2. EXECUTIVE SUMMARY :
The Government of India (GOI) through Ministry of Shipping Road Transport & Highways
(MORT & H) is contemplating to enhance the traffic capacity and safety for efficient
transportation of goods as well as passenger traffic on the very heavy traffic intensity National
Highways. The Government of India had entrusted to National Highways Authority of India
(NHAI) for the development, maintenance and management of NH-7 from km 33+130 to km
93+000 (59.87km) in the state of Tamil Nadu.
In order to provide a better level of service to the vehicular traffic and to augment the capacity of
NH 07 (NH-44 New) by widening the existing four lane to six lanes divided carriageway facility
including rehabilitation/strengthening of the existing four lane, it has been decided to carry out the
works under NHDP Phase V as BOT (Toll) on Design, Build, Finance, Operate & Transfer
(DBFOT) basis.
3. SCOPE OF THE PROJECT:
The scope of the project include the following during the concession period:
Construction of the project highway as set forth in Schedule–A and as specified in Schedule–B
together with provision of Project Facilities as specified in Schedule–C and standards as set
forth in Schedule–D of the concession agreement with other applicable standard specification.
Operation and Maintenance of the project highway in accordance with the provisions of the
concession agreement of Schedule “K”
Performance and fulfillment of all other obligations of the Concessionaire in accordance with
the provisions of Agreement and matters incidental thereto or necessary for the performance of
any or all of the obligations of the concession agreement by the Concessionaire.
Six laning shall be undertaken and completed by the Concessionaire in conformity with
specifications and standards set forth in Annex- I of Schedule –D of CA.

The Scheduled Six Laning date shall occur on the 912th (Nine Hundred and Twelve) day from the appointed date i.e. 04-12-2013 On or before the scheduled six laning date, the Concessionaire shall have completed six laning projects.
Mile stones –I, II and III have already been achieved by the Concessionaire.Note: For Schedule six laning EOT – I approved up to 30 th May 2014. EOT – II submitted 15th Nov 2015 by the Concessionaire and recommended by IE up to 03rd May 2015 Mile Stone :

9.3. Construction Programme:Construction Programme submitted to IE by the Concessionaire vide, Letter no. 208 - Dated 25.11.2011.Concessionaire has been advised to review the program vide, IE Letter no 102A - Dated 07 Nov 2012 taking in to account the progress achieved till date. Revised Construction Programme as per article 12.1 of CA for balance works are not submitted as per interim EOT recommended by IE. For 2nd EOT construction programme submitted it is reviewed by IE.

9.4. Construction Safety The National Highways Authority of India has engaged M/s. HAKS Engineers, Architects and Land Surveyors, PC in association with Info Trans Engineers Pvt Ltd, as Road Safety Consultant. Safety consultant are visiting the project site Regularly, and carry out Safety audit also. The safety audit report are being submitted to PD as well as to IE. The recommendation of safety consultant in their report are being implemented at site to the extent of provision in CA.
9.5. Method Adopted in Construction:The method of construction adopted has been regularly checked and reviewed by the IE through conducting field and laboratory tests on compaction, whether materials used are in compliance with specifications and standards.
9.6. Conformity of Construction Works:The source of materials used for construction works are regularly checked by IE for conformity with the specifications and standards. Routine checks were regularly conducted by the IE field team. The Team Leader and Key Personnel also attended some tests like Concrete Cube strengths testing, Core thickness, Gradations, Bituminous Extractions tests etc. during their site visits. Casting of RCC/PSC girders are in completed at camp locations and regularly inspected by IE field team. 9.7. Defects and Deficiencies:Along with concessionaire EPC contractor and IE team visited site on 30/06/2015. (Ref. IE Monthly inspection Report enclosed)
9.8. Maintenance of the Existing 4 lane Highway:The concessionaire is regularly maintaining the existing road and IE is constantly monitoring the maintenance works.
9.9. Road Accident Report:The Concessionaire is submitting regularly the Accident occurrence report to IE through mail. (Annexure – c) 9.10. Survey Works:
1) IE is in the process of reviewing survey reports containing traverse points, TBMs & etc.
2) Erection of New TBM pillars from Km. 33+130 to Km. 93+000 is completed.
3) Checking of GPS points, TBMs and Reference Pillars / Boundary pillars at Km. 33+130 to Km. 93+000 is completed.
4) Checking of Top level of all layers being done (Embankment, Sub-grade, GSB, WMM, DBM and BC.)

