Due to Governor Greg Abbott’s March 13, 2020 proclamation of a state of disaster
affecting all counties in Texas due to the Coronavirus (COVID-19) and the Governor’s
March 16, 2020 suspension of certain provisions of the Texas Open Meetings Act, this
meeting will be held by video conference call, as authorized under Texas Government
Code section 551.127.

This meeting of the TCA has been properly posted with the Secretary of State’s Office
according to the provisions of the Texas Open Meetings Act, Chapter 551, Texas
Government Code. The members may discuss and/or take action on any of the items
listed in the agenda. The Commission may go into executive session on any agenda item,
if appropriate and authorized by the Open Meetings Act.

TIME & PLACE
The Texas Commission on the Arts (TCA) held a telephonic meeting of the Commission
beginning at 9:00 a.m. on September 3, 2020.
CALL TO ORDER
Commission Chairman Dale Brock called the meeting to order by reading the following
statement: “A public notice of the meeting containing all items on the agenda has been
filed in the Office of the Secretary of State at 2:59 p.m. on August 19, 2020 as required

THE FOLLOWING ITEMS:
APPROVAL TO EXCUSE ABSENT COMMISSIONERS
Commissioner Partee made the motion and Commissioner Heller seconded that
Commissioner Payton be excused from the September 3, 2020 meeting. Motion carried.
APPROVAL OF MINUTES OF THE JUNE 11, 2020 MEETING
Commissioner Roberts made the motion and Commissioner Gibson seconded that the
minutes of the June 11, 2020 Commission meeting be approved as written. Motion
carried.
UPDATE ON TCA’s FISCAL YEAR 2020 OPERATING BUDGET
Amber Rhodes, Director of Finance, reviewed the FY 2020 operating budget with
Commissioners.
UPDATE ON TCA’s FISCAL YEAR 2021 OPERATING BUDGET
Ms. Rhodes reviewed the FY 2021 operating budget with Commissioners.
UPDATE ON TCA’s INTERAL AUDIT
Ms. Rhodes reviewed the results of the Internal Audit with Commissioners.
ACCEPTANCE OF LETTERS OF APPEAL IMPACTING GRANTS TO BE
CONSIDERED FOR APPROVAL AT THIS MEETING
Kenneth Williams, Program Administrator, presented an appeal from the Houston Center
for Photography. Discussion followed. Commissioner Heller made the motion and
Commissioner Partee seconded that the Commission deny the appeal from the Houston
Center for Photography. Motion carried.
REVIEW OF TCA’s FISCAL YEAR 2021 GRANTS BUDGET
Laura Wiegand, Director of Programs & Technology, gave an update to the
Commissioners on the 2021 grants budget. Discussion followed.
APPROVAL OF ARTS CREATE GRANTS
Ms. Wiegand reviewed the FY 2021 Arts Create Grants with Commissioners. Discussion
followed. Commissioner Guerra made the motion and Commissioner Gaines seconded
that the Commission approve the Fiscal Year 2021 Arts Create grant distribution as
presented, with noted abstentions reflecting Commissioners’ conflicts of interest. Motion
carried.
APPROVAL OF ARTS RESPOND CULTURAL DISTRICT PROJECT GRANTS
Dr. Gary Gibbs, Executive Director, reviewed the funding distribution for the FY 2021
Arts Respond Cultural District Project grants with Commissioners. Discussion followed.
Commissioner Gibson made the motion and Commissioner Heller seconded that the
Commission approves the funding distribution for the FY 2021 Arts Respond Cultural
District Project Grants as presented, with noted abstentions reflecting Commissioners’
conflicts of interest. Motion carried.

