College of Engineering, Pune (COEP) invites tenders for following Interior and Allied

works in Academic Complex on item rate basis from reputed qualified contractors.

The interested bidders can apply to the director COEP to purchase blank tender forms

along with necessary cost from 16th August 2011 to 29th August 2011. The pre bid

conference will be held on 24th August 2011 @ 11.00 hrs. in the conference hall, adjacent

to director‟s office. The last date of submission is 30th August 2011 upto 12.00 noon as

stated in the bid documents. The right to accept or reject any or all offers is reserved by

SECTION –A

1) Scope of works The Director, College of Engineering, [An Autonomous Institute Govt. of Maharashtra]

Shivajinagar, Pune .411005, (Employer) invites the tenders for the Interior and Allied Works:

Academic Complex Building: Acoustics & Interior as detailed in the table given bellows

The successful bidder will required to complete the work by the intended completion period specified above.

2) Qualification of the bidder: - The bidder shall provide qualification information which

shall include :-

a) Total acoustical works executed as well as under execution, for each year of the last 3 years for works similar in nature of the present work.

b) Contractor should be registered contractor, registered under Government / Semi-government organization / Public undertakings. Reputed Contractors who dose not have a formal registration with any government body but having excellent proven work experience in this field can also be eligible.

c) Copy of Income tax return for previous 3 years. d) Details of any litigation, current or during the last 3 years in which the bidder is involved,

the parties concerned and disputed amount in each case. e) A DD of EMD specified, drawn on any nationalized or scheduled Bank, against EMD in

the name of „The Director, College of Engineering, Pune‟ should be deposited with the Technical bid.

3) Qualification criteria : -

a) Bidder should have satisfactorily executed, in last three years, including current projects, as a main contactor, at least three similar assignments of auditorium seating 250 or more & value not less than Rs. 35,00,000/- or at least two similar assignments of auditorium seating 500 or more & value not less than Rs. 50,00,000/- or & one similar assignment of auditorium seating 900 or more & value not less than Rs 75,00,000/- . self certified Xerox copy of the certificate / P. O. from the concerned should be attached

b) Bids from Joint ventures are not acceptable.

c) Even though the bidders are pre-qualified, they are subject to be disqualified if they have: -

made misleading or false representations in the forms, statements and attachments submitted in proof of the qualification requirements; and/or

record of poor performance such as abandoning the works, not properly completing the contract, inordinate delays in completion, litigation history, or financial failures etc.; and/or

Participated in the previous bidding for the same work and had quoted unreasonably high bid prices and could not furnish rational justification to the employer.

d) The tenders will be evaluated on techno-commercial basis by giving 30% weight to experience & technical expertise of the contractor & 70% weight to bid price. The formula & evaluation procedure is given in Annexure 3.

4) Bid price

a) The contract shall be for the complete work as described in the bill of quantities, drawing and technical specifications.

b) Corrections, if any, shall be made by crossing out, with signature. c) All duties, taxes and other levies involved under the contract shall be included in the

total price except Service tax & Octroi. Service tax if any should be quoted separately. Employer will give Octroi exemption certificate(s) to the bidders if required.

d) The rates quoted by the bidder shall be fixed for the duration of the contract and shall

not be subject to adjustment on any account. e) The rates should be quoted in Indian Rupees.

f) The bidder shall bear all costs associated with the preparation and submission of his

Bid, and the Employer will in no case be responsible & liable for those costs.

g) The Bidder, at the Bidder‟s own responsibility and risk & cost, is encouraged to visit and examine the Site of Works and its surroundings and obtain all information that may be necessary for preparing the Bid and entering into a contract for the Works.

5) Submission of Tenders a] Each bidder shall submit only one tender. Submission of more than one tender by the same bidder shall automatically lead to disqualification of the bidder. b] The tender submitted by the bidder shall comprise the following two different envelops put together in a large envelope: -

o Part 1: Technical Bid: Qualification documents along with EMD as specified. o Part 2: Commercial bid.

c] The two parts of the tender (Technical bid & Commercial bid) should be sealed in two separate envelopes & both of them to be sealed in one big envelope, addressed to The Director, College of Engineering, Pune (Owner) All The envelopes will also bear the following identification :-

“Technical bid” on technical bid envelope & “Commercial bid” on commercial bid envelope

Put the tender ref number at the right hand corner of the envelope.

