The Justices of the peace for the said County assembled at this Sessions by virtue and in pursuance

of an Act passed in the last Session of Parliament intituled “An Act to settle and describe the Divisions of

Counties and the limits of Cities and Boroughs in England and Wales in so far as respects the Election of

Members to serve in Parliament” have divided and assigned to every Polling Place within the said county

mentioned in the Schedule marked N to the said Act annexed the several Parishes and Districts hereinafter

1st January 1833

It appearing to this Court that great irregularities have lately prevailed in passing Scotch poor from

parish to parish through this county it is earnestly requested that no such poor be in future passed except

according to the Provisions of the Act 59 Geo. 3 c.12 & 33 and that Irish Poor may be shipped from the

nearest Port according to the Provisions of the said Act And it is ordered by this Court that one shilling per

mile be allowed for passing each adult person and six pence per mile for every Child under fourteen years of

age until further directions be given by this Court

9th April 1833

It is ordered by this Court that the Rate of Allowance to be paid to the Master of any Ship Vessel or

Packet bound to Ireland on board of which any poor person born in Ireland may be sent or passed in

pursuance of an Act passed in the fifty ninth year of the reign of His late Majesty King George the Third

intituled “An Act to amend the laws for the relief of the poor” shall be eight shillings for every poor person to

be put on board or sent by any such ship or vessel

It is ordered by this Court in pursuance of an Act passed in the twenty sixth year of the reign of his

late Majesty King George the second intituled “An Act for the settling and ascertaining the fees to be taken

1st July 1834

The Rules of the Millbrook Benevolent Society, the additions to and alterations of the Saint Germans

Friendly Annuitant Society and an alteration in the East Cornwall Savings Banks Rules were at this Sessions

allowed and confirmed pursuant to the Statute in that behalf

14th October 1834

It is ordered by this Court that two Copies of Imperial Standard Weights and Measures be established

for this County for the comparison of weights and measures therein the one for the East Division at

Lostwithiel the other for the West Division at Redruth. That two Inspectors of the said Weights and

Measures be appointed viz: Mr. John Parkin for the East Division and Mr. Josias Phillips for the West and that

they be called on to give Security according to the provisions of 4 & 5 William 4 c.49 s.16. That the Weights

and Measures now established by Law at Lostwithiel having been verified and stamped at the Exchequer as

Copies of the standard weights and measures be adopted as Standard weights and measures under the

Provisions of 4 & 5 William 4 c.49 and that a new set of weights and measures be procured duly stamped for

the use of the West Division at Redruth

That good and sufficient Stamps be procured for stamping and sealing all weights and measures to be

used within the County

That as soon as conveniently may be the several Inspectors of Weights and Measures do make a Circuit

through their respective Divisions for the convenience of such persons as may wish to compare their weights

and measures with the legal Standard signifying by public Advertisement the times and places where they

will attend for the said purpose (having reference to the several exclusive jurisdictions which may appoint

Inspectors within their respective Districts) taking care to arrange the said places of attendance that no one

shall be obliged to travel more than ten miles from his residence for the purpose of comparison as aforesaid

14th October 1834

It is ordered by this Court that a Committee of Justices be requested to meet at Bodmin on Tuesday the

ninth of December next at twelve o’Clock at Noon to consider of the subject of providing suitable

accommodation for the Judges and Justices at the Assizes at Bodmin

That the Committee consist of Lord Eliot Sir William Trelawny Mr. Pendarves Sir William Molesworth Sir

Charles Lemon and any other Justices who may find it convenient to attend (image 226)

6th January 1835

The Presentment made at the last Sessions relating to the Assize Hall & Judges’ Lodgings at Bodmin

having been at this Sessions taken into consideration It is determined by this court that the same is well

founded and is hereby confirmed And it is further ordered that immediate steps be taken to treat with the

Corporation of Bodmin for their right and interest in the present buildings and ground immediately adjacent

That the Plan for a new Assize Hall proposed by Mr. Burt be adopted subject to such alterations in the

interior Arrangements and Elevation as may be suggested by a Committee to be appointed for that purpose

and that the present Sessions be adjourned until the tenth day of February next at Bodmin for taking this

subject and also the subject of the Judges’ Lodgings into further consideration and that in the meantime the

necessary Notices be given. That Lord Falmouth Lord Eliot Sir William Trelawny Sir William Molesworth Sir

Charles Lemon Mr. Pendarves Mr. Rodd Mr. Tremayne Mr. George Borlase Mr. Willyams Mr. Phillips Revd.

