AMENDMENT NO. 4 TO PROFESSIONAL SERVICES AGREEMENT This Amendment No. 4 to Professional Services Agreement (“Amendment”) is between NorthStar Engineering (“Consultant”) and Sutter County, a political subdivision of the State of California (“County”). This Amendment modifies the Professional Services Agreement entered into on March 28, 2017 between Consultant and County, and which is attached to this Amendment as Attachment 1, Amendment No. 1 which is attached to this Amendment as Attachment 2, Amendment No. 2 which is attached to this Amendment as Attachment 3, Amendment No. 3 which is attached to this Amendment as Attachment 4 and collectively referred to as the “Agreement”. RECITALS A. The parties to this Amendment entered into the Agreement for preparation of construction documents, environmental studies and environmental permit applications for the Fortna Road Bridge Replacement Project (18C-0133); and B. The parties now desire to increase the completion time of the Agreement. NOW, THEREFORE, THE PARTIES MUTUALLY AGREE AS FOLLOWS: The Agreement shall be modified as follows, effective November 19, 2019: 1. Scope of Work: Section 1, Exhibit “A” of the Agreement shall be modified to include the following Additional Work Authorization #2: Northstar will perform Bid and Construction Support Services, Regulatory Permit Compliance, Site Preparation and Materials Testing with the help of their subconsultant NV5. 2. AMENDMENT NO. 4 TO PROFESSIONAL SERVICES AGREEMENT

in Exhibit “A” shall be provided to the County, within ONE-THOUSAND ONE-HUNDRED FIFTY (1150) days of receipt of the notice to proceed unless extended by mutual written agreement of the parties. Said time period shall not include the time beyond that allocated in Exhibit “A” that Consultant must wait for the provision of data or review by the County. The term of this Agreement shall be from March 28, 2017 to MAY 30, 2020 UNLESS THE Agreement is terminated prior there to pursuant to the provisions of section 18 of the Agreement. All other terms and conditions of the Agreement not modified by this Amendment remain in full force and effect.

EXHIBIT “A” ‐ ADDITIONAL SCOPE OF SERVICES  CONSTRUCTION SUPPORT SERVICES COST (NSE# 17‐007) 

 

Summary

Due to the fact that the issuance of the Notice to Proceed will be issued after the date upon which giant garter snake (GGS) exclusionary methods should be in place, NorthStar, acting as the County’s Biological Monitor will provide the necessary services prior to the initiation of ground disturbing activities so as to maintain compliance with forthcoming regulatory permits. All other tasks will be completed as appropriate throughout the construction process.

Task 1 - Bid and Construction Support

NorthStar proposes to provide both Biological Monitoring and Avoidance and Minimization Measures (AMMs) assistance during the contractor bidding period as well as support during the project’s construction phase. Once the contract documents are complete, NorthStar shall be available for consultation and clarification of Project plans, specifications and contracts pertaining to environmental and biological compliance. The services shall also include site visits with contractors as necessary as the County prepares and distributes any necessary addenda.

Once the construction begins, NorthStar anticipates conducting field visits, change order review and comment, responses to Requests for Information (RFI) from the contractor and the incorporation of the project as-built drawings from the contractor into electronic design drawing files. Documents will be provided in Autodesk AutoCAD so the final electronic drawing files will be provided in “.dwg” format.

Task 2 - Regulatory

NorthStar will provide the following regulatory compliance and oversight activities:

Field Inspection (Structural) / Compliance: A NorthStar engineer will conduct on-site inspections to ensure that the bridge is being constructed to design specifications.

Storm Water Inspection / Write Up: Once ground disturbing activities begin, a NorthStar biologist and/or a storm water specialist will conduct inspections both weekly and following rain events until 75% vegetation cover is achieved. All storm water inspections will be documented into a report as per Water Pollution Control Plan requirements.

Biological Monitoring Services: NorthStar biologists will serve as the County biologist providing biological monitoring services for the duration of the project.

o As part of this work NorthStar will o Submit resumes to regulatory agencies to confirm qualified biologists. o Prepare permit AMMs and CEQA MMRP monitoring plan to be provided to contractor. o Ensure compliance with all AMMs and mitigation as identified in regulatory permits and CEQA

document including: Worker awareness training and documentation; Pre-, post-, and daily construction monitoring; Record-keeping and weekly, monthly and annual reporting as applicable. Close-out activities of project activities.

Exclusionary Monitoring: Following the installation of the exclusion fencing a NorthStar biologist will perform weekly monitoring of the fencing, supported by daily drive-by by county staff, to

assure that no wildlife is trapped. If county staff observes trapped wildlife, they will contact NorthStar immediately to proceed with safe/legal removal/relocation of trapped animal. Any deficiencies in the exclusionary devices will be noted in weekly reports and NorthStar will coordinate or initiate repairs as needed to ensure effective exclusion.

Task 3—Materials Testing

NorthStar is familiar with CalTrans 2015 Standard Plans and Specifications, AASHTO Design Standards, and is certified in CalTrans material testing standards. Testing will be compliant with all current requirements. NorthStar will subcontract NV5 to perform testing of construction materials.