„Do not open before‟ & the date of tender opening. In case of not finding all required identifications on all or any of the envelopes, the bidder will be disqualified without giving any reason thereof. d] Tender must be received in the office of the Director, College of Engineering, Shivajinagar, Pune- 411005. (Employer) not later than the time and date given in the notice. If the specified date is declared a holiday, Tenders shall be received up to the appointed time on the next working day.

e] Any tenders received by the Director, College of Engineering, Shivajinagar, Pune- 411005 after the deadline for submission of tender will be rejected & no communication in this regard will be made. 6) Validity of Tenders

Tender shall remain valid not less than 45 days after the deadline date specified for submission.

7) Opening of Tenders

Tenders will be opened in the presence of consultants, bidders or their representatives who choose to attend on the date & time and the place specified in the letter of invitation.

Information relating the evaluation of tenders & recommendations for the award of contract shall not be disclosed to bidders or any other persons not officially concerned with the process until the award to the successful bidder is announced.

8) Evaluation of Tenders

The owner will evaluate & compare the tender determined to be substantially responsive i.e. which a) Meet the technical qualification & evaluation criteria specified.

b) Are properly signed

c) Conform to the terms and conditions, specification & drawing without material deviations.

9) Award of contract

The Employer will consider awarding the contract to the bidder whose tender has been determined to be substantially responsive and who meets the specified qualification criteria and has scored the maximum points in evaluation system. Notwithstanding above, the employer reserves the right to accept or reject any Bid, and / or to cancel the Bidding process and reject all the Bids, at any time prior to the award of contract, without thereby incurring any liability to the affected bidder or bidders or any obligation to inform the affected bidder or bidders of the grounds for the Employer's action.

10) Performance Security

Within 15 days of receiving letter of acceptance, the successful bidder shall deliver to the Director, College of Engineering, [An Autonomous Institute of Govt. of Maharashtra], Shivajinagar, Pune 411005, the performance security (Either a bank guarantee or a bank draft in favour of the employer) for an amount equivalent of 5% of the contract price. The performance security shall be valid till the expiry of the period of maintenance of the work, specified in the clause 12.

11) Period of Maintenance:

The “Period of Maintenance (defect liability)” for the work is Twenty-four months from the date of taking over possession. During the period of maintenance; the contractor will be responsible for rectifying any defects in working. This will be done by the contractor at his own expenses.

12) SPECIAL CONDITIONS

1. For Technical data / detail & specifications if in doubt /unclear /mismatch, the same are

to be clarified with the Acoustic Consultants. 2. The bills of quantities indicated in this tender are approximate & are liable to change at

the discretion of the employer / Consultants. Any variation in quantities will not be applicable for change/modification in quoted rates.

3. The Contractor will be responsible for the due & proper execution of all the works as per the terms & conditions. The contracting agency should study the design details and understand clearly, prior to quoting. The responsibility of performance will be with the Contractor.

4. The contractor may have to use additional supports, materials, accessories, equipments, hardware, labor etc for proper execution & performance, required stability

of complete system, fulfilling interior design requirements, following best engineering practice, executing the additional instructions given by the consultants or employer during the work. No additional cost will be paid for this.

5. The employer reserves the option to allot the work partly or totally to single or different Contractors. The employer also reserves the right to supply some of the material. The scope of work for such items will be limited to erection only.

6. The employer / Consultants reserve the right to call explanations from any bidder, regarding the calculations / clarifications on any details. They may also visit the office of the bidder / various works carried out by him. The necessary cooperation in this regard is envisaged form the bidder.

7. The bidder shall make no changes in the tender form or in the specifications & schedule. The bidder may however submit alternative proposals, in separate enclosures, indicating any variation whichever they feel is beneficial. Calculations, salient features, advantages, economics & drawings shall back the same. Acceptance or rejection of such alternate proposal will be the right of the employer & consultants.

8. The consultant / their representatives shall have access to the workshop /Manufacturing facilities of the bidder and or successful contractor so as to assure themselves of the quality of the material & workmanship.

