Mr. Michael C. Goldengate:

I write hurriedly to forward a clipping from an old scrapbook in the vault at Smith, Hubbard & Tichenor, LLP. I confess I had overlooked this item from the Alta California, July 29, 1853, Volume 4, No. 208. I hasten to call it to your attention because in the last paragraph, the section beginning "Our informant says . . ." is mention of "two half-breeds at work on a claim about twenty miles above Port Orford."

And doing all right at it …

Needless to say, this contemporary record corroborates my recent submission, Where is the Lost Treasure of the Half-Breeds Who Founded Half-Breed’s House Under Humbug Mtn.? Sorry I spaced on the source. I have been temporarily distracted these past few days. My sister, Sarah Elizabeth, came into town for groceries and, while at the Whale-of-a-Tale coffee bar, we chanced to find kindred spirits from when we were undergraduates. As former members of SDS, we have banded in common cause to try to set things on a different course in northern Curry County. [Etc. Edited for space – Ed.]

Well, while Ass. Dr. Beckon’s letter (above) and its critical source material, on the Half-Breed’s House story, arrived shortly before we sent out the last issue, nevertheless, it was too late to include therein. But, likewise, because she had not yet seen the MOMENT OF TRUTH issue, her letter shows no distress or agitation at the finished product. HOWEVER, PLAYERS!!! You know how this works by now !!! Right? Yes – for, a short two days later, and the very day that last week’s S.Y.M.-Zonia was printed, her attorneys presented another face entirely …

They were up in arms over the lithograph !!! Read for yourselves!!!

Well …

Players -- you will, as I was, be wondering what this tirade is all about, especially following so quickly on the heels of the DEAL struck – just weeks ago -- between S.Y.M.-Zonia and Dr. Beckon’s S.H.&T. firm: it was an allegation of invasion of privacy!!! Really!! I mean – READ IT!! Read it for yourself(ves) !!!

What’s all the Fuss ?? I mean really? Is this guy getting CARRIEDE AWAY, or what? I was reminded of a story, about Port Orford getting literally carried away … As Squibob had once written:

Port Orford is a small place, a very small place! I heard that the Columbia steamer once got up a steam and left here, without casting off one of her stern lines, and accidentally towed the whole city up the coast about forty miles before the line parted, very much to the confusion of Tichenor, who having been elected a member of the Oregon Legislature, sailed off in a small schooner to find the city, but being unsuccessful, attempted to return to Port, but did not get in for some time, owing to the accident …

CARRIED AWAY indeed!! In particular, our efforts at authenticating and SUBSTANTAITING the FIRST EVER submission of Titular Leader’s S.Y.M.-Zonia, Where is the Lost Treasure of the Half-Breeds who Founded Half Breeds’ House under Humbug Mtn.? (June 25, 2012) [Last week—Ed.] has literally brought down the house – but NOT in a good way. Indeed, it has brought the House of Tichenor down upon us, for asserted invasions of privacy, VOYEURISM {???} and violations of an attorney-client privilege. I mean… ALL THIS through the publication of the eye-witness lithograph of Grafton Tyler Brown V, who executed under contract to S.Y.M.-Zonia, for the purpose of documenting the MOMENT OF TRUTH ?? Wowee!!

I was so astonished to receive this missive, and so surprised by its aggressive -- even hostile -- tone, so shortly after our striking the NOLLI PROSEQUI deal, under which a new era of cooperation has already arrived, between S.Y.M.-Zonia and Titular Leader Beckon, that the psychology major in me (U.C.. Berkely, 2005) was roused to curiosity, and I suspicioned that there was … something going on here .. to trigger such a disproportional, even irrational, response. What was it? What was bothering Tichenor? That he would act so possessive, about the publication of a picture that must certainly mean GREAT PRESS for the S.H.&T Firm that was now our sponsors? It was the repeated references to voyeurism that in particular looked like a clue -- what was possessing him …? I wondered ..

SO I LOOKED MORE CLOSELY, as had proved useful very recently, in analyzing the original 1851 Pierpoint daguerreotype of Battle Rock, which had revealed the “LOOK BENEATH” sign, leading to the Battle Rock Diary, (See, Whatever Became Of Capt. Kirkpatrick’s Hastily Buried Ms Battle Rock Journal? (June 17, 2012)….

