(1) When a motor vehicle titled and domiciled in Alabama is salvaged or considered a total loss ... it will be the responsibility of the owner or any person acquiring ownership (individual, company, or insurance company) to complete form MVT 41-1 {Application for Salvage Certificate of Title), and mail or deliver it to the Department of Revenue as soon as practicable for processing.

(3) Upon receipt of a properly completed MVT 41-1 and the supporting documents as specified in Section 2, the Department will issue a salvage certificate of title. The salvage certificate of title will reflect the legend "Parts Only - Non-Rebuildable" if such disclosure was made on the MVT 41-1. The salvage certificate of title will reflect the legend "Flood Vehicle" if such disclosure was made on the MVT 41 -1 ...

Notes: We are to submit the required form to the Department, who will return a Salvage Title with any appropriate additional branding based on our disclosures on the form. There are no official guidelines as to what defines a "Non-Rebuildable" vehicle, so this would presumably be left to our best discretion as to what should be rebuilt.

Alaska

Sale Title Type Not Specified Alaska law does not address salvage titles nor does Alaska issue a salvage title. A vehicle with a salvage title is treated the same as a reconstructed vehicle.

Bills of sale are acceptable to transfer ownership.

A person who wrecks, dismantles, or destroys a vehicle is required to immediately surrender the title, registration and plates to OMV. The title should have "junked.n "wrecked," or"dismantled" written across the face of it.

If a vehicle is to be rebuilt for use on the road it is be titled according to the procedures for any reconstructed vehicle. When the title is surrendered to OMV the vehicle is treated much the same as any ordinary vehicle part and may be sold using a bill of sale.

Arizona

Non-Repairable - Has no resale value except as a source of parts or scrap metal and the owner or insurer designates the vehicle solely as a source of parts or scrap metal. - Is a completely stripped vehicle that is recovered from theft and that is missing the engine or motor, the transmission, all of the bolt-on sheet metal body panels, all of the doors and hatches, substantially all of the interior components and substantially all of the grill and light assemblies or that the owner designates has little or no resale value except its worth as a source of scrap metal or as a source of a vehicle identification number that , could be used illegally. - Is a completely burned vehicle that has been burned to the extent that there are no usable or repairable body or interior components, tires and wheels, engine or motor or transmission and that the owner irreversibly designates as having little or no resale value except as a source of scrap metal or as a source of a vehicle identification number that could be used illegally.

Salvage "Salvage vehicle" means a vehicle, other than a nonrepairable vehicle, of a type that is subject to titling and registration pursuant to this chapter and that has been stolen, wrecked, destroyed, flood or water damaged or otherwise damaged to the extent that the owner, leasing company, financial institution or insurance company considers it uneconomical to repair the vehicle.

Stolen Vehicle "Stolen vehicle certificate of title" means a vehicle ownership document issued to the owner of a vehicle that has been stolen and not recovered.

(6) "Salvage vehicle" means a motor vehicle that is: (A) Water-damaged; or (B) Sustains any other damage in an amount equal to or exceeding seventy percent (70%) of its average retail value as determined under criteria established by rule of the Office of Motor Vehicle; and

(7) "Water-damaged" means damage to a motor vehicle caused by submerging or partially submerging the vehicle in water to the extent that the vehicle was submerged or partially submerged at any water level above the dashboard of the vehicle, regardless of the actual dollar amount of the damage.

2305 (a) The provisions of this subchapter shall not apply to motor vehicles more than seven (7) model years old prior to the calendar year of the occurrence.

(b) Any title that is branded pursuant to this subchapter shall retain the brand on the title for the life of the vehicle.

Notes: We are to submit total loss vehicles to the State. Vehicles 7 model years old and newer will be branded as "Salvage" if the damage meets or exceeds 70% of ACV, or is water damaged.

Salvage or damaged, to the extent that the owner, leasing company, financial institution, or the insurance company that insured or is responsible for repair of the vehicle, considers it uneconomical to repair the vehicle and because of this, the vehicle is not repaired by or for the person who owned the vehicle at the time of the event resulting in damage.

Colorado

Salvage A salvage vehicle is a vehicle that is damaged by collision, fire, flood, accident, trespass, or other occurrence, excluding hail damage, to the extent that the cost of repairing the vehicle to a roadworthy condition and for legal operation on the highways exceeds the vehicle's retail fair market value immediately prior to such damage, as determined by the person who owns the vehicle at the time of such occurrence or by the insurer or other person acting on behalf of such owner.

There also exist brands in addition to salvage for various damage sustained to the vehicle: Rebuilt (from salvage), nonrepairable ((a) IS INCAPABLE OF SAFE OPERATION ON THE ROAD AND THAT HAS NO RESALE VALUE EXCEPT AS SCRAP OR AS A SOURCE OF PARTS; OR (b) THE OWNER HAS DESIGNATED AS SCRAP OR AS A SOURCE OF PARTS.), flood (SUBMERGED IN WATER TO THE POINT THAT RISING WATER HAS REACHED OVER THE DOORSILL AND ENTERED THE PASSENGER COMPARTMENT AND DAMAGED ELECTRICAL, COMPUTER, OR MECHANICAL COMPONENTS.), odometer tampering, or Junk (INCAPABLE OF OPERATING ON ROADS AND IS NO LONGER A VEHICLE BECAUSE IT HAS BEEN DESTROYED, DISMANTLED, OR CHANGED).

Connecticut

Salvage An insurance company takes possession of a vehicle that (1) has been declared a total loss and {2) the company or its agent offers it for sale in Connecticut as a result of the settlement of a claim for damage or theft. If the vehicle's certificate of title was issued in Connecticut, the company must (1) stamp the title with the word "SALVAGE" in letters one inch high and not more than three inches long and (2) attach the appraiser's damage report for the vehicle to the title.