William Molesworth Revd. Joseph Pomery Revd. Charles Hodgson be Members of such Committee and that

they be requested to confer with the Corporation of Bodmin on the subjects above mentioned (image 237)

10th February 1835

It is ordered that the Plan of the intended new Courts for holding the Assizes at Bodmin aforesaid now

produced and marked “J.H.T. 10 Feby. 1835” be adopted.

That the Elevation marked “J.H.T. 10 Feby. 1835” be also adopted.

That the front and two ends of such building be of Granite.

That an Allowance be made for such of the materials of the present Hall as shall not be required by the

Corporation of Bodmin according to the valuation of Mr. James Chapple.

The Estimate given in by Mr. William Burt subject to the above allowance is Five thousand and thirty

pounds.

That the specifications produced by Mr. Burt be submitted to Mr. Wightwick, Architect, Plymouth, and

that the work be executed by Mr. Burt according to the amended Specifications and that the same be paid

for by measure and value according to the decision of a competent person to be employed by the County,

and it is understood that unless any material alteration in the Specifications be made by Mr. Wightwick, Mr.

Burt is not to be paid a greater sum than the amount of his present estimate, but if the work when

measured and valued shall not amount to the above mentioned sum, the County is to have the advantage of

it.

That a negociation be entered into for the purchase of the George and Dragon Public House, the owner

to name one person and the County another as Arbitrators and that the two persons so to be named shall

choose another before they proceed to their valuation who shall decide between them if they differ (image

Resolved that the opinion given by the Solicitor General be again submitted to him for his

reconsideration together with the opinion given by Mr. Justice Coleridge on the same case.

That the Petition for a private Bill now produced be adopted and transmitted to the County Members

with a request that they will present and support the same.

That the County Members be requested to ascertain whether it is probable that a public Act may be

obtained to enable the Justices in any case in which a removal of the Assizes may be ordered under the Act

of 3 and 4 Willm. 4 cap.71 to provide suitable accommodation for holding the Assizes and Lodgings for the

Judges by provisions similar to those of 7 Geo. 4 cap.63 (image 243)

20th October 1835

It is ordered that Notices be given of an application to Parliament according to the tenor of the Orders

heretofore made for building New Courts at Bodmin and that the question of erecting such Courts be taken

into further consideration at an adjourned Sessions to be held on the twenty fifth day of November next and

that Notice of such adjourned Sessions be given by public Advertisement (image 267)

It is ordered that Mr. John Parkin be appointed Inspector of Weights and Measures for the Eastern

Division and Mr. Josias Phillips for the Western Division of this County (image 267)

The Compensation to be made to the Inspectors of Weights and Measures being now difficult to be

taken into consideration from the time and labor not being known necessary for performing the duties the

consideration thereof is ordered to be postponed to the next General Quarter Sessions of the peace to be

holden for this county

And it is further ordered that the distinguishing Marks of the said Divisions shall be as follows (that is to

5th January 1836

It was also resolved that all former Orders made at the General Quarter Sessions of the Peace holden for

this County or at any adjournment thereof relating to the intended new Assize Hall and the Judges’ Lodgings

be respectively confirmed and the former Committee of Magistrates appointed for that purpose be

confirmed

It was also ordered that a Clause be introduced into the intended Bill for building new Courts at Bodmin

for the purpose of levying a special and separate rate for the purposes of this Act. That a clause be

introduced on the principle of the 9 Geo. 4 Cap 40 Sec. 15 providing and enacting that every Tenant at Rack

Rent may deduct from the rent payable to his Landlord one half of the amount of such special County Rate

and that every tenant having paid such rate shall be discharged from the payment of so much money as such

half part shall amount to as fully as if the same had been actually paid to such Landlord in part of such Rent

It is ordered by this Court in pursuance of an Act passed in the fifty eighth year of the Reign of His late

Majesty King George the third intituled “An Act for preventing the destruction of the breed of Salmon and

fish of the Salmon kind in the rivers of England” that Nicholas Kendall Esquire be and he is hereby appointed

Conservator or Overseer for the preservation of the Salmon and fish of the Salmon kind and the brood

spawn and fry thereof and preventing the destruction thereof and for enforcing the provisions of the said

Act within the River Fowey in the said County in the room of John Hext Esquire who has resigned that Office

on account of ill health (image 281)

2nd March 1836

That the Elevation of a County Hall marked J:H:T: 10th February 1825 be adopted.

