    This morning, Commander came into my office and requested to speak to me.Once the door was closed, she shared with me that she had not been truthful in aconversation that took place in the early afternoon on May 1, 2009.On May 1, 2009, I asked Commander to come into my office and close thedoor. The issue that we discussed was reference the current internal, involving JailSergeant Commander had previously seen and Commanderengaged in a closed door conversation, and was concerned that it involved theinternal and possibly violated a direct order for not to speak with anyone aboutthe incident.During the May 1st conversation, I shared Commander concerns withCommander I asked her if she had discussed the internal withCommander told me that there was nothing specific discussed. She told methat they had not discussed the allegations, questions, or next steps. Commandersaid that she had given general advice to not allow the internal toaffect his job performance and to go on like nothing was happening. She said that theyalso discussed family related issues.Commander told me today that she was not truthful on May 1st, and that shedid discuss specifics of the internal with Commander told me thatshe should have listened to me a couple ofweeks ago, when I gave her the advice to stayout of the investigation and let it run it' s course. I did not ask specifics, because I am stillunsure of the course of action that will be taken.It is my personal opinion that since Commander has already takenresponsibility for her actions, that this may be a candidate for an expedited internal. Myadvice to Commander as I remember it, was just advice and not an order. Ibelieve that if the "expedited internal" route is taken, specifics of Commanderand Jail Sergeant are relevant only to the original internal, and astatement should be taken as part of that investigation.

    On May 1, 2009 you and Deputy Chief Marsalisi had a discussion regarding the currentinternal investigation regarding Sergeant Deputy ChiefMarsalisi asked you ifyour had discussed this internal investigation with Sgt. You replied to DeputyChiefMarsalis i that you had not discussed the investigation with Sgt.On May 2, 2009, the two of us spoke over the phone regarding this incident. You statedto me that you were untruthful with Deputy Chief Marsalisi on the day prior. Youaclmowledged the severity of your actions, and requested that you be allowed to relaythis information to Deputy ChiefMarsalisi on the following Monday.On May 4, 2009, you met with Deputy ChiefMarsalisi and told him you were untruthfulon the previous Friday. You admitted to discussing the specifics of the internal with Sgt.

    Allegation: Violation of General Order 26.1.1.II.TT. TruthfulnessUpon the direct order of he ChiefofPolice, the Chief's designate, or a superiorofficer, members of he police department shall fully and truthfitlly answer allquestions specifically directed, and narrovvly relating to the pe!formance orofficial duties, or fitness for office, which may be asked of hem.

    Finding: SustainedThis issue was a result of a conversation between you and your supervisor. Thisallegation was a result of your self-reporting of the incident.Honesty and integrity are paramount in the law enforcement profession. Just asimportant is the ability to trust coworkers, peers, and subordinates.

Please notify SherrySmith within 5 days of receiving this memo if you wish to discuss this disciplinerecommendation or request to exercise your appeal options.After notification, I will schedule the appropriate meeting or review board.     Expedited Internal Discipline Recommendation -Commander

    S U B J E C T :

    I have considered the known facts that are relevant to the untruthfulness incidentinvolving Commander onM ay 1,2009. Honesty and integrity are paramountin the law enforcement profession. Just as important is reputation and having the trust ofcoworkers, peers, and subordinates. This department has suffered from the pastperception that command staff is not held to the same standards that it holds othermembers to. In the past three years, we have taken steps to bring expectations intoalignment and instill confidence in the new administration.Commander decision to be untruthful, when questioned about an importantissue is a violation of General Order 26.1.1 .TT. The fact that the act was committed by acommand staff member magnifies the situation, in that it detracts from the progress thatwe have made in building the reputation of the new administration.Surely, the Guild wi l l use the discipline here as "a comparable" to any discipline handedout against one of their members. So, for sake of future argument, I wi l l address specificissues that may differentiate this fromother incidents. M y questioning of Commander

    was related to another internal investigation, and was focused on preliminaryinformation gathering for an upcoming interview with the subject employee. Commander

    was directly asked a question, which she did not answer truthfully, howeverthere was no "official order," nor had she been read "Garrity" and compelled to answerthe question. Commander did not wait to be caught or have the untramfolnessdiscovered. It is debatable i f the untruthfulness would have been discovered, withoutCommander coming forward, admitting to the act, and acceptingresponsibility.It is my opinion that the facts listed above create a degree of separation frompreviousuntruthfulness incidents, for which employees have been disciplined for. It is myrecommendation that Commander receive two 8-hour days of f without pay forviolating General Order 26.1.1 .T T - Untruthfulness.