Salvage Parts Only If the insurance company determines that the vehicle has 10 or more major component parts (such as the engine or transmission) that must be replaced because they are damaged beyond repair, the title must instead be stamped "SALVAGE PARTS ONLY" in the same dimensions. The insurance company must send OMV a copy of the certificate. If the title for the vehicle was issued by another state, the insurance company must attach a copy of the appraiser's damage report for the vehicle to the title.

(a) Whenever any registered or unregistered motor vehicle, for which a title has been issued by the Department, is transferred as salvage as a result of a total loss insurance settlement, the insurance company or its authorized agent shall send the certificate of title of the vehicle to the Department within 30 days from the date of settlement. Upon receipt of the certificate of title and appropriate fee, the Department shall issue a salvage certificate. Such salvage certificate shall be deemed to meet all State proof of ownership. (b) If the owner of any registered or unregistered motor vehicle for which a title has been issued by the Department receives a total loss insurance settlement for the vehicle and chooses to retain ownership of the vehicle as owner retained salvage, the insurance company shall either comply with the requirements in paragraph (a) of this section or require the owner of the vehicle to procure a salvage certificate from the Department prior to paying the total loss insurance settlement. (c) If a salvaged or junked motor vehicle is sold to a scrap processor and if the vehicle is to be totally destroyed, the salvage dealer or junk dealer shall, within 30 days of said sale, certify on the salvage certificate that the vehicle was sold to be destroyed and list the name of the scrap processor or buyer along with the date of sale and that the vehicle no longer exists and forward the salvage certificate to the Department for cancellation. (d) The Department shall issue to the seller a receipt in the name of the seller, agent or owner for the salvage certificate. The seller or vehicle owner or agent shall keep such records and receipt for a period of 3 years from the date of sale and shall make such records and receipts available for inspection and examination by any police officer during the regular working hours of such business, seller or agent.

(f) The record keeping requirements outlined in this section shall be applicable to scrap processors, salvage dealers, junk dealers and insurance companies or their authorized agents. The record keeping requirement and penalties for failure to maintai_n such records shall not apply to individual owners who choose to retain ownership of their total loss vehicle as owner retained salvage.

Notes: If we declare a vehicle a total loss, we will secure the title and send to the State, who will issue us a Salvage certificate. If we then "junk" or scrap the vehicle, we must indicate this on the title and surrender the salvaQe certificate to the State who will then return a receipt acknowledgement. We must retain this receipt for

(1) As used in this section, the term: (a) "Certificate of destruction" means the certificate issued pursuant to s. 713.78(11) ors. 713. 785(7)(a).

(i) "Late model vehicle" means a motor vehicle that has a manufacturer's model year of 7 years or newer.

(r) "Salvage" means a motor vehicle or mobile home which is a total loss as defined in paragraph (3)(a).

(3)(b) ... an insurance company that pays money as compensation for the total loss of a motor vehicle or mobile home shall obtain the certificate of title for the motor vehicle or mobile home, make the required notification to the National Motor Vehicle Title Information System, and, within 72 hours after receiving such certificate of title, shall forward such title to the department for processing ...

... For a late model vehicle with a current retail cost of at least $7,500 just prior to sustaining the damage that resulted in the total loss, as established in any official used car guide or valuation service, if the owner or insurance company determines that the estimated costs of repairing the physical and mechanical damage to the vehicle are equal to 90 percent or more of the current retail cost of the vehicle, as established in any official used motor vehicle guide or valuation service, the department shall declare the vehicle unrebuildable and print a certificate of destruction, which authorizes the dismantling or destruction of the motor vehicle. .. .

... If a motor vehicle has a current retail cost of less than $7,500 just prior to sustaining the damage that resulted in the total loss, as established in any official used motor vehicle guide or valuation service, or if the vehicle is not a late model vehicle, the owner or insurance company that pays money as compensation for the total loss of the motor vehicle shall obtain a certificate of destruction, if the motor vehicle is damaged, wrecked, or burned to the extent that the only residual value of the motor vehlcle is as a source of parts or scrap metal, or if the motor vehicle comes into this state under a title or other ownership document that indicates that the motor vehicle is not repairable, is junked, or is for parts or dismantling only

Notes: When a vehicle is declared a Total Loss (any settlement in lieu of repair), we are to send the title to the State for review and processing within 72 hours receipt of transfer documents. Any late model vehicle with a value greater than $7,500 will issued a Salvage Title if the estimate amount is less than 90% of the vehicle value, or a Certificate of Destruction if the repair is 90% or more of the vehicle value. All other vehicles (not Late Model or lower ACV) will be issued Salvage unless we the insurer request a Certificate of Destruction for vehicles so severily damage that they have no rebuildable potential.

(9) "Major component parf' means any one of the following subassemblies of a motor vehicle: (A) Front clip assembly (fenders, hood, and bumper); (B) Rear clip assembly (quarter panels, floor panel assembly, and roof assembly, excluding a soft top); (C) Engine and transmission; (D) Frame; or (E) Complete side (fenders, door, and quarter panel).

(11) "Salvage motor vehicle" means any motor vehicle: (A) Which has been damaged to the extent that its restoration to an operable condition would require the replacement of two or more major component parts; (8) For which an insurance company has paid a total loss claim and the vehicle has not been repaired, regardless of the extent of damage to such vehicle or the number of major component parts required to repair such vehicle, but shall not mean or include any stolen motor vehicle which has been recovered with the public manufacturer's vehicle identification number plate intact and the vehicle: (i) Is undamaged; (ii) Has only cosmetic damage; or (iii) Has been damaged but only to the extent that its restoration to an operable condition will not require the replacement of two or more major component parts;

Article 2 40-3-36.1. Designation of flood damaged or fire damaged vehicle on certificate of title For any salvage motor vehicle which, after inspection, it is determined that repair to an operable condition does not require replacement of two or more major component parts but it is determined that the damage to the vehicle is a result of flood or fire shall be designated as flood damaged or fire damaged by the commissioner and such designation shall be indicated on the face of the certificate of title for such vehicle.

