The 2011 State of the City Addresswas delivered by Mayor ChuckReed at the newly refurbished San

Jose Civic Auditorium, 115 W. San CarlosStreet, San Jose, CA 95113 on Thursdayevening, February 17, 2011. The refurbishingwas paid for using SJ Redevelopment fundingand is an example of how civic funds are usedto create jobs during recessionary times.

After all the ‘Thank you’s were delivered, the Mayor presented the most important com-mentary towards the end of his address. In thiseconomy, revenues have not increased whilecosts have continued to climb. One has to ad-mire the leadership which was demonstrated byMayor Reed in directly addressing the issue. Hestated, “In the past 10 years, annual retirementsincreased by $90 million. In the next five years, they will increase by another $250 to $400 mil-lion and more on top of that in the future.” Ifcurrent unfunded retirement contracts are notmodified, then the majority of city revenues willbe used to pay for retirement benefits. Can youimagine your taxes being used to pay for fewercivic services and more retirement benefits? Itis a totally unacceptable vision of our future.

Why is this so? It is because prior electedofficials were willing to enter into contractswithout having the full costs fully calculated andunderstood. The obligations entered into are‘unfunded’ and pushed off into the future. Thoseformer elected officials did not do their civicstewardship in a manner that took care of thepeople’s interest. Rather it is evident today thatthe special retirement interests of labor unionswere more important than those of the city’sconstituents who expect civic services deliveredat reasonable costs. This is a microcosm of whathas been going on for years at all levels of gov-ernments: Local jurisdictions (school boards, water districts, etc), city, county, state and fed-eral levels. It is no wonder that certain jurisdic-tions have gone bankrupt.

Fiscal reform is required now: sooner ratherthan later according to the information presentedby the Mayor in graphic form for all to see andunderstand. During FY2010, the city’s workforce was reduced by 800 positions; 150 indi-viduals were demoted or laid off, including 49firefighters and 25% of the remaining workforce, including management took a 10% reduc-tion in total compensation. While these mayhave been the frugal fiscal steps possible during

FY2010, this approach of cutting work force, demoting, and laying off workers is not the an-swer. The resolution of this pressing obligationalso does not lie in the requirement of longervesting periods and larger employee contribu-tions.

The answer lies in changing the current re-tirement plans: Elimination of bonuses & guar-anteed increases of benefits; to require olderretirement ages; early retirements result in re-duced benefits; require higher employee con-tributions to retirement funds; and more.Another concept is to index payouts to the eco-nomic level being experienced. This also as-sumes that the global and national economiesare operating at a sustainable level. This is notthe case today. There are not guarantees in life.

As our elected leader, the Mayor is to becommended for presenting detailed informationwhich enables all to see why reform is necessarynow. It is essential for any contract to be ap-proved by the City Council members to have itsfull costs calculated and known prior to accept-ance and enactment as policy. This is ‘trans-parency’ of a public issue at its best.

The mayor stated reasonable boundaries forthe future fiscal expenditures: a) Insolvencyleading to bankruptcy is not acceptable; b) Therecent civic experiences of Vallejo will not berepeated here; c) current retirement obligationswill not be stopped; d) Unacceptable are an in-adequate police and firefighter force, coupledwith libraries and community centers being shutdown. Essential public safety and civic servicesmust be delivered.

Now that the size and scope of this fiscalmatter is on the table for all to see and under-stand, it is incumbent for all involved to step upto do the work needed for reasonable resolution. No less is required of all public and private lead-ership levels involved. Why should taxes bepaid for civic services delivered in the past? Cur-rent budgeted funds paid into retirement escrowfunds which grow over time through prudent in-vestment, must be the source of retirement ben-efit payouts. The people are willing to vote ifthose involved cannot come to any reasonableagreement. And the informed voter is not willingto be exploited any longer. This is the main FY2011 City of San Jose Challenges to be re-solved.∆

2011 City of San JoseChallenges to be resolved

Recent historical events have happened re-garding local natives of Santa ClaraCounty and/or the San Francisco Bay

Area. Unfortunately, the youth no longer get their in-formation from traditional print sources. It is for thisreason that our local city and county leaders mustbegin to preserve the local past and present history inan online accessible site. Ideally an actual exhibit toengage the audience of all ages would be the bestvenue and a great tourist attraction too. The technolo-gies of today with video display such as the “Museumof Tolerance” in Los Angles would be an awesomevenue.

