Travel is not only an effectivean t i do te to ennu i , i t i s ap rophy l a c t i c t r eatmen t o fethnocentrism. It lifts the veil ofcustom from outside world andexposes the latter to viewwith all itswonders, excitement and novelties. Most of the time, we live an entirelycircumscribed existence being slaveto a dead routine. So, I too graspedthe opportunity to travel to Busan,South Korea for InternationalScience Fair (KSASF). When myBiology teacher, Mrs Shalin iKanchan approached me for thetrip, my mother quickly agreed. WORLD JUDICIARY — LAST HOPE FOR HUMANITY’S SURVIVAL DECEMBER 2011 (3)

"One must care about a world one will never see." —Bertrand Russell, mathematician and philosopher

Rule of Law

The WorldToday

Strengthening the UNO

Need of the Hour

Global governance and empowering theInternational Court of Justice

World Judiciary — Humanity’s LastHope

The societies and nations the worldover are governed by rules andregulations applicable to, andenforceable on, all. But the rule oflaw remains elusive in many places;and in many cases vulnerablesections do not get redressal, whilethe powerful manipulate law intheir favour. It is so at thei n t e r n a t i o n a l l e v e l t o o .

International law is based on covenants, conventions, treaties and agreements among nations, but has nobinding effect. It is, therefore, imperative to have aworld body duly constituted by reasonably representedpeoples and nations of the world, expressly granting itsanction to enact universally applicable internationallaw or world law, by whatever name called. Such lawshall then be respected and shall have binding effect. The rule of law throughout the world is of paramountimportance in this era of globalization.

The world today is passing through probably the mostdifficult phase in human history when the very survivalof humanity, nay, life itself, is gravely endangered. Onone hand, scientific and technological advancement andglobalization have opened new vistas, on the otherhand, it has created many problems which aremultiplying faster than the efforts to contain them.Global warming and climate change, nuclearproliferation, lawlessness and terrorism, civil andethnic wars and danger of third world war are matters ofglobal concern, besides poverty, hunger, disease, drugs, money laundering and many other problems. All globalproblems require global solutions.

In the six decades of its existence, the UNO has seenmore people die in numerous wars all over the world, than had died in both the world wars combined. TheUNO also saw the nuclear countries build up massivestockpiles of nuclear weapons, said to be over 36,000warheads strong. Moreover, 80 countries have alsostockpiled chemical and biological weapons. Eventhough the UNO has many achievements to its credit, inthe ultimate analysis, one has to admit that it has fallenfar short of the expectations of its founding fathers. Oneis reminded of what Jan Tinbergen, the 1969 NobleLaureate in Economics, said, “Mankind’s problemscan no longer be solved by national governments. Whatis needed is a World Government. This can best beachieved by strengthening the United Nations system.”In the present world scenario it has become all the morenecessary to strengthen the UNO, by suitablyamending its Charter, so as to make it a more effectivebody for preventing wars, resolving internationaldisputes, countering terrorism, conservation andprotection of environment, ensuring nucleardisarmament and evolving enforceable world law, toensure world peace and prosperity and a safe future forchildren.

Now that the leaders of various countries are unwillingor incapable of either arresting the global stockpiling ofweapons of mass destruction or reversing the massivetide of environmentally damaging and ecologicallydestructive activities worldwide, the need of the hourclearly is for an international law-making body, whoseenactments would be uniformally applicable on all thecountries and all the peoples of the world. However, world leaders have already demonstrated their lack of

statesmanship which was clearly evident at the UN’sMillennium Summit (held from 6th to 8th September2000 at New York) where even though the agendarecommended by the U.N. Millennium Forum of CivilSociety organizations and the N.G.O.s includeddiscussions on ‘a new international economic andpolitical order’, the biggest gathering of Heads of Stateand Heads of Government failed to come to anyconclusion in this regard. We have also seen theoutcome of the Second Millennium Summit held on 14-16 September, 2005, at New York. The much talkedabout reforms of the UNO are nowhere in sight.

