1.1.2. Responsibilities for structural business statistics

In the Federal Republic of Germany, official statistics are generally managed by the statistical offices of the Federal Republic and of the Federal States (Laender). The main responsibilities of the Federal Statistical Office, the Statistisches Bundesamt (StBA), include preparing the methodological and technical bases for all federal statistics (to ensure that federal results are uniform), coordinating statistics, one set with another, and compiling, publishing and presenting federal results. The statistical offices of the federal states (Laender), on the other hand, are responsible for carrying out surveys and collecting and editing data for federal statistics in a uniform fashion, working to deadlines and to conduct statistics for state (Laender) purposes. In the StBA, industrial statistics are handled by Division IV. Services statistics are handled by Division VII “Services, Agriculture, Environment ", and Division V "Prices, Foreign trade, Transport, Earnings".

General statistical law

Since the provisions of Article 73 No 11 of the Basic Law make the Federation responsible for statistics for federal purposes, provisions governing the overall organisation of federal statistics and the legal procedures and substantive law applying

to them were combined for the first time in the Law on Statistics for Federal Purposes of 3 September 1953 (Bundesgesetzblatt [Federal Law Gazette] - BGBl.I, p. 1314).

Right to collect data in general

The Federal Statistics Law (BStatG) of 22 January 1987 (BGBl.I, p. 462 and p. 565) sets out basic rules governing the arrangement, preparation and implementation of surveys for federal statistics. The Federal Government is also responsible for meeting the data requirements of supra- and international organisations. Alongside the rules governing surveys in the BStatG, there are special legal provisions (acts and regulations) governing the individual sets of federal statistics.

The BStatG attaches particular importance to the rules governing statistical confidentiality (paragraph 16 BStatG).

Right of access to administrative data

Whether official statistics may use administrative sources and, if so, in what form, depends on the regulations which apply in each case. Examples of public administration fields for which secondary statistics (Sekundärstatistiken) are available include: — the registration of births, marriages and deaths and of residence; — employment and social services; — housing and construction; — taxation and customs; — the judiciary and administration of justice. Other bodies whose data can be used for the compilation of registers include chambers of trade and industry, chambers of craft trades and registry courts. The use of statistical information is regulated by:

special acts covering statistics. Taxation statistics for example are governed by the Taxation Statistics Act of 11 October 1995

legislation concerned with other subjects but containing statistical provisions. For example, statistics on naturalisations are governed by paragraph 36 of the Nationality Act of 22 July 1913.

Insofar as administrative agencies of the Federation are collecting data pursuant to non-statistical legal or administrative provisions, or where such data are accruing in another way, the Federal Statistical Office may entirely or in part be entrusted with the statistical processing of these data (paragraph 8 of the BStatG).

1.3.1. Activity classifications

Name of classification

Klassifikation der Wirtschaftszweige, 2003 edition (WZ 2003). In addition, the GKZ 2003 which is a classification derived from the WZ 2003 is used for value added tax statistics.

The WZ 2003 was created in 2003.

Date of introduction for structural business statistics

The WZ 2003 has been used for structural business statistics since 2003 reference year, for trade statistics since 2004 reference year.

Compatibility with NACE Rev. 1.1, existence of a 5th or 6th digit

WZ 2003 is an extension of NACE Rev. 1.1. The alphanumeric system of NACE Rev. 1.1 was taken over with two exceptions and a fifth level was added for national purposes (the fifth level is called a Subclass). The exceptions are: Class 52.48 of NACE Rev. 1.1 was split into classes 52.48 and 52.49 in WZ 2003. Class/group 64.2/64.20 of NACE Rev.1.1 was recoded into class/group 64.3/64.30 in WZ 2003.

Unit responsible for classifying activities

For the value added tax statistics the classification is made by the tax authorities. For the employment statistics the classification is made by the Federal Employment Agency.

Variable used for identifying principal and secondary activities

The principal activity of an enterprise is normally determined by its value added. If there are no data on this, the net production value or the census value added are used as approximations, or the number of persons employed is used as a substitute criterion. Secondary activities are determined in the same way as the principal activity. Ancillary units are classified with the principal activity.

The regional classification is known as the "Amtliche Schlüsselnummern und Bevölkerungsdaten der Gemeinden und Verwaltungsbezirke in der Bundesrepublik Deutschland" (Official code numbers and population data of municipalities and administrative districts in the Federal Republic of Germany). The latest version dates from 1993. The administrative classification is used as the statistical classification.

There has not been a comprehensive register for statistical use in the past, but one has been in place since the middle of the 1999 calendar year. Nevertheless, specific registers related to the population of specific statistical domains such as industrial enterprises. Wholesales and retails sales or agricultural enterprises have been used. The business register is currently being completed, but there are still some quality issues to be solved.

It varies from section to section: since the early 70ths the BR (former “Kartei im Produzierenden Gewerbe” is used for production industries, since the 90ths in sales section and since end of 90ths in service sector.

1.5.4. Register updating

List of main sources of information for updating

The business register is being compiled partly from files already available on production industries and partly from data from major censuses undertaken or planned (1993 census of distributive trade, hotels and catering, 1995 census of crafts, 1996 census of industries comparable to crafts). The Regulation also provides for data to be taken over from external administrative files.

The Statistical Register Law enables data from the files of the tax authorities, the Bundesanstalt für Arbeit (Federal Labour Office), chambers of commerce and industry and chambers of crafts to be accessed and used.

This is done since 1999.

The following sources will also be used to update the register: — statistical surveys; — registration forms submitted to local authorities for registrations; — deregistrations and modifications of businesses and their local units; — administrative registers.

1.6. Explanation of the main sources of data

The annual industrial statistics are collected through ten questionnaires, which differ from each other in respect of the activities covered, the reporting unit or the variables (investment and cost structure). There are surveys for three separate activity regroupings: 1. mining, quarrying and manufacturing; 2. electricity, gas and water supply; 3. construction. In services surveys are carried out in the distributive trades sector and hotels and restaurants. In addition use is made of administrative data from value added tax. Employment data is taken from employee-based employment statistics.

The number of employees can be compiled from this source, as far as they are employees in employment and liable to pay social security contributions. The reporting group includes all employees, including those undergoing occupational training, who are liable to pay contributions to health insurance, care insurance, pensions and/or unemployment insurance under the Labour Promotion Act or for whom contributions towards pensions have to be paid by employers. This delimitation means that as a general rule all manual and non-manual workers (including those undergoing occupational training and also those who are “marginal” part-time employees) are covered by social security. Those not obliged to pay social security contributions include the self-employed, unpaid family workers and civil servants.

Under insurance law, gainful employment is designated as "marginal" employment or "marginal" self-employment if it is exercised only "in the short term" or "remuneration is marginal". Gainful employment counts as:

short-term when, by its nature or in accordance with a prior contract, it is for a maximum of two months or 50 working days during the course of a given year;

marginally remunerated when the remuneration during the month is regularly less or equal than an amount of 400 €.

Additional to the regular employees covered by social insurance only those marginal employees of the last case are included in the employment statistics.