That the Plan marked J:H:T: February 10th 1835 be adopted with the exception of the Substitution of a

back entrance in lieu of one of the Water Closets.

Mr. Burt proposes that he should execute the building of the County Hall according to the plan and

elevation above referred to and the specifications annexed (with the addition of the extra Costs of wainscot

for the parts of the Courts exposed to friction) for five thousand four hundred and thirty pounds the work to

be measured and valued in the usual manner. If the result of the valuation be less than the sum of five

thousand four hundred and thirty pounds the County to have the benefit of it but the County is in no case to

pay more than that sum. In case of any alterations or additions, the same to be valued and paid or allowed

for, but the agreement not thereby rendered void. The money to be paid in six Instalments of eight hundred

pounds each at stated periods as may be hereafter agreed on and the balance when the work is complete

and approved of. The Building to be completed by the end of May One thousand eight hundred and thirty

seven.

Resolved. That it be recommended to the next General Quarter Sessions in the event of the Bill now

before Parliament for building an Assize Hall and passing into a Law to ratify an Agreement to the above

effect (image 287)

5th April 1836

This Court doth as far as it lawfully may approve of and adopt a Resolution entered into at an adjourned

Sessions held at Bodmin on the second day of March last with reference to the Agreement there

provisionally made and that it appearing to this Court that the Bill for building new Courts of Assize at

Bodmin and for other purposes has not yet passed into a Law an adjourned Sessions be held at Bodmin on

the Second day of May next for the purpose of making such order or orders and entering into such Contracts

as they shall think fit for purchasing or taking from the Corporation of Bodmin or any other person

interested therein the present building at Bodmin now accustomably used for holding the Summer Assizes

and any other buildings lands grounds or hereditaments lying near thereto or convenient to be required and

used for the improvement or enlargement thereof and for the erecting building and providing on or near the

site thereof a new Shire or County Hall with proper and suitable offices and accommodations and also for

the purpose of making such Orders for the defraying the costs and charges of erecting the said new Shire or

County Hall and purchasing the premises incident thereto as may be lawful and necessary before the next

General Quarter Sessions of the peace to be held for this county and that due Notice to be twice given in

some Newspaper circulating within the said county of the time and place of such adjourned Sessions and the

purpose for which the same is specially appointed to be holden (image 294)

It is ordered by this Court that Tenders in writing be received up to the fifteenth day of June next for

printing the County Register and that at the next Quarter Sessions the Magistrates present shall take such

Tenders into their consideration (image 296)

The Compensation to be made to the Inspectors of Weights and Measures being now taken into

consideration It is resolved that twenty five shillings per diem is a fair remuneration for each of them

including all the expences incurred in the inspection ordered by the Michaelmas Sessions last

It is ordered that a communication be opened with the different towns in the county having Weights

and Measures of their own in order to arrange with them for the appointment of their Inspectors as County

Inspectors to receive a Sum equivalent to the Amount of fees for comparing such weights and measures as

may be brought them from their several districts every first Market day in each month during the hours from

ten to five of such day and to receive the Sum of twelve shillings per day for so many days as the Court of

Quarter Sessions may otherwise direct them to attend at particular places within their several districts

2nd May 1836

That the Clerk of the Peace be desired to advertize for a sum of money not exceeding Six thousand

pounds to be advanced within twelve months for the purposes of the Act for building new Courts at Bodmin.

Tenders to be received at the next Sessions.

That the Clerk of the Peace be authorized on behalf of the County to enter into an agreement with

William Burt according to the terms of a resolution passed at an adjourned Sessions held at Bodmin on the

second day of March last and ratified by the General Quarter Sessions held at Truro on the fifth day of April

last for building a new County Hall at Bodmin.

That Mr. Burt be authorized to make an Agreement on behalf of the County for removing and disposing

of such parts of the House now occupied by Henry Boundy as may be necessary before the next Sessions.

