MINUTES OF THE 26th MEETING OF TOWN VENDING COMMITTEE (TVC)HELD UNDER THE CHAIRMANSHIP OF COMMISSIONER CUM CHAIRPERSON,
TOWN VENDING COMMITTEEMUNICIPAL CORPORATION, CHANDIGARH
ON 09.03.2020 AT 03.00 PM IN THE CONFERENCE ROOM OF MCC.

Proceedings/Minutes
The Commissioner, Municipal Corporation, Chandigarh cum ChairpersonTown Vending Committee (TVC) welcomed all the TVC members, Special Invitees,
Officials and staff present.Thereafter, the Social Development Officer, Vendors Cell put up agenda
points for discussion before TVC in the meeting.

Agenda: - 1 Complaints/Representations received from Street Vendors.
The Social Development Officer, Vendors Cell apprised members of the
Town Vending Committee regarding 482 recent complaints/representations received
from different Street Vendors. The members of the Town Vending Committee resolved
to forward such representations/complaints to existing Sub Committee notified earlier
under the Chairpersonship of Additional Commissioner, MCC for redressal. TVC
appreciated the work done by Sub Committee.
Agenda: - 2 Grievance Complaint redressal
The Social Development Officer, Vendor Cell apprised members of the
Town Vending Committee regarding 2580 complaints received from various sources as per
detail given in the agenda, which were scrutinized by Vendors Cell in the absence of GrievanceRedressal Mechanism. The Town Vending Committee in agreement appreciated the work doneby Shri. Anil Garg Ji, the Additional Commissioner, MCC and Vendor Cell for putting emphasis
on resolving the grievances.
Social Development Officer informed to TVC members that the ChandigarhAdministration, Chandigarh has proposed the name of Sh. Jasbir Singh, Addi. Civil Judge, Sr.Div., (Retd.) as Chairman of Grievance Redressal Mechanism with a request to finalize the
names of the other two members for final notification.
The Chairperson directed to immediately start the procedure of selection
of two other members by publishing an advertisement as per the qualification criteria
envisaged under the respective act and. rules.
Agenda: - 3 Street Vendor Charter, Municipal Corporation, Chandigarh.
The Social Development Officer, Vendor Cell briefed the content of draft
Street Vendor Charter to all the Town Vending Committee members. The
Commissioner cum Chairman, Town Vending Committee informed that Right to Service
Act has already been enforced in the Municipal Corporation, Chandigarh and various
public utility services has already been added in the said Act. The Commissioner cum
Chairman, Town Vending Committee suggested to the SDO, Vendor Cell to check
whether the public dealing services has been added in the Right to Service Act or not

and if the same is not added in the Right to Service Act, then process be initiated for
adding the same in the existing Right to Service Act.
Further the Town Vending Committee in agreement to all the members
resolved to keep pending the Street Vendor Charter, Municipal Corporation, Chandigarh as
proposed in the agenda item.
Agenda: - 4 Regarding Fee Concession on medical ground.
The Social Development Officer, Vendors Cell informed to the Town
Vending Committee that various representations have been received from vendors for
fee concession on medical ground but due to the absence of Standard Operating
Procedure (SOP), the vendor cell is unable to decide/resolve such cases. The draft
Standard Operating Procedure has also been placed before the TVC for consideration
and orders. The Additional Commissioner, MCC suggested that all the vendors may be
included in the group insurance. The Commissioner cum Chairman, Town Vending
Committee has expressed his view that vendors be enrolled in the Ayushman Bharat
Scheme.
The SDO, Vendor Cell informed that as per Street Vendors Bye-Laws,
2018, Sr. no 10 (h), exemption (maximum 50%) in the form of relief of registered street
vendors in case of penalties imposed will be given only when, the street vendor or
his/her next kin shows valid documents due of urgency i.e. hospitalization, pregnancy,
death episode, accidents or any extreme emergency due to natural or manmade
disasters or riots etc. Such cases will be examined by SDO/Nodal Officer and will be
decided at the level of Joint Commissioner/Additional Commissioner on
recommendation of TVC.
The Town Vending Committee in agreement to all the members present
resolved that a meeting be called with the Director Health Services, UT, Chandigarh at
the level of Additional Commissioner, MCC to resolve the issues regarding cases for fee
concession on medical ground. Also, the members of the TVC resolved to get one
Medical Officer deputed by the OHS, Chandigarh Administration to examine such cases

