Another Five-HeadedBaby ScamIm pleased to announce that
City Hall is finally accepting
emails from the TX Citizen
again, allowing us to actually
ask questions of City Council and
Staff via the electronic mail. According
to the bounce notifications that we kept, our
emails to City Hall, City Council, and the
police and fire departments have been getting
bounced at least as far back as May of 2013.
Weve complained about this quite a bit,
given that locking the press out of email contact
with a government is probably actionable and
certainly un-American, but were guessing
that it was the mention that Nick Rogers gave
the situation in his column in our January 30
edition that finally prompted the change.
We look forward to staying in very, veryclose touch with all the folks at City Hall from
here on out, without having to come up with
new gmail addresses every time we want to
contact them.
Now, lets talk lies.
As you may remember, the recently-
declared-unconstitutional Disposable Container
Ban was sold to the public as a litter-control
measure. We know that wasnt the actualmotivation for writing it, as it was put forth by
the same people that attempted to ban alcohol
from the river several years prior, successfully
banned coolers over four gallons in capacity
from the Comal (law since overturned), and
constantly complained about the crowds of
visitors to the rivers. These attempts, these
bans, and these complaints all originated with
the same small group of riverfront property
owners and their friends people who would
like the rivers to themselves.
You may also remember that the
spokesmodel for the Can-Ban, Kathleen
Krueger, made claims about the litter
collection that were patently untrue, such
as the fact that if all the cans collected from
the river were laid end to end from thedowntown squircle, they would reach Ft
Worth. I personally did the math while I
was still in the newsroom at KGNB,
found out that those cans would
actually stretch from here toSan Marcos, and was told by
Krueger that, well, thats still
too many.
Last week I talked about the
five-headed baby, and how if I go
to the carnival and buy a ticket to see a five-
headed baby, Id damn well better see a five-
headed baby. If I go into the ten-in-one and
see a two-headed baby, Im going to be upsetthat Ive been lied to. If the barker says Ok, it
doesnt have five heads, but two heads is still
a lot for a baby, Im going to punch him. You
have cans that stretch to San Marcos? Then
youd better not say Ft Worth. I mean really.
What if you were told you had a to ride a bike
to San Marcos and then found out you really
had to go to Ft Worth? Youd go UNSANE.
Honesty, yall. It keeps you out of trouble. The
fact that anybody started looking into this story
at all springs from that first disingenuous claim.
Krueger and her crew could possibly
have gotten away scot-free on this entire
scam, even avoided the court challenge,
had no one noticed they were inflating the
numbers. There would most certainly not
have been a TX Citizen, and I would havemoved on from KGNB, because I enjoy things
like money and food and sleep and money,
and nobody would have been the wiser. She
fudged the numbers to impress and frighten
the public, I caught her, and all Hell broke
loose. Good times.
Anyway, a little more digging revealed the
good stuff that then-River Manager Nathan
Pence had been reporting bags of trash that
were perhaps one-quarter full, as completely
full, 60 gallon bags. Oops. Thats up to a
400% exaggeration. Then we found out
that the river litter numbers he was issuing
to the pressincluded all the properly disposed
of waste from all of the trash cans in the river-
adjacent parks. In other words, not litter at all.
Oh dear. So much deception.

Then there was Mayor Gale Pospisil. When I
presented her with the actual figures, her response
to me was The numbers dont really matter. To
which I responded, Then dont use numbers to
sell your point. Actually I didnt respond. But I
thought it in a really powerful voice in my head.
I ran a piece on KGNB which reported the
amount of cans in pounds rather than gallons.
After hearing that story, the Mayor sent an email
to then City Manager Michael Morrison, letting
him know that she wanted the litter reported in
gallons, and not pounds, because the gallon
figures required substantially higher numbers.
Hey, it wasnt Morrisons fault. I figured that out
all by myself! Give the man a break.Since the judge in the Can-Ban case has
stated that he intends to strike down the ban
as unconstitutional, the Pro-Ban machine has
been out in force right back to threatening
businesses and sending out misleading data.
Well get to that in the upcoming weeks, but
for now lets check up on a couple of the
Mayors recent statements and see how they
look in the harsh light of day:

