El pasado 10 de abril se realizóotro retén en las esquinas deStory Rd & Lido Way. El Depar-

tamento de Policía de San José (SJPD) re-portó que 919 vehículos fueroninspeccionados. En este retén se hicieron 9arrestos por estar bajo la influencia de alco-hol, una persona fue arrestada porque tenía

orden de arresto , 31 conductores fueroncitados por no contar con licencias, 5 con-ductores fueron citados por tener licenciassuspendidas y al final de reporte la institu-ción indica que fueron incautados 33 ve-hículos.

El 8 de abril el Jefe de la Policía, RobertDavis informó a EO que las personas queno tienen licencia tienen la opción duranteel proceso de detención de llamar a un fa-miliar para que se presente con licencia y

recoja el vehículo.“Estamos dando la oportunidad a las

personas que no tienen licencia llamen aun familiar. Ellos tendrán 30 minutos parallamarlos y así evitar que se les incaute elvehículo”, dijo que Davis .

Sin embargo en la práctica esto no estápasando. Cuando EO llegó al operativo delretén preguntó a los afectados y algunos di-jeron no saber de esta nueva medida.

“Los vehículos incautados son de

aquellas personas que no contactaron aalgún familiar para recuperarlo. Pero fueron12 los vehículos devueltos y ayudados conesta nueva disposición”, dijo el oficial JoséGarcia de la Oficina de Información delSJPD.

Inelegibles para una amnistía“Las personas que son citadas por con-

ducir sin licencia no reciben una infracciónde tránsito sino una cargo de “delito menor”.Estos delitos menores originan un granproblema para los inmigrantes . “En la Am-nistía de 1986 cuando una persona tenía

tres delitos menores no calificaba. Por estarazón en esta próxima reforma migratoriaestamos proponiendo eliminar la barrera delos tres delitos menores o tener una claú-sula que diga que conducir sin licencia nodebe ser considerado”, dice el abogado deinmigración Mark Silverman.

Silverman sostiene que algunas per-sonas tienen diversas condenas por mane-jar sin licencias, lo cual ocurre porque lesresulta imposible conseguir licencia debidoa su condición de indocumentados. Δ

California’s Economic Climate Needs Protection

Costs of New Climate Change Rules Threaten Our Businesses and FamiliesBy James Duran

Times are tough in California. Here in the Silicon

Valley, the unemployment rate was at 10% as of

February, almost twice as high as just a year ago.

And the Mercury News recently reported that in

San Jose alone, roughly 4,000 homes are in vari-

ous states of foreclosure. Add to that the state’s

multi-billion dollar budget deficit, and it’s plain to

see we’re in trouble.

What’s equally troubling, however, is the fact that

the California Air Resources Board (CARB)

seems to be completely oblivious to all this. The

agency is moving forward with a plan that will

cost California businesses and families billions of

dollars to fight global warming. Even in the best

of times this would be hard, but today it will be

devastating.

Senator Robert Dutton has introduced legislation

– SB 295 – which if signed into law by the Gover-

nor, would force CARB to calculate the real costs

of its global warming plan and to put off imposing

costly new policies on consumers until the state’s

economic climate improves. We believe this bill

is reasonable and very necessary for a number of

reasons.

CARB’s climate change battle plan is full of con-

tradictions. The agency’s widely published con-

clusion is that we can reduce global warming

emissions virtually for free. But the fine print

says there will be billions of dollars in increased

energy, fuel and building costs, which will fall dis-

proportionately hard on small businesses and low

income families. And California’s non-partisan

Legislative Analyst and CARB’s own panel of

economic experts concluded CARB’s economic

analysis was seriously flawed and grossly under-

stated the plan’s cost to consumers.

Those costs, according to CARB’s own plan, in-

clude higher energy bills – 8% or more for natural

gas, 11% or more for electricity, and $11 billion

for lower-carbon fuels. There will be billions

more in building costs, investments in new

“green” technologies and equipment, and energy-

efficient buildings, to name a few. These costs

won’t fall just on big businesses – they will be

passed along to everyone who uses energy, trans-

portation and virtually every kind of product and

service, including food.

The Hispanic Chamber of Commerce of Silicon

Valley has made this a priority issue, since our

members and communities will be among the

hardest hit by the costs of global warming regula-

tions. We’ve shared with CARB our concerns

about these costs and repeatedly asked for a mean-

ingful accounting of what these programs will cost

various industries, business sectors, and communi-

ties and families, not just on average over many

years, but in real time starting now. We were told

as individual rules were developed; the necessary

cost studies would be done.