(C) Any insurance company which acquires a damaged motor vehicle by virtue of having paid a total loss claim shall mail or deliver the certificate of title to the commissioner for cancellation. In every case in which a total loss claim is paid and the insurance company does not acquire such damaged motor vehicle, the insurance company paying such total loss claim, the vehicle owner, and the lienholder or security interest holder, as applicable, shall take the following steps to secure a salvage certificate of title for such motor vehicle:

(1) When an insurance company makes a payment of damages on a total loss claim for a vehicle, the insurance company shall be deemed to be the owner of such vehicle and the vehicle shall be considered to be salvage except that ownership of

(i) a vehicle that has incurred only hail damage that does not affect the operational safety of the vehicle or (ii) any vehicle 9 model years of age or older may, by agreement between the registered owner and the

insurance company, be retained by the registered owner of such vehicle. The insurance company shall promptly deliver or mail within 20 days the certificate of title along with proper application and fee to the Secretary of State, and a salvage certificate shall be issued in the name of the insurance company. Notwithstanding the foregoing, an insurer making payment of damages on a total loss claim for the theft of a vehicle shall not be required to apply for a salvage certificate unless the vehicle is recovered and has incurred damage that initially would have caused the vehicle to be declared a total loss by the insurer.

Notes: In theory, when vehicle damages exceed 75% of the vehicle value, we are to apply for a salvage title. In practice, we apply for and receive a salvage title on other total losses, even when the damage is a lesser percentage of the vehicle value. Additionally, we are to seek the "water damaged" brand on vehicles what were damaged by flood or submersion. Kentucky Statute states "water damaged" vehicles are those that were flooded to the dashboard or higher. We may seek a salvage title on other (lower water-level) floods even if they do not meet the definition of "water damaged." One of two exceptions would be intact recovered thefts. 186A.530(7)(a) states that we are to apply for a salvage title on applicable recovered theft salvage vehicles; from the inverse of that, it can be inferred that we are not to apply for a salvage title if the damage does not meet the definition of a salvage vehicle. The other exception would be "junked vehicles" or those considered destroyed pursuant to 186A.295. In those instances, we are to surrender the title to the State (via county clerk) for cancellation. There are statutory guidelines that compel us to total vehicles with damages greater than or equal to 75% of the vehicle value; however all vehicles we settle as Total Losses are issued a salvage title even if they do not meet the damage threshold.

There are three exceptions to this rule. The first are hail damaged vehicles, which receive a branded clean title and not a salvage title. The second are intact recovered thefts, which LAC excludes from the RS definition of Total Loss. An insurance company which obtains title to a motor vehicle as a result of paying a total loss claim resulting from collision, fire, flood or other cause shall obtain a salvage certificate of title in its name for such vehicle from the State Tax Commission. The provisions of this subsection shall not apply to vehicles ten (10) years old or older with a value of One Thousand Five Hundred Dollars ($1,500.00) or less, or to vehicles with damage which requires the replacement of five (5) or fewer minor components, which such insurer may dispose of by endorsing change in ownership on the certificate of title using space reserved for reassignment of title by licensed dealer without obtaining a salvage certificate of title.

Title Type: HAIL Vehicles that are totaled due to hail damage will have their title stamped "HAIL." To obtain a Hail Title the following must be provided: 1. Statement requesting hail title on company letterhead, 2. Form 78-002 with "Hail" box selected, 3. Current title signed over to insurer, 4. Form 78-900, and 5. $9 title application fee.

Notes: We are required to apply for a salvage title for any vehicle we declare a total loss and pay, except vehicles 10 years or older and ACV below $1500, or those with vehicles with damage to 5 or fewer components. In practice, we secure a salvage title on all vehicles regardless of age and ACV, except for our intact recovered thefts with minimal or no damage.

Upon receipt of title application, applicable fee, the completed inspection, and the return of any previously issued negotiable salvage certificate, the director shall issue an original title with no salvage or prior salvage designation. Upon the issuance of an original title the director shall remove any indication of the negotiable salvage title previously issued to the insurance company from the department's electronic records.

Notes: We are to secure salvage on all total losses except for those we subjectively declare unsafe for or incapable of highway operation which require a junk title. The exceptions are intact recovered thefts, which may have the title reversed upon a law enforcement inspection.

Montana

Salvage "Salvage vehicle" means a motor vehicle damaged by collision, tire, flood, accident, trespass, or other occurrence to the extent that the owner, an insurer, or another person acting on behalf of the owner determines that the cost of parts and labor makes it uneconomical to repair the vehicle. An insurer acquiring ownership of a motor vehicle that is less than 15 years of age and that the insurer determines to be a salvage vehicle shall surrender the certificate of title to the department within 15 days after acquiring the certificate of title.

Nebraska

Salvage A salvage vehicle is a vehicle that is a late model vehicle that has been wrecked, ~amaged, or destroyed to the extent that the estimated total cost of repair to rebuild and restore the vehicle to its condition immediately before it was damaged exceeds 75% of the retail value of the vehicle at the time it was damaged. This includes vehicle's damaged by flood. Flood-damaged means a vehicle that was submerged in water to the point that rising water reached over the floorboard, entered the passenger compartment and caused damage to any electrical, computerized or mechanical components. The "flood-damaged" designation does not apply when an insurance claim representative or a vehicle repairer inspects the vehicle and indicates it: (i) has no electrical, computerized or mechanical components damaged by water; or (ii) had one or more electrical, computerized or mechanical components damaged by water and all such damaged components were repaired or replaced.

Late model vehicle is a vehicle that: is 7 years old or less, as determined by the manufacturer's model year designation, or; has a retail value of more than $11, 000 until January 1, 2015.

