Audit Methodologies

The GCAA will perform 2 types of audits: 1. Conventional Audit:

Majority of the audits will be conventional audits.

2. Organisation Risk Profile (ORP) Approach: This approach is still under the review and testing phase.

Post Holder Training

Post holder training for the Industry was introduced by the GCAA this year. As of date, 8 such trainings have been performed and a 9th will be held this month, with approximately 18 attendees per course. The feedback received has been very encouraging, with the Industry finding this training very beneficial.

ICAO Audit

The GCAA would firstly like to thank operators for their cooperation and patience during the recent ICAO audit conducted on the GCAA. The impressions received from the ICAO auditors, with reference to the GCAA’s performance, development and progress were very encouraging and the final result of the audit will be relayed to the GCAA by ICAO Headquarters in Montreal.

RULEMAKING • The GCAA controls to whom Notification of publication is addressed to

within an organisation. Such email address must be controlled at corporate level and not at individual level. To ensure proper communication organisation must set-up a plan to ensure that when individual are away (resignation, deputisation when leave) such notification are effectively communicated within the organisation. Ref CAR PART 3 CH 9

• From 2015, the GCAA will minimize small change to regulations by

establishing cycles of major change for each department. In principle, if someone makes a major change in Jan, then the next major change wont be before next Jan. We will still allow TR’s on ad-hoc basis if the TR cannot wait for the major change.

DEFINITIONS (1/5) ‘Rules’ comprise of the following: • Regulations are sets of requirements that create, constrain or limit rights, and

allocate responsibilities to persons/organisations regulated by the Civil Aviation Law. The issuing legislation is in the form of Civil Aviation Regulations (CARs); which is in compliance with ICAO SARPs as the primary regulatory Standard, and if applicable any other Standard decided by GCAA.

• DG Directive (DIR) a tool for direct rulemaking in instances where a safety concern requires immediate mitigation action by the GCAA that cannot wait for normal rulemaking process, or, when it is not practical to dedicate a particular CAR to regulate a minor aspect which is not addressed by the exiting CAR. The DIRs may later be transferred to Regulations or may be cancelled if the safety concern does not exist anymore.

DEFINITIONS (2/5)

• Acceptable means of compliance (AMC) are standards [but not necessarily the only standards] adopted by the GCAA to illustrate means to establish compliance with the CARs. An entity/or a person not wishing to comply with the AMC must comply using other means acceptable to the Authority.

• GCAA Safety Standards are extensions to regulations that outline the standards which need to be executed by the GCAA. These Safety Standards may, at the same time, impose some requirements over the regulated entities/persons involved.

• Temporary Revisions (TR) will be issued when there is an immediate need to supersede regulatory requirement(s), or to add new requirement(s) to an existing rule. A TR will be published as an attached document to the concerned rule. All TRs shall be consolidated into the relevant regulation or removed (if no longer required) after a maximum period of one year from the date of the oldest active TR.

• Civil Aviation Advisory Publication (CAAP) The intent of these publications is to

provide information and guidance material, as well as GCAA requirements, to persons or organisations regulated by the GCAA.

• Guidance material (GM) means non-binding material developed by the GCAA that helps to illustrate the meaning of a requirement or specification and is used to support the interpretation of the regulations and AMC. GM can be sometimes a standalone GM.

• Airworthiness Notices (AWN) are issued by the GCAA to circulate information to all concerned stakeholders about airworthiness related matters.

• Notice To Aerodrome Certificate Holders (NOTAC) is issued when the GCAA’s

ANA Department needs to notify a change, or clarify, the UAE regulations, certificate criteria and guidance material associated with aerodrome certification/oversight. In the case of a CAR, the content of the NOTAC supersedes the relevant text in the published document and remains in force until either the material covered is incorporated into the CAR or the NOTAC is withdrawn.

• Air Navigation Service Information Notice (ANSIN) is addressed to all UAE ANSP and other relevant stakeholders. ANSIN is occasionally used to disseminate information of non-regulatory nature, deemed necessary by the GCAA, for the attention/action of the ANSPs.

DEFINITIONS (5/5)

• Safety Alert is a leaflet used for the purpose of safety promotion. Lessons learned from wrong

practices, safety events, trends observed, misinterpretation of the rules etc.. are relayed to the industry. An alert can have the following categories: attention, info, and/or, recommendation.