Details of change of scope (COS) - Pedestrian Underpass of size 8m x 2.5m has been upgraded as Vehicular Underpass of size 8m x 4.5m
Reason for COS: VIP Reference Dr. Thambi Durai, Hon'ble Member of Parliament (LS), Karur to consider a Vehicular Underpass instead of Pedestrian underpass in front of Adhiyamman Educational & Research Institute, Hosur. Whether COS initiated by concessionaire / NHAI – NHAI Issue of change of scope (Cos) Notice: NHAI issued the change of scope (Cos) notice as per
Clause16 of CA vide letter No. NHAI/PIU-Krishnagiri/MC-II/BOT-HK/CW/2009 /552 dated 24thMarch 2012.
According to above change of scope (Cos) notice, Concessionaire submitted the tentative cost Estimate. IE reviewed the cost estimate and returned the estimate with observation, for Re submission vide IE letter No: 004 dated 19th Jan 2013.

Details of change of scope (COS)- Additional Box culvert of 2x2m size at Rayakottai Junction( Km.40+955).
Reason for COS: Local Administration of Hosur Municipality Commissioner, Sub- Collector and Public are requested Additional Box Culvert as the existing Box Culvert at Ch.40+935 is unable to discharge rain water stagnation frequently during heavy showers leading to huge traffic jam at this Junction.
Whether COS initiated by Concessionaire/ NHAI/ IE- NHAI
According to above Change of Scope submitted by Concessionaire vide their letter no. HKTRPL/IE/2015/Site/1469 dated 31 Jan 2015.

Issue of Change of Scope Notice : NHAI issued Change of Scope Notice as per Clause 16 of CA vide their letter no. NHAI/NHDP-V/MC-II/BOT/HIC/029 dated 16 April 2015. PD issued a letter to IE vide letter no. 11015/2/2009/PIU-K’giri/924 dated 20 April 2015.
16. Extension of Time (EOT) :
Concessionaire submitted Interim application for Extension of Time to the Intermediate Milestones and Scheduled Six Laning Date for the Project considering the delays in the Project up to 30.11.2012 vide letter No. HKTRPL/IE/2013/Site/502 dated 16th March 2013
IE send the reply vide letter No. CEI-Pj/NHAI/1213006/HO/1798 dated 25th July 2013 to resubmit the EOT taking in to consideration the present site condition.
Concessionaire vides its letter. no. HKTRPL/IE/2013/Site/717 dated 12 th September 2013 requested the Independent Engineer to review the interim EOT submissions in accordance with clause 3.1(vii) of schedule “Q” of the concession agreement in line with the clause 6 of the Schedule G. It is under review by IE.
IE has recommended interim Extension of time to scheduled six laning date up to 30.05.2014 vide letter no.CDM/CE/ 1213006/124/dated 19.11.2013.
Concessionaires vide his letter No. HKTRPL/IE/2014/Site/1059 dated 31st March 2014 requested the Independent engineer to review the 2nd interim EOT submissions in accordance with clause 3.1(vii) of schedule “Q” of the concession agreement in line with the clause 6 of the Schedule G.
IE has recommended interim extension of time to Scheduled six laning date up to 03.05.2015 vide letter no. CDM/CEI/1213006/435 dated 11.06.2014 to Authority for Approval, pursuant to clauses 4.1.3, 10.3.1, 10.3.2, 12.4.2, 13.4 and Schedule ‘G’ of Concession Agreement.

Concessionaires vide his letter No. HKTRPL/IE/2015/Site/1575 dated 24 April 2015 requested the Independent engineer to review the 3rd interim EOT submissions in accordance with clause 3.1(vii) of schedule “Q” of the concession agreement in line with the clause 6 of the Schedule G.
IE does not consider 3rd EOT application of the Concessionaire since the request by the Concessionaire for consideration of the PCC is under review.
17. Safety Constraints / Maintenance:-
1. Median Openings are to be closed wherever BC is completed as per final List at Median openings communicated issued vide to letter No: CEI-Pj/NHAI/1213006/PD/2014/078 dated 16 Apr, 2014.
2. As per clause 4.8.1 & 4.8.3 Metal beam crash barrier shall be provided wherever High embankment 3m or more and wherever median is depressed, finished or having the width less than 4.50 meters and the barrier shall be on both directions .
3. Diversions are to be maintained as per IRC SP-55 with proper safety arrangements.
4. Traffic sign boards, Cautions boards, reflectors and safety barriers are to be provided for parapets of Bridges, Culvert and Such other structures.
5. Service roads are to be connected to the Main Carriageway with proper designed acceleration and deceleration lanes.
6. Median Plantation and Avenue Plantation wherever is missing will have to be taken up under maintains immediately.
7. Wherever the road is formed in cutting is observed to be not to the required side slopes 2:1. As such the stretches is cutting will have to be developed to the requires side slopes inorder to prevent strippage of earth and loose boulders on to the highway during heavy rains.