SUBTASK 1-Earthwork Engineering and Testing

In general, Earthwork Observation and Testing Services will be performed as specified in the 2016 CBC and approved plans and specifications. NV5’s responsible engineer and engineering technicians will perform the following CQA engineering services:

· Review the approved plans and specifications, meet and discuss requirements with owner, contractor, construction managers, architect and other team members.

· Review and approve contractor submittals associated with earthwork grading operations. · Observe finished clearing and grubbing operations for conformance with geotechnical

recommendations. · Observe and evaluate the exposed native subgrade soil surface for relative competency and

stability. · Confirm foundation excavation embedment, depth, soil materials for conformance with

geotechnical report. · Obtain representative bulk soil samples of the subgrade soil and borrow soil for laboratory

compaction curve testing, consistent with the American Society for Testing and Materials (ASTM) D1557 guideline procedures.

· Observe moisture conditioning, placement and compaction of the subgrade soil and subsequent engineered fill soil lifts.

· Perform in-place field moisture and density tests on testable materials consistent with the ASTM guideline procedures for density and moisture content, to determine the percent compaction relative to the ASTM D1557 maximum dry density and optimum moisture content.

· Observe final proof rolling of building pads and finished subgrade surfaces. · Testable Class II AB Material CQA: Perform in-place field moisture and density tests on

testable materials including the compacted subgrade soil and each subsequent engineered fill soil lift (layer), consistent with ASTM guideline procedures for density and moisture content to determine compaction relative to the ASTM D1557 maximum dry density and optimum moisture content.

· Perform in-place field density testing on asphalt concrete consistent with ASTM, AASHTO and ASTM guidelines procedures, per the approved plans.

· Prepare a site plan that shows the approximate limits of the building pads and the approximate compaction test locations.

· Prepare daily field reports to document the following CQA observation made during each of our site visits: weather conditions; earthwork contractor’s work activities; work progress; completed work products; equipment used and personnel; CQA compaction testing and other pertinent CQA information.

SUBTASK 2 – Special Inspectional and Structural Testing

· In general, Special Inspection and Testing services will be performed as specified in the 2016 CBC and approved plans and specifications. NV5’s certified special inspectors and material testers will perform the following services:

· Provide periodic special inspection of reinforcing steel for foundations. · Provide periodic special inspection during the placement of structural concrete including

review of batch tickets for confirmation of approved concrete mix design, placement and consolidation of cast-in-place concrete of each day’s concrete pour.

· Perform testing during casting of concrete for the foundations, structural slabs, and exterior traffic rated cast-in-place concrete, as required. Concrete special inspection will be limited to sampling and testing fresh concrete in accordance with ASTM C39. Field tests will include slump, air content, unit weight for lightweight concrete and temperature measurements. For foundations, sets of 5 cylinders will be cast for each day’s placement or per each 50 cubic yards. For slab-on-grade flatwork, sets of 4 cylinders will be cast for each day’s placement or per each 5,000 square feet. Compressive strength will be tested at 7 days (1 cylinder) and 28 days (2 cylinders) with one hold cylinder. If shorter hold time compressive strength tests are required, such as 3-day, 5-day or 14-day, additional cost per each test will be incurred.

· Prepare daily field reports to document the observation made during each site visit: weather conditions; contractor’s work activities; contractor’s workmanship; work progress; completed work products equipment used and personnel; testing and other pertinent CQA information.

SUBTASK 3 – Engineering Oversight

NV5’s project manager will provide oversight of the CQC services performed, including review of contractor’s submittals, change orders and/or requests for information submittals, and attendance at project meetings, as needed. NV5’s geotechnical engineer will oversee and certify the earthwork and foundation excavations in accordance with the approved plans, and project manual. NV5’s lab engineer will oversee and certify the structural materials testing performed in accordance with the approved plans and project manual.

Task 4 - Site Preparation

NorthStar environmental staff will prepare the site for upcoming construction by excluding areas that could be utilized as habitat and removing desirable habitat components (e.g. vegetative cover) from within project work area boundaries. Installation of the exclusion fencing will be based on the submitted Exclusion Fencing Map (component of Biological Assessment), will include the installation of exclusion fencing with one-way exit cones, and will be conducted under the supervision of a USFWS qualified biologist. Materials and equipment (i.e. silt fencing, one-way exit cones, and trencher) for installation will be acquired by NorthStar and reimbursed by the County. Additionally, NorthStar will compile a "Documentation of Exclusion Efforts” report, as typically required by regulatory permits, which will include a written report and corresponding photo package. A pre-construction GGS survey will be conducted prior to the initiation of ground disturbing activities.

All exclusionary measures and associated activities will be documented and included in subsequent construction and environmental compliance and monitoring reporting documents, including, but not limited to, the California Environmental Quality Act (CEQA) Mitigation and Monitoring Reporting Plan (MMRP). California Department of Fish and Wildlife 1600 Lake and Streambed Alteration Agreement, Clean Water Act 404 and 401 permits and Endangered Species Act Section 7 informal consultation.