9. The measurements given in drawings are subject to verification at site. In case of any discrepancy, the same shall be brought to the notice of both, the engineer in charge & Consultants for the decision.

10. The paneling & ceiling will be measured for payment as finished paneling only. Frame work taken up to ceiling or wall for supports will not be measured & will not be paid extra.

11. The mock up : a) The contractor shall erect mock up of each type of paneling or repetitive item &

proceed with final work after getting approval in writing from the consultants. b) The disapproved mock up unit shall be removed by contractor, immediately. c) No extra cost will be paid to the contractor for erection of any such mock up,

modification of it or for removal of mock up. 12. In order to complete the work, within the time limit of the tender, the contractor may

have to work in more than one shift. 13. In case of not availability of specified materials in the market, the contractor may

substitute by equivalent materials of same quality & properties, after duly approved by the Consultant.

14. In case of any controversy, the decision of the employer /consultant shall be final & binding on contractor.

15. Verbal instructions given by the consultant, if any, will be confirmed in writing by the contractor within 7 days & before execution thereof.

16. At least one engineer, of the contractor, capable of understanding all the technical points & act accordingly, should be available on site all the times.

17. The contractor along with his technical staff should be present at site at the time of site-visit of the Consultants & whenever needed.

18. In case of conflict in specifications or terms, between tender, drawings, general engineering practice, national & international codes, more stringent among all will be applicable.

13) TECHNICAL SPECIFICATIONS

1. All the materials to be used for the work of ceiling / paneling shall be of the best quality confirming to relevant I. S. code & approved by the Consultants.

2. All the exposed timber shall be of as per sample approved, with moisture contain as per I.S. standards & well seasoned, free from knots, cracks, warps, and other defects and shall be treated against white ants with Aldrex – Aldrin or equivalent chemicals, as per specifications of the manufacturers (minimum 2 coats).

3. All the internal timber frame shall be 1st quality, Salwood, well seasoned free from knots, cracks, wraps, and other defects and shall be treated against white ants with Aldrex – Aldrin or equivalent chemical (minimum 2 coats) as per approved sample.

4. Rate of all items include the cost of finishing timber with synthetic enamel paint / spirit / wax polish /melamine as specified to match with surrounding surface. The decision of the Consultants on the nature of finishing shall be final and binding on the contractor without any extra cost.

5. All particle boards / ply sheets both marine and veneered block boards (Phenol bonded) will be water proof quality with ISI mark ISO – 9001 of approved 1st class manufacturers like Indian Plywood, Green Valley, Euroboard, Goyal, products / Marino ply or equivalent. As per I.S. 710.

6. Glue shall be Fevicol / Vamicol or equivalent brand and approved product. All glue joints shall be pressed / till glue has dried thoroughly and confirming to IS 848.

7. All the edges shall have teak wood lapping of 6mm thick. 8. The contractor shall obtain the approval regarding shade, quality, type & make of color

in respect of paint and polish, carpet or fabric from the Consultants before purchasing. The contractor, if required, shall produce the reasonable number of samples and put up such samples on wall, partitions, and furniture as directed by the Consultants.

9. All unexposed surface of paneling / ceiling will have coat of primer and / or polish as specified or directed by the Consultants.

10. Laminates if any, to be used in paneling shall be of 1.5mm thick from ISI mark ISO – 9001 of approved 1st class manufacturers

11. The frame work for false ceiling / paneling etc. shall be laid in true line, level in both directions; the wooden scantlings shall be straight and fixed rigidly with screws of appropriate size, at appropriate distance as directed at required level. The framework shall be painted with two coats anti – termite solution or Black Japan before the same is covered with ceiling / paneling boards etc.

12. The G. I. suspenders for false ceiling shall be straight and fixed rigidly to R.C.C. structures / slab / roof truss / purlin or wood support etc.

13. All the G.I. suspenders, ceiling sections, perimeter channels, intermediate channels, ceiling angles, connecting clips, soffit cleats etc. used for wall paneling & ceiling should be as specified by the manufacturers like „India Gypsum Ltd‟ (GS-MFSC-4.1) Or Anutone acoustics Ltd. & as per directions given by the Consultants.