Cost of repairs: The estimated or actual retail cost of parts needed to repair a vehicle, plus the cost of labor computed by using an hourly labor rate and time that are customary and reasonable. Retail cost of parts and labor rates may be based upon collision estimating manuals or electronic computer estimating systems customarily used in the automobile insurance industry.

New Hampshire

Salvage Any insurance firm or representative thereof who shall declare a motor vehicle other than an exempt vehicle as provided in RSA 261 :3 as having been a total loss shall make application for a salvage certificate of title within 20 days of the total Joss payment.

A total loss vehicle shall mean either an unrecovered stolen vehicle or a damaged vehicle: - That is determined to be physically or economically impractical to repair in connection with an insurance claim settlement; or - For which the cost of repairing the vehicle is 75 percent or more of its fair market value prior to the vehicle being damaged, if the damage occurs during its model year or the 4 subsequent calendar years. The total cost of repairing the vehicle shall not include the cost of repairing, replacing, or reinstalling inflatable safety restraints, tires, or entertainment systems.

Any motor vehicle whose manufacturer's model year is older than 15 years, except heavy trucks and truck­tractors whose gross vehicle weight exceeds 18,000 pounds.

Salvage Whenever a motor vehicle is reported as being stolen or is damaged to such an extent that it is economically impractical to repair such motor vehicle, the owner, insurer or person in possession of the certificate of ownership shall, within 1 O working days after the motor vehicle was reported as stolen or damaged, or within 10 working days after settling a total loss insurance claim, surrender the certificate of ownership for such motor vehicle to the Commission. Upon surrender of the certificate of ownership, a salvage certificate of title shall be issued to the owner of the salvage motor vehicle.

A certificate of ownership without a salvage designation shall be issued to the owner of the following motor vehicles: - A stolen motor vehicle that is subsequently recovered and which has not sustained damage to such an extent that it has been rendered economically impractical to repair, provided that the recovered stolen motor vehicle does not have a missing, altered or damaged vehicle identification number or plate. - A stolen motor vehicle that is subsequently recovered with a missing, altered or damaged vehicle identification number or plate after determination at a State inspection that such recovered motor vehicle is not a stolen motor vehicle, provided such vehicle has not sustained damage to such an extent that it has been rendered economically impractical to repair.

Non-Repairable - Has no resale value except as a source of parts or scrap metal or that the owner irreversibly designates as a source of parts or scrap metal or for destruction; - Has been substantially stripped as a result of theft or is missing all of the bolts on sheet metal body panels, all of the doors and hatches, substantially all of the interior components and substantially all of the grill and light assemblies and has little or no resale value other than its worth as a source of a vehicle identification number that could be used illegally; or - Is a substantially burned vehicle that has burned to the extent that there are no more usable or repairable body or interior components, tires and wheels or drive train components or that the owner irreversibly designates for destruction or as having little or no resale value other than its worth as a source of scrap metal or as a source of a vehicle identification number that could be used illegally.

Salvage Every title shall bear the brand "REBUILT SALVAGE" and the abbreviation "NY'' if the vehicle is eight model years old or newer on the date of loss and tilled in New York after any one of the following has occurred: - The vehicle has been wrecked, destroyed or damaged to the extent that the total estimated or actual cost of parts and labor to rebuild or reconstruct the vehicle to its pre-accident condition, and for legal operation on the road or highways, exceeds 75 percent of the retail value of the vehicle at the time of loss as set forth in a current nationally recognized compilation of retail values.

Theft No title will be branded if the vehicle is a theft recovery for which the insurance company sends the commissioner a statement on letterhead stationery asserting that the vehicle was recovered with no damage or with damage which does not exceed 75 percent of the retail value at the time of recovery, as set forth in a current nationally recognized compilation of retail values.

(33) a. Flood Vehicle. -A motor vehicle that has been submerged or partially submerged in water to the extent that damage to the body, engine, transmission, or differential has occurred.

d. Salvage Motor Vehicle. -Any motor vehicle damaged by collision or other occurrence to the extent that the cost of repairs to the vehicle and rendering the vehicle safe for use on the public streets and highways would exceed seventy-five percent (75%) of its fair retail market value, whether or not the motor vehicle has been declared a total loss by an insurer. Repairs shall include the cost of parts and labor. Fair market retail values shall be as found in the NADA Pricing Guide Book or other publications approved by the Commissioner.

f. Junk Vehicle. -A motor vehicle which is incapable of operation or use upon the highways and has no resale value except as a source of parts or scrap, and shall not be titled or registered.

§ 20-109.1

(b) Transfer to Insurer. - If a salvage vehicle owner does not want to keep the vehicle, the owner must assign the vehicle's certificate of title to the insurer when the insurer pays the claim. The insurer must send the assigned title to the Division within 10 days after receiving it from the vehicle owner. The Division must then send the insurer a form to use to transfer title to the vehicle from the insurer to a person who buys the vehicle from the insurer. If the insurer sells the vehicle, the insurer must complete the form and give it to the buyer. If the buyer rebuilds the vehicle, the buyer may apply for a new certificate of title to the vehicle.

The exceptions to salvage titling are those we subjectively deem "junk" vehicles, which are heavily damaged and declared incapable of operation, and recovered theft vehicles which are not required to be declared salvage until after they are recovered and damage examined (if the damage is nominal, we sell those on a clean title).

Salvage A vehicle must be branded as "salvage" when it has had damage that is in excess of 75% of the pre-damaged retail value according to the National Automobile Dealers Association Official Used Car Guide.