8. The Crash barriers which were removed from the existing for four lane highway at ponds for using in the road work are to be restored at the earliest.
9. LED Traffic beacons are to be provided on the entire project highway at pedestrian crossing, public gathering locations, cross roads and entry / exit of service roads.
10. Delineators & studs are to be provided wherever lane marking is completed.
11. Safety measures are to be provided at the construction zones in Hosur built up area in to avoid untoward incidents.
12. Debris & bituminous waste dumped in the median and road side will have to be cleared as environmental safety measures.

19. Work execution not As per CA Provision :1. Median width in Rural Area has to be minimum 4.50m, but Concessionaire has widened the
road retrofitting. The existing median for major portion is less than 4.50m . 2. Concessionaire is providing Hume Pipe (900mm dia. NP3) longitudinal drain in place of
1.5m wide separator cum – lined covered drain, which is not in line with provisions of CA. The Concessionaire has been informed that construction of longitudinal Hume pipe drain is entirely at their “Risk & Cost”. NCRs also issued to Concessionaire.
3. As per clause : 2.4 of Schedule ‘C’ Highway lighting at flyover, underpasses(PUP&VUP) to be provided as per IRC:SP:87-2010 clause no.12.3.3 (V) grade separated structures, interchanges, flyover, underpass(VUP&PUP) and overpasses at the ground level 50m beyond the point from where flaring of main carriageway takes place(clause:3.3.4 page no 42 of code).
4. As per CA , all road signs shall be with high intensity micro prismatic grade sheeting (type iv) as per ASTM standards. But in the site all road signs of diamond grade retro reflective sheeting (Type IX & XI) are being provided.
5. As per CA at Ch. 77+950 (RHS) Major Bridge to be constructed PSC Pretention 5-Girder system for super structure and RCC for Substructure. But in site it is constructed with PCC Substructure and RCC 4-Girder system.
20. Scope of Work as per O & M:
As per CA Clause no. 12.2 the concessionaire shall maintain, at its cost, the existing lane(s) of the Project Highway so that the traffic worthiness and safety thereof are at no time materially inferior as compared to their condition 7 (seven) days prior to the date of this Agreement, and shall undertake the necessary repair and maintenance works for this purpose; provided that the Concessionaire may, at its cost, interrupt and divert the flow of traffic if such interruption and diversion is necessary for the efficient progress of Construction works and conforms to Good Industry Practice; provided further that such interruption and diversion shall be undertaken by the Concessionaire only with the prior written approval of the Independent Engineer which approval shall not be unreasonably withheld. For the avoidance of doubt, it is agreed that the Concessionaire shall at all times be responsible for ensuring safe operation of the Project Highway
Applicability of Schedule – K (Details in Pages 303 to 309 of CA)

Introduction:The project site of Hosur-Krishnagiri of NH-7 from Ch.93+000 to Ch.33+130 was inspected on 30,
June 2015, jointly with Concessionaire HKTRPL, construction contractor L & T representative and members of IE team headed by:

Progress & Quality of Works:1) Even though the Concessionaire has given assurance to start the bus bay location at Ch.91+580
RHS on or before 2nd June 2015, the work has not yet been started.2) Toll Plaza monthly monitoring is carried out regarding Ambulance; Highway Patrol and ETC
system and found to be satisfactory.3) Laying of 2 nos of 300mm dia pipes for Utility Duct are in progress from Ch.92+250 to 92+400
RHS of Service Road. 4) Long pending issue of Land Acquisition of D.K. Swamy at Ch.88+950 RHS has been cleared
now and the Concessionaire has to take up the work immediately.5) BC laying work is in progress at Ch. 87+300 RHS of Toll plaza area and temperature has been
checked and found to be within the limits of tolerance. 6) Earthen shoulders are not maintained at the merging portion of service road and MCW at
Ch.87+000 PUP approaches on Hosur side.