14. For ceiling & paneling work, filling joints, finishing & painting should be done as per the manufacturers specifications & directions given by the Consultants.( I.S. 2542 & 2095)

15. The Resin bonded fibre glass wool insulation shall be made of fine, long inorganic glass fibers bonded by high temperature resin and shall have energy conserving and sound insulation properties. The glass wool made of UP Twiga Fibreglass Ltd. Or any

equivalent product and confirming to I.S. 8183 specification will be of required density as per B.O.Q.

16. Agro-wood paneling, polishing, should be done as per the directions of the manufacturer Andaman Timber Ltd. Polish should be applied after cutting & to all the surfaces.

17. The fabric to be used should be of required acoustical grade & as per approved samples.

18. All the hardware to be used in furniture paneling and partitions will have to be approved from the Consultants.

19. Hardware fittings shall be from approved manufacturers and shall be confirming to respective I.S.I. specifications.

20. Paint shall be Asian / ICI / Garware / Jenson & Nicolson or equivalent. The rates of items shall include the cost of primer, preparation of proper surface by sand papering, filling with required grade putty, two coats of paints and removing of stains on floors, walls, ceiling and other movable items.

21. Different types of paints may required for different paneling or sections of paneling & ceiling & contractor should follow the specifications & directions given by the Consultants about this.

22. Melamine polish – preparation of surface – filling grain completely with putty made of whiting powder with required strainer and Acrypol N 83 (Pidilite Ind. Ltd.) Sand & Surface mildly with 120/150 Emery paper softer drying for 15 min. polishing – 1. Mix Acrypol SP 85 matt in equal proportions. Spray the mixture uniformly with a spray gun at a pressure of 30 psi. 2. Allow it to dry for 6 – 8 hrs. 3. Sand surface with 120 / 150 Emery paper. 4. Repeat 1, 2 and 3 for two more coats up to required surface or approved by the Consultants.

23. The rates quoted for various items included in this tender such as wooden framework, false ceiling, paneling etc. shall be inclusive of the cost of necessary framework, scaffolding, lifting of materials etc. As the work is proposed to be executed at various heights, no extra claim shall be entertained on account of execution of work at various heights / floor. The measurement of items included in this work shall not be taken and paid separately for different floor levels and varying heights.

ARTICLES OF AGREEMENT 1) This deed of agreement is made in the form of agreement on _______________day

__________________ month _____________201___________, between (the referred to as the first party) and _____________________ (Name of the contractor), S/O ___________________ resident of _________________(hereinafter referred to as the second party), to execute the work of construction of _____________________ (hereinafter referred to as works) on the following terms & conditions.

2) Cost of contract

The total cost of the works (hereinafter referred to as the “total cost”) is Rs._______as reflected in Annexure -1.

3) Payments under its contract:

Payments to the second party for the work will be released by the First party in the following manner:-

On pro-rata basis as per the R. A. bill(s) of the contractor. Payable amount in each R. A. bill should not be less than Rs. 15,00,000

: As per the certified bill of the contractor based on the measurements along with certification of completion to the satisfaction by the First Party

On completion of the work &submission of the completion report approved by the employer (i.e final Bill)

4) Payment will be made by the first party: a) On the second party submitting an invoice for an equivalent amount along which the

certified copy of the bill of quantities & measurements; b) On certification of the invoice by the engineer &/ or consultant nominated by the first party

with respect to quality of works in the format Annexure - 2; and c) Necessary deductions towards taxes, govt. dues, and security deposits will be done at

every payment. 5) Notice by Contractor to Engineer

The second party, on the works reaching each stage of construction, issue a notice to the first party or the Engineer nominated by the first party (who is responsible for supervising the contractor, administering the contract, certifying the payment due to the contractor, issuing & valuing variations to the contract, awarding extensions of time etc.) to visit the

site for certification of the stage completion. Within 15 days of the receipt of such notice, the first party or the contractor nominated by it, will ensure issue of stage completion certificate after due verification.

6) Completion time

The work should be completed in 90 days from the date of this Agreement. In exceptional circumstances, the time period stated in this clause may be extended in writing by mutual consent of both parties.