Standard Certificate of Title with "Previously Salvaged" brand If a vehicle for which a salvage certificate of title has been issued is reconstructed, a regular certificate of title may be obtained by completing an application for the certificate. The applicant shall include with the application a certificate of inspection in the form required by the department, the salvage certificate of title, and a five dollar fee. paid an agreed price for the purchase of the motor vehicle to any insured or claimant owner, the insurance company shall receive the certificate of title and the motor vehicle and proceed as follows. Within thirty days, the insurance company shall deliver the certificate of title to a clerk of a court of common pleas and shall make application for a salvage certificate of title. The clerk shall issue the salvage certificate of title on a form, prescribed by the registrar, that shall be easily distinguishable from the original certificate of title and shall bear the same information as the original certificate of title except that it may bear a different number than that of the original certificate of title. Except as provided in division (C)(2) of this section, the salvage certificate of title shall be assigned by the insurance company to a salvage dealer or any other person for use as evidence of ownership upon the sale or other disposition of the motor vehicle, and the salvage certificate of title shall be transferrable to any other person. The clerk shall charge a fee of four dollars for the cost of processing each salvage certificate of title.

(2) If an insurance company considers a motor vehicle as described in division (C)(1) of this section to be impossible to restore for highway operation, the insurance company may assign the certificate of title to the motor vehicle to a salvage dealer or scrap metal processing facility and send the assigned certificate of title to the clerk of the court of common pleas of any county . The insurance company shall mark the face of the certificate of title "FOR DESTRUCTION" and shall deliver a photocopy of the certificate of title to the salvage dealer or scrap metal processing facility for its records.

Notes: Vehicles we settle as total losses due to the impracticality of repair are required to be declared Salvage and we are compelled to apply for a salvage title; unless we consider the vehicle impossible to restore for operation, in which instance we surrender the title "FOR DESTRUCTION" and sell it to a parts salvage dealer or scrap processor.

These guidelines allow us to sell intact recovered thefts on clean titles, as the Salvage determination is not

§4 7-1105. Definitions A. As used in the Oklahoma Vehicle License and Registration Act: damaged by collision or other occurrence to the extent that the cost of repairing the vehicle for safe operation on the highway exceeds sixty percent (60%) of its fair market value, as defined by Section 1111 of this title, immediately prior to the damage. For purposes of this section, actual repair costs shall only include labor and parts for actual damage to the suspension, motor, transmission, frame or unibody and designated structural components; 2. "Rebuilt vehicle" means any salvage vehicle which has been rebuilt and inspected for the purpose of registration and title; 3. "Flood-damaged vehicle" means a salvage or rebuilt vehicle which was damaged by flooding or a vehicle which was submerged at a level to or above the dashboard of the vehicle and on which an amount of loss was paid by the insurer; 4. "Un recovered-theft vehicle" means a vehicle which has been stolen and not yet recovered; 5. "Recovered-theft vehicle" means a vehicle, including a salvage or rebuilt vehicle, which was recovered from a theft; and 6. "Junked vehicle" means any vehicle which is incapable of operation or use on the highway, has no resale value except as a source of parts or scrap and has an eighty percent (80%) loss in fair market value.

§4 7-1111 . Salvage Title

0. Any owner of a salvage or junked vehicle sh~ll submit the certificate of title to the Tax Commission or motor license agent for issuance of an appropriate title. Any holder of a certificate of title issued by this state, to a vehicle which no longer exists, shall surrender the certificate of title to the Tax Commission for cancellation.

Notes: The State of Oklahoma defines Salvage vehicles as ones whose damage exceeds 60% of the vehicle value. Additionally, we are to apply for a Junk title if a vehicle's damage exceeds 80% and the vehicle is incapable of operation. Note that not all vehicles with 80% damage are compelled to be junked, but only those incapable of operation.

The exceptions are Unrecovered Thefts, which are issued an Unrecovered Theft Vehicle title. At such time of vehicle recovery, we may apply for a Salvage or Junked or Recovered-Theft Vehicle title depending on the damage of the vehicle.

Oregon

Salvage Totaled Vehicle means: - A vehicle that is declared a total loss by an insurer that is obligated to cover the loss or that the insurer takes possession of or title to. - A vehicle that is stolen, if it is not recovered within 30 days of the date that it is stolen and if the loss is not covered by an insurer. - A vehicle that has sustained damage that is not covered by an insurer and that is such that the estimated cost to repair the vehicle is equal to at least 80 percent of the retail market value of the vehicle prior to the damage.

A salvage title is required when an insurer obtains the certificate of title form the owner of a vehicle that has been declared a total loss.

"Nonrepairable vehicle." An abandoned vehicle under paragraph ( 1 )(iii) of the definitions of "abandoned vehicle" which is incapable of safe operation for use on roadways or highways and which has no resale value except as a source of parts or scrap only, a salvage vehicle issued a nonrepairable or nonrebuildable vehicle document by another state or a vehicle which a salvor or vehicle salvage dealer designates as a source for parts or scrap or which the owner irreversibly designates as a source for parts or scrap. Such vehicles may not be issued a certificate of titre or certificate of salvage.

"Salvage vehicle." A vehicle which is inoperable or unable to meet the vehicle equipment and inspection standards under Part IV (relating to vehicle characteristics) to the extent that the cost of repairs would exceed the value of the repaired vehicle. The term does not include a vehicle which would qualify as an antique or classic vehicle except for its lack of restoration or maintenance.

75-1161 (a) General rule.--Except as provided in sections 1162 (relating to transfer to vehicle salvage dealer) and 1163 (relating to transfer to scrap metal processor), a person, including an insurer or self-insurer as defined in section 1702 (relating to definitions), who owns, possesses or transfers a vehicle located or registered in this Commonwealth which qualifies as a salvage vehicle shall make application to the department for a certificate of salvage for that vehicle.

Notes: We are to apply for a salvage title on vehicles we declare as total loss when the cost of repairs exceeds the repaired vehicle value. In practice we secure a Salvage Title on totals even if the estimate is less than the vehicle value. Additionally, we may apply for a Non repairable Vehicle certificate if we wish to designate the vehicle as a source of parts or scrap only (which presumably we would only do on vehicle we deem are not suitable for rebuild).

