Chandigarh, Housing Board is undertaking Construction of2108 Flats of different categories in Sector 63 and 160 Two Bed Roomflats in Sector 51-A, Chandigarh. As per the terms & conditions of thecontract document, certain base rates have been specified in respect ofvarious items of work pertaining to Building materials/ Sanitary andElectrical fixtures to ensure that the contractual agencies uses only thebest materials available in the market under the present contracts. ThisEol is aimed at selection of such materials which are of more or less ofthe same value as specified under the contract. Accordingly, it isproposed to short list/approve such manufactures/brands and inparticular to select particular type/types of items that best suit thecontract requirements.

Interested manufacturers or their authorized representativesshould send details of their products along with their specifications, bulkcost. test certification and approvals of their products, if a'ny, accorded bythe State/Central Govt./CPWD or any other Department together with anyother detail/document/information that the manufacturers wish toappend with the "Expression of Interest Document" uploaded on the

BRIEF

Chandigarh Housing Board is undertaking Construction of 2108 Flats ofdifferent categories in Sector-63 and 160 Two Bed Room flats inSector 51-A, Chandigarh. As per the terms & conditions of the contractdocument, certain base rates have been specified in respect of variousitems of work pertaining to Building materials/ Sanitary and Electricalfixtures to ensure that the contractual agencies uses only the bestmaterials available in the market under the present contracts. This Eolis aimed at selection of such materials which are of more or less of thesame value as specified under the contract. Accordingly, it is proposedto short list/approve such manufactures/brands and. in particular toselect particular type/types of items that best suit the contractrequirements.

It is further brought out that the manufacturer whoitems/products will be approved and used on various works, will have toenter into an Guarantee Agreement with the contractor and Engineerin-charge of the work as per the prescribed proformas annexedherewith.

GUARANTEEBONDThis agreement made this __ day of between

M/s. & M/s (hereinafter called the Guarantors----- ------which expression shall include where the context so admits therepresentative successors or his/its assignees of the one part) and theEngineer-in-charge on behalf of Chandigarh Housing Board, Chandigarhconstituted under Section -III of the Haryana Housing Board Act, 1971as extended to the Union Territory, Chandigarh having its principaloffice at 8 Jan Marg, Sector 9-0, Chandigarh (hereinafter called theBoard which expression shall unless repugnant to the context ormeaning thereof including its successor and assignees of the otherpart) .

Whereas this agreement is. supplementary to the contract(hereinafter called the Sub Contract) dated-------- made between theGuarantors of the one part and Board of the other part, whereby thecontractor & manufacturer, inter alia, undertook to render the buildingsand structures and supply of flush door shutter/ window shuttersconforming to the prescribed specifications. Wherein, the material inquestion have been used in between Block No. Unit No. at__ (Location) during the period between __ to at the siteof work.

And whereas the Guarantors agreed to give a guarantee tothe effect that the said material will remain defect free for the next fiveyears to be reckoned from the date of completion of the work under thecontract Agreement No. dated __

During this period of guarantee, the Guarantors shall makegood all manufacturing defects and for that matter, shall replace at hisrisk and cost such defective material(s) as observed to the satisfactionof the Engineer-in-charge, and shall commence the works of suchrectification within seven days from date of issuing notice from theEngineer-in-charge calling upon him to rectify the defects, failing whichthe work shall be got done by the Department by some otherContractor/ manufacturer at the Guarantor's cost and risk, and in thelater case the decision of the Engineer-in-charge as to the costrecoverable from the Guarantors shall be final and binding.

That if the Guarantors fails to replace the defectivematerial(s) or commits breaches hereunder then the Guarantors willindemnify principal and his successors against all loss, damage, cost,

expense or otherwise which may be incurred by him by reason of anydefault on the part of the Guarantor in performance and observance ofthis supplemental agreement. As to the amount of loss and/or damageand/or cost incurred by the Board, the decision of the Engineer.in-charge will be final and binding on the parties. In case of failure toreplace the defective material, in addition to the recovery, stated here,the Guarantors and the Contractor shall be black listed.
