the warden this morning' said the

posse, heavily armed, were on the

track of the negro convict who was'.he tns".gatcr and ringleader of the

conspiracy to escape and who is travcling with two other convicts betweenLawrence and Nortonville.

The net result of yesterday's chaseis as follows:

Dead: At Nortonville, Kas., James

Huffman, aged 20, from Coffeeville,

Kas., killed instantly; Jay J. Poffen-kol- z,

25, military prisoner from Chica-

go, killed instantly.Wounded: At Nortonville, John

Green, 21 white, from Vinita, I. Tshot in the hand and knee, woundsserious; Wm. A. Drake, 19, white, fromSouthwest City, Mo., shot twice in thearm, wound slight.

.Nine of the convicts- who escapedfrom the federal prison at Fort Leav-

enworth, Kas., Wednesday afternoon,had been accounted for this morning.

Two have been killed, two wounded,and five others captured unhurt; of

the sixteen still at large, four are be-

ing pressed closely and word is expec-ted any moment that they have beencaptured or killed. The other fleeingconvicts are still making for the In-

dian territory.A telephone message from Leaven-

worth reports the capture of JamesWilson, colored, the tenth convict tobe taken. Wilson's feet were stillshackled.

A Star special also reports the woun-

ding and capture, south of Tonganoxle,of Frank Thompson, a negro, the lead-

er of the outbreak, but it has not beenconfirmed.

A FARMER CAPTURES TWO.Lawrence, Kas., Nov. 9. Dave Lew-

is, a farmer, brought in two convicts,Gus Parker and David Grayson. Lewis

captured the men unaided at Midlapd,three miles north of Lawrence. Thismakes the total of convicts capturedtwelve.

Tucson, Ariz., Nov. 9. A Star specialfrom Guaymas, Mex., says the lost

Taypa mines, celebrated in Spanishannals as having produced $80,000,000

in silver and gold in the 17th century,have been found. Explorers, recentlyreturned from Cieneguita, report hav-

ing discovered old stone prisons, old

smelters and also stupendous work ac-

complished by the ancients.

sistance they can in this work. I wouldalso suggest that personal letters bewritten to friends and acquaintancesin New Mexico by the different mem-

bers of the auxiliary committee, andalso that they write to the differentcounty school superintendents and tothe principals of the different schoolsIn the cities asking them to designatea day for the children to make theircontributions. This plan is being car-

ried on throughout the United States;for instance. Thanksgiving day wouldbe an appropriate time to receive theofferings from the school children whodesire to subscribe. Letters might al-

so be written to the different territor-ial institutions and to religious, bene-volentpatriotic, and other societies requesting them to circulate , subscription forms among their .' associates,employes, members, neighbors, etc.

The public, parochial and '" otherschools and colleges should be givenspecial attention. It is desired thatthere be numerically a large offering,not alone from men and women, butfrom the children, the boys and 'girls,young men and women In the schoolsand colleges. Washington, Nov. 9. C. E. Sapp, internal revenue collector for the districtof Kentucky, has resigned. His resigna-tion was accepted by the president. Thechief deputy was appointed temporarilyto mi the vacancy.

The announcement of the tender andacceptance of Sapp's resignation fol-

lowed the visit of Senator Deboe, whohanded the resignation to the president.Sapp's resignation ends the long contestwaged against him by the reform ele-

ment in the Republican party of Ken-

tucky. SanD has been charged repeatedly with flagrant violations of the civilservice law ana lias oeeu unaer investi-gation.

rines and 26 insurgents were killed.

Major Walter destroyed the curatelaand 70 houses.

Resignation Withdrawn.Professor Bradey, whose resignation as

a member of the faculty of the NewMexico College of Agriculture and Me

day to add the finishing touches to itsreport. It can be stated on authoritythat the commission has not reported,up to this time, in favor of either theNicaragnan or Panama project. Con-

sequently, the administration has notreported a preference for either route,but in view of the well understood fa-

vor with which congress heretofore re-

garded the Nicaraguan route, the de-

cision of the executive departmentswill be in favor of that project.

Judge McFie Today Deoided Two Important Oases Affecting the Finances

of the City.Tudee McFie this afternoon rendered

a decision in tbe case of the Santa FeWater and Light Company vs. The Cityof Santa Fe, submitted to him on apoint of law. Judge McFle gives judg-ment against the city for $500 for eachof the quarters ending June 30 andSeptember ,w oi tnis year unaer tnecity's contract with tbe water companyof date of 1893. Under another contract entered into in January of thisyear judgment is given for $100 forwater sprinkling purposes for the firstquarter of 1901 but for the second quar-ter of 1901 the claim is not allowed. Aninjunction was also granted under theallegation that the city is insolvent,restraining the city authorities frompaying out any funds on band pendingthe settlement of the Water company'sclaims.

According to the stipulation Intowhich both parties to the case entered,this decision will not preclude the cityfrom attacking the validity of the city'scontract with the water company at anyfuture time.

passed, asking for action by the nat-

lutions on irrigation, on improvementon rivers and harbors, on the admissionof territories, on a department of min

ing, on forest reserves, on the Nicara-

gua canal, etc.A committee consisting of Hon. L. B.

Prince of New Mexico; Hon. H. R.Whitmore of Missouri; Hon. RobertGraham of Colorado; Hon. W. M. Bun-
