Scope : Legislative Decree 81/2008 and subsequent amendments has the power to release the affidavit on the adoption and effective implementation of the organization and management models of health and safety as declined in art. 30 of same legislative decree, and having the aim of preventing the crimes referred to the art. 25 septies of Legislative Decree 231/01 and subsequentamendments.This opportunity is up to the Joint Bodies constituted of associations of employers and workersbetweenthemostrepresentativesatnationallevel.However, the law does not give a resolution about the kind of requirements or procedures for the implementation of the affidavit activity, except for the one, provided for in paragraph 3b of art. 51 of the Decree 81, according to which "for the purposes referred to paragraph 3- bis, the joint bodies establish specific joint commissions, technically competent".Therefore, National Commission for Accident Prevention, Hygiene and the Working Environment (CNCPT) has promoted in UNI the declination of a standard affidavit path all over the national territory for construction companies through the drafting and publication ofUNI/PdR2:2013referencepractice.Furthermore, within the UNI framework, a technical report is being approved that regularly declaims the methods of affidavit of MOGs by Joint Bodies (UNI1601968 Project) aimed at makingtheprocessuniformforalltheproductionsectors.As the practice is near to its expiring date, the publication of a dedicated sectorial standard has been decided as the result of a public consultation inside standardization body.