That the Estimate made by Thomas Bishop and Robert Coad of the value of the freehold houses the

property of Henry Boundy required for the purposes of the intended new Assize Hall at Bodmin at the sum

of One thousand and one hundred pounds be approved and confirmed and the said Henry Boundy at this

Sessions signed an agreement to accept the same (image 300)

28th June 1836

It is also ordered that three rates under the Assize Hall Act be forthwith levied and raised on the

Inhabitants of this county and that the same when so raised be paid into the hands of Edward Coode

gentleman Treasurer of the said county (image 301)

It is ordered by consent of the Inhabitants of the boroughs of Penryn and Launceston and of the Hamlet

of Saint Thomas Street in the said borough that they be severally assessed to the general County rate in the

It is ordered that the Allowance to Constables attending the Sessions as Witnesses under Recognizance

or Subpoena be at the rate of Seven shillings and six pence per day if on one prosecution only and if on more

than one at the rate of two shillings and six pence per day for each prosecution more than one (image 304)

It is ordered that the proposed new Site for the County Hall be adopted and that one hundred pounds be

allowed by the County towards the extra expence to be incurred provided the Corporation of Bodmin will

advance Seventy pounds in addition to the proposal made 28 June 1836 to meet the whole Sum demanded

by Mr. Burt for the proposed Alteration to which the Corporation have signified their Assent

It is ordered that Mr. James Chapple be appointed to survey the progress of the building on the New

Courts on behalf of the County and to measure and value the same and that an adjourned Sessions be held

at Bodmin on the Second Monday in every Month to which a Report shall be made of the progress of the

building and that Mr. Chapple be paid for such Service at the Rate of one pound per week during the time he

may be so employed (image 305)

Arthur Williams Phillips of Falmouth and Richard James of Penryn were appointed Inspectors of Weights and

That the Clerk of the Peace be requested to communicate with Mr. Burt the Architect of the County Hall

and to fix with him the periods for the payment of the several Instalments in order that the Contract may be

executed without delay

That Mr. Chapple be directed to make his Report to the adjourned Sessions to be held on the second

Monday in each Month as ordered at the last General Quarter Sessions (image 312)

The Resolutions of the adjourned Sessions held 2nd March 1836 were read.

Mr. James Chapple having reported that in his opinion the building of the County Hall cannot be finished

by the end of May 1837 without considerable risk of injury

Resolved – That the period for completing the building be extended till the Michaelmas Sessions 1837

Mr. Burt engaging to use every exertion to finish it by the time first specified if he can do so consistently with

the Security of the Work. That in consequence of the alteration of the Site Mr. Burt be authorized to carry

covered Drains round the Building.

That the Instalments be payable as follows –

1st When the foundation stone is laid

2nd When the walls are level with Sills of windows

3rd When the timbers of floors are fixed and the walls up to the Sills of the Chamber Windows

4th When the walls are at the whole height

5th When the roofs are complete

6th When the first Coat of Plastering is on

And Mr. Chapple to report accordingly

That the Treasurer be authorized to accept an Offer made to the County of £2500 at £4 per Cent pr.

Mr. Chapple reported that considerable difficulty has been overcome in carrying on the foundations of

the County Hall but that they are now complete and part of the Plinth fixed. The Cells also are in progress

Ordered – That an Area be made round the Cells one foot wide for the free admission of air and walled

against the Country.

Ordered – That Granite be placed under the Plinth of the Front and both Ends where the wall will be

exposed by the irregularity of the Ground.

Mr. Chapple having reported a Variation from the Plan in one of the Walls forming the back Staircase in

the County Hall. Ordered that no further progress be made in that wall till the next Quarter Sessions (image

18th October 1836

It is ordered by consent of the Inhabitants of the parish of Saint Mary in the borough of Truro in this

county that they be assessed to the General County Rate in the sum of fifteen shillings for each Rate (image

314)

It is ordered that six Assize Hall Rates be forthwith levied and raised on the Inhabitants of this county and

that the same when so raised be paid into the hands of Edward Coode gentleman Treasurer of the said

county

It is ordered that a further sum of One thousand pounds be borrowed on the credit of the Assize Hall Act

and that the Money already borrowed and hereafter to be borrowed on the credit of the said Act be paid off

by ten equal Yearly Instalments together with the Interest thereon respectively (image 314)

At this Sessions it was resolved that the county will pay Two hundred pounds to the Corporation of

Bodmin on condition that they take down the present Mayoralty House and build a new House for the

accommodation of the Judges on a Plan to be submitted for the approbation of an adjourned Sessions to be

held for that purpose the Money to be payable when such House is finished and properly furnished and

fitted for use provided also that the Corporation undertake not to obstruct the County in adopting such

measures as may be necessary to protect the front of the new County Hall from injury

It is ordered by this Court that with respect to the deviation from the original Plan of the County Hall

referred to by the adjourned Sessions of the tenth day of October instant to the consideration of the present