Perhaps the choice before all who inhabit this earth, iswhether the unification of humankind will happen afterunimaginable horrors precipitated by humanity’sstubborn clinging to old patterns of behaviour, or is to beembraced now by an act of consultative will. It needsserious considerations whether world unity and worldpeace is possible by strengthening the United Nationssystem or by a totally new world order, which may alsoinitiate global efforts to conserve the environment, tooutlaw and eliminate all weapons of mass destructionand address the problem of terrorism, thus safeguardingthe future of humanity and specially the world’s over 2billion children and those yet-to-be-born. Besides, forinterpretation of International/world law and foradjudicating disputes and dispensing justice, it will benecessary to strengthen the International Court ofJustice and to extend the jurisdiction thereof to allnations.

On behalf of now over 42,000 CMS studentsrepresenting the world’s two billion children, I JagdishGandhi wrote many letters to Dr Kofi Annan, the thenSecretary General of the UNO requestingthat children’s Right to a Safe Future be recognised andincluded in the UN’s Declaration of Rights of the Child. The then Secretary General chose to reply (vide letter

dated 16th July 2001) to one of my letters (dated 29thJune 2001) in which I had also congratulated him on hisreappointment, and even then Dr Annan only thankedme for compliments and made no mention of my requeston behalf of world’s children. Clearly, the UnitedNations is neither ready to grant nor deny this right tothe children! Having failed to find justice anywhere,CMS had the option of either keeping silent or of takingthe children’s case to the world judiciary. Havingappointed itself as the custodian of the welfare ofworld’s children, born and yet-to-be-born, CMS has

decided to approach the Chief Justices of the World andsolicit their support in favour of the children’s cause. The children’s last hope rests with the world judiciary, for, Judges are the only authority who are trusted andrespected by all, the masses as well as the classes. As theconscience keepers of mankind and as the custodians ofthe welfare of humanity’s silent masses, it is the moralduty of the world judiciary to come out of their Courtsand to deliver a public judgement on the urgent issue ofglobal governance. A wonderful opportunity todemonstrate their support and to lend the weight of theiroffice and personage to the cause of world unity andworld peace, offers itself to the International Judicialfraternity at the International Conference of ChiefJustices of the World on Article 51 of the Constitution ofIndia held at Lucknow, India. If the Judiciary fails to grasp this historic opportunity, then nothing can save the world from total annihilationin a third world war or an eco-catastrophe.Since the minds of the judges are conditioned towardsjustice and also because they are capable of facilitatingthe establishment of a new world order as their viewsand pronouncements would act as a mandate from thepeople to advise world leaders on the vital issue ofsaving humanity and ensuring a safe future to world’schildren and also those yet unborn. Only the Judiciary iscapable of paving ways, by impressing upon the worldleaders, to bringing about ‘enforceable International /World Law’ binding on all countries and peoples of theworld either by reform of the UNO to create a body - aWorld Parliament for enacting such world law or by anew world order. It is also expedient to empower theInternational Court of Justice by extending itsjurisdiction. As the conscience keepers of mankind and as thecustodians of the welfare of humanity’s silent masses,World Judiciary should come out to deliver a publicjudgment on the urgent issue of effective globalgovernance. The voice of the united World Judiciary cannot beignored by other sections of the world, how-so-everpowerful. Children expect that the judges of the worldshall unite for the sake of humanity’s survival and forsafe future for children and generations to come.

On behalf of children of the world,

Convener of the International Conferences of ChiefJustices of the World Founder-Manager of CMS,Lucknow, India

(Dr Jagdish Gandhi)

Hence world children’s only hope - World Judiciary!

Background in BriefThepresent world scenario presents a grimpicture, asthere are many problems which endanger the veryexistence of human species, flora and fauna and alllife on earth. Many problems are multiplying fasterthan the efforts to contain them. Lawlessness andterrorism have raised their heads, the ugliest in thehistory of mankind. The situation is stark, dreadfuland inescapable; and it may trigger another warwhich may be more devastating because of the largestockpile of weapons of mass destruction with manycountries of the world or because there are chances ofnuclear technology falling in the hands of terrorists ornon-state entities. Global-warming and climate-change, devastating diseases like HIV/AIDSthreaten the existence of mankind. Many countriesare facing problems of poverty, hunger, lack of basicamenities like potable water, nutrition, sanitation andmedical facilities, and education. Children in manycountries are worst sufferers due to civil and ethnicwars, drug abuse, trafficking and many more. In sucha world scenario, apprehension of children is notunfounded. Therefore, it is the duty of the presentgeneration to meet the challenges and try to addresspresent day problems to give our children a betterinheritance than that bequeathed to us. In such aworld scenario, a modern school has a responsibilityto educate children to be useful to the society and toprepare them to shoulder responsibilities and meetchallenges of times when they grow up.