Parts Only damage and is good for "parts only." Classification B indicates the vehicle has considerable damage but is considered repairable. It will be the responsibility of insurance companies to evaluate and classify salvage. South Dakota

Salvage Salvage vehicle, means any motor vehicle as defined in § 32-3-51.10 that an insurer or self insurer determines a total loss due to theft or to damage caused by fire, vandalism, collision, weather, submersion in water, or flood. This section does not apply to any motor vehicle more than ten model years old or with a gross vehicle weight rating of more than sixteen thousand pounds.

Junking Certificate A certificate of ownership, which may not be restored to a title document which allows highway use, issued by the department to the owner of a vehicle which is going to be dismantled and sold for parts.

Theft If a stolen vehicle is recovered, the insurer or self insurer shall, within thirty days of recovery, inspect the vehicle and apply for a title as follows: - If the vehicle has no damage or the damage is less than that defined in § 32-3-51 .8, surrender the existing salvage title to the department. The department shall promptly issue a title marked as a recovered theft with no damage disclosure notation pursuant to § 32-3-51 .8; or - If the vehicle has damage equal to or greater than that defined in § 32-3-51.8, surrender the existing salvage title to the department. The department shall promptly issue a title marked as a recovered theft with the damage disclosure notation pursuant to§ 32-3-51.8. - However, if the condition of the vehicle is such that it would have been determined a salvage vehicle as defined in § 32-3-51.19 due to the damage to the vehicle, the salvage title is retained and the insurer or self insurer is not required to apply for a title pursuant to this section.

is garaged, loss vehicle VIN, mileag~, equipment, as well as loss vehicle condition, which is used to

assist in determining the value of the loss vehicle.

When a valuation is created the database is searched and

comparable vehicles in the area are selected. The zip code

where the loss vehicle is garaged determines the starting point

for the search. Comparable vehicles are similar to the loss

vehicle based on relevant factors.

CALCULATE BASE VEHICLE VALUE

DATABASE REVIEW

. -_ ,i:CC maintains an extensive database of vehicles that currently are

$ or recently were available for sale in the U.S. This database includes

vehicles that CCC employees have physically inspected, as well as

vehicles advertised for sale by dealerships or private parties. All of

these sources are updated regularly.

Adjustments to the price of the selected comparable vehicles are made to reflect

differences in vehicle attributes, including mileage and options. Dollar adjustments are

based upon market research.

Finally, the Base Vehicle Value is the weighted average of the adjusted values of the

comparable vehicles based on the following factors:

CLAIM INSPECTION

FARMERS INSURANCE EXCHANG,E has provided CCC with the zip code where the loss vehicle

is garaged, loss vehicle VIN, mileage, e~uipment, as well as loss vehicle condition, which is used to

assist in determining the value of the loss vehicle.

When a valuation is created the database is searched and

comparable vehicles in the area are selected. The zip code

where the loss vehicle is garaged determines the starting point

for the search. Comparable vehicles are similar to the loss

vehicle based on relevant factors.

CALCULATE BASE VEHICLE VALUE

DAT ABASE REVIEW --CC~ maintains an extensive database of vehicles that currently are

or recently were available for sale in the U.S. This database includes

v~·hicles that CCC employees have physically inspected, as well as

vehicles advertised for sale by dealerships or private parties. All of

these sources are updated regularly.

Adjustments to the price of the selected comparable vehicles are made to reflect

Model Salvage Vehicle Titling Legislation

Salvage, Rebuilt Salvage, Flood, and Nonrepairable Vehicles

Sec. 3- XOl Definitions

(1) MOTOR VEHICLE -- as used in this Article, motor vehicle has the same meaning as found

in Section 1-142 of this Code, however, it does not include vehicles with a GVWR of more

than 10,000 pounds.

(2) SALVAGE VEHICLE -- means:

(a) any motor vehicle which has been damaged, destroyed, wrecked, or submerged in

water to the extent that the total estimated or actual cost of parts and labor to rebuild

or reconstruct the vehicle to its pre-accident condition and for legal operation on the

roads or highways exceeds 75 percent of the retail value of the vehicle prior to such

damage, as set forth in a current edition of any nationally recognized compilation,

including automated data bases, of retail values, as approved by the department. The

value of repair parts for purposes of this paragraph shall be determined by using the

current published retail cost of the original equipment manufacturer parts or the

actual retail cost of the repair parts to be used in the repair. The labor cost of repairs

for purposes of this paragraph shall be computed by using the hourly labor rate and

time allocations that are reasonable and customary in the automobile repair industry

in the community where the repairs are performed.

(b) any motor vehicle, without regard to whether such vehicle meets the preceding 75

percent threshold which :

(i) an insurance company acquires ownership of pursuant to a damage settlement,

not including a settlement in connection with a recovered theft vehicle, unless

such motor vehicle sustained sufficient damage to meet the 75 percent

threshold ; or;

(ii) the vehicle owner designates as a Salvage Vehicle by obtaining a Salvage

Title, without regard to the extent of the motor vehicle's damage and repairs. 1

(3) SALVAGE TITLE -- means a certificate of title issued by the department designating a

motor vehicle a Salvage Vehicle.

( 4) REBUILT SALVAGE VEHICLE -- means any motor vehicle previously issued a Salvage

Title, which has passed state anti-theft and safety inspections to ensure that the motor vehicle

was rebuilt to required standards, and has been issued a certificate indicating that the motor

vehicle has passed the required anti-theft and safety inspections.

(5) REBUILT SALVAGE TITLE -- means a certificate of title issued by the department for a

vehicle previously designated a Salvage Vehicle which has passed required state anti- theft

and safety inspections, and is now designated a Rebuilt Salvage Vehicle.

(6) NONREPAIRABLE VEHICLE -- means any motor vehicle which is incapable of safe

operation for use on roads or highways and which has no resale value except as a source of

parts or scrap only or which the owner irreversibly designates as a source of parts or scrap.