Zeitung, regarding the vote to establish the
Can-Ban: We have to remember that 62
percent of the citizens who voted, voted to
ratify the ordinance,

It was 58% of the vote. And yes, the
numbers do matter. If they didnt matter,
she wouldnt have cited any. The HZ didnot correct her.
Main Course) Now this one this
ones really good. Also from an HZ
interview, and intended to bolster the
case for appeal: Another strong reason
to appeal, the mayor said, is because the
city has already won on appeal lawsuits
challenging its river ordinances regulating
Jell-O shot s and beer bongs.
FALSE. OH SO VERY FALSE.
EMBARRASSINGLY SO. WE ARE MORTIFIED.
The beer bong and Jell-o shot
ordinances never went to trial.As such, they
have never been appealed. AS SUCH, the
City has never won an appeal on those cases.
The HZ did not correct her.
Dessert If you re wondering why the
HZ goes ahead and distributes the Mayors
misinformation without correction, the Citys
check register has a few answers, 38,159.36
of them to be exact. Thats how much, in
American dollars, City Hall spent with the
Herald-Zeitung in 2013. (I should have said
it was a million dollars, because, you know,
numbers dont matter.)
Anyway, If I had a client dropping that
kind of dough I wouldnt want to correct
them either. Which is why its a good idea
for newspapers and governments to not do
business together. So far, so good on our end.

Gallagher Addresses Council Grown Men WeepWere not kidding about the weeping part,
either. Local attorney and Mayoral candidate
Greg Gallagher dropped an oratory bomb
regarding any potential Can-Ban appeal
at Monday nights Council meeting. Weve
got the text here, but to really appreciate
the speech, complete with ad-libs and
emotion and whatnot, you need to check
out the video. That video is posted on the
Citys website at tinyurl.com/nbcc21014.
Gallagher comes in at 49:30.
Although I opposed the river
ordinances passed over the past few
years, Ill be the rst to say our rivers
are cleaner and safer. However, we
must ask ourselves, at what cost? Did
the ends truly justify the means? Our
city has been polarized and neighbor
has been pitted against neighbor.
Tourism is down. Businesses have lost
revenue and many, unfortunately,
have shut their doors. You boast and
take personal credit that H.O.T. tax
revenue is up, yet thats not your
doing. Thats a natural result of an
improving economy, not a result of
your misguided ordinances.
Worst of all, your so called
leadership got us, the taxpayers,
involved in countless litigation
that ate up tax revenue that could
have been used to hire more police
ofcers and reghters and give both
these rst responder groups a much
deserved raise.