But now CARB is proceeding with adopting those

individual rules, and they’re still not answering

those critically important questions about what

these rules will cost.

We are concerned that by the time anyone figures

out what the true costs are, even more people will

be losing their businesses, losing their jobs, and

maybe even losing their homes. We need to take

stock of the real economic impacts, weigh their ef-

fect on our already-struggling economy, and ad-

just accordingly.

We’re not advocating doing nothing about global

warming, but we believe what we do must be well

researched, must be cost-effective and must take

current economic conditions into account.

Sadly, CARB’s actions have demonstrated they

can’t be counted on to do this. That’s why the

Hispanic Chamber of Commerce of Silicon Val-

ley, along with the California Hispanic Chambers

of Commerce and California Black Chamber of

Commerce support SB 295.

SB 295 won’t stop the fight against global warm-

ing, but it will force CARB to do the right thing

by merely requiring a new economic analysis and

postponing new rules until California’s unemploy-

ment rate falls below 5.8% for three consecutive

months.

The global climate is important, but the economic

climate is equally important. Especially for small

and minority-owned businesses and low income

and minority families, SB 295 is the protection we

need not only for the environment, but for our

economy as well.

On April 10th the San Jose Po-lice Department (SJPD) con-ducted a DUI checkpoint at

King Rd. and Lido Way, one block fromStory and King Rd. El Observador was“observing” the operation and these arethe results:

out a license5 drivers were cited for suspended

driver’s licenses33 vehicles were impoundedOn April 8th Police Chief Rob Davis

informed EO that people without licenseswould have a chance to call a friend orfamily member who has a driver ‘s licenseto pick up his or her car and avoid im-poundment.

“We are giving an opportunity to theimmigrants that don’t have a driver licenseto get their cars back. They will have 30minutes to call a member of his or herfamily,” said Davis.

But this was not happening when EOarrived and observed the DUI checkpoint.El Observador asked people who werestopped during the DUI checkpoint and

certain people stated they weren’t in-formed about this alternative.

“The vehicles that were impoundedbelonged to drivers that had a chance tocall a family member but didn’t have anyresponse. SJPD returned 12 vehicles dur-ing this checkpoint. We are flexible”, saidJosé García, Public Information Officer.

Garcia stated, that the SJPD has al-ways done that, but activists said this isnot true. Drivers that were affected saidthe same thing, and El Observador cor-roborated this version.

Ineligible for immigration reformThe 31 drivers cited for driving with-

out a license will get a misdemeanor, notan infraction for their “crime”. These mis-demeanors are getting immigrants in trou-ble. “During the amnesty of 1986, peoplewho had three misdemeanors were ineli-gible for amnesty. For this reason, we aredemanding the elimination of the bar ofthree misdemeanors in this immigrationreform or have a clause that says thatdriving without a license won’t be consid-ered a misdemeanor,” stated immigrationattorney Mark Silverman. “Many personshave several convictions for driving with-out a license - convictions which hap-pened because of their inability to get alicense due to their undocumented sta-tus.”

About the 2010 Census

The San Jose Police Departmenthas been featured almostweekly in news reports of six

taser deaths since 2005, racial profiling, se-lective vehicle stops, and drunken arrests.An October Mercury News report that SanJose police arrested 4,600 in one year forpublic intoxication, and a disproportionate56% were Latinos, resulted in hundreds at-tending a public hearing. After hours ofangry and some tearful testimony of unjustarrests, mistreatment by officers, and awoman whose father was killed by policetaser, City Manager Debra Figone initiateda task force to study the issue and find a justresolution.

The task force of 25, selected byFigone, has a fair representation of stake-holders, including Asian, African-Americanand Latino communities, Police Chief RobDavis, the District Attorney and Public De-fender, downtown business, city and countygovernment. I have attended most of the 6-9 pm Thursday meetings, and here is my re-view:

Chief Davis diplomatically explainsthat what seems as targeted arrests are infact compassionate efforts “to protect thepublic, especially downtown club-goers,from injury by falling down, getting hit bycars, or aspirating their vomit.” Davischeerfully related, “in some cases officerseven give the inebriated a ride home to en-sure their safety.” When asked how oftenofficers provide such front door service, heoffered to try to get the data.