7) Construction of bus bay location at Ch.84+830 RHS can be taken up immediately in as much as LA problem is already resolved.
8) The Bus bay location at Ch. 83+700 RHS is yet to be started.9) The progress of Quadrant pitching is observed to be at snail’s pace for Major Bridge at
Ch.77+993 RHS and the progress is to be stepped up.10) Flow from Pipe Culvert at Ch.68+585 on the downstream is totally blocked by forming an
approach road to the Rest Area. Since functioning of the Culvert is under question the same is to be solved by clearing the formed approach road to the extent required to connect to the Minor Bridge at Ch.68+350.
11) Paver blocks fixing work is in progress at ch: 68+500 of Rest Area without submission of methodology. The Concessionaire is there for requested to submit methodology and proceed with further work.
12) Paver blocks laying work is in progress at Bus bay location at Ch.53+520 RHS. It is observed that, the laying of paver blocks are not matching with the adjacent BC and the same should be rectified simultaneously while laying work is in progress.
13) The camber corrections are to be done immediately for BC laid locations of Thali Junction, Ch.39+020 to Ch.39+500 and Ch.36+300 to Ch.36+500 of Service Road RHS.
14) Pipe drain chambers are to be raised to the required level before the laying of 2nos of 300mm dia pipes for Utility duct work.
15) Pot holes are observed in two locations needs to be rectified immediately from Ch. 35+180 to Ch.35+300 RHS and Ch.35+600 RHS of Service Road.
16) 2nos of 300mm dia pipe laying of utility duct work is in progress at Ch.35+000 to Ch.35+800 .It is observed that the pipe is not in alignment from Ch.35+400 to Ch.35+420 and the same is to be rectified before further activity.
17) Deck slab of Box culvert at ch:40+935 is completed and lot of honey combing observed in the concrete surface of wall at final lift needs to be rectified immediately.
18) The existing earthen drain is not maintained from Ch. 54+360 to Ch.54+700 LHS and the same has to be maintained as per CA.
19) The work of rehabilitation is in progress for the existing minor bridge at ch:38+500 RHS.Inspite of pointing out in the earlier reports, the following items are once again repeated as the same are not attended to date. 1. The Project Information board is not provided.2. The plantation in median shall comprise shrubs whose height would normally not exceed 1.0m to 1.5m and shall be as per IRC-SP-21 needed to be trimmed immediately.3. Housekeeping is to be maintained. 4. Number of Pot holes found to have developed in Ch.92+250 to 93+000 on Service Road LHS which are to be closed within 48 hours as per Schedule – “K” ( clause :17.2) of CA.5. The item of providing Landscaping and beautification is yet to be started under all Flyovers. This may be taken up without any further delay.6. MS grills fixed in between MCW and service road from Ch.-88+340 to -88/500 RHS are not true to the line and the same should be rectified immediately7. Safety guardrails (RCC) are to be provided for all PUP’s and VUP’s approaches as a Safety measure to avoid accidents.

8. The existing RCC drain in between RE wall and Service Road is to be closed from Ch.40+600 to 40+980 RHS as shown in the approved Plan and Profile of MCW and Service Road.9. Potholes and patches should be closed immediately.10. Avenue Plantation and Median Plantation are to be maintained regularly.11.Proper safety measures should be provided wherever fixing of metal beam crash barrier, studs fixing works and road cleaning works service road formation and miscellaneous works etc., are in progress.12. Unauthorized openings in the median portions should be closed immediately to avoid accidents.13. Chainages shall be marked throughout the stretch wherever activities are in progress.14. LED traffic beacons and chevron boards are to be provided at curve locations of radius less than 400m and up to 400m radius.15.The level of Paver blocks laid in the bus bay at ch: 92+600 RHS is not matching with the Service Road BC level and the same is to be rectified immediately.16.BC in the left out portion of Service Road RHS from Ch.91+100 to Ch.91+120 has to be completed immediately. 17.The existing drain in the on RHS of Service Road at Rayakotta flyover from Ch.89+400 to 90+100 RHS is to be cleaned and damaged portion need to be reconstructed. 18.Paver blocks found to be damaged badly at Bus bay location at Ch.86+960 RHS needs to be replaced without further delay as the same is pending since more than 6 months period.19.The footpath cover slabs found to be damaged for the Major Bridge at Ch.77+900 RHS are to be replaced with new one and debris on approaches to be cleaned. 20.The Bus bay separator (Island) in the two locations at Ch.52+200 and Ch.76+630 are removed in order to match with the reviewed drawings.21.The opening in the median portion at box culvert location at Ch.74+580 is to be closed immediately to avoid accidents.
