under:

The institution was granted recognition by ERC, NCTE on 12.05.2005 with an annual

intake of 100 from the academic session 2005-2006. This is a composite institution.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated

05.05.2015 and as decided by ERC, inspection letter to the institution as well as VT experts were

issued on 07.07.2015.

The VT report mentioned that:

(i) The library books are less than the required norms.

(ii) The size of the multipurpose hall is less and the building is not as per norms.

Further the Director of Higher Education, Govt. of Jharkhand vide letter dated 26.05.2015

committed that all such requirements along with appointment of full time faculty will be complied

as per new Regulation 2014 by 31.10.2015.

In view of the above the Committee decided as under:

Recognition of the institution be continued

The status of the institution will be reviewed after 31.10.2015.

9. 193.12(i).4 Godda College, Po/Dist.- Godda, Jharkhand-814134 (B.Ed.)

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules,

Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and

observed as under:

The institution was granted recognition by ERC, NCTE on 12.09.2005 with an annual intake of

100 from the academic session 2005-2006.

As per VT report:

(i) All the halls are under construction and roofing is not yet done.

(ii) Multipurpose hall is also not completed.

(iii) The built up area of the institution is less than the required norms.

Further the Director of Higher Education, Govt. of Jharkhand vide letter dated 26.05.2015 committed

that all such requirements along with appointment of full time faculty will be complied with as per new

Regulation 2014 by 31.10.2015.

In view of the above the Committee decided as under:

Recognition of the institution be continued. The status of the institution, relating material and human

resource including other requirements etc. will be reviewed after 31.10.2015.

ER-193.12(ii) Misc Cases-II

10. ER-193.12(ii)

Suniti Educational Trust, Plot No.6763(P), 6853(P), 6856(P), 6884(P),

Vill- Kalyani, PO-Kalyani, City-Kalyan, Dist-Nadia, West Bengal - 741235.

(Course – B.Ed.)(University of Kalyani, West Bengal)(Code No.ERCAPP125)

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules,

Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and

observed as under:

The ERC in its 186th Meeting held on 23-24 April 2015 decided that the copy of the complaint of

Dr. Bishnupriya Chanda be forwarded to the University and the Collector for inquiry and

necessary action. Accordingly a letter dated 01.05.2015 to the institution, university and collector

was issued to inquire in to the matter.

The Registrar Kalyani University vide its letter dated 08.06.2015 received on 15.06.2015 has

submitted its report and recommendation as under:

(i) The Chairman of the Suniti Educational Trust and principal of the College be directed not

to debar any female teacher, female staff or girl student from entering the college and

joining their respected duties on ground of being dressed in Salwar-Kameez.

(ii) Any action taken by college or the Trust or the Chairman or the Principal against Ms.

Chanda due o her wearing salwar-kameez be declared illegal and the College be directed

to revoke all orders, if any, on that account.

(iii) Since the University has a role in selecting and appointing a teacher in the College as per

rules of affiliation, disciplinary action be taken against or dismissal of any teacher be

done by the college authorities with prior intimation to the University and after

obtainment of a no-objection certificate from them, non-compliance of which be treated

as a implicative violation of condition of affiliation.

(iv) Further inspection be undertaken by the University to see whether the College has been

complying with all directives given b them at the time of affiliation.

In view of the above the Committee decided as under:

A copy of the above letter along with recommendation be sent to the Shri Dillip Kumar Viswas, Chairman,

Suniti Educational Trust for necessary action in this matter. Copy may be forwarded to Assistant Registrar

(LAW), NHRC, New Delhi for information and necessary action.

observed as under:

(i) Teaching faculty list approved by the affiliating body is not submitted.

(ii) Testimonials Certificates for new faculty not submitted.

(iii) Signature of the Registrar of the concerned university on each paper of the teaching faculty not

submitted.

(iv) The Principal is not appointed.

In view of the above the Committee decided as under:

The institution is directed to submit the above documents within 21 days.