I am a research person by nature and personalpassion. I share the news of relevance whenever I can. However, most teachers, students or communitymembers don’t have the time or training to do so. Iwant to have the diverse stories which mention localheroes (or victims) preserved as our community’s his-torical record. Our youth cannot learn from lessonsof the past via history when those stories are nottaught at school. The local school’s textbooks are gen-erated in Texas. Local leaders, such as all of you, canhave the most powerful impact on the future by let-ting our local youth know that they are a part of his-torical important developments. There are so manystories to share of significant historical importanceright here in our community.

Unfortunately, those historical figures honoredare often remembered in an audience or venue di-rected at other adults. Who shares these stories withthe youth of our community? Mr. Cortese, in your re-cent ‘State of the County’ you mentioned that thisyear 2011 is dedicated to the Child. I love the concept.I teach kindergarten students. These children ab-solutely love historical stories. However, as thesechildren mature, they do not see their connection tohistory and soon lose interest.

I am willing to work on a project based on theconcept of ‘remembrances’. In Riverside, CA, myhusband and I contributed to the historical presenta-tion and exhibit of ‘Founding Families’ which con-tributed to local history. My husband’s (BenjaminoHernandez) family contributed artifacts and photos.

It had amazing participation from youth and theirschools. They were so pleased to see themselves re-flected in this exhibit.

Our county is a diverse blend of communities.Unfortunately, all history is not preserved with equalfunding. Historical societies have traditionally pre-served skewed contributions of some while overlook-ing the major contributions of others.

The time to correct this distortion of history isnow. Soon the youth who do not see themselves aspart of history won’t bother to care. I know all of uscare. What are the next steps? San Jose is also con-sidered a cradle of history for northern and southernCalifornia because so many of the local natives weremigrant workers who traveled up and down the stateto find work. A history, that honors all, preserves theunity in this state. The youth will only learn the les-sons of history if they see themselves included andconnected to that past and included and connected toan inclusive vision of our collective future as an in-clusive diverse community

Publisher’s Note: Mrs. Teresa R. Hernandez is akindergarten teacher at George Mayne School, Mil-pitas which is within the Santa Clara Unified SchoolDistrict. We hope it generates enough interest to at-tract funding. Tax-deductible contributions may bemade to EL OBSERVADOR FOUNDATION, INC.founded 1983 as a community based non-profit or-ganization. We have a program which would teachour youth to interview (in both English and Spanishlanguages) in order to collect the oral histories of eld-erly Latinos using new technologies, especiallyvideographic journalism. Ideally, the historical expe-riences of all should be recorded and preserved so asto document the model of how Latinos have co-ex-isted here in Santa Clara Valley for at least four cen-turies. Through the years things have been improvinggradually. As in the historic Mexican Consulate/SanJose Independent Police Auditor Memorandum ofAgreement.

The County of Santa Clara launched the public aware-ness campaign “Who do you Love?” in 2010 and isslowly gaining momentum. They began the new year

with a lovely strategy that allowed newlyweds to participate. Valentine’s Day continues to be a popular day to wed for cou-

ples in Santa Clara County. It’s also a day that many people asso-ciate with doing something special for loved ones. Couples thatdecided to get married during this year’s Valentine’s Day weregiven the opportunity to join the campaign that in the long runwill show true love.

“The County’s Emergency Alert Notification System is reallyimportant because we’ve noticed that natural disasters are hap-pening everywhere, so we’re just trying to make sure that we’reready to help the residents in Santa Clara County,” said GwenMitchell, Director of Public Affairs.

As the newlyweds posed to be photographed, they were ex-posed to the latest way of encouraging friends and family to signup for Alert Santa Clara County (SCC), the county’s emergencyalert notification system. The photos are going to be onwww.iloveyoupleasesignup.com, where the photo and a messagecan be sent. The photos will also be on display on the “Who doyou Love” wall at the county building and on the county’s Face-book.