But the reality is that club-goers areushered out of clubs at closing time, chan-neled by the 60 or more police on crowdedsidewalks, and arrested when showingsigns of inebriation-such as walking clum-sily, bumping into others, jaywalking (evenon streets closed to traffic by police), shout-ing, slurring speech. More egregious of-fenses are failing to follow orders fromofficers, asking questions, talking back orvideotaping arrests. Community advocatescall these “failing the attitude test” or “an-noying an officer” arrests that may includethe serious additional charge of “resistingarrest,” which can be elevated to a felony.

Adults out for a night of music, danc-

ing, drinking, and generally having goodtime, all legal inside a club, may be startledto realize that the moment they exit ontopublic property-the sidewalk, they are inanother world owned by police. The alco-holic beverages for relaxation and to cooloff from the crowed dance floor are sud-denly converted into penal code 647(f)—public intoxication. By officer discretionalone, one may end the evening in a jail cell,possibly injured by a police club or taser.One man was shot in the face after he“interfered with an officer” who taseredhis wife.

The question asked by the task force is:are these arrests necessary, especially whenthe DA deems only 15% prosecutable? Inprior times, inebriated individuals were of-fered a taxi home, allowed to call someoneto pick them up, or taken to a “drunk tank”to sleep off their drunkenness. Davispleads, “arrests are the only legal way totaken them into custody and save themfrom greater harm to themselves or others.”

But contacts with police and city hallinsiders and community groups offer theseobservations: “The Chief is stubborn, willnever admit a mistaken policy damagingpolice-community relations.” “Davisfought the Police Auditor, not realizing shewas his loyal opposition whose recommen-dations could save his job.” “The chief setsthe tone for officers, or fails to do so, so theydo whatever they want.” “Davis is not acop’s cop, never a street officer, doesn’thave respect of street cops, so he can’t pushtoo much.” “The support he has is becausethey have plenty of overtime pay, force andarrest policies work for them, and he muz-zled the police auditor.” “Davis has thesupport of the mayor, the council, and citymanager-as long as they’re happy withDavis, he stays, the public be damned!”

The question for Mayor Reed, CityCouncil and City Manager Figone and mostimportantly, San Jose residents, is: If ChiefDavis cannot restrain aggressive officersquick on the draw with tasers orfirearms, arresting non-violent inebri-ated individuals with sober designateddrivers, then who can police the police?Δ

Some key 2010 Census activities accompa-nied by scheduled dates are presented herefor all to become informed. The first and

most important fact is the purpose of any census is tocount all residents, both citizens and non-citizens. Un-documented individuals need to permit themselves tobe enumerated (counted) because, in the future, ourgovernment distributes tax funds to various programswhich provide services to all--based on the official cen-sus data. An undercount hampers local governmentsand their agencies when they receive funding based onofficial census data only to experience that the com-munity has qualified recipients of that service in num-bers which exceed the official census count.

Therefore, undocumented individuals, aka ‘illegalaliens,’ need to come out of their shadow locationwhen the census enumerators do their work. The in-formation the 2010 Census collects is not shared withany other federal agency. So trust them just to countyou and that is all.

Here are the key dates for the conduct of the 2010Census by the U.S. Census Bureau:

* Fall 2008...Recruitment begins for local censusworkers & staff to fill jobs and perform preparatory op-erations. This began last fall and is going on now.

* Spring 2009...Census workers go door-to-doorto update address lists.

*Fall 2009...recruitment begins for enumerators(census counters) needed for peak workload occurringduring the 2010 Census.

*February to March 2010...Census questionnairesare mailed or delivered to households.

*April 1, 2010...CENSUS DAY (the official day).*April to July 2010...Census takers visit house-

holds that did not return a questionnaire by mail.*December 2010...By law, the Census Bureau de-

livers the 2010 Census data (population counts) to thePresident for apportionment purposes.

*March 2011...The Census Bureau completes de-livery of redistricting data to states.

NALEO (National Association of Latino ElectedOfficials) encourages all individuals to participate inthis census because: a) fair funding allocations arebased on the population counts deemed official and b)re-districting of all election jurisdictions will be basedon these official population information. Efforts havebeen made to ensure that bilingual census staff is hired,especially those who will reach growing immigrantpopulations who are not English language proficient.

The Latino Census Network, composed of some30 organizations focused on census issues because anundercount must not happen. For example, if just 3%of the Hispanic population of Census 2010 occurs, then1,400,000 Latinos will be missed (as the Census Bu-reau admits happened during the 2000 Census). Thatnumber translates to two Congressional districts (seatsin Congress). Democracy requires accurate census datawhich is translated to fair representation in Congress,state assemblies, city councils, etc.