I LOOKED MORE CLOSELY – and saw the reason!! For a close up of our lithographers expert work, originally appearing last week’s special issue, MOMENT OF TRUTH , reveals, IN FACT, the hidden passion triggering Tichenor’s agitation. In particular, I looked more closely at the placement of each firm member: of Smith ( rear, standing, with the beard) of Hubbard (seated, in the rear, with smudge, or moustache) and of Tichenor himself (with moustache; seated foreground, hand in lap, returning approved story to Ass. Dr. Beckon) and then I noticed WHAT THEY WERE ALL LOOKING AT was not the approved paperwork, not the recovered historical truth of the Lost Treasure of the Half Breeds Who Founded Half-Breeds’ House under Humbug Mtn? but … Ass. Dr. Beckon herself!!! I mean – talk about VOYEURISM … !!!! It gave a whole new meaning to “firm member” and to the vaunted “firm-member”-ship of Smith, Hubbard & Tichenor !!! Uh-oh …. Out of room. And now …. !!!

PLAYERS!!!! It should be needless to say, that almost since the very day of S.Y.M.-ZONIA’s publication of the well-received and highly sought-after CLOSED CIRCUIT edition of April 1, 2012 – namely (of course), the Incident on the Emily Farnham number, issuing exactly three months ago today -- there has been an almost imperceptibly gradual editorial shift towards the evident existence of some kind of NOLLI PROSEQUI deal between Capt. William Tichenor, of the spanking little steam prop, Sea Gull, and San Francisco Customs Collector T. Butler King – which deal, according to numerous sources, evidently brought Butler King in as a partner in the founding of the City of Port Orford (Oregon) . It has become well nigh undeniable now …

Bancropt had said it, and Fred Lockley had confirmed it. King was also identified as holding copyright to (some) copies of the City of Port Orford Survey map – and yet – he had NO REAL ESTATE INTEREST IN THE CITY: Smith had a claim, Hubbard had a claim, and Tichenor had a claim. And King …. ??? They mysterious San Francisco Surveyor who first surveyed Port Orford on July 15, 1851 [“Two weeks” from now – Ed] had not surveyed a claim for King.

How come?? And, so where was his interest? And WHAT KIND OF INTEREST WAS IT? To what aspect of development of the City of Port Orford, was T. Butler King’s interest tied? AHA – Of course, … he would “OWN THE WATERFRONT.”

He would be PORT AUTHORITY.

That might explain the NOLLI PROSEQUI. Perhaps . King would own the wharves and piers – running the whole show -- and his recovery would consist in charges and fees assessed for tying up at his wharves -- wharfage extending out into the Harbor of Port Orford, also known as Ewing Harbor, for the U.S. Surveying Schooner Ewing, that had anchored there briefly … Tichenor had big plans, as he revealed in his eloquently argued text, A Harbor of Refuge for the Pacific Coast ….

Tichenor’s lost monograph -- A Harbor of Refuge for the Pacific Coast …. Brought to you by

Tichenor’s essay, dated June 2, 1879, is in five parts, and addresses to Lt. Col Seaforth Stewart as senior member of the United States Board of Engineers of the Pacific Coast, which was seeking public comment on the proposition for development of a maritime “safe haven’ or “harbor of refuge” on the Pacific coast, for vessels in distress from dangerous seas. Capt. Tichenor presents arguments for the candidacies of five ports in Oregon and Northern California. 1) The Columbia River; 2) Cape Foulweather; 3) Cape Gregory or Arago; 4) Port Orford; 5) Trinidad bay.

Tichenor’s masterful essay is a lengthy document, and we print here only those portions which set forth Capt. Tichenor’s arguments for the selection of Port Orford as the Harbor of Refuge for the Pacific.

REPORT OF THE BOARD OF ENGINEERS FOR THE PACIFIC COAST ON THE SELECTION OF A SITE FOR A HARBOR OF REFUGE ON THE PACIFIC OCEAN, etc. etc. and, it should be noted, that a majority of the Board selected Port Orford as the most suitable site for such a refuge ….

HOWEVER, no such maritime infrastructure was ever constructed – no Harbor of Refuge was erected: either at Port Orford, or anywhere else along the Pacific Coast, although it does not immediately appear to me, Michael C. Goldengate, precisely why!! The study appears nearly conclusive --

Conclusive? Indeed it appears that Port Orford as the site of such a harbor, was almost a foregone conclusion, inasmuch as, of the four maps that were printed to accompany and illustrate the REPORT … ON THE HARBOR OF REFUGE, three of them depicted … various nautical details about PORT ORFORD.