(7) NONREPAIRABLE VEHICLE CERTIFICATE -- means a motor vehicle ownership

document issued by the department designating that vehicle a Nonrepairable Vehicle.

(8) FLOOD VEHICLE --means a motor vehicle that has been submerged in water to the point

that rising water has reached over the door sill and has entered the passenger or trunk

compartment.

Sec. 3-X02 Duty to Apply for Salvage Vehicle Title -- Noorepairable Vehicle Certificate

(1) Unless an insurance company has made a damage settlement arising out of damage sustained

to a Salvage Vehicle or a Nonrepairable Vehicle, the vehicle owner shall apply to the

department for a Salvage Title or Nonrepairable Vehicle Certificate, whichever is applicable,

before the motor vehicle is repaired or the ownership of the motor vehicle is transferred. In

no event shall such application be made more than 30 days after the vehicle is damaged.

(2) Every insurance company, which pursuant to a damage settlement, acquires ownership of a

vehicle that has incurred damage requiring the vehicle to be designated a Salvage Vehicle or

Nonrepairable Vehicle, shall apply to the department for a Salvage Title or Nonrepairable

Vehicle Certificate within 15 days after the title is assigned and delivered by the owner to the

insurance company, with all liens released.

(3) Every insurance company which makes a damage settlement for a vehicle that has incurred

damage requiring such vehicle to be designated a Salvage Vehicle or Nonrepairable Vehicle,

but does not acquire ownership of the vehicle, shall

Alternative 1:

notify the vehicle owner of the owner's obligation to apply to the department for a Salvage

Title or Nonrepairable Vehicle Certificate for the motor vehicle, and shall notify the

department of this fact in accordance with procedures established by the department.

Alternative 2:

withhold payment of the claim until the vehicle owner applies for a Salvage Title or a

Nonrepariable Vehicle Certificate

(4) The lessee of any vehicle which incurs damage requiring the vehicle to be designated a

Salvage or Nonrepairable Vehicle shall notify the lessor of this fact within 30 days of the

damage.

(5) The lessor of any motor vehicle which has incurred damage requiring the vehicle to be titled

as a Salvage or Nonrepairable Vehicle, shall apply to the department for a Salvage Title or

Nonrepairable Vehicle Certificate within 21 days after being notified of this fact by the

lessee.

( 6) Every person acquiring ownership of a motor vehicle that meets the definition of a Salvage

or Nonrepairable Vehicle, for which a Salvage Title or Nonrepairable Vehicle Certificate has

not been issued, shall apply to the department for the required document prior to any further

transfer of such vehicle, but in no event, more than 30 days after ownership is acquired.

Sec. 3-X03 Duty to Notify Lessors, Purchasers, Department of Flood Vehicle Status

(1) Every owner of a vehicle that becomes a Flood Vehicle shall, at or prior to the time

ownership is transferred, give the transferee written notice that the vehicle is a Flood

Vehicle.

(2) Every lessee of a vehicle that becomes a Flood Vehicle, shall, within 15 days of the

occurrence, give the lessor written notice that the vehicle is a Flood Vehicle.

(3) Every vehicle owner transferring ownership of a Flood Vehicle shall at the time of such

transfer notify the department of the vehicle's Flood Vehicle designation in accordance with

procedures established by the department.

Sec. 3-X04 Department to Designate Salvage, Flood, and Nonrepairable Vehicles

( 1) Upon notification of a vehicle's designation as a Salvage Vehicle, or Nonrepairable Vehicle,

and payment of appropriate fees, the department shall issue, a Salvage Title, or

Nonrepairable Vehicle Certificate, as appropriate in accordance with procedures established

by the department.

(2) Each Salvage Vehicle Title issued by the department shall, in addition to complying with

requirements of Sec. 3-107 of this Chapter, be conspicuously labeled with this designation on

its face.

(3) Upon notification of a vehicle's designation as a Flood Vehicle, and payment of appropriate

fees, the department shall conspicuously label this Flood Vehicle status on the face of the

vehicle's title.

(4) Each Nonrepairable Vehicle Certificate shall contain the same identifying information and

comply with format, size and security requirements applicable to certificates of title by Sec.

3- l 07 of this Chapter, and shall be conspicuously labeled with this designation on its face.

(5) The designation of a motor vehicle's status shall be conspicuously labeled on the face of any

subsequent title, including any duplicate title, issued by the department for the vehicle.

(6) The department shall maintain the preceding designations of a vehicle's status as a permanent

part of each vehicle's record, and shall include this information as part of any electronically

transmitted or printed vehicle record provided by the department for that motor vehicle

Sec. 3-XOS Restrictions on Use and Transfer of Salvage Vehicles

(1) No motor vehicle for which a Salvage Title has been issued shall be registered by the

department for use on the roads or highways of this state unless it has been issued a Rebuilt

Salvage Title.

(2) The ownership of a Salvage Vehicle shall only be transferred through the use of a Salvage

Title.

(3) No Salvage Vehicle shall be issued a Rebuilt Salvage Title unless the Salvage Vehicle has

been repaired or rebuilt, and passed a H anti theft and safety inspection by a person or

persons licensed or employed by a State under a program approved by the department, [ or

other designated agency] and an inspection for stolen parts by a certified State or local law

enforcement official, under a program approved by the department.

Sec. 3-X06 Restrictions on Use and Transfer of Nonrepairable Vehicles

(1) No motor vehicle for which a Nonrepairable Vehicle Certificate has been issued shall be

titled or registered by the department for use on the roads or highways of this state.

(2) Ownership of the motor vehicle for which a Nonrepairable Vehicle Certificate has been

issued may only be transferred two times.

(3) Whenever a motor vehicle has been flattened, baled, shredded, or otherwise destroyed,

whichever comes first, the motor vehicle title or Nonrepairable Vehicle Certificate for the

vehicle shall be surrendered to the department within 30 days.