Raul Cisneros, of the Department of Commerce,explains that the census count is used to award morethan $300 billion in federal funds to states and com-munities to support a variety of programs and publicservices. So the 2010 Census needs the involvement ofall of us. It is in the best interests of all to be counted inorder to be included in the population counts which areused to allocate funds and support for education, healthcare, and local economic development.Δ

Saret Silva, a 17 year-old senior fromCarlmont High School in Belmont, CApassed away on April 4 of Acute Myel-

ogenous Leukemia. Saret was the daughter ofCesar and Flor Villamont Silva, who are natives ofPeru. The family resides in Redwood City.

Saret was diagnosed with leukemia in May2007. She relapsed in December of 2008.

In a statement released by her father, Saretwas known as a smart little girl and had receivedacceptance letters from the University of CaliforniaLos Angeles and University of California SanDiego.

“Saret wanted to study medicine, and special-ize in oncology to help other children with cancerwho were in a similar situation as she,” her fathersaid.

Ramona Garcia, outreach coordinator of His-panic/Latino Community for The Asian AmericanDonor Program, said Silva was in need of a bonemarrow donor in order to save her life. Unfortu-nately, her chances of finding a donor were slim be-cause there are not enough minorities registeredin the National Bone Marrow Program.

“Most of the time, donor matches are found inpeople of the same ethnicity,” Garcia said.

According to the Asian American Donor Pro-gram, 7.1 percent of registered donors are Asian,7.6 are African American, 5.3 are Latino, 1.1 are

Native American and 73 percent are Caucasian.Bone morrow is fluid that is produced in the

pelvic bone. It produces white cells that fight illness.“When someone has Leukemia, the white cells

cannot fight back against the cancer and organscannot function properly,” Garcia said.

The National Bone Marrow registrationprocess is simple. A potential donor has to be be-tween the ages of 18-60, have no serious ongoinglower back problems, and be in good generalhealth.

“Four Q-tips are used to gather a sample to de-termine your tissue type,” Garcia said. “You arethen placed in the national registry and are notifiedif your are a potential donor.”

The Silva family is asking for the public’s helpin order to pay for funeral expenses.

Assembly Majority LeaderAlberto Torrico (D-Newark) has introduced

legislation that will enable companiesto work with schools to assist studentsand ensure they receive a proper edu-cation.

“AB 1508 cuts through the redtape and allows employers to enterour classrooms and get students inter-ested in subjects such as math and sci-ence,” said Assembly MajorityLeader Alberto Torrico. “Most ofthese students are not ready to join the21st century workforce. They needmath and science to be able to work.”

Torrico held a press conferenceon April 10 at James Lick HighSchool in San Jose to outline the im-portance of the bill (AB 1508). At-tending were elected officials,

community organizers and formerNational Football League players EricWright Guy McIntyre of the SanFrancisco 49ers, and Mervyn Fernan-dez of the Oakland Raiders.

“We need people who are willingto donate their time to work with ouryouth and give them guidance and di-rection,” Torrico said at the press con-ference. “This is not just theresponsibility of our schools. We areall in this together.”

According to Torrico’s office,California has lost $46.4 billion intotal economic losses from every120,000 twenty-year-olds who nevercomplete high school. Two-thirds ofall high school dropouts use food

stamps during their working life andare 68% more likely to be on a wel-fare program.

In addition, California’s studentsremain far behind those in other stateson many measures of achievementand are dropping out of school in as-tonishing numbers. For example, Cal-ifornia ranked seventh from thebottom in eighth grade math and sec-ond from the bottom in science on the2005 National Assessment of Educa-tion Progress. About one-quarter of allCalifornia students who enter theninth grade fail to earn a diploma fouryears later.

According to Torrico’s office,California has displayed an alarming

trend in corrections spending, whilecutting back on more productive andpreventative investments like educa-tion. This type of spending has re-vealed dire consequences asCalifornia’s economy has become in-creasingly dependent on a skilled andhighly educated workforce to remaincompetitive.

“That is why we’ve had to importforeign workers to work in our com-panies,” Torrico said. “We need to getour students interested in the workthat our companies do.”

The bill was introduced to the leg-islature on February 27, 2009. Gover-nor Schwarzenegger will review it inthe coming weeks.

