Tips on Completing the Residential Property Disclosure

The following Residential Property Condition Disclosure Statement is required by the state of South Carolina. This form represents a statement of the condition of the property to the best of your knowledge. You may need to reference other parties (such as past contractors, home inspectors, regime manager, etc) in order to obtain appropriate information to complete certain questions. If the condition of your property changes between now and the time you close, YOU must amend the original disclosure statement accordingly as the homeowner is the only party legally able to revise this information. Upon completion, be sure to initial and date the bottom of pages 1, 2 and 3 and sign and date the Owner(s) Acknowledgement section of page 4. It is advisable to hire a home inspector or other qualified professional in order to make certain

determinations on the type of plumbing, siding, etc. Item # 7 - If your property is connected to sewer, the Community System is the appropriate option as there

is no city/county-run sewer system in our area. The Public Service Districts are considered Community Systems.

Item #10 - Please note that termite bonds are no longer issued. You may have a termite warranty on your

property, and we suggest that you consult with your termite control company to properly answer these questions.

Item #18 - If your property is located within a planned-unit development, plantation, gated community, etc.,

the property is likely subject to restrictions to property use, resulting in a YES answer. The explanation below should reference any existing covenants, restrictions, architectural guidelines, etc.

Item #20 - You may need to consult with your regime manager (for villas, condominiums and some

townhomes) to determine if any special assessments have been proposed and/or if any lawsuits are pending. Item #22 - The answer should be YES, given that all of Beaufort County is in a federally-designated flood

plain. This can also serve as your explanation. Item #23 - Consider any propane tanks, water softener equipment, etc. that may be leased instead of owned.

Also, if you have placed your property on a long or short (vacation) term rental program, you should reference any existing rental agreements, etc.

Item #24 - Please note that it is now law that property owners are not responsible for any unpaid bills for

utilities secured by the tenant who has a lease on the property.
