PART A

1. ALLOCATION OF REGULATED AIR CARGO SCREENING FACILITY (RACSF) CODES

1.1 Allocation of RACSF Codes

1.1.1 Registration of RACSF is site-specific. Civil Aviation Department (CAD) allocates a RACSF code to each accepted site on CAD’s register in accordance with the format below:

“RF” + Unique registration number (4 digits)

example: “RF1234”

1.1.2 CAD maintains a register of valid RACSFs. The register is available at the CAD website:-

http://www.cad.gov.hk/english/icao2021_regracsf.html

2. SCREENING OF CARGO FROM REGULATED AGENTS (RAs)

2.1 Under the RACSF scheme, a RA may tender unknown cargoes to a RACSF for security screening at their premises1. After security screening, the RA or the RACSF shall be responsible for the secure transportation of the screened cargoes (SPX cargoes) from the RACSF to the CTO / airline before they can be accepted for carriage onboard commercial aircraft. Below is a typical channel through which a consignment can be offered to an airline under the RACSF scheme.

2.2 A RACSF shall only receive cargoes from RAs for security screening. A RACSF shall not directly receive

cargoes from non-RAs or unknown consignors for security screening, unless the RACSF itself is an RA and is eligible to annotate the security status (SPX) of the screened cargoes and its RA code on the shipping documents before tendering the cargoes to CTOs / airlines.

2.3 Cargo Acceptance Procedures by RACSF include:

(a) Documentation Check (i) Consignment of cargo shall be accompanied by shipping documents, including Master Air Waybill

(where applicable), House Air Waybill / Shipper’s Letter of Instruction and/or other types of shipping documents whichever is available

(ii) The shipping documents shall contain at least the following information. - nature / content of the consignment; and - quantity of the consignment (including weight, number of packages, dimension / volume).

(iii) If in doubt, the identity of the person delivering the cargo consignment shall be verified (e.g. check of company identification document) to ascertain that the person is the authorized representative of the tendering RA, the warehouse / cargo processing contractor or the transportation contractor of the RA.

(b) Appearance Check (i) The quantity (e.g. number of cartons), weight, dimension and the outer physical appearance of the

cargo consignment shall be reasonably checked against the information contained in the shipping documents mentioned in 2.3(a) above.

(ii) The packaging of the consignment shall be examined for any signs of tampering and suspicion, such as:- - signs of reseal or forcible opening; or - unreasonable packaging; or - wires, oil stains or other indications that the consignment may contain explosives or incendiary

devices.

2.4 Cargo Acceptance Procedures by CTO / airline include: (a) Documentation Check

(i) Consignment of cargo shall be accompanied by shipping documents, including Master Air Waybill and House Air Waybill / Shipper’s Letter of Instruction and/or other types of shipping documents, where applicable.

(ii) The shipping documents shall contain at least the following information. - nature / content of the consignment; - quantity of the consignment (including weight, number of packages, dimension / volume); and - RA code of the tendering RA and security status2 of the cargo consignment, if the consignment

is received from a RA. (iii) The status of the tendering RA shall be checked (i.e. checking RA code against CAD’s RA register).

(iv) If in doubt, the identity of the person delivering the cargo consignment shall be verified (e.g. check

of company identification document) to ascertain that the person is the authorized representative of the tendering RA or RACSF, the warehouse / cargo processing contractor or the transportation contractor of the RA or RACSF.

2 During Phases 1-3 of the transitional period, airlines / CTOs can continue to accept cargoes with “SPX” or “SCO” status and RA Code annotated on MAWB tendered by RAs without further security screening at CTOs (For known cargoes which are to be arranged for screening by RAs to meet the screening percentage requirement of the corresponding phase of the transitional period, the RAs are responsible for making their own request for screening either at CTOs or at RACSFs). Starting from Phase 4 of the transitional period, airlines / CTOs can only accept cargoes with “SPX” status and RA Code annotated on MAWB tendered by RAs. Cargoes tendered to airlines / CTOs without such status shall be subject to security screening at CTOs.

