The property to the north isvacant and the property to the south contains multiple family residential uses. The majority ofthe subject property is zoned "G-2" Wholesale. The uses allowed under the proposed "D-1"Professional Office district are far less intensive than the uses allowed under the "G-2"Wholesale district. Therefore, the proposed zoning will make the future use(s) of the site morecompatible with the surrounding office and residential uses. For comparison purposes, acomplete list of the uses permitted in the "G -2" W holesale and "D-1" Professional Office districtis attached to this report.

    COMPLIANCE WITH MASTER PLANThe Southeast Area Comprehensive Plan designates the subject property for professional officeuse. Therefore, the proposed zoning will bring the property into compliance with the land usepattern being advanced in the master plan.IMPACT ON VEHICULAR AND PEDESTRIAN TRAFFICThe traffic from the site will utilize the existing driveway on E. Miller Road, which is designatedas a collector road designed to carry a relatively high volume of traffic. The amount of trafficgenerated by the uses allowed under the "D-1" Professional Office district will not have anynegative impacts on the transportation system in the area. In fact, the uses allowed under thisdistrict will generate less traffic than many of any use(s) that could potentially occupy thebuildings under the current zoning.ENVIRONMENTAL IMPACTNo negative environmental impacts are anticipated to result from the proposed rezoning. Thetypes of uses permitted in the "D-1" Professional Office district are low impact uses that do notgenerate much traffic, noise and other potential nuisances. In terms of the physical environment,no changes to the site are proposed.IMPACT ON FUTURE PATTERNS OF DEVELOPMENTThe proposed rezoning will have no impact on future patterns of development in the area.Although the proposed "D-1" Professional Office zoning will create a "spot zone", there arenumerous other instances of spot zoning already in the area. Furthermore, it is very rare that aproperty owner makes a request to down zone a parcel of land. The only reason that thisproperty owner is making that request is to allow the buildings to be used either exclusively or inpart for residential purposes. It is unlikely that other property owners in the area would make asimilar request, however, if they did, it would also be looked upon favorably since it reduces,rather than intensifies the zoning and the u ses and activities permitted therein.

    RECOMMENDATIONStaff recommends that Z-4-10 be approved to rezone the property at 1301 E. Miller Road from"H" Light Industrial, "G-2" Wholesale and "J" Parking Districts to "D-1" Professional OfficeDistrict, based on the findings of fact as outlined in this staff report.