Sessions – the Passages in question shall remain of the breadth of six feet six inches but that the stair-cases

therein be widened to the breadth of seven feet by resting a part of them on the party walls adjoining. That

a variance having been discovered between the original specification which had been mislaid and the Copy

of which had been adopted in lieu of it, the Contract be drawn according to the original Specification and the

work in future carried on accordingly, the deviation in the Work already done being reported by Mr. Chapple

to have been immaterial to the strength and solidity of the Work. That Granite Steps be substituted for

Wooden Steps in the Staircases of the Court to be paid for by Measure and Value but not to exceed the price

of fifteen pounds (image 320)

14th November 1836

A plan of the house intended by the Corporation of Bodmin to be built for the accommodation of the

Judges was submitted to the Court

Resolved – That the said Plan be approved of with the addition of a Water Closet to be provided on the

Ground Floor

That the question of the sum to be demanded for the use of the said house during the Assizes be

postponed till the next General Quarter Sessions

representing that the Number of Polling Places for taking the Poll at the Election of Knights of the Shire for

the Eastern division of the said county are insufficient and praying that the town of Callington within the

Middle Division of the Hundred of East in the said county may be made a Polling place for taking the poll at

the Election of Knights of the Shire for the Eastern division of the said county and upon hearing what could

be alledged and proved upon oath It is ordered that a Petition be presented to His Majesty as prayed (image

It appearing to this Court or to the Justices assembled at this Sessions on the first day of the said

Sessions upon consideration of the state of business likely to be brought before them at this Sessions if

heard and determined by the whole Court is likely to occupy more than three days including the day of their

being so assembled It is ordered and this Court do appoint Edward William Wynne Pendarves and John

Samuel Enys Esquires two of the said Justices and such others of their Companion Justices of our said Lord

the King as shall join with them for that purpose to sit apart from the rest of the Court at the House of

William Oliver in the said borough of Bodmin being a place near to the said Court of Quarter Sessions while

others of the said Justices are at the same time proceeding in the dispatch of the other business of the same

Court to hear and determine a certain application to this Court under and by virtue of a certain Act of

Parliament passed in the seventh year of the Reign of His late Majesty King George the third intituled “An

Act for erecting a proper and convenient Pier at the Port of St Ives in the County of Cornwall for the better

protection of Ships and Vessels resorting to the said Port” and also to try such cases of felony as shall be

brought before them

Upon application made to this Court by Joseph Carne John Vivian Henry Harvey Esquires and others

under a certain Act of Parliament made and passed in the seventh year of the Reign of His late Majesty King

George the third intituled “An Act for erecting a proper and convenient Pier at the Port of St Ives in the

County of Cornwall for the better protection of Ships and Vessels resorting to the said Port” and upon

hearing what could be alledged and proved upon oath it appeared to this Court that the Trustees under the

said Act have been by the duties received under the said Act fully reimbursed the Principal Monies by them

the said Trustees borrowed and laid out for the purposes of the said Act together with all interest and

charges attending the same And that a Sum of Money has been raised which with the accruing dues to the

twenty fifth day of March next will be sufficient for the future support of the said Pier and for keeping the

said Port and Harbour in repair It is ordered by this Court and this Court doth adjudge that from and after

the twenty fifth day of March next all and singular the said respective dues and duties granted by the said

Act shall in respect of all British Ships Sloops Boats or Vessels Goods Wares and Merchandize cease and

13th March 1837

Mr. Chapple reported that the colour of the large stones forming the landing places on the Stairs of the

County Hall was not equal to that of the other granite used on the Stairs, that he believed the strength to be

equal, that it appears as hard in washing and in his opinion is as likely to be as durable as the other, that the

centre landing place being already fixed it would cause very material delay and inconvenience if it were

removed.

Mr. Burt stated that he could not obtain stones of the size necessary for the landing places in the same

place where the other granite is procured and that he cannot obtain stones of the same size and of better

quality elsewhere in the neighbourhood of Bodmin, that he cannot state what delay it might produce if

stones of the quality now in question be rejected.

Resolved – That Mr. Chapple be desired carefully to inspect the Stones prepared and to reject those in

which any flaw appears and any where the difference of colour is particularly striking.