AlertScc is a free, easy and confidential way to find out whatto do and where to go during floods, fires, crime incidents, haz-ardous material incidents, infectious disease information andearthquakes. AlertSCC sends voice messages to all the land linesof Santa Clara County and can also send text messages once thenumber is registered.

“We don’t want to over use it,” said Mitchell. “So if peopleget a message, it’s really serious.”

The alert system has already been used in Morgan Hill to no-tify residents of the sexual assaults that were taking place in theircommunity as well as a chemical spill in Sunnyvale.

The county has also partnered with the Consulate of Mexico, making the alert system available in Spanish.

Forty one couples tied the knot during this year’s Valentine’sDay. To schedule civil marriage ceremonies with the Office of theClerk-Recorder, call (408) 299-5664 and for more informationabout the alert system, visit www.alertscc.com.

Domestic Violence Decreasedin Santa Clara County

Affectionate twistto the emergencyalert system

There were five (5) domesticviolence related deaths inSanta Clara County last year

according to the Santa Clara County Do-mestic Violence Death Review Commit-tee. Of those 4 were murder/suicides (2events) and 1 homicide. Of the fivedeaths, 2 were from the Asian commu-nity, 2 from the Caucasian communityand one from the Hispanic community. No one from the African American or im-migrant communities (less than 10 yearsin the U.S.) died this year. We also lostone person from our GLBT community.

The ages of homicide victims ranfrom 28 to 70 years of age. One seniorlost their life this year and this is the firstsuch death in the senior community inover 5 years.

No children lost their lives in domes-tic violence incidents this year and onechild survived the loss of their only par-ent.

There was an indication of substanceabuse in one case and in four cases thecouples involved were separated, di-vorced or discussing either, at the time ofthe deaths. This continues to bolster thecommittee’s finding that the time of sep-aration (or the discussion of it) is a verydangerous time for domestic violencevictims.

The Committee also discovered anumber of similarities in the deaths. Wehave listed those as “red flags.” The listcontains facts we deduced from thedeaths we studied. They may not applyin every situation. These include:

Separation or talk of it prior to thehomicide.

Extreme jealously, possessiveness.Prior unreported domestic violence. Unemployment or underemploy-

ment.Stalking behavior.Threats of suicide and or homicide.

Depression.Kidnapping or falsely imprisoning a

victim.Perpetrators were also noted to be

loners, with no real friends outside the re-lationship.

Perpetrators controlled the victim fi-nancially and otherwise and became dis-traught at the discussion of anyseparation.

The committee also noted that theperpetrators in these cases had attach-ment issues which started in their earlyyears and early learning or emotionalproblems.

Meticulous planning by the perpetra-tor prior to the death.

Untreated and inadequately treatedmental health issues.

Access to handguns-legally obtained.

Newlyweds Harlan Howard and Angelita Howard from Sunnyvale.

Washington, DC.-Penalties forlate filing of tax

returns can be harsh, but whatcan you do if you haven’t re-ceived the information youneed from your employer orothers? If you are waiting for

your Form W-2, mortgage in-terest statement, 1099 DIV orother documents that are neces-sary to complete your taxforms, it’s in your best interestto take action. IRS does not ac-cept “failure to receive docu-ments” as an excuse for failure

to file.If you haven’t received

your W-2 form by January 31,it’s time to contact your em-ployer. The IRS will be stand-ing by to assist you at800.829.1040 on that date andbeyond. Before you make the

call, be sure you have the fol-lowing information ready: yourSocial Security number, datesof employment and your em-ployer’s name, address andphone number. IRS will notonly contact your employer, but it will also send you a Form4852 (a substitute Form W-2)to fill out in case you don’t re-ceive the Form W-2 in time tomake the tax deadline.

In the old days, when thenecessary tax documents didn’tarrive, there was no choice butto call your financial institutionand spend what seemed like aneternity waiting on hold tospeak to a customer servicerepresentative about retrievingthe missing document.

The Internet has changed

all that by allowing banks andmortgage lenders to post thisinformation online. Afteryou’ve established an onlineuser name and password, mostbanks and mortgage lendersmake the tax information youneed available to you on theirwebsites. Even if you acciden-tally tossed out some importanttax documents along with thejunk mail, you can easily ac-cess the numbers you need foryour tax return.

