b) Plant on site increased from 22% to 56%.
c) Design increased from 66% to 89%.

Due to the repeated meetings with the JV partner directly involved in site activities.
There was a considerable improvement in performance in July, which resulted in
withdrawal of the second Notice to Correct. However, the first Notice to Correct
remains and progress will be monitored in September and October, carefully
following the revised programme approved in August.
If progress does not continue, Termination will be reconsidered in November.

The Contractor failed to reach the targets in their second Notice to Correct. As such, the
Employer is now entitled to terminate the Contract giving 14 days’ notice. However,
given the Contractor’s improved performance on site, suggest that the Employer may
wish to delay termination. The Engineer shall monitor further improvements closely in
August. Termination may be reconsidered in September.