Entre las organizaciones comunitarias beneficiadas está Somos Mayfair, una organi-zación que ha conectado a las familias a travésde sus diferentes programas. Somos Mayfair harecibido 20 mil dólares para seguir desarrollando programas que permitan promover yayudar a familias. “Uno de los aspectos quenos ha encantado es la capacidad de conexiónque tiene Somos Mayfair en unir a las familiasa trabajar juntas. El Presidente Barack Obama hizo muchaspromesas durante su campaña. “ El cambioestá llegando y si se puede,” repiten estas

populares frases muchas personas que están bajo lalucha de diferentes causas. El pasado 14 de abril, diferentes grupos comunitarios de San José pidieron alPresidente Obama de mantener su promesa en presen-tar una reforma migratoria justa y humana.

“Estamos aquí porque no queremos que se trate alos inmigrantes como criminales”, dijo Salvador Bus-tamante de la organización Reforzando Nuestras Vidas(SOL siglas en ingles). “ No queremos familias que sequeden aisladas y queremos que los inmigrantes seanrecompensados por el trabajo que hacen”.

Los grupos también demandan la eliminación de losprocesos de inmigración que tienen un gran retraso.“Estos retrasos hacen más difícil que inmigrantes seconviertan en ciudadanos”, dijo Adel Olvera Directoradel Programa de Ciudadanía e Inmigración para el Cen-tro de Entrenamiento y Trabajo, CET. “ Muchas vecesestos retrasos causan que familias no estén juntas”, ex-plicó.

Richard Hobbs, Director Ejecutivo Interino de laRed de Servicios de Derechos y Educación para Inmi-

grantes (SIREN siglas en inglés) dijo que la última vezque el gobierno de los Estados Unidos pasó una reformamigratoria fue en noviembre de 1,986. El 18 de mayo secumplirán 10 mil días desde que se pasó esta reforma.Han pasado 10 mil días de espera para que se cumplanlas sus necesidades básicas y humanas y a su vez se lesconceda sus derechos bajo de la Declaración Universalde los Derechos Humanos”.

Como muchas personas en este país, los inmi-grantes están sufriendo de los efectos de la actual rece-sión económica.

“Antes el costo de hacerse ciudadano estaba por elorden de los $400 dólares, ahora cada persona deberápagar $675 para hacerse ciudadano. Muchos no lohacen porque no cuentan con ese dinero”, dijo Olvera.

Marcha pacíficaSe ha previsto para el viernes 1 de Mayo llevar a

cabo una marcha pacífica que se iniciará en la Story yKing culminando en el Municipio de la ciudad. (200 E.Santa Clara St. ) Los organizadores exhortan a las per-sonas de todos los grupos étnicos a participar. La cita esa partir de las 4pm .

President Barack Obama made many promises during his cam-paign.

“Change is coming and Yes we can,” we some of his more famousslogans.

On April 14, 2009, various community groups in San Jose askedPresident Obama to keep his promise and introduce just and humane im-migration reform.

“We are here because we do not want immigrants to be treated likecriminals,” said Salvador Bustamante of the Strengthening Our Lives(SOL) organization. “We do not want families to be torn apart and wewant immigrants to be rewarded for the work they do.”

The groups are also asking for the elimination of immigration back-logs.

“Immigration backlogs make it more difficult for immigrants to be-come citizens,” said Adel Olvera, director of the immigration and citi-zenship program, for the San Jose Center for Employment and Training.“Sometimes, backlogs prevent families from being together.”

Richard Hobbs, interim executive director for the Services, Immi-grant Rights, and Education Network (SIREN), said that last time the USgovernment passed a law that would legalize the status of undocumentedimmigrants was in November of 1986. The Immigration Reform andControl Act of 1986 legalized the status of anyone who entered the U.S.prior to January 1, 1982.

“Next month, on May 18, 10,000 days will have passed since De-cember 31, 1981,” Hobbs said. “Undocumented immigrants have beenwaiting 10,000 days for a law that would meet their basic human needsand grant them globally recognized human rights under the UniversalDeclaration of Human Rights.”

Like many people in this country, immigrants are also suffering fromthe effects of the current economic recession.

“Before it used to cost $400 to apply for citizenship,” Olvera said.“Today, immigrants have to pay $675 to apply for citizenship. Many im-migrants cannot afford that because the do not earn enough money.”

At the May 1st march organizers believe they will be marching alongside thousands when their moment arrives. They believe elected officialswill be at their side as well.

The march will be on Friday May 1st at 4 pm. It will start on Storyand King Rd and end at San Jose City Hall. The organizers encouragepeople of all ethnicities to participate. Participants should wear comfort-able shoes, bring water and an American flag.

“We are asking the community to have a non-violent peaceful marchin order to bring reform,” Olvera said. “Call your friends, your neigh-bors, bring everyone.”