City Montessori School (popularly known asCMS), Lucknow, is playing its role as a sociallyresponsible school right from its inception in 1959.The school has a special philosophy, vision andmission. This is supported by UNESCO in its Pressrelease (printed herein) while awarding to the CityMontessori School, Lucknow, UNESCO Prize forPeace Education in the year 2002, 'in recognition ofits efforts to promote the universal values ofeducation for peace and tolerance at a time whenthese values are increasingly being challenged'.CMSis a senior secondary school and is recognised by theGuinness Book of World Records as the world'slargest school by students on roll in a single city, andthe present strength is over 42,000 students. As thelargest school and recipient of UNESCO Prize forPeace Education, CMS, under its philosophy, visionand mission, considers itself duty-bound to createawareness among intelligentsia for world unity andworld peace so as to ensure a safe and secure futurefor humanity, especially for children and futuregenerations, under a new international political andeconomic order. With this underlying idea, CMS isorganising International Conferences of ChiefJustices of theWorld onArticle 51 of theConstitutionof India. As explained hereinbefore,Article 51 of theConstitution of India relates to international peaceand security and is only a reference point and abeacon—a guiding light, the spirit of which isinternational understanding, co-existence,reciprocity and world unity and peace.

I shudder to think…I shudder to think whatwould have happened ifthat day I had not stoppedto help him. What if I hadallowed my selfishness tooverpower my feelings of

rendering help to that old man? If I haddone so, probably, my selfishness wouldhave cost me my life! I still quiver with fearto recall that day.I glanced at the clock. It was fifteen

minutes to seven in the morning. I glancedat my wrist watch to confirm. It alsoshowed the same time. This meant that Iwas already late and I would probably haveto run to catch the steamer at the river ghat.I used to stay in a very tiny village nearPatna. I had completed my class 12 andnow had to appear in a competitiveexamination in Patna for doing graduation. My mother wished me luck and I dashedout of the door. The road was muddy and

"Hey Fatty, catch me if youcan!," challenged my eldercousin Jai."Try me, Matchstick!," Iretorted and darted towardshim in full speed. Finally,

with a little effort, he was in my grip. Wewere pretending to be enemy armies andplaying in the scorching heat of the sun onthe day of Rakshabandhan. My mothercalled us inside and I tied a 'Rakhi' on Jai'shand and was promised that, 'he will protectme all through my life.' I teased him sayingthat everywhere I was the one who used toprotect him from bullies and I am beingpromised his protection instead of gifts, why?Due to my healthy appearance I wasconsidered elder to my undernourishedelder brother in our locality. But timechanged for both of us in reverse order. Ibecame lean and thin and he developed amuscular body. He wanted to serve thecountry by joining the Indian Army while Istrongly opposed to the mere idea of hisjoining the army because I feared for hissafety amidst the enemy forces. But hemade fun of me by teasing me around toascribe my thinking as selfish on the pleathat I needed him as my personal bodyguard!Well, he was partially correct. At first sight, nobody believed that he wasn't acommando! Everyone was scared of him inschool and neighborhood and no boy everdared to stare at me. He had a great sense ofunderstanding; so there many otheradvantages of his being in my company. He took the entrance exam for NDAwhile Iwas in class tenth. One day, when I returnedfrom school, I heard small thuds, Jai wasjumping on the upper floor. I could hear thesounds, 'Yes, I did it!' 'Wow', 'Its huge!'. Ittook me no time to realise that my brotherhad qualified the written examination, andthat too with flying colours.I was happy but shocked. He hugged mesaying that he had been called forshortlisting session in Dehradun. I tried to keepmy composure calm and congratulated himhalf heartedly as I knew that now hewouldn't stop till he pursued his dream ofbecoming a lieutenant.I went upstairs and locked myself in myroom to rue that I was now alone without hiscompany, admitting that he had his ownambitions. Another moment I realized that Iwas being selfish, I can't make my dearestbrother sacrifice his dream just to fulfill thepromise he made to me every year onRakshabandhan'. I shivered at my nextthought what if something dangeroushappens to him? Tears came to my eyes atthis thought.K n o c k ! K n oc k ! An d , m y de e pcontemplation was shattered with adoorknock. I got up wiping my tears andopened the door. Jai came in and asked mefor a promise that I will behave sensibly andtake care of myself in his absence. He hadtears in his eyes but he calmed me andpromised that though he would be away butstill he would guide and protect me.After 3 days of training and interviews, hewas short listed and went through a rigoroustraining at the Academy. We regularlyshared our experiences at night throughcalls. He used to tell me about hispunishments, early rising, his great lot offriends, first experience of handling a gun,

