Justification

The study on the feasibility of the EIT, commissioned by ITRE, highlights serious concerns regarding almost all aspects of the Commission proposal. The lack of proper core funding for the KICs may well render the injection of 308 million in the EIT structure and start up useless. The Commission should therefore withdraw its proposal and comes forward with a new proposal based on the suggestion made in the study for a cluster EIT and with proper core funding, which must be assured through an agreement between the two arms of the budgetary authority in accordance with the IIA of 17 May 2006.

The EIT was not part of the agreement on the Financial Perspective. Therefore the question of the financing needs to be solved according to the provisions of the IIA.

The Commission should continue to explore other avenues for the EIT and regularly compare different options to the chosen one. One alternative could be to create virtual EIT-community clusters in very few, specific areas of high public and scientific concern (e.g. climate change), where progress can be achieved in the foreseeable future and where a natural connection exists between research and the creation of services, products and business models.

Justification

For identifying the strategic innovation challenges to be addressed by the Knowledge and Innovation Communities (KICs), good use should be made of the strategic objectives and thematic priorities identified by industry and other stakeholders from the R&D community in the Strategic Research Agendas of the European Technology Platforms and Joint Technology Initiatives, as well as the near-market cluster projects of the intergovernmental EUREKA initiative. Furthermore, once selected, the KICs have to establish clear linkages with relevant initiatives at European level.

(10) There is a need to support education as an integral but often missing component of a comprehensive innovation strategy. The agreement between the EIT and KICs should provide that the degrees and diplomas awarded through the KICs should be EIT degrees and diplomas. The EIT should promote the recognition of EIT degrees and diplomas in the Member States. All these activities should be carried out without prejudice to Directive 2005/36/EC on the recognition of professional qualifications.

The EIT is not an institution comparable to a nationally based physical structure such as a university or a research centre. The EIT shall therefore not have competence to issue degrees or diplomas.

physical infrastructure for each KIC is necessary for promoting true excellence in research, training and technology transfer. Such a cluster EIT may gradually be composed of 20 or more KICs spread throughout EU territory.

According to the feasibility and impact assessment study on EIT conducted by independent experts upon request of the ITRE committee, the structure of EIT as proposed by the Commission will in no way improve the current EU situation with respect to research and innovation, as some of its characteristics impose serious constraints on its feasibility. The study proposes the alternative of a cluster EIT, see particular pages 61 to 64 (PE 382.188).

(11) The EIT should establish guidelines for the management of intellectual property, which should foster the use of intellectual property under appropriate conditions, including through licensing; provide appropriate incentives for the EIT and partners, including individuals involved, KICs and partner organisations as well as for spin-offs and for commercial exploitation. Where activities were funded under the Community Framework Programmes for Research and Technological Development, the rules of those programmes would apply.

With industry supposed to provide a major part of the resources of the KICs, it would be counterproductive to make industry pay twice: on the input side by co-financing the activities of the KICs and on the output side by having to pay the full price for acquiring the ownership of or getting access rights to the KIC's results. exploit the results from the KICs for growth and jobs, due account will have to be taken of financial and other contributions by the various partner organisations when establishing the intellectual property provisions for the KICs.

(13) In order to guarantee the functional autonomy and independence of the EIT, it should administer its own budget whose revenue should include a contribution from the Community as well as contributions from Member States and private organisations, national or international bodies or institutions, revenues generated by the EIT’s own activities or endowments. The EIT should seek to attract an increasing financial contribution from private organisations.

(13) In order to guarantee the functional autonomy and independence of the EIT, it should administer its own budget whose revenue should include a contribution from the Community as well as contributions from Member States and private organisations, national or international bodies or institutions, revenues generated by the EIT’s own activities or endowments. The EIT should seek to attract an increasing financial contribution from private organisations. Upon a proposal from the European Commission, the European Parliament and the Council may establish a European Innovation Fund in order to fund core activities of the EIT.

One of the main feasibility problems of EIT is its funding. According to the study on EIT conducted by independent experts upon request of ITRE, "the European Parliament should consider advocating the creation of a European Innovation Fund. This could be accomplished fairly easily if one adopts the funding mechanism that the Canadian government has used to create the Canadian Innovation Fund... our proposal is to use it for the core funding of the EIT, and especially for the form we think is viable, namely the cluster model for the EIT, i.e., the multiple European Institutes of Technology".

2. “Knowledge and Innovation Community” means a joint-venture of partner organisations, whatever its precise legal form, selected and designated by the EIT to carry out at the highest level integrated innovation, research and education activities in a specific field.

Due to the fact that the Commission tabled the EIT proposal after the adoption of the financial perspective it proposes to finance the EIT by unallocated margins from budget section 1 A. This would affect well functioning existing Community programmes with a high absorption capacity which already at present are underfunded. Furthermore the Interinstitutional Agreement obliges the budgetary authority to ensure the availability of sufficient margins in each budget section. Therefore a funding mechanism similar to the European Globalisation Fund is suggested.

Innovation is one of the priorities of the European Union and its Member States. The latter's' commitment to support innovation and competitiveness needs to be translated into an "Innovation Fund" financed preferably from unspent annual appropriations. Moreover in order to render the EIT operational a minimum amount of funding should be available in the first stages after the set up.

2. The Governing Board may exceptionally decide to extend the operation of a KIC beyond the period initially set if this is the most appropriate way to achieve the objective of the EIT.