The inspector of colleges University of Kalyani vide its letter dated 09.06.2015 received

on 15.06.2015 has intimated that in view of the irregularities committed by the institution,

the Executive Council of the University in its meeting dated 09.06.2015 has decided to withdraw

affiliation of the Baliadanga Sarif B.Ed. College, Baliadanga Dignagar, Nadia with immediate

effect.

In view of the above the Committee decided as under :

The institution was granted recognition by ERC on 12.05.2005. The ERC in its 188 meeting held on 19-20 May

2015 considered the appeal order and as decided by ERC inspection letter to the institution as well as VT

experts were issued on 15.07.2015. This is a composite institution. As per VT report the following deficiencies

are observed :

(i) There is shortage of teacher educators, seven more teacher educators are to be recruited.

(ii) Some portion of the building needs to be repaired at the earliest.

The ERC in its meeting 191 considered the letter dated 26.05.2015 received from the Director of

Higher Education, Govt. of Jharkhand Committed that all such requirements like teaching faculty and non

teaching staff, building and library etc will be complied with a s per new Regulation 2014 by 31.10.2015 and as

decided by ERC Recognition of the institution for B.Ed. course be continued. The status of the institution

will be reviewed after 31.10.2015.

of 100 from the academic session 2012-2013.

The ERC in its 188th

Meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015

and the ERC decided to make inspection of the institution and the inspection letter to the institution as

well as VT experts were issued on 15.07.2015. As per the VT report the following points are observed

(i) The teaching faculty selected by the University are on contractual basis.

(ii) The institution does not maintain the Endowment Fund and Reserve Fund with ERC,

Bhubaneswar.

(iii) The institution has not submitted FDRs of Rs.4.00 Lakh.

(iv) The boundary wall needs to be constructed.

The ERC in its 191st meeting considered the letter dated 26.05.2015 received from Director of Higher

Education, Govt. of Jharkhand committed that all such requirements along with appointment of full

time faculty on Regular basis shall be complied with as per Regulation 2014 by 31.10.2015.

It was decided that the recognition of the institution be continued. Review of the status of the

institution shall be taken up after 31st October 2015.

In view of the above the Committee decided that in spite of repeated show cause, no reply has

As per the decision of 188th meeting Letter of Intent u/s 7(13) was issued vide No.31982 dated 23/05/2015

to the institution to comply the following within 60 days.

a) The institution need to submit an affidavit and willingness for required units of the proposed course

as per New Regulation 2014.

b) The institution required to submit the original FDR of Rs. 5.00 lacs towards Endowment Fund and

Rs. 7.00 lacs towards Reserve Fund with conversion in joint name i.e. name of the institution and

Regional Director, ERC, NCTE, Bhubaneswar as per New Regulation 2014.

c) The institution need to submit list of 10 schools for internship and school based activities along with

the reply of 7(13) duly approved by District Education Officer.

d) Faculty list approved by affiliating body after the appointment through duly constituted selection

committee and ensuring compliance of NCTE norms of teaching staff etc.

e) Advertisement in leading newspapers.

f) Letter of University / Affiliating Body, nominating experts / representative for the Selection

Committee.

g) Minutes of the Selection Committee duly constituted as per the norms of the affiliating body.

h) Approval of the University / Affiliating body to the selected faculty in the prescribed format.

i) An affidavit on Rs.100/- stamp paper to the effect that the institution has selected staff as per

NCTE/State/University norms in the prescribed format.

j) An affidavit on Rs.10/- non judicial stamp paper by the individual faculty member selected by

the institution. Details should be filled in by every faculty member selected in the prescribed

format.

k) Educational & Professional qualification certificates of all teaching staff showing their

eligibility for appointment as per the NCTE norms and experience certificate of the

Principal/HOD.

l) FDRs duly converted (for a period of five years) in favour of joint name of the

Society/Trust/Institution and Regional Director, ERC, NCTE, Bhubaneswar with Joint operation

Mode: „AND‟.A letter to the concerned bank is being sent authorizing the bank on behalf of

Regional Director for the conversion in the joint name.

m) An undertaking from the Management of the institution as per the prescribed format available

on ERC website.