crawling in marshy swamps etc. He wasposted in disputed Kashmir after thetraining.Whenever he came home during thefestivals, we used to sit on terrace and gazedat the stars for hours. I wanted to be anastronaut and every one in my family, except my brother, considered me a crazydreamer. My brother always said, 'A man isbut the product of his thought. What hethinks, he becomes.'Years flew by and I came in class twelve. Itwas my last year of school, so I signed up forthe school trip to Mount Abu in Rajasthan, during the summer break. As I was broughtup with my brother, in a militarybackground, I enjoyed adventure.mountaineering, rock climbing. This tripwas actually all about that adventure. So Iwas thrilled. I felt the adrenaline rushthrough my veins as I climbed the steepplateau rocks. As soon as we got back, I called my brotherand told him my experience. He suddenlygrew very serious in his tone and asked meto promise that whatever happens, I wouldwork hard and get good percentage in class12th board exams and will leave no stoneunturned till I become an astronaut (Hispromise in exact words). I was a littleconfused and asked him about the need ofasking such things at that time. He told methat, there in Kashmir, his battalion rescuedthe villagers after the avalanche and then Ipromised him what he wanted me to do. Hebid adieu and I got engrossed with myfriends. The next afternoon, my group leader cameinto my room and informed that last night,my brother got killed in one of those 'out ofcontrol' situations at the line of control. Itold her that there must have been somemisunderstanding. It was impossible. No!No! No! I talked to him just 6 hours ago andnow they were telling me that he had died, isgone… forever! She told that my brotherwas true martyr, he died saving an injuredsoldier.I didn't believe her for a second. I packed myluggage and was sent home. I tried to callhim but his phone was off. All through myway back home, all good memories of ourtimes we spent together flashed before myeyes. I had faith in God that He can't takeaway my dearest brother from me.I felt like I was trapped in one of mostterrifying nightmares, the one where youhave to run, run till your lungs burst, but youcan't make your body move fast enough. Mylegs slower to move slower and shower as Ifought my way through the callous crowdstanding before myhouse.I found Jai's dead body wrapped in ournational flag in a glass case. I hugged mybrother for the last time. His suitcase washanded to me. I couldn't see anything. Mysurrounding seemed hazy, I hadn't realizedthe moisture in my eyes had brimmed over. Iquickly rubbed my hands across my cheekbut the traitor tears were there again. Now, finally I understood the meaning ofhis last words. He knew that he wouldn'tsurvive. I resolved to achieve my dream, forhim. Even now, two years after his death, Ican feel an invisible guiding forceprotecting me from every unseen trouble.

I shudder to think

"War is as outmoded as cannibalism, chattel slavery, blood-feuds, and dueling, an insult to God and humanity... a daily crucifixion of Christ." —Muriel Lester