7) If any of the compensation events mentioned below would prevent the work being completed by the intended completion date, the first party will decide on the intended completion date being extended by a suitable period :

a. The first party does not give access to the site or a part thereof by the agreed

period. b. The first party orders a delay or does not issue completed drawing, specifications

or instructions for execution of the work on time.

c. Ground conditions are substantially more adverse than could reasonably have been assumed before issue of letter of from information provided to second party or from visual inspection of the site.

d. Payments due to the second party are delayed without reason.

e. Certification for stage completion of the work is delayed unreasonably.

8) Any delay on the part of the second party in completing the work within the stipulated period will render him liable to pay liquidated damages. @ 0.5 % of the total work value per weak which will be deducted from payment due to him. The first party may cancel the contract and take recourse to such other action as deemed appropriate, once the total amount of liquidated damages exceeds 5% of the contract amount. 9) Duties & responsibilities of the first party a) The first party shall be responsible for providing regular & frequent supervision & guidance to the second party for carrying out the works as per specifications. This will include but not limited to, written guidelines & regular site visit of the authorized personal of the first party, for checking quality of material & work, to ensure that it is as per the norms. b) The first party shall give 3 sets of drawing, specifications & guidelines to the second party for the proposed work. c) Possession of the site will be handed over to the second party within 10 days of signing of the agreement.

d) The engineer or such other person as may be authorized by the first party shall be meeting once in a week where a second party or his representative at site will submit the latest information including progress report & difficulties if any, in the execution of the work. The whole team may jointly inspect the site on a particular day to take stock of activities. e) The engineer shall record his observations/instructions at the time of his site visit in a site register maintained by the second party. The second party will carry out the instructions & promptly rectify any deviations pointed out by the engineer. If the deviations are not rectified, within the time specified in the engineer‟s notice, the first party as well as the engineer nominated, may instruct stoppage & get the work rectified at the cost of the second party. 10 Duties & Responsibility of the second party. The second party shall:

a) Take up the works & arrange for its completion within the time period stipulated in clause 5;

b) Employ suitable skilled persons to carry out the works;

c) Regularly supervise & monitor the progress of work;

d) Abide by the technical suggestions / direction of supervisory personal including

engineers etc. regarding the work;

e) Be responsible for bringing any discrepancy to the notice of the representative of the first party & seek necessary clarification;

f) Ensure that work is carried out in accordance with specifications, drawing, as per

best engineering practice & within the total of the contract amount without any cost escalation;

g) Keep the first party informed about the progress of work;

h) Be responsible for all security & watch & warned arrangements at site till handing

over of the building to the first party

i) Maintain necessary insurance against loss of material / cash etc. or workman disability compensation claims of the personal deployed on the works as well as third party claims.

j) Pay all duties, taxes and other levies payable, as per law under the contract (First

party will effect deduction from bill in respect of such taxes as may be imposed as may be under the law)

10. Variations / Extra Items The works shall be carried out by the second party in accordance with the approved drawing & specifications or directives from the engineer in –charge. However if, on account of site condition or any other factors, variations are considered necessary, the following procedure shall be followed:

a) The second party shall provide engineer with a tender for carrying out the variation

when requested to do so by the engineer .The engineer shall assess the tender which shall be given within seven days of the request before the variation is ordered.

b) If the tender given by second party is unreasonable, the engineer may order the

variation & make a change to the contract price which shall be based on engineer‟s own forecast of the effects of the variation on the contractor‟s costs.

c) The second party shall not entitled to additional payment for cost which could have

been avoided by giving early warning. 11. Securities The Performance Security shall be provided to the Employer no later than the date specified in

the Letter of Acceptance and shall be issued in an amount and form and by a bank or surety acceptable to the Employer, and denominated in Indian Rupees. The Performance Security shall be valid until a date 28 days from the date of expiry of Defects Liability Period [ 1 Year] and the additional security for unbalanced bids shall be valid until a date 28 days from the date of issue of the certificate of completion.

12. Termination 13.1) The Employer may terminate the contract if the other party causes a fundamental breach of the contract.

13.2) Fundamental breach of contract include, but shall not be limited to the following

(a) The contractor has stopped the work for 15 days & stoppage has not been authorized by the engineer.