No other candidate ports were mapped. Tichenor argument had carried the day. Capt. Tichenor’s lengthy contribution to the REPORT, not incidentally, includes a number of biographical details about Tichenor himself, that might otherwise be difficult to learn – so we recommend it to you PLAYERS who are seeking to meet the challenges posed last week – regarding the list of vessels he piloted.

And PLAYERS !!! How might this 1879 REPORT bear upon T. Butler King’s interest in Port Orford in 1851?

It’s simple: it shows that Tichenor could be extraordinarily persuasive ion the area of his expertise: sailing, navigation, and maritime safety. Tichenor clearly talked his way out of the San Francisco pokey, and, by way of exchange, talked King into a speculative venture in remote and – seemingly -- rather insignificant, and largely overlooked Pacific harbor.

Port Orford (Oregon): Also (of course) the chief seaport in S.Y.M.-Zonia ™.

The Incident on the Emily Farnham dates to the tying up of the vessel at Astoria (Oregon), in November, 1850, and reaches a climax on November 15-16, with the attempted boarding of the brig, at Tanzy Point, by Astoria Collector of Customs General John Adair. At that point, Capt. Tichenor and his crew fought off the federal officials, kidnapping two of them, and set sail for the open ocean in the Emily Farnham. After stops along the coast to unload “passengers,” the vessel arrived in San Francisco bay and tied up at Long Wharf -- then not yet quite so long as it would eventually be -- sometime during the first week of January 1851. A rather long 6-week voyage, even against a winter headwind …

HOWEVER – upon presenting his papers at the Custom House, Tichenor, rather than being arrested and forced to abandon his vessel, for the various federal crimes committed against Astoria Collector Gen’l John Adair, and for contempt of court, appears to vanish from the press, along with the Incident on the Emily Farnham: the Incident on the Emily Farnham appears to be WITHOUT A CONCLUSION in San Francisco – lacking even so much as a disappointing denouement. For Captain Tichenor evidently persuaded San Francisco Customs Collector T. Butler King to adopt as his official position, a NOLLI PROSEQUI as to all possible charges – indeed, it appears that no charges were ever filed against Tichenor, and he resumed his scheduled return run to Astoria, on the Emily Farnham.

Thereafter, that is, in the months ahead, T. Butler King appears as a co-venturer with Capt. Tichenor, in the founding of the City of Port Orford – and the singularity of the fact, suggests some sort of quid pro quo had been reached – one based almost entirely on Capt. Tichenor’s prowess of persuasion: his ability to lay it on thick – like,

with a Master Mason’s trowel (hint… hint … ) -- aka to wax persuasively eloquent over the merits of Port Orford – even to one who held the chief post in what is certainly the greatest harbor on the planet, San Francsico bay. How?

THEREAFTER , decades pass. In 1879, the United States Secretary of War appoints a panel of engineers, to determine a maritime Harbor of Refuge somewhere on the Pacific Coast, and a disunited chorus of expert voices arises. Among all the voices, urging the adoption of the sites from the Columbia River to Yaquina Bay, to Cape Arago on the Oregon Coast, and Mack’s Arch, Trinidad bay, Humboldt bay and even Crescent City “harbor” on the California coast, the panel listens to one man arguing for the harbor known as of Port Orford. Capt Tichenor’s written testimony is almost the only v oice, even among the doznes of seasoned experts and weather-beaten sailors, arguing for selection of Port Orford. He wins the argument. Again: laying it on with a trowel. Like… a Master Mason’s trowel (hint … hint …).

PORT AUTHORITY: Once again, Capt. Tichenor is the true Port Authority on the Pacific Coast. His initial selection of “Ewing Harbor” as the site for his development of Port Orford City, was ratified, first by T. Butler King, and then -- thanks to his continuing persuasive advocacy – by the board of Engineers panel, which recommends Port Orford to the Secretary of War, 28 years later. But again – now, as before -- the outcome of his advocacy, the effect of all his persuasion, appears to be lost in the midst of time: there is no, no way, evidently, to determine precisely what interest T. Butler King had accepted, in the development of Port Orford – and it appears at this point, equally uncertain why the Board of Engineers recommendation to create a Harbor of Refuge there, went unheard. Either way, however, it is clear that Capt. Tichenor was to all these experts, the PORT AUTHORITY. And now …
