COMMONWEALTH OF PENNSYLVANIA vs. RICHARD SORENSEN

Criminal Law—Suppression of Evidence—Custodial Interrogation—Consent to Search—Warrantless Search.Defendant averred he was assaulted while he was leaving his employer with his

employer’s cash bags. He claimed the cash bags were stolen from him during the assault. He was treated at a hospital for wounds received during the averred assault. Police detec-tives came to the hospital and asked him questions about the incident. After he was released and while he was at home, detectives came to his home and asked to search his vehicle. He consented to the search. Evidence found in the vehicle established that he had in fact stolen his employer’s money. Defendant was charged with Theft by Unlawful Taking and Theft by Receiving Stolen Property.

Defendant moved to suppress the statements he made to police while he was being treated at the hospital as well as the evidence obtained in his vehicle. The Court denied defendant’s suppression motion.

The Court reasoned that the conversation at the hospital was not a custodial deten-tion because, among other reasons, defendant was not yet a suspect at the time. Addition-ally, any restraint on defendant’s movement at that time was solely a result of his medical treatment, not because of any actions by the detective.

As to the evidence obtained in the vehicle, the Court held that defendant’s voluntary consent to the search fell within an exception to the presumption that warrantless searches are unreasonable.

anthony, J., March 1, 2019. The defendant is charged in this case with one count each of Theft by Unlawful Taking and Theft by Receiving Stolen Property. On October 25, 2018, the defendant sought an extension of time to file Omnibus Pretrial Motions, which I granted. On November 5, 2018, the defendant filed an Omnibus Pretrial Motion, which included a motion to suppress evidence, a motion to suppress statements, and motion to suppress testimony relating to the opinions of the affiant and EMT personnel. A hear-ing was held on January 2, 2018, and this opinion follows.

FINDINGS OF FACT

On Tuesday, January 17, 2017, Detective Timothy Wagner of the Borough of Slatington Police Department was called to the

Turkey Hill on Main Street in Slatington, Lehigh County, Penn-sylvania for an assault. Wagner found the store manager—identified as the defendant, Richard Sorensen—on the ground by a vehicle. Wagner observed an abrasion and some blood on the right side of the defendant’s head. The defendant advised Wagner that as he was getting into his car, someone struck him in the head from behind and he lost consciousness. The defendant said he was car-rying four bank deposits in his coat pocket, which he was just about to remove when he was struck. When he awoke, the deposits were missing. He stated one of the deposits was from Saturday night that he took home with him because his night deposit box key was missing. The defendant was then transported to the hospital by EMT.

Detective Wagner went to Lehigh Valley Hospital to speak with the defendant. Wagner walked with the defendant and his wife as the defendant was being taken for an MRI. Still believing the defendant was a victim of a robbery, Wagner asked what hap-pened and for a description of the attacker. The defendant could not provide a description, but explained that he had taken a de-posit home with him when he realized his night deposit box key was missing. He stated he slept with the deposit under his pillow and then returned it to the Turkey Hill Monday morning. He in-dicated this deposit was one of the four he had with him when he was robbed.

Following his discussion with the defendant, Wagner spoke with the EMT that treated the defendant. The EMT advised Wag-ner that she did not believe the injury sustained by the defendant would have knocked him unconscious. Wagner also contacted bank personnel and was told the defendant called the morning of Janu-ary 17th to say he lost his key and would be in that morning to make a deposit. The bank representative advised that the defendant never called before to state he was making a deposit. The repre-sentative also told Wagner that ever since the defendant started working at the Turkey Hill, the store’s deposits have been short.

Detective Wagner subsequently viewed video surveillance from inside the Turkey Hill, which showed some inconsistencies with the statements made by the defendant. The video of Sunday,

January 15, 2017, shows the defendant taking a deposit from the store’s safe, placing it in a white bank bag, and leaving the store. The video of Monday, January 16, 2017, shows the defendant ar-riving to the store with the white bank bag, which appears to be empty. The defendant throws the empty bag on the floor near the safe and never places any deposit back in the safe. The video from Tuesday, January 17, 2017—the date of this incident—shows the defendant taking two deposits and placing them in his coat. The defendant did not use the white bank bag, which was still on the floor where the defendant put it on Monday.

After the defendant was released from the hospital, Detective Wagner spoke to him and asked the defendant if he could photo-graph the inside of his vehicle and look for any evidence of the robbery. The defendant consented and said his wife would unlock the car for him. Wagner met with the defendant’s wife, Erica, at the Turkey Hill and confirmed with her that he could photograph the inside of the vehicle. Erica said yes, and unlocked the car. As Wagner was looking in the car, he discovered that the center con-sole was locked and asked Erica about it. She advised she did not even know it locked, and then she entered the car and unlocked the console. Inside, Wagner saw a small safe. He asked Erica if she could open it, but she said she did not know the combination. Erica called her husband for the combination, but he said he could not remember it. Wagner seized the safe in order to secure a search warrant. On January 20, 2017, Wagner executed the warrant. Inside the safe was several piles of money bundled with rubber bands totaling $12,998.00 in U.S. Currency.

