Addressing Inaccuracies, Misconceptions About Canada’s New Impaired Driving Law

IN THE NEWS

A great deal of inaccurate information has been circulating about Canada’s new impaired driving laws, incorrectly suggesting Bill C-46 has given police wide-ranging new powers to demand breath tests from anyone, anywhere, without reasonable grounds to believe an impaired driving offence has been committed. We are pleased to have the opportunity here in MADD Matters to address the two most common misconceptions we have been hearing about the new laws. News articles and social media posts have claimed that the new mandatory alcohol screening law permits police to approach people in their homes or at bars and demand that they provide a breath sample, even if there is no reasonable grounds to believe that they have been driving impaired. Is that true?

The simple answer is no. These stories conflate two distinct breath testing provisions:

• Bill C-46’s new mandatory roadside alcohol screening provision, which does not require individualized suspicion of drinking and driving; and

• the long-standing power of the police to demand that an individual, who they have reasonable grounds to believe has committed an impaired driving offence, submit to evidentiary breath testing.

Mandatory alcohol screening only applies to individuals who are driving. The police can only make a demand if they have lawfully stopped the driver, the demand is made immediately on stopping the driver and the officer has an approved screening device in his or her possession.

Police can, in the course of an impaired driving investigation, go to someone’s home or other location and, if they determine reasonable grounds to believe

that person has committed an impaired driving offence, demand that person submit to evidentiary breath testing. This law is not new; the Canadian Criminal Code was amended in 1969 to authorize police to demand that individuals submit to evidentiary breath testing (not mandatory alcohol screening) in specified circumstances. Thus, police have long had the power, during the course of an impaired driving investigation, to come to the residence of a suspected impaired driver and demand that he or she accompany them to the police station and submit to evidentiary breath testing. This generally only occurs if a person caused a crash and fled the scene, or was described by reliable witnesses as being drunk while driving.

However, the police can only make this demand if:

• they have reasonable grounds to believe that an individual committed an impaired driving offence;

• they inform the individual of his or her right to consult with a lawyer and give him or her an opportunity to do so; and

• the testing is conducted by a person qualified to conduct evidentiary breath tests on an “approved instrument” (not the roadside screening device used in conjunction with the mandatory alcohol screening test).

I read that an individual who drives home completely sober and then drinks at home can be vulnerable to being convicted of impaired driving. Is that true?

Once again, the simple answer is no. This conflates two distinct provisions of the Criminal Code.

Bill C-46 makes it an offence (subject to a major exception) to have a blood-alcohol concentration (BAC) of .08% or more within two hours of having driven (the two-hour rule). However, the Bill specifically states that no offence is committed if: the alcohol was consumed after driving; the individual had no reason to expect that he or she would be required to submit to a breath or blood test; and the individual’s evidentiary BAC is consistent with being below .08% when driving.

This two-hour rule was enacted to address two questionable defences (the bolus drinking and intervening drink defences) that impaired drivers commonly used to evade criminal conviction despite having a BAC well above the Criminal Code limit.

• The Bolus Drinking Defence. This defence is typically based on an accused’s claim that he or she drank a large quantity of alcohol just before driving and that the police stopped him or her very shortly thereafter. The accused alleges that this recently consumed alcohol had not entered his or her blood stream when he or she was stopped by the police. Thus, the accused claimed that the BAC was below the legal limit when driving and only rose above the limit during the 1.5 – 2 hour interval from the time he or she stopped driving until he or she took the evidentiary breath tests.

• The Intervening Drink Defence. This defence is based on the accused’s claim that he or she consumed alcohol after driving but before submitting to evidentiary breath testing. As in the case of the bolus drinking defence, the accused alleges that his or her BAC was below the legal limit while driving. In some intervening drink cases, the accused claimed that he or she consumed alcohol at the scene of the crash before the police arrived. In other cases, the accused fled the scene, went home and had several drinks. In both scenarios, the accused uses the intervening drink defence to claim that he or she was sober at the time of the crash, but drank afterwards to ‘calm his or her nerves.’

Contrary to what some have stated, the two-hour rule does not give the police any new powers to demand a breath test. The police cannot require an individual who is sitting at home to submit to mandatory breath screening. However, as has always been the case, the police can go to an individual’s residence in the course of investigating an impaired driving or other criminal offence. If, on completing their investigation, the police conclude that there are reasonable grounds to believe that the individual committed an impaired driving offence, they may demand that the individual accompany them to the police station and submit to evidentiary breath testing. This is not new.

National Volunteer Week: Volunteers Lift Our Communities Up

The theme for this year’s National Volunteer Week, running from April 7 – 13, is: The Volunteer Factor – Lifting Communities. How true that statement is! Canadian volunteers contribute countless hours, considerable skill and endless passion to thousands of organizations, helping to improve and strengthen communities across the country.

In MADD Canada’s case, thousands of volunteers with our more than 100 Chapters and Community Leader groups work within their communities to prevent impaired driving and to help victims and survivors. From awareness campaigns, to education programs for youth, to championing new laws and policies to prevent and address impaired driving, our dedicated volunteers bring MADD Canada’s mission to life.

