SPONSOR: MAYOR ROBERT A.B. REICHERT A RESOLUTION OF THE MACON-BIBB COUNTY COMMISSION AUTHORIZING THE ACCEPTANCE OF APPROXIMATELY 28.37 ACRES OF LAND LOCATED AT 1000 BOULEVARD AND DEDICATING THE SAME FOR PARK PURPOSES; AND FOR OTHER LAWFUL PURPOSES. WHEREAS, on April 10, 1940, the trustees of the estate of the late United States Senator Augustus Octavius Bacon prepared a deed conveying approximately 28.37 acres of land (the “Property”), now bound by Boulevard, Briarcliff Road, and South Jackson Springs Road, and dedicating the same to use “for park purposes”; and WHEREAS, copies of the 1940 deed, as well as the 1905 deeds incorporated thereby are collectively attached hereto at Exhibit A and incorporated herein by reference; and WHEREAS, the Macon-Bibb County government has no record that the Property was ever formally accepted by the City of Macon or Macon-Bibb County; and WHEREAS, the Macon-Bibb County Commission now desires to formally accept the Property and to dedicate the same for park purposes; and WHEREAS, the Macon-Bibb County Commission finds that acceptance of this conveyance in accordance with the April 10, 1940 deed is in the best interest of the citizens of Macon-Bibb County, and is necessary and proper to promote or protect the safety, health, peace, security, and general welfare of Macon-Bibb County and its inhabitants; and NOW, THEREFORE, BE IT RESOLVED by the Macon-Bibb County Commission and it is hereby so resolved by the authority of same that the Macon-Bibb County Commission hereby accepts the donation of the Property, being approximately 28.37 acres of land, as indicated in the deed from the trustees under the last will and testament of Augustus Octavius Bacon to the City of Macon, recorded on April 10, 1940, at Book 496, Page 156, and commonly known as 1000 Boulevard, as shown in Exhibit B hereto, and incorporated herein by reference. BE IT FURTHER RESOLVED that the Property is hereby dedicated for park purposes, in accordance with O.C.G.A. § 36-64-2, and shall serve as a passive park or green space for public recreational use until such time as additional funds may be dedicated to its improvement or to the installation of park facilities from time to time in the future. BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute such documentation as may be deemed necessary in order to accept the requested donation on behalf of Macon-Bibb County.

BE IT FURTHER RESOLVED that the Macon-Bibb County Commission hereby

declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and

shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by

reference into this provision.

BE IT FURTHER RESOLVED that in the event scrivener’s errors shall be discovered in

this Resolution or in the Exhibits hereto after the adoption hereof, the Macon-Bibb County

Commission hereby authorizes and directs that each such scrivener’s error shall be corrected in all

multiple counterparts of this Resolution.

BE IT FURTHER RESOLVED the Macon-Bibb County Commission grants the Mayor

the authority to take any and all further actions necessary to carry out the intents and purposes of

this Resolution.

BE IT FURTHER RESOLVED that except as specifically provided herein, any and all

ordinances or resolutions or parts of ordinances or resolutions in conflict with this Resolution shall

be and the same hereby are repealed, and this Resolution shall be in full force and effect from and

after its adoption.

BE IT FURTHER RESOLVED this Resolution shall become effective immediately upon

its approval by the Mayor or upon its adoption into law without such approval. APPROVED AND ADOPTED this _____ day of __________________, 2020.