( 4) The department shall update its record to indicate the destruction of such vehicle and no

further ownership transactions for the vehicle shall be permitted. If at the time the vehicle is

destroyed it is titled in another state, the department shall notify the state where the vehicle is

titled of the surrender of the title or Nonrepairable Vehicle Certificate and of the vehicle's

destruction.

Sec. 3-X07 Procedures for Titling Rebuilt Salvage Vehicles

(1) The department shall not issue a Rebuilt Salvage Title for a motor vehicle with a Salvage

Title unless the vehicle has passed required state anti-theft and safety inspections. A motor

vehicle for which a Rebuilt Salvage Title has been issued may be registered for use on the

roads and highways of this state.

(2) Every owner of a motor vehicle designated as a Salvage Vehicle shall, as a condition of

having that vehicle designated a Rebuilt Salvage Vehicle, present to the department the

Salvage Title, along with a certificate, which complies with the security and guideline

standards established by the department, indicating that the vehicle has passed the required

anti-theft and safety inspections.

(3) Upon satisfaction of the preceding requirements, the department shall issue a Rebuilt Salvage

Title, and shall maintain this designation as a permanent part of the vehicle's record, and

shall include this information as part of any electronically transmitted or printed vehicle

record provided by the department for that motor vehicle.

(4) Each Rebuilt Salvage Title issued by the department shall, in addition to complying with

requirements of Sec. 3-107 of this Chapter, be conspicuously labeled with the designation

"Rebuilt Salvage Vehicle --Anti-theft and Safety Inspections Passed" on its face.

(5) If the vehicle for which a Rebuilt Salvage Title is issued sustained such damage by being

submerged in water, the department shall also conspicuously label this Flood Vehicle status

on the face of the Rebuilt Salvage Title.

(6) Ownership of a Rebuilt Salvage Vehicle shall only be conveyed through the use of a Rebuilt

Salvage Title.

(7) After a Salvage Vehicle has passed the required State anti-theft and safety inspections, the

inspection official shall affix a secure decal stating "Rebuilt Salvage Vehicle --Anti-theft and

Safety Inspections Passed" to the driver's door jamb of the vehicle and issue to the owner of

the vehicle a certificate indicating that the motor vehicle has passed the required anti-theft

and safety inspections. The decal and certificate must comply with permanency and security

requirements established by the department.

The Total Loss Subcommittee met on Thursday, September 03, 2015 at 9:30 am. The topic of discussion

was the applicability of NRS 487.790 to auto insurance claims settlement practices.

Chapter 487 of NRS specifies the duties of an insurance company with respect to "salvage vehicles,"

which are those vehicles that have been declared a total loss vehicle, a flood-damaged vehicle, a non­

-repairable vehicle or have had a salvage title. For the purposes of this chapter, "total loss vehicle" is

defined as one for which the cost of repair, with the exception of painting, replacing electronic

components, or towing, is 65 percent or more of the fair market value.

Notwithstanding this statute, an insurer may make an economic decision to settle a claim on the basis of

the actual cash value of the vehicle rather than repairing the vehicle, regardless of the cost of repair.

However, the Division has concerns with the situation when an insurer treats a vehicle as a salvage

vehicle when the cost of repair does not meet the threshold set forth in NRS 487. 790.

The Division set forth the _position that an insurer may offer a settlement and retain the vehicle. If the

insurer retains the vehicle, it may obtain a salvage title and resell it, but if the claimant insists on keeping

the vehicle, the insurer may not force the insured to accept a salvage title and may not deduct the value

of the salvage· from the settlement.

Some members of industry expressed their own concerns with this position. According to some industry

representatives, given all the electronic components In modern vehicles, which are excluded from the

65 percent determination, costs of repair have risen considerably, resulting in more situations in which

the vehicle is an economic total loss but does not meet the statutory definition of a "total loss vehicle"

pursuant to chapter 487.

Some insurers expressed concerns regarding the liability aspect of an insurer declaring a vehicle a total

loss and having it put back on the road with a clean title when it may be unsafe. Division staff replied

that it may be possible for the insurer to obtain a release of liability.

Some insurers also had difficulty with the issue of over-indemnification. It was expressed that if an

insurer pays the insured the actual cash value of the vehicle and the insured keeps the vehicle, the

insured is made more than whole. In addition, the money the insurer makes in selling the salvage vehicle

is part of the economic decision of whether to declare the vehicle a total loss. If the insurer cannot

retain the salvage, it may not make economic sense to declare any vehicle a total loss if the actual cost

of repair is less than 100 percent (assuming the statutory threshold is not met). Division staff, on the

other hand, pointed out that an insured individual is often not able to obtain the same payment for a

vehicle from a salvage yard as an insurer, since an insurer would often have considerable negotiating

power, knowledge about reasonable salvage values, and preexisting contractual arrangements with

salvage yards. An insurer's deduction of the insurer's anticipated salvage recovery could therefore leave

the insured less than whole, since the insured could possibly never realize that salvage recovery.

Furthermore, it is not clear that an owner-retained vehicle would result in an over-indemnification

situation in the absence of a deduction for salvage. An owner who retains a vehicle that has been

disabled after an accident, and who does not attempt either to sell it to a salvage yard or to repair it,

would not be any better off financially as a result of keeping an inert, non-usable vehicle. If the owner

attempts to repair the vehicle and can do so for less than the actual-cash-value payment made by the

insurer, then it is likely that the insurer would have been able to effectuate repairs at the same or lower

cost, thus incentivizing the insurer to make the economic decision to repair the vehicle in the first place.

The Division reiterated that the definition of salvage vehicle was set in statute and could not be

bypassed. It was agreed that something should be drafted for the 2017 legislative session and at that

time, representatives from the col lision industry and the Department of Motor Vehicles should be

brought into the discussion. In the meantime, it was agreed that industry would share information on

the total loss settlement process and relevant laws from other states.