That under all the circumstances it does not appear expedient to disturb the centre Landing Place (image

Upon reading a certain order made by the King’s most excellent Majesty in Council the twenty eighth

day of January last reciting an Act passed in the seventh year of His present Majesty’s reign intituled “An Act

for rendering more easy the taking the Poll at County Elections” by which it was enacted that it should be

lawful for His Majesty in Council by and with the advice of his Privy Council from time to time on Petition

from the Justices of any County in England or Wales in Quarter Sessions assembled representing that the

number of polling places for such County was insufficient and praying that the Place or Places mentioned in

the said petition may be a Polling Place or Places for the County or Division of the County within which such

Place or Places is or are situate to declare that any Place or Places for that County or Division and that the

Justices of the Peace for such County in Quarter Sessions or some special Sessions assembled as mentioned

in the Act passed in the third year of the Reign of His present Majesty intituled “An Act to settle and

determine the division of Counties and the limits of Cities and Boroughs in England and Wales in so far as

respects the Election of Members to serve in Parliament” shall conformably to the said last mentioned Act

divide such County or Division into convenient Polling districts and assign one of such districts to each Polling

Place And reciting a certain petition from the Justices assembled at the last General Quarter Sessions of the

peace held in and for this County representing that the number of Polling Places for the Eastern Division of

the said County was insufficient and therefore praying that the Town of Callington might be a Polling Place

for the said Eastern Division of the said County and stating that His Majesty having taken the said petition

into consideration Did in pursuance of the said Act of the seventh year of his Reign by and with the advice of

His Privy Council declare order and direct that the said Town of Callington should be a Polling Place for the

Eastern Division of the said County of Cornwall and that the Justices of the Peace for the said County

assembled in Quarter Sessions mentioned in the said Act of the third year of His Majesty’s Reign should

conformably to the said last mentioned Act divide the said Eastern Division of the said County into

convenient Polling Districts and assign one of such districts to each Polling Place And upon hearing what

could be alleged It is ordered by this Court that the several parishes or places hereinafter named be assigned

to the said Town of Callington as a Polling Place for the said Eastern Division, that is to say, Callington,

Calstock, Saint Dominick, Linkinhorne, Saint Mellion, Southill, Stokeclimsland, Botusfleming, Saint Ive,

Landrake, Landulph, Pillaton, Quethiock, Saltash and Saint Stephens by Saltash (image 333)

It is ordered by this Court that the Treasurer of the said County do pay to Edward Hearn of Stratton in the

said County Gentleman the sum of One hundred pounds towards the charges of certain Special Constables

employed for the purpose of preserving the public peace for the prevention of riot and tumult within the

Hundreds of Stratton and Lesnewth in the said County and for the apprehending James Sibley of the parish

of Saint Teath in the said County miller Henry Whitting of the parish of Poundstock in the said County

Laborer and Thomas Jago of the parish of Saint Gennis in the said County Carpenter charged with having

with divers other persons assembled in the towns of Camelford and Stratton respectively in the said County

and there committed a riot and tumult in order to prevent the effect of the new Poor Law Amendment Act

and that the remainder of the charges of the said Special Constables be taken into consideration at the next

General Quarter Sessions of the Peace to be holden in and for the said County (images 334-335)

It is also ordered that an offer be made to the Mayors of the several boroughs of Lostwithiel and Tregony in

the said County to assess the said several Towns to the General County Rate at the following sums, that is to

say, the borough of Lostwithiel in the sum of five shillings and the said borough of Tregony in the sum of four

Bodmin in the said County appointing Richard Bray of the same borough to be Inspector or Corn Returns for

the said borough according to the provisions of an Act passed in the ninth year of the reign of His late

Majesty King George the fourth intituled “An Act to amend the law relating to the importation of Corn” was

and they are hereby named appointed and empowered as soon as may be after the Spring Assizes shall be

Phillips for the information of Lord Melbourne on the 30th June 1834 on the subject of holding both Assizes

for this county at Bodmin and communicated to this Court) the Clerk of the Peace do certify to the Privy

Council that Courts have now been provided sufficiently commodious for the dispatch of the civil and

criminal business of the Assizes at Bodmin together with proper accommodation for the Judges

That Mr. Kendall Revd. Wm. Molesworth Capt. Hext Revd. R.G. Grylls Junr. Revd. Nicholas Kendall be a

Committee to met at Bodmin to determine on the [purchase of Furniture for the new Courts and to give

directions accordingly

That this Court will abandon all claim on the Corporation of Bodmin for the sum of £70 on condition that

the Corporation do lay out and complete the Roads around the Hall to the satisfaction of this Court and

agree to keep them in repair hereafter and the County being released from the Engagement respecting the

Road from the Hall to the Street and that the Corporation be requested to lay a plan of the proposed

Improvements of Mount Folly before an adjourned Sessions to be held at Bodmin on the 9th day of April