MADD Canada Teams With Lift & Co On Training for Cannabis Sales Staff

Lift & Co, in partnership with MADD Canada, has developed a training program for cannabis retailers and staff. The program, now titled CannSell, strives to educate cannabis retail employees on the responsible sale of cannabis, as well as their legal and regulatory obligations. The training will also provide basic knowledge about cannabis to ensure those who are selling it understand the various forms, effects and the potential risks and harms of cannabis use, including impaired driving.

The program is customized as needed to reflect the regulations in each province.

The retail training certificate program has already been delivered to retail sales staff of the Nova Scotia

Liquor Corporation, Prince Edward Island Cannabis Management Corporation and numerous private retailers across the country.

Most recently, the Alcohol and Gaming Commission of Ontario, which oversees alcohol and cannabis sales and service in the province, have selected CannSell as the approved retail certification training program for Ontario’s private cannabis retailers.

“Effective training programs for cannabis retail sales staff will help reduce the risk of impaired driving,” said MADD Canada Chief Executive Officer Andrew Murie. “With our extensive expertise in education and awareness around the prevention of impaired driving, MADD Canada is proud to team with Lift & Co to develop and deliver comprehensive training that includes a strong emphasis on the risks of driving under the influence of cannabis, and how to prevent it.”

Sharing Stories, Sharing Resources, Sharing Hope – MADD Canada’s National Conference for Victims of Impaired Driving

For one weekend at the end of April, victims and survivors of impaired driving come together for a conference where no one has to hide their feelings or put on a brave face for others. MADD Canada’s National Conference for Victims of Impaired Driving, from April 26 – 28, offers a safe and understanding environment where victims and survivors of impaired driving can share their feelings, gain information and coping tools, and learn that they are not alone in their grief.

More than 200 delegates will attend keynote addresses and smaller workshop sessions which provide support, fellowship and resources to help deal with the losses and injuries delegates have suffered as a result of impaired driving. Topics will include: surviving loss, living with injuries, the criminal justice system, victims’ rights and coping with anger.

The conference also offers a program for youth, aged 15 to 24, featuring sessions and activities that have been specially designed to address the challenges and grief faced by young victims and survivors.

“Our goal is to provide a space where victims and survivors feel safe and free to share their stories of loss and grief, to learn from and support one another and to gain information and resources that will help them on their journey,” said Steve Sullivan, MADD Canada’s Director of Victim Services. “Nothing can change their losses, their injuries or their grief, but as delegates tell us every year, simply being among other victims and survivors gives them some comfort and strength.”

On Saturday, April 27, a Candlelight Vigil of Hope and Remembrance will be held to honour victims and survivors of impaired driving. Guests are welcome to attend the Candlelight Vigil but are asked to RSVP to Ardene Vicioso at [email protected] as space will be limited. (Please note: individuals who are already registered to attend the full national Conference do not need to RSVP for the Vigil.)

Spring and Summer Months Will Bring Our Campaign 911 Message

It may feel as though the warm weather is still a long way off, but MADD Canada is gearing up for Campaign 911 throughout the late spring and summer months. Initially launched in 2008, Campaign 911 has spread to towns, regions and provinces across the country. The program encourages Canadians to treat impaired driving as the emergency it truly is by calling 911 if they see a driver they suspect is impaired.

Together with our police partners, as well as other local and provincial stakeholders, MADD Canada Chapters and Community Leaders use signs, billboards, public service announcements and other materials to inform the public about the possible signs of an impaired driver or impaired boater, and tips on what to do if you spot one.

The campaign has been successfully extended to the

lakes and waterways too, with hundreds of Report Impaired Boaters – Call 911 signs installed at harbours, marinas and boat launches across Canada in the past few years. The marine signage and related collateral materials and information have been generously supported through funding from Transport Canada.

Campaign 911 runs all year round, but is promoted prominently through the summer and over long weekends, when the risk of impaired driving is high. In addition to sponsorship from our partner of more than 30 years, Allstate Insurance Company of Canada, our Campaign 911 program has been generously supported by Maritime-Ontario Freight Lines Limited. Welcoming Our New Sponsor – ParcelPal

MADD Canada is pleased to announce our newest national sponsor – and our new Official Delivery Service in Canada – ParcelPal Technology Inc.  ParcelPal is an on-demand marketplace and delivery app that allows people to shop online for a wide range of products – including alcohol and cannabis – and have the products delivered to their home by trained and vetted drivers within one hour. The company currently operates in Vancouver, with plans to expand to other areas of the country over the next 18 months.

For the purchase of cannabis or alcohol, consumers enter an age-restricted section of the ParcelPal platform where they must agree to the age restriction and scan their ID to ensure authenticity. Their ID will be displayed within the courier app at delivery, ensuring the driver can identify that the person receiving the order is the person on the ID provided.

As part of this partnership, MADD Canada and ParcelPal will team on a national awareness campaign to educate Canadians on the dangers of impaired driving, and the options for them to get the products they need without leaving their homes or parties.

MADD Canada is calling on students to help us advance the sober driving message in a creative way through our National Poster and Multi-Media contests.