and based on sound legal principals
and our Texas Constitution. The river
outtters and all of our towns tourist
related businesses should now be free
to go about their business without
further government interference.
You know, the tragic irony is, we
pride ourselves on being a very
red county, in a very red state, yetthis council, every Monday night,
sits here and breaches the most
fundamental tenant of conservative
Republican principles: you all, our
citys government, meddle in most
mundane aspects of our daily lives
to our detriment. When a municipal
government regulates how a child
should eat a fruit cup on a Texas
river, Ayn Rand spins in her grave.You should not appeal this
ruling. If you dont understand
it, please ask your attorneys to
explain it to you. Better yet, Google
Texas Constitution and read it.
Oh, I know Mrs. Mayor, an alleged
overwhelming amount of e-mails
from unknown and unnamed citizens
support an appeal. That may be true.
However, theyre wrong and probably
the same group of wealthy river
homeowners that got us into this
mess in the rst place. Dont listen
to them. I repeat; they are wrong.
Its not their money at stake and
their personal agenda is in conict
with the 21st century growth of New
Braunfels and the reality that we live
in Texas No. 2 tourist destination
behind San Antonio.
So, what should we do ifwe dont appeal? Well, thats
easy. First, we end this litigation
madness! Then, we go back to the
drawing board and craft a solution
free of special interest groups and
back room conversations. This time
we should work together and come
up with reasonable solutions that
favor tourism and serve the needs of
everyone in our city and not just anelite few. We are all very passionate
about this issue because we all love
our town and we all want the same
thing two clean, safe rivers that
promote tourism while balancing
the need for a quiet and peaceful
existence for those, like me, who live
on or near our two amazing rivers.
Mrs. Mayor, Council members,
you will soon ask us, the citizens
of New Braunfels, to support you
in your desire to appeal Judge
Burgesss ruling. I hope you dont
get that support. Your policies have
failed and we have squandered three
years of economic opportunity. In 90
days three new faces will grace this
chamber. Let new leadership, elected
by the people, decide how we should
move forward. Your time is over,
youre done. Instead of using thisremaining time on this council to ask
for approval of the status quo, you
should instead be asking all of us for
our forgiveness.

Update: Can-BanThe specter of appeal lurked in thecourtroom during a brief hearing concerning
the lawsuit in the disposable container andcooler size ordinances.Visiting Judge Don Burgess, who had
already ruled that the ordinances wereunconstitutional and unenforceable, listenedMonday as lawyers for the plaintiffs and theCity of New Braunfels disputed the legal rulesregarding attorney fees. The judge said hewants to make sure all issues are well resolved.
I got a feeling that this case isnt endinghere, Burgess said. My job is to prepareas precise a package, both formally andlegally, as I can so parts of this case donthave to be done again.
I dont want to send something to Austinthat has error, he said.
William McKamie, who represents theCity in the lawsuit, and City Attorney ValAcevedo indicated they intend to recommendthe City appeal. Whether the Council willagree remains to be seen.
A proposed order to invoke a permanentinjunction on the City from enforcing theordinances has yet to signed by the judge, ashe waits for the issue of fees to be resolved. Herecessed the hearing until March 21 to giveboth sides more time to go over the fees.
Jim Ewbank, who represents the collectionof businesses that sued the City over theordinances, said the judge made the right call,saying he didnt provide the defendants with
his bills until last week. Ewbank said his feesare about $255,000 while McKamies feesare at about $350,000.
McKamie, however, argued that sincethe businesses only sought injunctive relief, theCity is not required to pay any attorneys fees.Ewbank took exception with that view.
The injunction is the relief, he said. Thefees are the resolution.
Those fees will certainly continue to rise if the
decision is appealed and Ewbank said hes readyto continue to fight if thats the case, although hewould prefer that the City decide otherwise.
We want to get the order in place andbegin working with the City to find a resolution,Ewbank said. Education and enforcement isthe best way. Theres a lot that can be done thatachieve the goals of the City, the citizens andbusinesses short of an appeal.
Once the final order is signed, the Citywill have 30 days to appeal.
Mayor Gail Pospisil has said NewBraunfels will continue to enforce theordinances. Even though the judge had
ruled the ordinances as unconstitutionaland unenforceable, McKamie said they arestill in force until the judge signs the order.Ewbank, however, advised that the City stopenforcement. The proposed order simply saysthat the judge decides for the plaintiffs.
(Burgess) wanted the order to be verygeneral, Ewbank said.
Also to be decided is the amount of bondthat the businesses involved in the suit willhave to take out. The bond is in case the Citysuffers damages while the case is on appeal. IfCouncil refuses to vote for an appeal, the bondwill be returned to the plaintiffs.
Update:Rathbun vs ScientologyLawyers for a Comal County woman arguedon Feb. 4 that her lawsuit against the Church ofScientology International (CSI) does not violatethe Churchs First Amendment rights.
The Church had filed an Anti-SLAPPmotion that claims the lawsuit infringes uponits rights and should be dismissed.
Monique Rathbun is suing the Church,its leader and others for what she says was acampaign of harassment and spying against her.Her legal team argued that the Church cannotprove that her suit is damaging the rights of CSI.
This lawsuit is not based upon, relatesto or (is) in any way a response to thedefendants First Amendment rights, attorneyMarc Wiegand argued. He also argued thatthe Churchs behavior crossed any line that
would have been considered protected.In his rebuttal, the Churchs attorney,
Ricard Cedillo, said Monique Ratbun wasbeing surveyed because her husband,Marty, was offering Scientology serviceswithout the Churchs permission, violating theorganizations trademarks and copyrights.
We wanted to investigate what he wasdoing, who was visiting him and who in ourorganization was helping him, Cedillo said.
However, another of Monique Rathbunsattorneys, Leslie Hyman, pointed out that if the
Church is going to base its actions upon Marty
Rathbun providing Scientology services without
its approval, then its a business dispute.
If its a fight between two businesses,
then Anti-SLAPP does not apply, Hyman said.
Judge Dib Waldrip gave both sides until
Feb. 14 to file objections and responses. After
that, the judge has 30 days to decide on theChurchs motion.

