Attached is a memo reviewing current leave and absence procedures. Included is a discussion of leave types and usages that are allowed. Please review with your staff. If you have questions please contact Danni Smith ([email protected]) or Debbie Rogers ([email protected]).

Memorandum 2015-2016 School Year
Clarification needs to be provided concerning certain types of leave that might be taken and how that leave will impact employee leave usage and the operations of the Substitute Management System (AESOP). The Substitute Management System (AESOP) will only place substitutes for whole or half days. Employees may only submit whole or half days into the system. A professional employee who must take off less than a half day must:
1. Coordinate the leave with the supervisor so that coverage, if required, can take place; and,
2. Complete a handwritten “Employee Absence Report” (a PRS-60 form available from the Print Shop) and forward that form to Box 160.
If substitute coverage is provided by a teacher, during his/her conference period, payment will be done through supplemental pay as per currently practiced. If an employee is non salaried or is paid by the hour and wishes to expend leave for units less than a whole or half day he/she will either use compensatory time that he/she has; be docked for time missed with notification on a PRS-60 form and sent to Box 160; or, if he/she wishes to use appropriate leave time a PRS-60 form will be submitted to Box 160. Use of leave for less than a whole or half day must be used with coordination of his/her supervisor. Types of Leave Days Provided to the Employee Old State Sick Leave—accumulated prior to June 30, 1995 from prior service in GISD or another Texas district as recorded on the service record. This leave may only be used for the four reasons which were permitted in the law under which this leave was accumulated. These reasons are:
1. Personal illness 2. Family illness 3. Family emergency 4. Death in family
This leave ceased to accumulate when it was replaced by State Personal Leave in Senate Bill 1 in May 1995, but can be transferred between Texas districts. The employee receives full pay when using this leave.

State Personal Leave—as required by Senate Bill 1 passed in May 1995 replaces the old State Sick Leave, and is given to all full-time employees at the rate of five days per year with no limit on accumulation. It is transferable between Texas districts and may be used for any reason. This leave may not be taken for a discretionary reason on state mandated testing dates or dates set by the campus principal or supervisor. The employee receives full pay when using this leave. State personal may be used for any of the following reasons:
1. Personal illness 2. Family illness 3. Family emergency 4. Death in family 5. State personal 6. Religious holiday
Local Leave—currently given at the rate of two days per year and accumulated from past years of service in Garland ISD only. Local leave is not transferred from another district. . Refer to Board Policy DEC (Local). The employee receives full pay when using this leave. Local leave may be used for all the same reasons as state personal. Extended Leave (formerly known as Supplemental Sick Leave) – is provided by Garland Local policy as a "safety net" of 30 days of Extended Leave to all full time employees. This leave can be used after all other paid leave is exhausted. Less than full-time employees will be credited with extended leave based on the percent of time worked. Extended Leave will be applied automatically once all paid leave is exhausted. Professional employees are paid the normal daily rate minus the cost of a substitute ($100 per day). Auxiliary or paraprofessional employees are paid the normal daily rate minus $50.00 or one-half of the daily rate of pay (whichever calculation gives the employee the greatest amount). The 30 days are available one time only and when exhausted will not be renewed. The reasons allowed for the use of Extended Leave are: Personal/Family Illness, Death in Family, or Family Emergency. Specific Usage Areas for Employee Leave that Should be Reviewed: Jury Duty: Jury Duty as described in GISD Board Policy DEC (Legal) states: “The District may not discharge, discipline, reduce the salary of, or other wise penalize or discriminate against an employee because of the employee’s compliance with a summons to appear as a juror. For each regularly scheduled workday on which a non salaried employee serves in any phase of jury service, the District shall pay the employee the employee’s normal daily compensation. An employee’s accumulated personal leave may not be reduced because of the employee’s service in compliance with a summons to appear as a juror. Education Code 22.006”

Jury Duty leave will be handled in the following manner:
1. Jury Duty is not an active choice for the employee to make within the AESOP system.
2. The employee will notify the employee’s supervisor of the jury summons at the earliest possible date.
3. The absence will be placed into the Substitute Management System under “State Personal Leave” if the employee is covered by and is part of the data bank for the Substitute Management System.
4. When dismissed from jury service the employee must obtain a “Certificate of Jury Duty Service” form from the Court Bailiff. That form should be returned to his/her supervisor and attached to the Employee Absence Verification Form. When the Absence Verification form is received in Human Resources, the absence will be changed to “Jury Duty” and no leave will be taken from the employee.
5. Failure to provide documentation of service will result in a deduction of paid leave for the absence. If no paid Leave is available, the employee will incur a dock. The actual summons is not documentation that is acceptable to prove service.
6. An “On Call” jury duty summons will require the employee to inform the supervisor and report to work on the date indicated on the “on call” jury summons. If the employee is required to report to Court, appropriate actions will be taken to provide substitute coverage, if necessary. The half day leave will be placed into the Substitute Management System pending verification of service by the submission of the “Certificate of Jury Service” form as described in #3.
The use of the Jury Duty is limited only to the operations of the employee as a juror and is not used to cover any other court related activities unless it is directly related to the function and/or responsibility of his/her job. Jury Duty is not to be used for private, personal issues that might require the employee to be absent from work to attend or be involved in a court and/or legal issue. Absences for court appearances related to any employee’s personal business must be taken as state personal leave (local leave or old state sick leave cannot be used) or leave without pay (if no state personal leave is available). An employee may be required to submit documentation of his/her need for leave for court appearances. According to Board Policy DEC (Legal) the District may not discharge, discipline or penalize in any manner an employee because the employee complies with a valid subpoena to appear in a civil, criminal, legislative, or administrative proceeding (Labor Code 52.051a). If an employee receives a valid subpoena they must communicate directly with his/her supervisor and provide the supervisor with a copy of the subpoena and the dates to be missed. The subpoena should be attached to the Employee Absence Verification form. The absence should be entered in the Substitute Management System and/or Kronos using “State Personal” as the absence reason. When the Absence Verification form and subpoena are received in Human Resources, the absence will be changed and no leave will be taken from the employee. All documentation to support jury duty or a subpoena should be sent to Human Resources, Box 160. Employees with last names beginning A-L go to Danni Smith. Employees with last names beginning M-Z go to Debbie Rogers.