DISCUSSION

I. Motion to Suppress Statements at Hospital

It is well settled that Miranda warnings are required where an individual is subjected to custodial interrogation. Common-wealth v. Williams, 941 A.2d 14 (Pa. Super. 2008).

In determining whether a suspect is in custody, two discrete inquiries are essential: (1) an examination of the circumstances surrounding the interrogation; and (2) a de-termination of whether, given those circumstances, would a

reasonable person have felt that he or she was at liberty to terminate the interrogation and leave. ... [A] person is in custody for Miranda purposes only when he is physically denied his freedom of action in any significant way or is placed in a situation in which he reasonably believes that his freedom of action or movement is restricted by the interrogation. ...

Commonwealth v. Yandamuri, 639 Pa. 100, 127-28, 159 A.3d 503, 520 (2017). In other words, a detention becomes custodial if the conditions or duration of the detention become so coercive as to constitute the functional equivalent of an arrest. Commonwealth v. Ellis, 379 Pa. Superior Ct. 337, 356, 549 A.2d 1323, 1332 (1988). In making this determination, the totality of the circumstances must be examined. Yandamuri, supra at 128, 159 A.3d at 520. If an individual is not in custody during questioning, statements given do not need to be suppressed for lack of Miranda warnings. Id.

I find the defendant was not in custody when Detective Wagner spoke to him at the hospital. At the time, Wagner believed the defendant was a victim of a robbery and interviewed him in order to investigate the robbery. See Commonwealth v. Hanna, 267 Pa. Superior Ct. 15, 405 A.2d 1280 (1979) (suppression not required where defendant was free to leave because he was not yet considered a suspect and investigation had not yet centered on defendant to the exclusion of others). The defendant’s wife was present during the conversation, and Wagner did not restrain the defendant’s movements in any way. Commonwealth v. Fento, 363 Pa. Superior Ct. 488, 497-98, 526 A.2d 784, 789 (1987). To the extent the defendant’s freedom was restricted in any way, it was solely a result of his medical condition. Id. Finally, the defendant was not arrested before, during or at the end of the interview. Id.

Based on the totality of the circumstances, the defendant was not physically denied his freedom of movement in any significant way by Wagner or placed in a situation in which he could reason-ably believe that his freedom of movement was restricted by Wagner. As such, Miranda warnings were not required.

Additionally, I do not find any merit to the defendant’s allega-tion that his statements were involuntary due to his injury or medication he received at the hospital. Other than the self-serving

testimony of the defendant and his wife, there was no evidence to show that the defendant’s cognitive functions were impaired when he spoke with Detective Wagner. On the contrary, Wagner cred-ibly testified that the defendant responded appropriately to his questions and did not exhibit any signs of being incoherent.

II. Motion to Suppress Evidence From Vehicle

A warrantless search is presumptively unreasonable, subject only to a few well established exceptions. One such exception is voluntary consent. Commonwealth v. Bell, 871 A.2d 267, 273 (Pa.Super. 2005). Detective Wagner credibly testified that the defen-dant gave him consent, and there is no evidence to suggest the consent was not voluntary, see discussion supra, or that Detective Wagner coerced the defendant in any way.1 Notwithstanding this, even absent consent, Wagner was justified in searching the vehicle based on the automobile exception to the warrant requirement. Commonwealth v. Gary, 625 Pa. 183, 192, 91 A.3d 102, 107 (2014). “The prerequisite for a warrantless search of a motor vehicle is probable cause to search; no exigency beyond the inherent mobil-ity of a motor vehicle is required.” Id. at 242, 91 A.3d at 138. Prob-able cause exists where the facts and circumstances within the officers’ knowledge are sufficient to warrant a person of reasonable caution in the belief that an offense has been or is being commit-ted. Commonwealth v. Rodriguez, 526 Pa. 268, 273, 585 A.2d 988, 990 (1991).

At the time Detective Wagner searched the defendant’s ve-hicle, he was aware that bank deposits were missing; he knew the defendant lied about how many deposits he had with him and about returning a deposit on Monday morning; he spoke to the EMT that treated the defendant and learned his injuries were inconsis-tent with what the defendant reported to Wagner; and he spoke

It follows that unlocking a center console with a readily accessible key was within the scope of the consent.

to bank personnel, who reported strange behavior on the part of the defendant on the morning of the incident. Taken together, the facts and circumstances established probable cause to search the defendant’s vehicle. Furthermore, Wagner was justified in search-ing the console as a bank deposit may have been found in there. Commonwealth v. Fleck, 324 Pa. Superior Ct. 227, 234, 471 A.2d 547, 550 (1984) (“A lawful search of fixed premises generally ex-tends to the entire area in which the object of the search may be found and it is not limited by the possibility that separate acts of entry or opening may be required to complete the search.”). Argu-ably, Wagner could have opened and searched the safe on site, but when the defendant claimed to not know the combination, Wagner seized the safe and secured a search warrant. The defendant is not challenging the issuance of the warrant.

Based on the above, the search of the defendant’s vehicle was valid and suppression is not warranted.