Multi-Media ContestOpen to students under 24 years of age, the Multi-Media Contest offers three categories:

• Short Films/Presentations

• Audio Public Service Announcements

• Multi-Media Public Service Announcements

The productions should focus on youth taking action and realizing they have the power to stop the damage caused by impaired driving.

Applications Being Accepted for MADD Canada’s Bursary ProgramMADD Canada is accepting applications for its Bursary Program until May 31, 2019. Canadian students who have been severely injured, or who have had an immediate family member (mother, father, legal guardian, sister or brother) killed or severely injured in an impairment-related crash, and who are pursuing any full-time, post-secondary educational program that is approved by a provincial Ministry of Education are eligible to apply.

Several $4,000 bursaries are awarded to qualifying students each year, as well as one $8,000 Leadership Bursary in honour of Louise Joanne Twerdy, a former MADD Canada National President and staff member.

Special thanks to all donors who earmark their contributions for this program, including Garth William Hazlitt of Winnipeg, Manitoba, who donated an incredible $25,000 to the Bursary Program in 2018 to create an annual $4,000 bursary for one deserving student to follow their educational dreams each year.

Matthew Paul Carvalho Poster ContestMADD Canada’s poster contest is named in honour of Matthew Paul Carvalho, who was killed by an impaired driver in 1990. Entrants are encouraged to express their concerns about the dangers of impaired driving in a creative way. The contest is open to students in two age categories: 10 Years and Under, and 11 to 14 Years.

A family’s strength following the loss of a loved one in an impaired driving crash has led to a partnership with MADD Calgary and Tsuut’ina Nation.  In December, the Chapter partnered with Tsuut’ina Police and Emergency Services for a special evening that included a Project Red Ribbon awareness event and an outdoor Candlelight Sharing Circle where people spoke of their loved ones and shared some of their stories.

MADD Edmonton and Area was involved again this year in the Leduc Candy Cane Checkstop on December 7. It was another great success raising close to $800 for the Chapter to use on programs and services in the community. Thanks to everyone who volunteered for this fun evening, and especially to Peace Officer James Russell with the City of Leduc Enforcement Services and the Chapter’s own Michelle Garraway for all their hard work and dedication.

MADD Yellowknife volunteers joined the RCMP in chilly weather to hand out information and thank the designated drivers during a checkstop in December. The group’s goal was to remind everyone to not drive impaired, thank the designated drivers, and let the community know that MADD Canada is now in Yellowknife.

MADD Brandon attended the Brandon Wheat Kings game January 19 to participate in the Chuck-A-Puck fundraiser. They had table set up, safe ride messaging throughout the game and a great prize package donated by the Radisson, Moxie’s and the Winnipeg Jets.

MADD Saskatoon joined the Saskatoon Police Service for sobriety checkstops throughout the month of January. They handed out Tim Horton’s gift cards donated by Saskatoon Police Service and Saskatoon Government Insurance to sober drivers as a way of saying “thank you.”

MADD Fort Simpson has partnered with a variety of local businesses to hand out the MADD Canada cell phone holder to the community. MADD Huron/Bruce held their Project Red Ribbon launch in Kincardine on November 14. Ontario Provincial Police (OPP) officers from South Bruce and Huron conducted Sobriety Checkpoints in two locations in Kincardine, with Chapter volunteers handing out red ribbons and card holders. MADD Beauce hosted two booths in major shopping malls in their area where they distributed Project Red Ribbon material and raised money for MADD Canada programs in their region. It was a great occasion to meet the local citizens and raise awareness. Some prominent local personalities came to chat, including Beauceville Mayor François Veilleux, and CAQ MNA for Beauce-Sud Samuel Poulin, who took the time for a picture with MADD Beauce volunteer Lucie Tanguay.

On December 12, volunteers from MADD Montreal participated in two sobriety checkpoints with Montreal Police Service’s Special Task Force as part of their Project Red Ribbon campaign. In the afternoon, President Debbie Coveny, along with James Lawler and Luc Chamberland, took part in the checkpoint in Côte St.Luc. Later that night, a second checkpoint was held in LaSalle. MADD Mary’s Harbour Community Leader Jackie Rumbolt has organized the Christmas Parade in her community for the past 12 years. Citizens from Mary’s Harbour and surrounding communities gather to watch the parade. This year Jackie handed out MADD Canada materials including red ribbons and wallet cardholders.

MADD Charlotte County Chapter members and St. George NB RCMP participated in the annual Project Red Ribbon launch police checkpoints. The rainy weather did not dampen the spirits of this cheerful group as they gather under their umbrellas.

MADD Chapters in Prince Edward Island teamed up with Maypoint RCMP to conduct checkpoints just outside the City of Charlottetown. Hundreds of motorists were given red ribbons, Campaign 911 information and a safe driving holiday message.

MADD East Hants Community Leader volunteers organized the annual December checkpoints with Enfield RCMP and First Responders from participating communities. During this one-day blitz, 2019 calendars, red ribbons and candy canes were given out to motorists in Walton, Kennetcook, Rawdon and Enfield.