Religious Observances Leave for religious observances may be taken by the employee according to GISD Board Policy DEC (Legal). This policy states: “The District shall reasonably accommodate an employee’s request to be absent from duty in order to participate in religious observances and practices, so long as it does not cause undue hardship on the conduct of District business. Such absence shall be without pay unless applicable paid local leave is available. 42 U.S.C. 2000e(j), 2000e2(a); Ansonia Bd. Of Educ. v. Philbrook, 479 U.S. 60, 107 S. Ct. (1986); Pinsker v. Joint Dist. No. 28J of Adams and Arapahoe Counties, 735 F.2d 388 (10th Cir. 1984)” Religious Observance Leave will be handled in the following manner:
1. If Religious Observance Leave is selected as a “reason code”, in the AESOP system, it will hit local leave first then state personal leave. If there is insufficient paid leave to cover the absence then it will go to a daily dock.
2. Old State Sick Leave cannot be used for religious observance leave.
3. Extended Leave cannot be used for Religious Observance Leave.
4. A two week notice, with documentation, is required by the supervisor and submitted to Human Resources with the monthly Employee Absence Verification Form. If the employee’s absence is covered by the Substitute Management System the employee will place the absence into the system as “Religious Observance” and it will impact his/her local and/or state personal leave balance and/or it will be an unpaid day.
Leave days can be subject to approval by an employee’s supervisor depending upon the type, time and purpose of its usage. The use of accumulated leave days, of all types, is an important decision that the employee must make. Every employee should review the Employee Handbook 2015-2016 for all guidelines, procedures and policies governing the use of leave. The Employee Handbook is available online on the GISD intranet under Human Resources.

EDUCATOR TESTING POLICY REVISION
House Bill 2205, effective September 1, 2015 changed the educator
testing policy. Previously, an educator could attempt the TExES exams
an unlimited number of times. The new policy limits the attempts to a
total of 5 attempts.
Test registration is still at www.texes.ets.org . You must have your TEA
test ID to register. Test ID can be obtained by logging in to your TEAL
account.

Attached are GISD’s District-Wide Child Find Plan and a quick reference guide for front office staff to assist in answering special education inquiries. Under TEA guidelines, district administrators are responsible for reviewing Child Find information with all staff members directly under their supervision without regard to their role and direct student contact. The Child Find video can be accessed by all employees through the following link http://geo2.garlandisd.net/. This can be viewed as a group or by individual workstation. A list of staff roles and responsibilities is included to guide each member of your staff in their Child Find responsibility. Please complete the checklist and return to Box 500 by November 30, 2015. The checklist will guide you as to how the materials should be used. It also provides documentation needed for TEA to ensure that each campus and department has complied with Child Find regulations. Posters and brochures will be delivered to your campus. District Wide Child Find Plan
Garland ISD Local Guidelines
Federal and state laws require that all school districts maintain a system for identifying, locating, and evaluating individuals with disabilities (birth through age 21) within its jurisdiction and who are suspected of having a developmental delay or disability. This mandate includes services to school age individuals in nursing homes, group homes, detention facilities, and private schools located within our district boundaries. Garland ISD plans to meet this challenge at the campus level by following the guidelines listed below.
Each campus is required to maintain a CHILD FIND log to document all inquiries, referrals, and actions taken and to submit to the central office of Special Education at the end of each semester.
Each campus or district location is required to display informational posters in their work area. Each campus principal or district administrator is required to train all staff on GISD’s Child Find
responsibility. Our community wide Child Find strategies are designed to locate eligible students residing in the community, receiving educational services within GISD boundaries, or in a residential facility in GISD jurisdiction. These efforts include, but are not limited to:
Public awareness activities Notices to physicians, day cares, and private schools Public service announcements GISD newsletter Posters on display in multiple settings Display at Community health fairs GISD Website
Each campus has an established Student Support Team (SST) which includes faculty who are informed and knowledgeable on the recognition of students with learning and behavior difficulties. Students attending public school, home school, or private school within GISD boundaries must work with the SST prior to a special education referral. The SST will recommend interventions to be tried before the initial referral begins. Asbestos Management Program
Dear Parents, Guardians, Students, Staff and Faculty,
Per Texas Department of State Health Services (TDSHS), School Facilities is requesting the
posting of this notice.
Plans are updated annually and copies maintained in the office of each building
administrator for review. Additional copies are also located in the Maintenance
Department.
Routine inspections are conducted as well as tri-annual re-inspections of all facilities.
Operations and maintenance procedures are implemented to ensure no building has
asbestos-containing material that poses a health threat to students, staff, or patrons.
It is a part of the district’s on-going effort to renovate and remodel existing facilities.
Numerous renovations and additions have been completed which involved abatement
of asbestos-containing material prior to the general construction. In many of these
buildings, the only asbestos material remaining is inaccessible until such time as the
building is to be renovated, and then it will be safely removed prior to the renovation.