and to put up recommendation for relief. TVC also directed to put up report of the
meeting held with OHS in the next TVC.
Agenda: - 5 Fee status of defaulter vendors.
The Social Development Officer, Vendor Cell informed to the TownVending Committee that as per resolution passed by the TVC in its meeting held on22.01.2020, the default vendors has been given opportunity to deposit their dues up to
29.02.2020 but only 329 Street Vendors came forward for opening their locks from24.01.2020 to 29.02.2020. As per the data shared by the E-sampark, out of the 329street vendors, only 99 Street vendors have cleared their all dues up to 29.02.2020. Thecategory wise detail has already been given in the agenda.
The SDO, Vendor Cell further informed to the TVC that the street vendorsare still depositing their dues after the expiry of 29.02.2020. The Town VendingCommittee in agreement to all the members present unanimously resolved that lastdate for depositing penalty fees will be considered up to 15.03.2020 and the vendorswho have got their lock opened and not deposited their amount may be informedtelephonically by the vendors cell. It has also been resolved to not to consider those
vendors who have not get opened lock by the last date i.e. 29.02.2020.
Agenda: - 6 Report of Sub Committee regarding identification of new vending sites inChandigarh.
The Social Development Officer, Vendors Cell presented the report of theSub Committee chaired by Chief Engineer regarding identification of new vending sites
in the UT, Chandigarh.
The Town Vending Committee members resolved to forward therecommendation of the Sub Committee to the Chief Architect, UT, Chandigarh forfurther approval at the level of appropriate authority except the site at Sr. no 13 inSector 22D, Chandigarh which is presently under litigation. The Chief Engineer, MC,Chandigarh has also requested to . Chairperson of the TVC to include recentlyinaugurated Thada Market for Street Vendors at Mulijagaran having capacity of 166members approximately.

Agenda: - 7 Revised proposal for extension of the Street Vendors Project on StreetFood Vending in partnership with School of Public Health, PGIMER,Chandigarh
The Town Vending Committee in agreement to all the members present
resolved the revised proposal for extension of the Street Vendors Project on Street Food
Vending in partnership with School of Public Health, PGIMER, Chandigarh and requested toSDO, Vendor Cell to proceed accordingly in signing MOU after putting the closer report of the
pilot project successfully.
Agenda: - 8 Miscellaneous discussion points
The following issues/decision taken by the TVC on the below mentioned
points are as under: -1. The Town Vending committee resolved to follow the directions of the UT
Administration on the issue in respect of prohibition for selling of Pan, bidi,
cigarette and tobacco products by the Street vendors.2. The Town Vending committee decided on the issue of licence of Chat vendors
to take action as per Street Vendors Act, 2014.
3. The proposal for shifting of vendor site in Sector 32, Chandigarh proposed by the
0/o Chief Engineer has been kept in waiting by the Town Vending Committee.
4. The issue of three transgender namely Vijay alias Vijayta, Shrishti Choudhary andAmit alias Mona who are tea vendors in Industrial Area and were not surveyed arebeing considered and approved by the TVC for granting street vendor licence afterdue registration procedure in .the MIS as per Chapter V (22) (vii) of the StreetVendors (Protection of Livelihood and Regulation of Street Vending) Municipal
Corporation, Chandigarh Bye-Laws, 2018.There being no agenda, the meeting ended with Vote of Thanks to the