Dear Mort,Glad you asked this, because I had
forgotten about being asked to look this upon a few occasions. There is only a tiny truthabout this issue. Vanilla actually comes froma bean, or more specifically a pod, that growssimilar to a green bean. Actual vanilla is veryexpensive but in high demand, so at timesartificial versions are used. The confusion isactually about another spice called castoreum.
Castoreum is at times used as a substitutefor vanilla in foods, and its derived from asubstance excreted from the scent/anal glandsof the North American Beaver. How do youknow when its in your food? You dont, as it isnormally labelled as natural flavoring.
Its funny, but I never realized howmuch natural flavoring comes from ourlocal politicians.

Dear Gabacho: Alas, homeboy is
probably going, going, adis. The Obama
administrations Deferred Action for
Childhood Arrival (DACA), which allows
undocumented youngsters a two-year stay
of deportation (subject to renewal) until
Congress gets its amnesty act together,
specifically states that candidates arenteligible if youve been convicted of a felony,
significant misdemeanor, three or more
other misdemeanors, andpose a threat to
national security or public safety.
Without knowing the circumstances of
the guy youre talking about, it doesnt seem
he stands a chance for judicial mercy or to
become a cause clbre for DREAMers across
the country. That said, if all the charges were
bull, and the legal system has royally screwed
the kid, get in contact with your local DREAMer
movement, as their courage in fighting for the
damned has been far more impressive than
what Latino politicians have shown. And do
it fast: the Obama administration deports
Mexicans as quickly as Californias reservoirs
are drying up.
My wife, (who is Mexican) is a tough
nut psychologically to figure out, so I
am turning to the expert to for some
desperately needed insight. Essentially,
when we began dating, all was right asrain. She was sweet, kind, considerate
and extremely attentive.
Now, what I call brown outs
occur. She will fly off the handle at the
drop of a hat, throw things, say awful
nasty thingsbasically turn into a
she-devil. Furthermore, the jealousy
(although seemingly dormant for the
moment) is always there. I think it
would drive her loca if I ever left my
garage and had a beer at the cantina
again. We love each other very much,
so I guess you could say our marriage