Planes swooped low in thedark sky like eagleshovering above. Realfighter planes they werecoughing out fire as realdragons would. Soon the

bombs started exploding and people ranhelter skelter for cover. It was a dark andbewildering night. Mothers carried theirinfants in their arms and ran. Fathers, brothers, sisters and friends all ran. Suddenshock and fear gripped their faces. A freelance photographer, I tried to hold mynerves. But inside me, a volcano seemed toerupt. I shudder when I think of that fearfuland dark night. Was it a terrorist attack? Or had ourneighbouring country launched a suddenattack? Perhaps a satellite from outer spacehad entered our planet or aliens hadplanned to destroy us. Within minutes oursleepy old city had woken up late eveningand become a scene of devastation . I hadgone to the shopping mall to buy somegrocery items for mother when the attackbegan. It was 10' clock then and few of thelate night shops were open. Most of themclosed at 8 p.m. I hid behind one of theshelves and tripped over something. Therack toppled over as I reached out to holdsomething. Bars of chocolate and a heap ofsweets fell upon me. On a brighter day Iwould have enjoyed some chocolate buthere I stood dazed and frightened, almostshivering as the sound of drones struck myears. With all my energy, I darted out of thestore and saw flashes of light in the darksky. Now I knew that this was an alien attack.Terrorists would not continue haunting andflying over us for such a long time. Mycamera clicked some pictures. In a nearbyrestaurant I saw the news flashing on thetelevision. They showed pictures ofdevastation. In that state of fear, I

remembered my past deeds. I had beenselfish and rude to say the least. I had nevercared for anything. But why was Iremembering all this now? I tried to praybut could not. I remembered my mother'swords 'He prays best who loves best all thecreatures of the earth.Again I thought of allthe horrible things I had done and vowednot to repeat those things and to become agood girl. 'Good' what a valuable word itseemed then amidst all the crueltyaround.Yes, the planes were landing now. I hidbehind a tree. Again my camera clicked;suddenly someone caught me by theshoulder. We were all lined up. A firingsquad stood in front of us. I closed myeyes. 'O God! was this the end of my life?'Then the sound of gun shots. But what isthis? I heard a loud voice say CUT! Myeyes opened and I stared at the spacearound me. It was almost dawn. A hugeman stood near me smiling. I thought Iwould faint in surprise!Slowly the truth dawned upon me. Thefamous Hollywood director SylvesterStallone was making a film here in our verytown. He was filming an alien attack andwanted real emotions of the people. Sothere had been no previous information. Itwas all real. Real people and real emotions!Only the story was not real.

Even today when I am remindedof that dark night, I shudder to think of it.My lips dry up and I almost start tremblingin fright. What if this had really happened?I am not one to give up easily. I must trainmy senses and work hard to make the worlda better place. Who knows what mayhappen in future but we must be strong toface all kinds of challenges and be readyfor action!

very slippery. I walked gingerly with allconcentration. It had been rainingcontinuously for last two days and all theroads had become a sea of slush. The rainyseason always brought havoc to thisvillage. Every year the Ganga turneddangerous owing to heavy floods and rain.It had started drizzling again. Nothingcould have been worse than this. It wasalready not easy to walk on this slipperyroad and now with an open umbrella, it wasalmost impossible. It was five minutes toseven. I cursed the wretched rain. The riverghat was still some distance away.Suddenly, I heard a feeble voice, like thatof a fainting echo of a ringed bell, askingfor help. I stopped and looked at theshadowy figure, old and frail, standing inthe middle of the road. His bullock cart wasstuck in mud and he was not able to push itout. He was asking me to help him. He waswrapped in a shawl and only his face wasvisible.I looked at my watch. Almost seven! Icould see the steamer, all ready to leave atany moment. I apologized to him. I toldhim to wait, he'd surely find some passerby to help him.The old man caught my sleeve. He said itwould not take much time. I felt irritated. Icould hear the first hooter of the steamer.Who was this man? Why should I stay backto help this man when I don't even knowhim? Isn't catching the steamer to appearfor the exam much more important thanhelping this stranger?I was tempted to ignore him and go butsuddenly I glanced at his face. His forcefuleyes touched my heart. Was I being tooselfish ? If I leave this man in the lurch,God would surely punish me. Some sort ofrace was going on between the devil andthe angel inside me.I was muddled up in deep thought when myfriend Ritu shouted for me to come as thesteamer was about to leave. Any learnedman would say, 'Of course, it is logical tothink of yourself sometimes'… My careerwas at stake…