• Airworthiness Directive is a notification to owners and operators of aircraft that a known safety deficiency with a particular model of aircraft, engine, avionics or other system exists and must be corrected. Non compliance with an AD results in aircraft being un-airworthy.

• Information Bulletin is a means to relay information to the industry or requirements administrative in nature.

• Airspace Policy is provides guidance to the Authority, as the airspace regulator, and to the ATM stakeholders on the management of airspace as a national resource. The objective of the ASP is to create an effective, efficient, safe, secure, accessible and flexible environment within which demands for access to National airspace do not put a constraint on reasonable growth in the aviation sector of the economy.

CONSULTATIVE COMMITTEE/NPA/CRD • PRP will be more engaged in the consultative committees established to draft

regulation. PRP may also suggest to the Rulemaking Task owner to involve Industry at any point of time of the drafting in particular when impact on them will be considered major.

• PRP controls if a changes require NPA or not. The NPA will indicate the prospective date of effectivity as much as possible.

• NPA is a chance for industry to improve the draft, suggest opportunities/alternatives, and raise its concerns about requirement or about date of effectivity. Uncommented NPA means “No Objection”. GCAA may accept, reject, and partially-accept comments.

• Comment and response to comments associated to a NPA are published on the associated CRD and they are open to consultation by website’s visitors.

WAIVER • Industry may apply for waiver to deviate from a requirement. The GCAA will

review the case supported by solid justification and may grant or reject the demand. In all case, the applicant will be notified.

• Pay attention that as per ICAO, any waiver against a SARP needs to be periodically reconsidered by the State and the industry in order to remove it. Your role in this matter is important even though GCAA may issue or has issued a permanent waiver.

Cape Town Convention: – It is compulsory to obtain Authorizing Entry Point (AEP) code from the GCAA to effect

registration with the International Registry; otherwise, registration/discharge shall be considered invalid.

– AEP code shall be obtained for registration of the following Interests:

• International interests, prospective interests and registrable non-consensual rights and interests;

• Assignments and prospective assignments of international interests; • Acquisitions of international interests by legal or contractual subrogation

under the applicable law; • Notices of national interests; • Subordinations of interests referred to in any of the preceding sub-

paragraph; • Amendments of any of the above mentioned registered interests and, • Discharge or release of any of the above mentioned registered interests.

– AEP e-services is available 24/7.

– The AEP code process usually takes 24hrs.

– The AEP code is granted automatically upon payment (the reference number to be entered on IR system is sent by email).

– Interests related to aircraft engines can directly be registered with the International Registry (as per the UAE Instrument of Ratification of the CTC). The IR system will not request to enter GCAA AEP code when registering/discharging interests related to engines.

– Required information:

• applicant’s contact details,

• interest parties’ contact details and its IR ID reference number,

• A pdf copy of the contract agreement that creates the interest to be registered with the International Registry

• IR file reference number of the registered interest for the discharge

• Announcement: – E-Services applications related to aircraft registration are not available for flying

schools and clubs. The GCAA will serve notice in advance when such services are available on-line for those entities.

– The GCAA has honored aircraft de-registration request under an IDERA letter. Aircrafts were de-registered in less than 15 days. No COA export was issued in this case.

- The introduction of IB 11/2014, which prescribes the maximum permissible age limit in terms of calendar years for a purpose of issuance of UAE Certificate of Registration (COR), stating that effective 01 January 2015, the UAE COR shall be issued only to those aircraft with an age limit to or less than 20 years.

Aircraft age shall be calculated from the date of issuance of the initial Certificate of Airworthiness to the application submission date for aircraft registration with the GCAA.

The aircraft that have been issued with a C of R before 01 January 2015 shall not be affected by this IB.

The aircraft age limit mentioned shall also apply to those aircraft that have been de-registered from the UAE Aircraft Register and are now requiring re-registration.

NOTE: the above does not apply to C of R amendments required for registered aircraft.

In order to harmonize and standardize our existing regulations and procedures to the latest standards and to the best industry practices, the Airworthiness department has updated MEL requirement .

o CAAP48 & CAR MEL were merged together. o New CAR MEL Rev 0 is under CAR Part IV – Operational

Regulations. o NPA 19-2014 was closed 15/11/2014. o CAR MEL has been reformatted and amended where necessary to

be in line with EASA requirements. o MEL alleviation document published under GTF-MEL-003. This

will facilitate update by Flight Ops whenever CAR OPS 1 & 3 are amended.

o This CAR MEL is expected to be published during December 2014.