ORDER

AND NOW, this 1st day of March 2019, upon consideration of the defendant’s Omnibus Pretrial Motions, filed November 5, 2018, IT IS HEREBY ORDERED that the Motion to Suppress Evidence Obtained from the Vehicle and Motion to Suppress Statements of Defendant are DENIED.

IT IS FURTHER ORDERED that the Motion to Suppress Testimony Relating to Opinions is HELD IN ABEYANCE until the time of trial.

Integrity is as closely associated with lawyers as butter is associated with bread. In fact, the term “integrity” has appeared with the term “lawyer” or “attorney” in nearly 9000 judicial opinions, and a Google search combining these terms yields over a half-million hits. Yet, for all the rhetoric about lawyers and integrity, the demands of integrity in a lawyer’s everyday life can be elusive to pin down and harder still to live out. In this program, lawyers are invited to consider with Professor Randy Lee how integrity manifests itself in a lawyer’s life. Join Professor Lee as he reflects on real life lawyer experiences through the lens of Robert Bolt’s classic play, “A Man for All Seasons”, a play about the struggles between lawyer Thomas More and his king, Henry VIII.

Professor Randy Lee teaches Constitutional Law, Professional Responsibility, Torts and various writing and advocacy courses at Widener University Commonwealth Law School. Professor Lee has taught previously at the Villanova and University of Pittsburgh Law Schools and in the Harvard University Summer Program. Professor Lee is a frequent speaker for the Pennsylvania Bar Institute and has also done programs for the Pennsylvania Office of General Counsel, the Pennsylvania Attorney General’s Office, and the Pennsylvania House of Representatives.

Professor Lee has spoken at judicial conferences for the Pennsylvania Commonwealth, Common Pleas and Superior Courts. He served as the chair of the Association of American Law Schools Section of Professional Responsibility, and also served as the chair of the Law School Subcommittee of the Pennsylvania Bar Association Professionalism Committee. “Champions of Justice – Four Short Stories of People Making a Difference for Those in Need”

Tuesday, December 10, 2019 Approved for 1 Ethics CLE Credit

Edgar Cahn, Sharon Browning, Gregg Volz and Sharon Dietrich – Brief biographies of four attorney champions of justice will highlight a session designed to bring public service under Rule 6.1 to life in an ethics hour. The story of Edgar Cahn, the only lawyer from outside Pennsylvania in the group, will provide an overview of system change that each of the other three lawyers featured have achieved. Specific pro bono projects of the three that can be joined by those attending this session will be featured, including Just Listening, Youth Court and Clean Slate.

David Keller Trevaskis, Esq., is an attorney and former third grade teacher with a Master’s Degree in Education. He is the Pro Bono Coordinator for Legal Services for the Pennsylvania Bar Association (PBA), responsible for assisting local bar associations, legal services programs and other groups who offer pro bono legal services across the Commonwealth. Trevaskis coordinates the PBA’s pro bono placement efforts, using the PALawHelp.org and PAprobono.net technologies to expand the resources for the neediest among us. He runs the PBA’s Pro Bono Office and the wide range of that work is viewable at http://www.pabar.org/public/probono/probonohome.asp. Trevaskis is a frequent presenter across Pennsylvania on civil legal aid and pro bono issues and is recognized as a national expert in public education about the law. He is the recipient of the 1996 Philadelphia Bar Association’s Leon J. Obermayer Education Award, a 2000 President’s Award from the Pennsylvania Bar Association for the Project PEACE anti-violence program he developed and still coordinates, the Philadelphia Bar Association’s Young Lawyer Division’s 2002 F. Sean Peretta Service Award, and a 2004 Chester County Bar Association President’s Award. In 2006, Trevaskis was the second recipient of the Compass Award, which was first given to United States Supreme Court Justice Sandra Day O’Connor.

“Survival 101: Law Practice Emergency Planning for Disability or Death”

Lawyers have an ethical duty to take steps to protect their clients in the event of sudden disability or death. This is particularly critical for solo attorneys. The problems encountered by judges, bar executives, and officers, disciplinary board members, and colleagues at the bar have become overwhelming, due mostly to the aging of bar members who have not planned as required. As a result, increasing pressure is being applied by insurers, the bench, and the disciplinary board to enforce compliance.

This course focuses exclusively on how to preplan to continue to run your office while you are sick, injured or disabled, or how to run your practice as part of the administration of your estate. Buyout, emergency coverage and succession planning for partners is also discussed. This course explains your obligations and provides specific details about what you need to do, and how to do it. Attendees will be provided with practical information and forms which can be put to immediate use at the firm to make compliance easier.

Ellen Freedman serves as the Law Practice Management Coordinator for the Pennsylvania Bar Association. In that capacity, she assists PBA’s members with management issues and decisions on the business side of their practice, including areas like technology, bookkeeping procedures, human resources, risk management, setting up a practice and so forth. Ellen holds the designation of Certified Legal Manager through the Association of Legal Administrators (ALA), the credentialing body for the CLM degree. She holds a Certification in Computer Programming from Maxwell Institute, a Certification in Web Site Design from Temple University, and a B.A. from Temple University, where she also did two years of graduate studies in Criminology.