Against all logic, I decided to help him. With all my might I pushed the wheel. Itdid not move. I tried harder. This time itmoved and became free from mud. The oldman was overjoyed and showeredblessings on me.I rushed to the ghat. I panicked as I saw thesteamer move. I cried for it to come backbut all was in vain. I stood there motionlessgazing at the Ganga trying to believe thatmy year had gone waste.Suddenly, I remembered the old man. Whynot go and help him? I had all the time inthe world now. I reached the spot where Ihad left the old man and his cart, there wasno trace of either of them. No sign ofwheels stuck. Did I imagine everything?Shaking my head in disbelief, I moved on.I got a shock when I neared my house. Abig crowd had gathered there. In the midstof all, my mother was crying bitterly.Everyone was shouting, screaming, Mymother ran to me and hugged me. For aminute, pandemonium broke loose, peopleasked me if someone else was also alive inthe disaster.Disaster! What disaster? I narrated that itwas because of that old man that I didn'tcatch the steamer. My father told me thatthe students who boarded the steamer wereno more in this world. The flooded riverhad engulfed the steamer.I sat down in utter shock as I wonderedabout my friends and my narrow escape. My horror increased when I was told thatnobody used the mud road since the bigroad was constructed connecting villagewith ghat.I wonder who that old man was? What washe doing there in that weather with a loadedcart? Was he there only to save me fromthe coming disaster?I shudder to think what if I had refused tohelp him that day. It still remains questionof wonder for me, 'What if….?!!!'

HEALTH COLUMN BREAKING THE JUNK FOOD HABITThe effects of fast food can be verydamaging. For the brighter, healthierand safer future of your kids, preventthem from eating excessive fast food, rightly known as, 'junk food'. Childrenare more prone to the advertisementgimmicks of the fast food chains andthe easy to eat and lip-smackingtastes, allure them away from healthyvegetables and homemade nutritious

food. As the foods contain starch, they do not make thechild feel full, thus, leading to overeating. Junk food has become synonymous to hamburgers, pizzas, French fries, hot dogs, rolls, etc. which have high calories, fats, saturated fat, sugar andsalt content. You can't prevent your children from eating junk food, but you can ask them to make healthierchoices.1. You can ask them to take less cheese topping on their pizza and have more of low-fat

toppings like onions, mushrooms, green peppers, tomatoes and other vegetables of theirchoice.

2. They can order roast mutton or chicken sandwiches made of whole wheat breads orbiscuits.

3. Burgerscan be single meat patty with extra lettuce leaves, tomatoesand onions.4. Theycan opt for salads with lettuce leaves and assorted vegetables.5. Grilled bake, roasted or broiled meats area better choice overbreaded or fried types.6. Theycan avoid anything that is cream based like 'creamy tomato soups'.7. Theycan choose low-fat milkshakes or juices over sodas and colas. It is best to start training children about foods as soon as they can talk since they are mostinfluenced by their families during the preschool years. As they grow up, they require guidancefrom experts in nutrition, a role which parents can't fulfill due to unawareness or inability tocounsel children on food. For those not particular with their diet, junk foods have been a part of total relaxation whilewatching TV. This habit has always been passed on from generation to generation due to themindset that munching on something while watching TV can make you enjoy the activity muchbetter. This can lead to a very unhealthy lifestyle due to the accumulation of processed food inyour system. Here are some thoughts on how you can efficiently avoid eating junk foods even while watchingTV.·Choose your priority between junk food and watching TV. Don't do both at the same time. If youcan't endure the feeling of not having to eat while watching TV, then find a healthy alternative tojunk food.·When going to the grocery, don't bring temptation at home. Plan for healthier munchies toreplace junk foods like vegetable sticks with dip and fruits. If you want to eat junk food, then getone and eat itwhenyou're outbutdon't bring it home·Fill-up your refrigerator with healthy food alternatives to junk food like fruits and vegetables. If asoda or a bag of chips are not visible for the taking, then the whole watchingTV activity becomeshealthier.·Divert your attention to another activity while watching TV. Exercise while watching TV. It's awin-win situation;you watch TV and get healthier at the same time.Educate yourself about junk foods. Junk food has a negative effect on our health and theexcessive eating of it that definitely leads to weight gain. It iseasier to avoid junk foods when youknow how itwill affect your body.