New Orleans is one of the most romantic cities in America. Walking hand-in-hand with the one you
love under the gaslights in Jackson Square will create a memory youll never forget. Since 1840,
Antoines restaurant in the French Quarter has been serving historic dishes for the rich and famous.
In 1899, their chef created Oysters Rockefeller which was named after John D. Rockefeller,
the richest man in America, due to the richness of the sauce. With a little variation of this recipe,Antoines created Oyster Bienville and named it after Jean de Baptiste Le Moyne, Sieur de Bienville
who was one of the founders of the city of the Crescent City. Even if you and your love cant get to
NOLA this Valentines Day, you can still bring some of that romance and history home to your own
kitchen; and what better way than with a dish legendary for its aphrodisiac properties!
Oysters Bienville 12-24 raw oysters in their shell
Course rock salt
cup chopped green onions
1 clove garlic, minced
3 tbls butter
1/3 cup all-purpose our
salt
tsp ground white pepper
tsp crushed red pepper akes
1 cup chicken broth
cup heavy whipping cream
2 egg yolks, beaten
lbs cooked, shelled and deveined,
shrimp, chopped
cup fnely chopped mushrooms
2 tbls white wine
cup grated Parmesan cheese
2 tbls dry bread crumbs
1/8 tsp paprika
Shucking oysters can be difficult and possibly dangerous. The last place you want to spend
Valentines Day is in the emergency room. So use oysters that were slightly steamed by the fish
market. This will cause them to crack open just slightly and allow you to easily open them up with
a simple butter knife. Ask the fishmonger at the seafood counter or look for oysters with a rubberband around them. They will be about $0.70 per oyster. Once open, use a butter knife to scoop
under the oyster and detach it from the shell. Rinse out any grit, dirt, or sand. Place each oyster
in the deep half of each shell and arrange shells on a bed of coarse rock salt in a shallow pan.
In a saucepan, saut green onions and garlic in butter about 5 minutes or until tender. Stir in
flour, salt, white pepper, and red pepper. Add chicken broth and cream, stirring until well blended.
Continue cooking over medium heat until the mixture is thickened and bubbly, stirring occasionally.
Reduce heat. Stir in beaten egg yolks very slowly so as to not cook the eggs. Return mixture
to saucepan. Bring to a gentle boil. Cook and stir 2 minutes more.
Stir in shrimp, mushrooms, and wine. Heat thoroughly. Remove from heat. Spoon 2
tablespoons of the shrimp mixture over each oyster.Combine Parmesan cheese, bread crumbs, and paprika in a bowl. Sprinkle over oysters.
Bake in a 400 degree oven for 15 to 20 minutes or until golden on top and the oysters curl.
Garnish with lemon wheels and fresh parsley. Serve under candlelight with your favorite
wine or bubbly.