If you find you just can’tget the documentation togetherin time, another option is filingan extension. This will delayyour filing deadline until Octo-ber 17, 2011. With the penaltyfor not filing a tax return or anextension a stiff five percent

per month up to a maximum of25 percent of the amount of taxdue on the late-filed return, fil-ing an extension is well worththe effort. Keep in mind thatyou’ll also need to file an ex-tension for your state tax re-turn.

Please note: taxpayersshould not confuse the extra sixmonths the extension providesfor filing with a postponementon paying. You’ll still need toestimate the taxes you may oweand submit that amount prior toApril 18, 2011 along with Form4868. To avoid paying apenalty, you must pay at least90 percent of what you esti-mate you owe, or 100 percentof your 2009 tax liability. Ifyou don’t pay in full, you’llwind up owing four percent an-nual interest on the liability notcovered.

Filing a tax return can bedaunting and stressful withoutthe advice and guidance of atax expert. A convenient, searchable directory of enrolledagents, the only federally-li-censed tax practitioners, maybe found at www.naea.org.

This Valentine’s Day, low-income tenants and theirsupporters spoke out against proposed cuts in theDepartment of Housing and Urban Development

(HUD) budget at the Opportunity Center in Palo Alto. The president’s budget provides $41.7 billion to HUD.

Funding for several program s will be reduced. This can in-clude over 25,000 Section 8 tenants cut off from federal assis-tance in California, including several thousand families inSanta Clara County. It can also mean cuts to homelessness pro-grams.

“There are no programs for people that have no money butnobody needs to be on the streets,” said Joyce Osagiede, Co-President, Tenants Council.

Osagiede grew up in Palo Alto and is currently unhoused. She has been living at the Opportunity Center for two yearswhile organizing against the proposed budget cuts.

Anew year is here and for manybaby boomer women, thatmeans getting back on track

with their health and wellness - eating right, exercising and scheduling those overdue doc-tor's appointments. However, a new surveyreveals that boomer women may not be soquick to dial their doctor when it comes to is-sues with their personal health.

Only 16 percent of baby boomer womenare likely to discuss a taboo topic with aphysician. Additionally, more than two-thirdsare less likely to seek out a physician if theyconsider their condition to be a "normal partof aging," according to the TENA BoomerWomen's Health Survey, conducted byTENA, the leader in incontinence productsand services.

In 2011, the first of the 77 million babyboomers will turn 65 years old. More thanhalf of them are women, who as they age,may find themselves experiencing new andsometimes uncomfortable conditions whichthey consider to be a "normal part of aging."Many of the personal health conditions that

baby boomer women may experience how-ever, such as bladder weakness and low sexdrive, are not symptoms of aging and mostcan be managed with the help of a physician.

Once boomer women are in the doctor'soffice, the stigma doesn't cease. The surveyalso found that over one quarter of womenfelt uncomfortable, embarrassed or judgedwhen they discussed a personal health issuewith their physician. Furthermore, althoughbladder weakness and low sex drive rankedas the top two most embarrassing conditionsto discuss with doctors, the same two condi-tions also ranked as the issues that werebrought up the least by physicians.

"If doctors aren't asking and patientsaren't speaking up, then women may need-lessly suffer for years with what may in factbe a manageable condition," says Dr. CynthiaHall, MD, FACOG, Founder and Director ofthe Center for Women's Continence andPelvic Health at Cedars-Sinai Medical Cen-ter. "I often have to coax information out ofmy patients to identify problems they may beexperiencing, so I know that it is especiallyimportant that doctors spark the conversation

because their patients may be embarrassed orreluctant to."

Nervous about talking to your doctorabout your symptoms at your next check up?Here are some tips from TENA on commu-nicating openly and honestly with your doc-tor:

Don't be timid, be tenacious: Talkingabout taboo health conditions, such as blad-der weakness, can be hard, but you deserveto live your life free from symptoms that holdyou back. Speaking up about the symptomsyou've been experiencing will help your doc-tor help you to manage your condition. Notready to talk to your doctor yet? Work yourway up by confiding in a friend or familymember.