At this Sessions Notice was given by Thomas John Phillips Esquire that at the next Sessions a Motion will

be made for making a more equal County Rate

Notice was also given by The Reverend William Molesworth that at the next Sessions a Motion will be

made that no application for Money from the county Rate above a Sum to be then specified shall be

entertained by this Court without Notice having been given of such application at the previous Sessions and

also that no Money business whatever shall be introduced on any other day than the first day of such

Sessions

Notice was also given by Nicholas Kendall Esquire that a statement of the number of Pauper Lunatics in

the Lunatic Asylum at Bodmin be laid before the Court with a view to an application for additional

Upon Application made to this Court by Adam Thomson of the borough of Lostwithiel in this county

Merchant in pursuance of the provisions of an Act of Parliament passed in the twelfth year of the reign of His

late Majesty King George the third for licence to have and use a certain building situated in a field called

Leadenhill part of the Estate of Restormel within the parish of Lanlivery in the said county distant upwards of

one mile from the town of Lostwithiel and from any other city borough or market Town and upwards of half

a mile from any parish Church as a Magazine for keeping unlimited quantities of Gunpowder And it

appearing to this Court that all the requisites of the said Act have been complied with and on due

consideration had of the premises this Court doth hereby licence the said Adam Thomson to keep any

quantity of Gunpowder in the aforesaid building not exceeding three Tons (image 387)

It is ordered by this Court that a Distringas be issued against the parish of Minster in the said County for

not appearing to answer a Bill of Indictment preferred against them at the last Sessions for a Nuisance

It appearing to this Court that the present County Rate is unfair unequal and unjust It is ordered that it

be referred to a Committee to enquire into the expediency propriety and time of making a new Rate and

that such Committee consist of Thomas John Phillips Edward William Wynne Pendarves John Hearle

Tremayne Edward Collins Humphry Willyams John Samuel Enys Gordon William Francis Gregor John Samuel

Enys Nicholas Kendall and John King Lethbridge Esquires and that any three of them be competent to act

It is ordered by this Court that no grant of Money shall be made from the County funds for any one

purpose if the same shall exceed One hundred pounds unless a Notice shall have been given on the first day

of the previous General Quarter Sessions that such grant will be applied for – that no application whatever

for County Money shall be made except on the first day of each General Quarter Sessions and no

consideration of such application shall be adjourned beyond the second day of such Sessions between the

It is ordered by this Court that Mr. J.B. Everest be and he is hereby appointed Superintendent of the

Assize Hall at Bodmin with power to appoint a proper person to take the care thereof – that a separate

Account be kept of the expences attending the same and that the expences of printing Calendars for the

Assizes and Quarter Sessions be charged to that account (image 394)

It is ordered by this Court that the Indictment of the Inhabitants of the parish of Minster in this county

for a Nuisance in not repairing a Highway in the said parish be and the same is hereby discharged a

Certificate under the hands and seals of two of Her Majesty’s Justices of the peace for the said county that

the said Highway is in good and sufficient repair having been produced (image 397)

Upon the continued appeal of the Mayor and Burgesses of the Borough of Truro in the said County

against a Rate or assessment for the relief of the Poor of the parish of Saint Mary in the said County for the

purposes chargeable thereunto according to law made the second day of April last at the rate of eight pence

in the pound for certain causes mentioned in the notice of the said appeal and amongst others that they are

not by law liable and ought not to have been rated and assessed at all in the said assessment in respect of

the Town Hall, Council Hall, Town Clerk’s Office and Toll Corn Chamber inasmuch as they are not occupiers

thereof nor were they such occupiers at the time of the making of the said Assessment and upon hearing

what could be alledged and proved It is ordered by this Court and this Court doth adjudge that the said Rate

be amended by striking out of the said Rate the assessment of the said Appellants for and in respect of the

Town Hall, Council Hall, Town Clerk’s office and Toll Chamber And it is further ordered that the

Churchwardens and Overseers of the poor of the said parish of Saint Mary do upon notice of this order pay

unto the said Mayor and Burgesses the sum of five pounds as and for their Costs in prosecuting the said

The Sessions amended the Rate by striking out of the same the name of the said Appellant and the said sum

in which he was assessed subject to the opinion of the Court of Queen’s Bench on the following case

The Borough of Truro comprises the entire parish of Saint Mary and considerable portions of the two

adjoining parishes of Saint Clement and Kenwyn. The Mayor Aldermen and Capital Burgesses of the Borough

are by Charter entitled to hold fairs periodically and two markets weekly within the Borough and to take