2.5 The following documents shall be maintained by the RACSF, where applicable, for a period of at least 3 months after screening: - Security screening log - Copies of security screening receipts for every consignment of air cargo screened* The RACSF shall also maintain the x-ray images / recordings of screened cargoes, e.g. by using the image capturing / recording function of the x-ray screening equipment or any other acceptable means by CAD, for at least 31 days after screening is conducted. The following document shall be maintained as long as a RACSF continues to hold a status of RACSF: - RACSF Security Programme including Screening Service Contractor Declaration, Cargo Processing

Contractor Declaration and Transportation Contractor Declaration, if any.

The required retention periods of other documents for an RACSF can be found in Part II Section 12.2 of the Application for Registration as RACSF for Off-airport Air Cargo Screening.

* If the RACSF belongs to (i.e. is a self-provided warehouse of) an RA, it may not need to issue receipts to itself after conducting self-screening of air cargo, provided that the RACSF has already maintained the security screening log.

2.6 Typical Cargo Flow under the RACSF Scheme

2.6.1 RA

2.6.1.1 Receive the consignment from the unknown consignor1.

2.6.1.2 Deliver the consignment to a RACSF for security screening.

2.6.1.3 If the consignment has been cleared by security screening, obtain a security screening receipt from the RACSF. Annotate its RA code and the security status “SPX” on the MAWB as per 2.2.2 and 2.3 of the Handling Procedures for Regulated Agent Regime (RAR).

2.6.1.4 [Where applicable, depending on the arrangement between the RA and RACSF] Deliver and safeguard the screened cargoes from unlawful interference until acceptance by the Cargo Terminal Operator (CTO). Obtain RCL from CTO.

2.6.1.5 Deliver the MAWB and RCL to the airline.

2.6.2 RACSF

2.6.2.1 Perform the acceptance check as per 2.3.

2.6.2.2 Apply security screening as requested by the RA, then record details of the consignment screened and the result of security screening on a security screening log. Such log shall, at a minimum, include the company name of the client RAs (or the RACSF itself if it conducts self-screening of air cargo), MAWB / HAWB No., gross weight, no. of pieces, date and time of screening, result of screening (pass or reject), reason of rejection if applicable, whether hand search / physical check / alternative screening methods acceptable to CAD has been conducted, and the identity of the screener (e.g. screener identification no. Sample of the security screening log is attached at Annex 1.

2.6.2.3 Issue a security screening receipt to the RA, which serves as a document proof that the cargo has been screened at the RACSF. The security screening receipt shall include, at a minimum, the company name of the client RA, MAWB / HAWB no., gross weight, no. of pieces, date and time of screening. The RACSF shall also indicate on the receipt:

(i) that the cargo have been “SECURITY CHECKED”;

(ii) the company name of the RACSF (e.g. in company chop); and

(iii) the RACSF code assigned by CAD.

Sample of a security screening receipt is attached at Annex 2.

2.6.2.4 Safeguard the consignment from unlawful interference after its reception.

2.6.2.5 [Where applicable, depending on the arrangement between the RA and RACSF] Safeguard the screened cargoes from unlawful interference until acceptance by CTO. Obtain RCL for the RA.

2.6.2.6 The security screening log and copies of security screening receipt shall be kept for a period of at least 3 months after screening is conducted. Documentation and recording by electronic means are acceptable provided that hardcopies can be made available upon inspection by CAD. The RACSF shall also maintain the x-ray images / recordings of screened cargoes for at least 31 days as per 2.5 above.

2.6.3 Cargo Terminal Operator (CTO)

2.6.3.1 Receive the physical consignment from the RA or RACSF. Perform the acceptance check as per 2.4(a)(iv) and 2.4(b)(ii), and issue RCL.