ACCEPTANCE OF ARTS RESPOND PROJECT GRANTS
Ms. Wiegand reviewed the funding distribution for the first round of FY 2021 Arts
Respond Project grants with Commissioners. Discussion followed. Commissioner
Roberts made the motion and Commissioner Chang seconded that the Commission
approves the funding distribution for the first round of FY 2021 Arts Respond Project
grants as presented, with noted abstentions reflecting Commissioners’ conflicts of
interest. Motion carried
APPROVAL OF ARTS RESPOND PERFORMANCE SUPPORT GRANTS
Anina Moore, Director of Communications, reviewed the funding distribution for the first
round of FY 2021 Arts Respond Performance Support with Commissioners. Discussion
followed. Commissioner Guerra made the motion and Commissioner Gibson seconded
that the Commissioner approves the funding distribution for the first round of FY 2021
Arts Respond Performance Support grants as presented, with noted abstentions reflecting
Commissioners’ conflicts of interest. Motion carried.
APPROVAL OF COMMISSION INITIATIVE GRANTS
Ms. Wiegand reviewed the funding distribution for the first round of FY 2021
Commission Initiatives grants with Commissioners. Discussion followed. Commissioner
Roberts made a motion and Commissioner Heller seconded that the Commission
approves the funding distribution for the first round of FY 2021 Commission Initiatives
grants as presented, with the noted abstentions reflecting Commissioners’ conflicts of
interest. Motion carried.
SELECTION OF EVALUATORS FOR THE STATE ARTISTS PANEL
Ms. Moore reviewed the selection process for the State artist panel and its evaluators with
Commissioners. Discussion followed. Commissioner Guerra made a motion and
Commissioner Partee seconded that the Commission instructs TCA staff to recruit
individuals to serve as State Artist evaluators for the Texas State Poet Laureate,
Musician, and Visual Artists (2D and 3D). Motion carried.
APPROVAL OF CULTURAL DISTRICTS RECERTIFICATION FOR FISCAL
YEARS 2009 AND 2010
Dr. Gibbs reviewed the Cultural District Recertification process with Commissioners.
Discussion followed. Commissioner Chang made the motion and Commissioner Gibson
seconded that the Commission officially recertify the designation of the following seven
districts through fiscal year 2029: Austin’s Six Square Black Cultural District, Denison
Arts and Cultural District, Huntsville Cultural District, Lubbock Cultural District,
McAllen Cultural District, San Angelo Cultural District, Winnsboro Cultural Arts
District; and the following five districts through fiscal year 2030: Abilene Cultural
District, Dallas Arts District, Fort Worth Cultural District, Houston Museum District, and
Houston Theater District. Motion carried.
APPROVAL OF CULTURAL DISTRICT DESIGNATIONS
Dr. Gibbs reviewed the Cultural District applications that were submitted with
Commissioners. Discussion followed. Commissioner Chang made the motion and
Commissioner Partee seconded that the Commission officially designate Red River
Cultural District in Austin, Deep Ellum Cultural District in Dallas, Near Southside
Cultural District in Fort Worth, Fifth Ward Cultural Arts District in Houston, and
Historic Third Ward Arts District in Houston, with noted abstentions reflecting
Commissioners’ conflicts of interest. Motion carried.

UPDATE ON TCA’s LEGISLATIVE APPROPRIATIONS REQUEST (LAR)
Dr. Gibbs reported the following: the LAR is due on September 11, 2020; TCA will ask
for $1, 268, 954 with the dollars to focus on COVID-19 relief; will ask for flat funding
with the restoration of the 5% and the Governor is aware of this request. Discussion
followed.
TCA EXECUTIVE DIRECTOR REPORT
Dr. Gibbs congratulated TCA staff for their successful transition to working from home
and reported that Deputy Director Jim Bob McMillan retired on August 31st and TCA
celebrated with a Zoom retirement party.
TEXANS FOR THE ARTS (TFA) REPORT
Ann Graham gave a verbal report.
TEXAS CULTURAL TRUST (TCT) REPORT
Heidi Marquez Smith sent a written report.
PUBLIC COMMENT

FUTURE MEETING SCHEDULE
Chairman Brock stated the December 3, 2020 meeting will be telephonic.

ACCEPTANCE OF LETTERS OF APPEAL IMPACTING
GRANTS TO BE CONSIDERED FOR APPROVAL AT THIS
MEETING
DISCUSSION: Applicants for TCA grant programs who believe their proposals for
funding were rejected for the following two reasons may appeal to the Commission for
reconsideration:
1. Influence of evaluation panel or Commissioners who willfully failed to disclose conflicts of interest; or
2. Provision of incorrect information by the TCA staff or evaluators at the time of voting, despite the presence of the correct information as part of the original
application.
The applicant must be able to show a link between one of these circumstances and a low
score or rating and/or negative panel comment.
Dissatisfaction with the denial of a grant or with the amount of the grant award is an
insufficient reason for appeal.
Appeals can be considered if they are received before the Commission gathers for their
quarterly meeting.
Appeals must be presented through a written appeal form to the Deputy Director. The
Deputy Director considers each appeal and issues a recommendation for the
Commissioners’ consideration.
RECOMMENDATION: The Deputy Director will present appeals and
recommendations for the Commission to consider.

