THE DISH END PVT LTD.

Introduction to the company Dish India pvt ltd

Dish India (P) Ltd., a Lloyd's register Asia approved unit is engaged in designing,

manufacturing, supplying and installing equipments like Dished-Ends, Tank Bottoms, Flat

Ends, Boiler Ends & Cones. The company is having the capacity of pressing up to 160 mm

thick material.

The company caters several industries including food, sugar, edible oil, distilleries,

breweries, chemicals, petrochemicals, fuel handling, fertilizers, pulp and paper, polyester,

textile, environment and other core industries like power, steel engineering and coal.

Case summary

It was founded by Mohanlal yadav on the basis of experience he gained from Rohtaj

industries. In management there were four engineers including yadav and it was making

Martensic (MS) and stainless steel(S.S) vessels for many industrial buyer.

As it was a quality product, they hired many skilled workers, supervisors and engineers

and they were 500 employees.

In 1978, under the leadership of S.R. kantikar, who was the leader worker of chemical

and pharmaceutical company, made the trade union of workers in thane belt, and he

influenced workers of Dish end pvt ltd also and the name given to the union was “

General Chemical Workers Union”.

Meanwhile S.K. Jadhav recruited as first HR manager under such situation and workers

started demanding against committee and management was not in the position to fulfill

the demands because of financial crises and the demands were wage rate increase of

1500/ month/ employee and certain other nonmonetary incentives like bonus,

uniforms, free transportation, education etc.. and employees were not able to

understand financial implication of company.

In 1979, there were political influence from the side of ramesh for their demands and

workers started creating unrest in the company and it was affecting production as well.

And once in the second shift,one supervisor Nair was abused and threatened by Ramesh

for pending demand and ramesh slapped Nair in the presence of workmen. And police

complaint was registered about these matter.

And Jadhav was also attacked by Ramesh and other eight committee members and it

was witnessed by Gatekeeper and complained it to chair person and jadhav was treated

in private hospital in vashi. And ramesh was in custody for 3 days.

When ramesh got reveled, he approached Dr. sawant’s union ‘Mazdoor Congress of

Engineering works at Ghatkopar. And he advised to enroll all employees and stop

working after collection of membership fees. And Dr. saawant kept the same demands

against management and said demands should be settled within 8 days of receipt or

bare consequences. And after 8 days on January 16, 1980 as usal company gate was

open but all those employees who want to go in th factory were not allowed by Ramesh

and others and those employees were around 35.

But it was observed by management that skilled and sincere workers want to cooperate

management but threats and preassure from union was not allowing them to do so.

After receiving feedback from majority of staff members, Ramesh and others were

called for domestic inquiry and charge sheet was given to ramesh for illigle strike and

violence under the factory.

And all those workers who were willing to work, had asked to give police protection

inside and outside company and management agrred and situation was also analysed by

ACP od thane and he gave the protection and company worked for two months under

protection. And complaint was given by management in labour court thane and court

declared the strike as illegal and advised to restore work condition and to join the work

unconditionally.

And ramesh and other 8 committee members were also suspended and management

removed all those 35 workers also who have not came for work for 3 months and it was

the shocking news for them. Meanwhiole the local leader shiv sena, kishor salvi met

jadhav and told them that majority of workmen have requested him to protect their

services and lives from savant.

Salvi also met chairmen yadav and requested him accordingly. Thereafter he formed a

committee of 11 new members and sent an introductory letter to the company in the

name of shramik sena union. On the request of kishor salvi, the management recruited

35 new employees on the basis of the policy sons of soils and they informed it to the

government of maharastra and they also gave the sympathy to company. And sharmil

sena requested industrial court to recognize under MRTU and PULP act, 1971.

After the period of 1 year, kishor received a certificate of recognition from dish ends pvt

ltd and then issue was settled by accepting 20 out of 25 original demands of workers.

Answer 1. - Impact of trade union and industrial dispute on the Dish Ends Ltd.

Answer 2. - The reasons for the industrial unrest in the company were

a) The General Chemical Workers Union informed the management that the union wanted

to negotiate the demands of the workers but the matter was not taken up seriously by the

management and it lingered for two years. Due to financial crisis, the company was not in a

position to consider the demands of the workers, and this was informed to the union unit

several times.

b) During meetings with the unit committee it was observed by the management that the

committee was not cooperative and was rigid during negotiations. The union had out up 25

demands and amongst those the major demand was a pay rise of Rs. 1500 per month for all

the workers in their basic salary and dearness allowance. During the meetings management

tried to convince the committee members but no one was able to understand the total

financial implications against the demands that were placed before the management.

c) Workers were getting impatient, as only negotiations were going on and the issues were

prolonged.

d) In December 1979, Ramesh with the help of political parties started pressurizing the

management to fulfill their demands.

e) In January 1980, labor unrest gradually increased, and the workmen became non-

cooperative because of instigation from the committee members. Ramesh abused,

threatened and slapped one of the supervisor of second shift.

f) Ramesh and his eight committee members were suspended because of threatening a

supervisor and assaulting the personnel manager. After the issue of the suspension letter

the very next morning Ramesh obstructed the work of other labors and committee

members and were not allowed to go inside the factory. Ramesh gathered workers and

instructed to stop the work completely in the company.

Answer3: Was the dismissal of trade union leader and the committee members justified?

Yes the dismissal of trade union leader and the committee members was justified. In 1978,

Answer 4: What is your response to the removal of 35 casual workers?

Management expect workers to observes codes of discipline, not to join illegal strikesand

not to inebriated to the workplace. Where a worker's behaviour deviates from expected

lines, it is the management's prerogative to take action and thai was the wise and right

decision of the company to the removal of 35 casual workers

Management have to take first action on Ramesh and eight other committee members

because they are not following the rules n regulation of company andacting indiscipline

or indiscretions in the company. Some of the workmen who tried to enter the factory

for their regular work were obstructed by Ramesh and other committee members and

were not allowed to go inside the factory.

Ramesh gathered the other workers, including casual workers, and inform them that

they had brought in Dr.Sawant's union and he has instructed to stop the work in the

company completely, so here buying up the union leaders, and striking clanders tine

deals with powerful politicians do no goods in management or to the organizations they

represent.

Here decision taken by management was the dismissal of Ramesh and other committee

members based on the findings of the inquiry of the inquiry officers and 35 casual

workers did not report for duty for more than three months therefore, also

Management has take right action to decide the removal of the 35 casual workers.

Answer 5 : What is the legal position regarding casual workers in the recognition of trade

union?

Before the strike Ramesh and many other were arrested by commissioner so they were

regarded as the criminal. For the case of abasement of nair and slapping them.

Salvi also met chairmen yadav and requested him accordingly. Thereafter he formed a