2.6.3.2 Safeguard the consignment from unlawful interference after its reception.

2.6.4 Airline

2.6.4.1 Confirm the status of known cargo (i.e. SPX) by checking the MAWB, and receive the RCL.

2.6.4.2 Perform the acceptance check as per 2.4(a)(i), 2.4(a)(ii), 2.4(a)(iii) and 2.4(b)(i).

2.6.4.3 Instruct the CTO to apply further security screening if the above acceptance check is unsatisfactory or when the airline deems it necessary.

2.6.4.4 Keep the shipping documents and RCL for inspection by CAD. Documentation and recording by electronic means are acceptable provided that hard copies can be made available upon inspection by CAD.

Note:

If the RACSF belongs to (i.e. is a self-provided warehouse of) an RA, it shall perform both the role of an RA and an RACSF in 2.6.1 and 2.6.2 above. If the RA in question performs self-screening of air cargo using its RACSF status, it may not necessarily issue security screening receipts to itself as required by 2.6.2.3 above, provided that the RA has already maintained the security screening log as required in 2.6.2.2 above.

3. Keeping of Contractor Declaration Forms

3.1 An RACSF may contract out some of its duties to contractors. However, the contractors shall duly complete contractor declaration form(s) applicable to their scope of duties and submit them to the RACSF for its keeping. Three types of contractor declaration forms are available under the RACSF scheme, namely:

- Cargo Processing Contractor Declaration Form (Blank form in Annex 3);

- Transportation Contractor Declaration Form (Blank form in Annex 4); and

- Screening Service Contractor Declaration Form (Blank form in Annex 5).

1. ABOUT THE REGULATED AIR CARGO SCREENING FACILITIES (RACSF) SCHEME

1.1 For the security of air cargo to be in line with the Standard 4.6.4 of Annex 17 (10th edition) to the Convention on International Civil Aviation (Safeguarding International Civil Aviation Against Acts of Unlawful Interference), the Hong Kong Aviation Security Programme which, is enforceable under the Aviation Security Ordinance, has incorporated the Regulated Agent Regime (RAR) since March 2000. The regime was formulated after consultation with the air cargo industry representative bodies like the Hong Kong Shippers' Council, Hong Kong Association of Freight Forwarding and Logistics Limited (HAFFA) and aircraft operators (airlines).

1.2 The Regulated Air Cargo Security Facilities (RACSF) Scheme is a new initiative aiming to meet the latest policy direction on air cargo security issued by the International Civil Aviation Organisation (ICAO), which requires that, by June 30, 2021, consignors of all ICAO Contracting States / Administrations have to be approved by the respective aviation security authority as validated known consignors. Otherwise, all cargo handled by the consignor will be subject to 100% security screening prior to being loaded onto a commercial aircraft. The aim of this ICAO’s new policy direction is to enhance the level of aviation security, with a view to combatting the rising aviation security threats around the globe.

1.3 Hong Kong has an obligation to meet the ICAO security requirements. In order to cope with the anticipated upsurge in screening demand, the Government has developed the RACSF Scheme to enable and regulate air cargo screening at off-airport locations. Under the scheme, interested industry operators such as freight forwarders and shared warehouse operators can conduct air cargo screening operations in their premises through registering with CAD to become RACSFs.

2. NOTICES TO RACSF

2.1 All RACSFs shall comply with all the requirements and directions contained in the Notices to RACSFs given from time to time by the Civil Aviation Department (CAD). RACSFs will normally receive an e-mail or a letter from the CAD when a Notice is given to them.

3. RACSF SECURITY TRAINING

3.1 REQUIREMENTS

3.1.1 Each RACSF shall nominate two persons as Nominated Persons (NP) for Cargo Security accountable for overseeing the effective implementation of cargo security operations and their compliance with the requirements in the RACSF Security Programme (i.e. Part II of the Application for Registration as RACSF for Off-airport Air Cargo Screening). The RACSF shall ensure that the two NPs have attended an RACSF Security Training Programme acceptable to the CAD (the Training Programme). Upon successful completion of the Training Programme, training certificates will be issued to individual candidates. All training certificates carry a validity of 3 years. Before expiry of the 3-year period, RACSFs shall arrange for their staff to complete the Training Programme for revalidation of the training certificates for another 3 years. RACSFs who have their trained staff left their companies should arrange training for their replacement staff to comply with the above training requirements within 3 months after the departure of the trained staff.