(b) The contractor has become bankrupt or goes into liquidation other than for a

reconstruction or amalgamation;

(c) The engineer gives notice that failure to correct a particular defect is a fundamental breach of contact & the contractor fails to correct it within a reasonable period of time determined by the engineer.

(d) The contractor does not maintain a security which is required;

13.3) Notwithstanding the above, the Employer may term the contract for

convenience.

13.4) If the contract is terminated the contractor shall stop work immediately, make the site

safe & secure & leave the site as soon as reasonably possible. 14. Payment upon Termination 14.1 If the contractor is terminated because of a fundamental breach of contract by the contractor, the engineer shall issue a certificate for the value of the work done less advance payment received up to the date of the issue of the certificate, less other recoveries due in terms of the contract, less taxes due to deducted at sources as per applicable law. 14.2 If the contract is terminated at the Employer„s convenience, the engineer shall issue a certificate for the value of the work done, the responsible cost of removal of equipment, repatriation of the contractor„s personal employed solely on the works & the contractor‟s costs of protecting & securing the work & less advance payments received up to the date of the certificate, less other recoveries due in terms of the contract & less taxes due to be deducted at source as per applicable law. 15. Dispute settlement

If over the works, any dispute arises between the two parties, relating to any aspects of this Agreement, the parties shall first attempt to settle the dispute through mutual & amicable construction. In the event of agreement not being reached, the matter will be referred for arbitration by a sole Arbitrator not below the level of retired Superintending Engineer, PWD to be appointed by the first party. The Arbitration will be conducted in accordance with the Arbitration & Conciliation Act 1996. the decision of the Arbitrator shall be final & binding on both the parties.

Annexure 3 A. Selection Process:

The selection process will be Quality & Cost-Based Selection (QCBS) and will encompass

a two-part evaluation viz., (a) Technical and (b) Financial by the Evaluation Committee

specifically constituted for the purpose. Evaluation by QCBS will be based on weighted

average of the scores of Technical (30 %) and Financial Bids (70 %).

B. Technical Evaluation:

(1) Technical Bid will be evaluated by the Committee based on the point system on the

following parameters:

Maximum Points i. General background and overall credit / Profile of the Bidder

10 (Threshold: Minimum 10 years: 4 points and 1 addl. point for every addl. year, limited to max. 6 points) ii. Average turnover from execution of work by the agency during the last 3 years

20 (Threshold: Rs. 1 Cr.: 4 points and 2 addl. points for every addl. Crore of turnover, limited to max. 16 points) iii. Relevant Experience in execution of projects of Auditorium in the past three years for Complete & under construction projects 40

(Threshold: 1 project of Minimum 500 capacity: 10 points and, 2 addl. points for Every 150 additional seating Capacity, limited to max. 30 points).

iv. Manpower commitment, dedicated team and team leader comprising experts. Standards, credential and with Certification, prize , awards, etc. The team comprises like , project engineer, design consultant, quantity surveyor, electrical, fabrication, etc. 30

(Threshold: Min. 4 : 16 points and 3 addl. points for every addl. Expert/ credential, limited to max. 14 points)

Total Points 100

The Evaluation Committee will award points for each of the above parameters. A

minimum score of 70 in the Technical Bid will be required to qualify for opening of

Financial Bid. The decision of the Evaluation Committee on short listing the bidders,

who qualify technically, will be final & binding on all bidders.

C. Financial Bid Evaluation:

The financial bids of only those bidders, who qualify technically, will be opened and

evaluated by the Evaluation Committee. Financial evaluation will be based on maximum

100 points. Lowest Financial Bid will be awarded 100 points. Points for higher bids will

be reduced on pro-rata basis with reference to the lowest bid. An illustration of financial

D. Final Selection:

Final selection of the successful bidder will be Quality and Cost Based Selection. For

this, both the scores in the technical bid as well as financial bid will be combined to form

the basis for final selection. The combined score will consider 30 % weightage for

technical competency and 70 % for financial bid. An illustration of the combined score

is given below:

E. Post Selection

(i) The decision of the Evaluation Committee on the technical / financial evaluation

will be final. Financial bids of the unsuccessful bidders will be returned unopened.

(ii) The selected Bidder will be required to enter into a suitable agreement with

COEP , Pune.