APPROVAL OF ARTS RESPOND PERFORMANCE
SUPPORT GRANTS
DISCUSSION: In accordance with TCA’s guidelines for Arts Respond Performance
Support grant applications, TCA staff processed applications submitted and completed
for the November 1, 2020 quarterly deadline. This batch of grants includes applications
submitted for activities starting between December 15, 2020 and March 14, 2021. The
Commission received and processed 38 applications in this quarter. These 38 applications
come from 22 organizations in 14 Texas cities.
Five advisory evaluators reviewed the requests, and a majority of the evaluators approved
the funding recommendations made by TCA staff. These recommendations are now
submitted to the Commission for its approval.

PROGRAM DESCRIPTION
Arts Respond Performance Support
This program provides professional artist fees to schools, libraries, and nonprofit organizations for hiring an artist from the TCA Touring Roster to do a performance.
Grant Type: Quarterly Application Limit: Multiple applications can be submitted, but only $12,000 cumulatively will be awarded to an organization per fiscal year (Sept.-Aug.). Minimum Request: $75 Maximum Request: $8,000 Match Requirement: dollar for dollar (1:1) Quarterly Grants Subject to Commission Approval Eligibility: All Texas nonprofits, schools, colleges, and units of government

APPROVAL OF CHANGES TO THE ARTS CREATE
APPLICATION PROCESS DUE TO COVID-19
DISCUSSION: Under the latitude granted by Governor Greg Abbott’s March 13, 2020
proclamation of a state of disaster affecting all counties in Texas due to the Coronavirus
(COVID-19) and in consideration of the needs of the Texas nonprofit arts field during the
continuing pandemic, TCA staff is recommending an alteration to the Arts Create grant
program for the FY22 application cycle.
Per the grant guidelines, the agency would accept new applications for two years of
general operating support in March 2021. Staff is proposing instead to extend the current
Arts Create grant recipients for an additional two years (FY22 and FY23). Those grantees
would fill out the same abbreviated form they submit for their second year of funding in
this program. These applications would follow the same procedure as typical Arts Create
– Year 2 applications and would be reviewed by TCA staff. The scores they received in
the past application cycle would be used to determine their FY22 and FY23 grant
amounts. Ideally the Arts Create award amount would be the same as that provided for
the current fiscal year.
Eligible arts organizations that do not have a current Arts Create grant would be allowed
to submit a full application and supporting materials for funding consideration. Those
applications will be taken through a peer panel review process.
This alteration would allow current Arts Create grant recipients to use significantly fewer
resources in pursuing these operational support funds for the next two years, while still
extending the application opportunity to eligible organizations.
RECOMMENDATION: That the Commission approves the proposed changes to the
Arts Create application process due to COVID-19 and extend the current Arts Create
grant recipients for an additional two years (FY22 and FY23), while allowing new
applicants the opportunity to apply to the program in March 2021.

APPROVAL OF EVALUATORS FOR ARTS CREATE
DISCUSSION: Nominations for grant evaluators are accepted throughout the year.
Nomination forms are found on the agency website and are available to anyone.
Nominations are encouraged from Commissioners, past panelists, artists, and arts
organizations. Evaluators volunteer their time and expertise to review and score
applications submitted to the Commission. Their scores are used by agency staff to
develop recommendations for the Commission.
Included in this group are panelists to evaluate Arts Create applications with
representation of the nine discipline areas. Panel makeup will be reflective of the
applications received.
Note that evaluators for Presenting from FY2020 will continue to serve as evaluators for
Quarterly Grants.
RECOMMENDATION: That the Commission adopts the slate of grant evaluators as
presented and that TCA staff be instructed to recruit individuals to serve as necessary in
order to fill any vacancies.