3.1.2 Those who have completed the Training Programme should internally brief the staff members with access to consignment designated as air cargo and/or related documents. It is the responsibility of an RACSF to arrange their respective in-house refresher training in order to ensure their staff members are continuously familiarized with the RACSF requirements. RACSFs shall maintain training records.

3.1.3 Those who failed the Training Programme should attend the next Training Programme to meet the RACSF training requirement.

3.2 RACSF TRAINING COURSE ORGANIZERS

3.2.1 Course organizers offering RACSF security training programme acceptable to CAD can be found on CAD’s website (https://www.cad.gov.hk/english/icao2021_training.html). Interested parties can contact the organizers direct for enrolment.

4 EXEMPTED CARGO

Certain categories of cargo are exempted from security screening. The exempted cargo shall be clearly declared on shipping documents as such and be accompanied with, if any, necessary documents as required by relevant Hong Kong SAR or overseas government’s department for tendering the cargo (e.g. sanitary certificate). They include

(a) transit cargo;

(b) transfer cargo;

(c) human remains / ashes;

(d) livestock;

(e) medical drugs and other essential medical supplies, human organs, blood plasma or similar materials for life-saving purposes; and

(f) items of mail, courier material and cargo under 6.3mm thick.

(Only (c) – (f) are relevant to RACSFs as (a) and (b) are handled by CTOs.)

5 NOTIFICATION OF CHANGE OF RACSF SECURITY PROGRAMME

As stipulated in the Declaration of Compliance – RACSF (i.e. Part III of the Application for Registration as RACSF for Off-airport Air Cargo Screening), an RACSF shall inform the CAD in writing as soon as reasonably possible if there is any change of the information contained in the application form, including the RACSF Security Programme. A RACSF can do so by submitting a duly completed Notification of Change of RACSF Security Programme (Annex 6) by fax: 2362 4257 or by e-mail to [email protected].

6 RACSF REGULAR SELF-ASSESSMENT

RACSF shall conduct regular self-assessment with reference to the RACSF Security Programme and the Handling Procedures for RACSF, at least once every two years, in order to identify deficiencies or security procedures that are not being properly implemented or that may require enhancement. The results of each self-assessment shall be maintained for 2 years and be available for the announced and unannounced inspections by CAD (see Annex 7 – Sample Checklist for Regular Self-Assessment).

and/or related documents shall be established by means of documentary evidence such as a national identity card or passport.

(b) Each cargo processing staff with access to consignment designated as air cargo and/or related documents shall have received the security awareness training set out in Part II Section 7 of the principal’s RACSF Security Programme (SP).

(c) The security procedures set out in Part II Sections 5, 8.2 and 8.4, where applicable (based on the actual scope of work of the cargo processing contractor), of the principal’s RACSF SP shall be adhered to.

as a national identity card or passport. (b) Each security screener shall fulfill the following requirements as stated in Part II of the principal’s

RACSF Security Programme (SP): i. have received the security awareness training conducted by one of the Nominated Persons of

the RACSF, or by a person with equivalent qualifications, as set out in Section 7; ii. fulfill the selection criteria set out in Section 9.2; and iii. have undergone the training and certification process administered by a Certification Body (CB)

accepted by CAD as set out in Section 9.3. (c) In addition, my company shall fulfill the following requirements as stated in Part II of the principal’s

RACSF SP: i. follow the procedures for security screening as set out in Section 8.3; ii. follow the screener working hours as set out in Section 9.4; iii. follow the procedures for equipment calibration and maintenance as set out in Section 10.1; and iv. keep all relevant documentation and records as set out in Section 12.

(d) Screening service shall not be further sub-contracted to a third party, unless the third party has also signed a “Screening Service Contractor Declaration” with the principal for the specified site address and meet the requirements in (a)-(c) above.