Do your homework: Doing some re-search before your appointment could go along way in helping you identify your condi-tion and management options that you canask your doctor about. Not sure where tostart? Check out www.betenacious.net for in-formation on the causes and symptoms ofsome common conditions that women expe-rience, such as bladder weakness.

Take notes: Keep track of your symp-toms and the times when they are mostprevalent and bring those notes with youwhen you visit your doctor. If you get nerv-ous, having notes there will help you stay ontopic and remember the little details. Also, having notes to share with your doctor willprovide more background on the condition -they may notice patterns that could indicatetriggers or causes of your condition.

For many moms-to-be, a first ultrasound is a lifechanging experience -- it can also be a life savingmoment for the child they're carrying.

While ultrasounds have been used in prenatal care formany years, new technology is changing the face of obstetricalcare. Today, doctors can use 3D and 4D imaging capabilitiesalong with "conventional" 2D ultrasound, allowing them to ex-amine everything from a baby's developing brain to its armsand legs. They can even see a fetal heart the size of a dime.

These new capabilities can help doctors detect problemsthat could put babies at risk.

"Thanks to early detection through prenatal care, medicinecan often save at-risk babies who would have been lost a gen-eration ago," said Dr. Jacques Abramowicz, Frances T. andLester B. Knight professor, director of Ob/Gyn Ultrasound andCo-Director of the Rush Fetal and Neonatal Medicine Centerin Chicago. "But we can only make a difference if moms takethe initiative to see their doctors and see them early in theirpregnancy."

According to the Centers for Disease Control and Preven-tion, more than 4 million American women will give birth thisyear, and nearly one-third will experience some kind of com-plication. The U.S. Department of Health and Human ServicesHealth Resources and Services Administration says babiesborn to mothers who receive no prenatal care are five timesmore likely to die and three times more likely to be born at lowbirth weight than those whose mothers receive prenatal care.

Prenatal care provides a wide range of support, includingmedical care, education and counseling. Ultrasound is often acritical part of that all-important care.

By providing pregnant women "with important informa-tion and sometimes an early warning if there could be a bumpin the road ahead, ultrasound aids physicians in making betterdiagnoses, which helps moms make better choices for their ba-bies and themselves," said Janice Blackwell, vice president,Ultrasound Global Marketing, for Philips Healthcare.

With very few movies to relate to,Latinos have something to lookforward to during this year’s

Cinequest Film Festival. They will be able to at-tend a world premiere of America, a film about

a hotel housekeeper in Puerto Rico. The 95 minute drama is based on the novel

‘America’s Dream’ by Esmeralda Santiago. Hersecond novel to be made into a feature film, theonly difference from the first is that America isnot biographical - yet it deals with real lifeevents.

Both tell the story of America, a woman whoworks in a Vieques Hotel, lives with an alcoholicmother, her teenage daughter, while in a violentrelationship with the father of her daughter.

“Although the story takes place in theCaribbean, it’s not all sunshine, her story is astrong one,” said Frances Lausell, producer of

America during a phone interview with El Ob-servador.

Lausell worked with Mexican director SoniaFritz while doing most of the filming in her homeof Puerto Rico, and even though the duo finds iteasy to identify with women stories, the directorconsidered it one of the most challenging ones.

Fritz, who has worked with immigrant issueswanted something without the stereotypicalproblems and referred to the film as an immigra-tion story, but not the typical one.

America, played by Lymari Nadal, decidesto move to the United States willing to start anew life, learns to overcome difficult situationsand chooses a healthier way of life.

“I hope they can connect with a story aboutempowering,” said Fritz.

Fritz also hopes people get inspired andleave the theater wanting to do better in life andtaking any positive message they see on screen.

“For us, it’s about opening doors not only forAmerica but the Caribbean,” said Lausell.

The world premiere of America will be onMarch 3, playing at the California Theater duringthe Cinequest Film Festival in San Jose. It willpremiere in Puerto Rico on March 10 and willalso be featured in a film festival in Guadalajara,Mexico during the end of March. The duo con-sidered that appropriate, considering March isWomen’s month.

“We had a good time and it shows at theend,” said Fritz.

For more information about tickets andscheduling, visit: www.cinequest.org.