Tolls within the parish of Saint Mary they are seized in fee of a market house market place and certain stalls

shops and standings therein which are fixtures and within which as well as in the Public streets and other

places within the Borough generally and not exclusively within the said parish of Saint Mary the markets and

fairs are held. By Indenture bearing date the fifth day of April one thousand eight hundred and thirty eight

and made between the Mayor Aldermen and Capital Burgesses of the said Borough of Truro of the one part

and the said Zebedee Weeks described to be of the parish of Kenwyn in the said County Yeoman and Mary

Ball of the same parish Widow of the other part for the considerations therein mentioned the said Mayor

Aldermen and Capital Burgesses did grant demise and lease unto the said Zebedee Weeks and Mary Ball

their executors administrators and assigns All those the Tolls and dues arising from the fairs and markets of

the corporation of the said Borough of Truro together with the market place and stalls shops standings and

all and singular other the Appurtenances therein and thereto belonging or appertaining as in and by the

Schedule and particulars thereof unto the now abstracting Indenture annexed and marked B was mentioned

specified and declared save and except the Toll on Corn and the dues arising from Shows Show Carts and

Caravans To Hold the same with the appurtenances unto the said Zebedee Weeks and Mary Ball their

executors administrators and assigns from the first day of March then last past for and during the term of

one whole year thence next ensuing and fully to be complete and ended, yielding and paying for the same

unto the said Mayor Aldermen and Capital Burgesses their successors and assigns the rent or sum of six

hundred and eighty three pounds by twelve equal monthly payments without any deduction for any rates

taxes or assignments whatsoever And in the said now abstracting Indenture of Lease is contained a covenant

on the part of the said Zebedee Weeks and Mary ball their executors administrators and assigns that they

should and would pay and discharge all and all manner of rates taxes assessments &c which should be

imposed or payable in respect of the said Tolls Dues Market place and premises during the said term and

also that they should, and would, not on any pretence whatsoever take more or less Tolls or Dues from the

persons frequenting the said Fairs and Markets than those mentioned and set forth in the said Schedule

unto the now abstracting Indenture of Lease marked B and that if any dispute should at any time arise

during the said term as to the proper tolls or dues to be collected such dispute should be settled and

determined by the Mayor of the said Borough for the time being whose decision should be binding and

conclusive on the said Zebedee Weeks and Mary Ball their executors administrators and assigns

These occupiers at Weekly Rents except four of them reside out of the parish of Saint Mary – the Key of the

market place within which are the market houses Stalls shops and standings is kept by the Appellant and the

chop stalls and standings set out in the Schedule as let at weekly rents are locked up by him except on

Market days which are held twice in the week

Under the above Indenture to which Mary Ball was made a Party as a surety only, the appellant collects

from the persons named in the Schedule thereto occupying the fixed stalls shops and standings within the

market place the rents specified therein and from persons not occupying fixed stalls but frequenting the

market and exposing goods for sale as well in the market place as in the public streets and other parts of the

Borough and also from other persons occupying stalls not being on the soil of the corporation he collects

Tolls. The fixed rents payable to the Appellant in respect of the fixed stalls shops and standings in the market

place amount annually to the sum of four hundred and seventy four pounds. The corporation at their own

expence keep the premises in repair – the tolls and other dues being dependent on the casual number of

persons attending the markets and fairs are uncertain in their annual amount, but together with the said

fixed rents of the stalls shops and standings in the market place produce a larger sum than the rent payable

by the Appellant to the corporation under the above lease and for the whole of the market rents and stalls

within the Borough he derives a profit but it neither appeared by evidence that he made a profit by a

payment of less to the corporation than the stipulated sum or by any beyond that sum to any tenants of the

fixed stalls shops and standings. The Borough of Truro in comprised in schedule A of 5 & 6 W 4 C76 and the

whole of its revenues are applicable according to the provisions of the 92 section of that Act.

The question for the opinion of the Court is whether the Appellant is such an occupier of land in the

parish of Saint Mary as will render him liable to be assessed to the relief of the Poor

And it was therefore ordered that the said rate be amended by striking out from the rate or assessment

the charge thereon made on the said appellant in respect of the Market House, Market Place and Tolls of

Market And it is further ordered that the Churchwardens and Overseers of the Poor of the parish of Saint

Mary do upon notice of this Order pay unto the said Zebedee Weeks the sum of five pounds as and for his

Costs in prosecuting the said Appeal (images 399-400)