Guidelines for TSNOX Shout Out School Nurse Recognition Program
Purpose:
To recognize school nurses whose clinical expertise and actions have made a significant impact in the life of a student,
staff member or community member.
Guiding Philosophy:
School nurses take action every day to maintain the wellness of the students and staff in their care. Sometimes a nurse
employs extraordinary measures that have a significant impact on the outcome of a particular medical situation. This
may include but is not limited to life-saving measures, early identification of significant health problems and provision
of services above and beyond routine school health care.
Procedure:
1. A school nurse may be nominated for recognition by a peer or an administrator. 2. The nurse will be recognized on the TSNOX Facebook page and at the annual Business Meeting /
Summer Conference. 3. Nominations should be submitted to: Renee Kotsopoulos, Nominations Committee Chair
at [email protected] or 125 Wagon Wheel Ln., Wylie Texas 75098. 4. Members and non-members of NASN/TSNO/TSNOX may be nominated. Part time and substitute

The BE/ESL Department is excited to announce the 5th Annual Youth Summit for English Language Learners: Service Leadership.
The 5th Annual Youth Summit will take place Friday, October 30 at the Curtis Culwell Center with a special Parent Event on Thursday, October 29 at South Garland High School. The focus of the Youth Summit is to promote positive community interactions and to inspire students to develop a philosophy of service leadership and volunteerism. These fundamental characteristics are founded on the Search Institutes’ 40 Developmental Assets for Student Success and reinforced throughout the school year in the ELL Student Leadership classes and afterschool, co-curricular activities. Students are provided with a variety of language and academic enrichment opportunities. Both events will feature guest speakers, Consuelo Castillo Kickbusch and Quynh Chau Stone. This forum provides students with an opportunity to engage in relevant service projects, connect with other community members, build critical assets for future success, and walk away empowered by the keynote speakers’ call to action. DATE: October 16, 2015 TO: High School Principals FROM: Brad Trudeau Director, Student Nutrition Services RE: Vending Machines _______________________________________________________________________ Guidelines resulting from the Healthy Hunger Free Kids Act of 2010 continue to evolve and have made some items sold on campuses allowable and some unallowable. Student Nutrition Services is monitoring those changes and will help guide you through the new requirements. If you have any questions about the guidelines please contact me at [email protected]. Please remember we are always here to serve the students and help the administrators of GISD. Students are now allowed to purchase products from vending machines only at high school campuses, and the products sold in those machines must meet the requirements listed on the attached flyer. According to the Texas Department of Agriculture Administrator’s Reference Manual, Section 20.30, schools, not the student nutrition program, are responsible for the retention of all documentation or records relating to the sale of food and/or beverages during the school day on the school campus that are not sold by Student Nutrition Services. The school must have a system in place to retain documentation or records demonstrating that the food and beverage items sold meet the Competitive Food and Beverage Nutrition Standards. All high schools were recently delivered a binder that should be kept on file in the school office as documentation for their snack vending machines. They will soon receive documentation from the vendor of the beverage machines. The ice cream machines are operated by Student Nutrition Services, and we have documentation on file. Nutrition Standards for Vending Machines
Since 2014-15 all foods sold in schools, other than food sold under the lunch and breakfast
programs, must meet specific nutrient standards. This applies to all foods sold outside federal
reimbursable meals, on the school campus, at any time during the school day, the period from
midnight before, to 30 minutes after the end of the official school day.
Foods sold in vending machines must also comply with the following nutrient standards and the
school is responsible for keeping a file with nutritional labels for all products sold:

To be allowable, Foods must:
1. Meet all proposed competitive food nutrient standards, and

This revered award recognizes outstanding educators who create excellent learning opportunities for students. Additionally, this award acknowledges and rewards outstanding urban schools who have raised the bar for urban schools everywhere. The award categories are elementary, middle, high, and alternative schools. The application has three important parts--the Intent-to-Apply Form, the written application and the video and photo submission. The two preliminary questions that determine if a campus may begin the application process are:
Did the school maintain a rate of average daily attendance equal or greater than 92 percent? AND
Do a large percentage of students qualify for free-or-reduced-price lunch or meet other low-income criteria used by your state education agency?