Obamacare:Failure in Five Steps
The Patient Protection and Affordable Care
Act, better known as Obamacare has thereever been a piece of legislation that so clearly
failed to accomplish its intended goals? The bill
was passed in piata form: gaudily festooned
with flowery rhetoric but essentially empty,
left to be filled with special interest free-for-
alls, political paybacks, and empty-headed,
economically-ignorant, anti-capitalist wishful
thinking. Now that the bill has passed, and the
various bureaucracies have had their way with
it, we can see what isin it, and its a sticky hotmess. Thanks, Speaker Pelosi.
Obamacare was intended to do just five
things: increase the quality of health insurance,
increase the affordability of health insurance,
lower the uninsured rate by expanding
public insurance, lower the uninsured rate
by expanding private insurance, and reduce
the cost of healthcare overall. The rosiest
projections suggest that none of these things
will improve substantially.
The quality of health insurance is
really a matter of perspective. The Obama
administration has made much of insurance
that is worthless if you are dropped when you
get sick. Nothing could be truer. Of course,
healthcare services like maternity and lactation
services are worthless to me (no equipment),
as are drug treatment services (no money),
and free contraception (no opportunities).Quality insurance needs to cover those
things that I need, and ideally, it should cover
only the things I cant afford on my own.
Insurance companies dont make money by
collecting less than they pay out for in services,
so paying for non-essential services that
everyone will use runs up the cost of coverage
for everyone involved, which leads us to the
next Obamacare goal.
Increasing the affordability of healthinsurance seems to be the area where
Obamacare will fail most spectacularly. As I
pointed out above, if there is one sure way
to mess this up, it has been accomplished by
adding numerous silly healthcare services
that are either unneeded or could be paid
for out-of-pocket. Furthermore, I would like
people to consider this question: what was
the last thing that you were legally required
to purchase that decreased in price? Put adifferent way, increased demand makes the
cost go which way?
Already people are seeing that their
healthcare premiums are going up. In most
cases, their deductibles and co-pays are
as well. (Sure, the wet-nurse is swell, but
Schroders college fund is going to be abit light from now on). Since wages have
not been going up in the meantime, I take
this as a bad sign for affordability. In fact,
the only people likely to see their health
insurance costs go down are those who
are qualified for subsidies of one kind or
another, the burden of cost shifting back to
taxpayers in general.
An example of this very problem is one
of the goals of Obamacare: to lower therate of uninsured by expanding the rolls of
public insurance. Those rolls are expanding,
and you can be sure that this will cost quite a
pretty penny. The bill may not come from your
insurance company, but it will be paid, either
through higher taxes or more borrowing.
Dont get me wrong, the statistics indicate that
the uninsured in America will still exceed 30
million after Obamacare. None of this will
solve the problem of the uninsured. The initial
evidence seems to indicate that the Medicaid
expansion is overshadowed by those who
have lost their private insurance. In the end, if
the rate of uninsured in this country does drop,
it will not drop significantly, and it will not be
cheap in any case.
The idea of expanding private insurance
and thus dropping the rate of the uninsured
was always a pipe-dream. If circumstanceshad allowed for such a thing, it already would
have been done. Private insurers dont go out
of their way to leave market share on the table.
They only do so if that market is unprofitable.
If the thought process was, instead, that
mandating that insurance be carried would
do the trick, a bigger stick should probably
have been used. The penalties for not having
insurance are far less than the cost of insurance
overall. Consumers tend not to make irrationaldecisions just because we wish they would
(though a clever ad campaign can help),
and since the administration seems to be
backing away from even the small penalties
they intended to apply, there is little reason
for people who dont want health insurance to
buy health insurance.
The idea that healthcare costs, overall, will
be reduced by Obamacare seems to be falling
by the wayside as well. Costs are continuingto rise, and any drop in that rate of increase
has more to do with the lack of money in the
market than with legislation of any type. In
addition, all we have really done is shifted the
cost from one set of books to another. If taxes
increase to pay for healthcare, that doesnt
lower the price of healthcare.Once again, the belief that Obamacare
could lower healthcare costs was based on a
fallacy. If money was being wasted, you can
be certain that some shrewd businessman
would have already found a way to profit by
removing that waste. In fact, the very idea
that the government is capable of teaching
business how to spend money more effectively
is so absurd that I cant even continue the line
of thought beyond this sentence.So, you say, Obamacare is a disaster,
but what do you have to offer other than
criticism? Not surprisingly, Republicans
have fallen into this trap and are offering
their own healthcare solutions. Let me be the
first to say that the Republicans are just as
sure to mess things up as the Democrats did.
Any attempt on their part to try to polish this
abomination is folly at best and dangerous at
worst. Democrats know this and are happy to
have Republicans share some of the blame as
quickly as possible.
I have nothing to offer but criticism.

Now that the engines of the plane
have been shut off, the fuel dumped, pilot
and copilot killed, and a .45 taken to the
control panel, Im supposed to come upwith some constructive suggestion or sit
back down and think happy thoughts like
everyone else? Well, you can be sure thats
not going to happen.
Sometimes theres nothing left to do but
place blame and run screaming around the
cabin like your hair is on fire.
Obamacare is one of those situations.
Im not sure I would even suggest repealing
it. The damage has already been done; thisplane is coming down. I know things wont
be made any better with a fresh coat of
paint, and Im not sure were in the position
to redesign it into a glider at this point. If its
possible, maybe we can auger this pig in a
less populated area. Barring that, have the
first responders on standby, and Stewardess,
bring me another drink.
