CHAPTER - 1: PROJECT OVERVIEW1.1 INTRODUCTION

1.1.1 IntroductionNational Highways Authority of India (NHAI) has been entrusted with the Development, Maintenance and Management of National Highways by Ministry of Road Transport and Highways (MORT&H), Government of India. Under National Highway Development Programme (NHDP), Phase – V, Government has decided to convert some of the existing 4 lane highways into 6 lane Highways. These projects are to be executed through Public Private Partnership (PPP) on Design, Build, Finance, Operate & Transfer (DBFOT) pattern.

The National Highways Authority of India (NHAI) has taken-up Projects of certain selected stretches under NHDP Phase-V, BOT programme, out of which 555.500 Km. of NH-79A, NH-79, NH-76 and NH-8 from Kishangarh (km 0.000) to Ahmedabad (Km. 555.500) including Udaipur bypass is a part of this prestigious project. The project would envisage widening of existing Four- Lane highway into six Lanes with additional features, such as, providing of additional Service Roads, Underpasses, Flyovers and Bridges to enhance operational efficiency and safety for the Traffic & Road Users.

1.1.2 General Information on Project RoadThe 6 laning of NH-79A, NH-79, NH-76 and NH-8 on Kishangarh - Udaipur - Ahmedabad Section including Udaipur Bypass is intended to improve the economic and social welfare of the people. The main objective of 6-Laning of Kishangarh - Udaipur - Ahmedabad Section of NH - 79 A, NH -79, NH - 76 and NH – 8 including proposed Udaipur Bypass is to ensure:

Facilitate development of Delhi-Mumbai Segment of Golden Quadrangle by widening of Kishangarh-Nasirabad-Bhilwara-Chittorgarh-Mangalwar-Udaipur- Kaya - Khairwara – Shamlaji - Himmatnagar- Prantij Chiloda and Ahmedabad corridor i.e. NH-79A, NH-79, NH-76 and NH-8 from existing Four Lane to proposed Six Lane divided carriageway through DBFOT pattern,

To provide fast corridor for smooth flow of traffic, minimal adverse social and environmental impacts and reduce rate of accident with the proposed Six Lane widening and Road Strengthening,

Enhanced Safety of the Traffic, the Road Users and the People Living in proximity to the Project highway.

Enhanced Operational Efficiency of the highway,

Fulfilment of the access needed to the Local Population

Minimal adverse impact on the Road Users and the Local Population due to Construction, Feasible and Constructible options for the project with least cost option

1.1.3 Brief Description

The project road corridor is a section of NH-79A, NH-79, NH-76 and NH-8 starting from Kishangarh at km 364.000 of NH-8 (i.e. Km.0.830 of NH 79A). It meets with NH-79 at km

14.100 after traversing 36.000 km length of NH-79A. Further at Km 183.000 of NH-79 Project Road meet at Km. 220.000 of NH-76 and go through the NH-76. The Project road passes via Chittorgarh and meets Udaipur Bypass at km 117.800 of NH-76. The proposed new Six lane Udaipur Bypass starts at km 118.200 near Debari on NH-76 and end at km 286.800 near Kaya on NH-8. Subsequently, the road passes through urban section of Khairwara at km 351 and then passes through Ratanpur at km 388, Shamlaji at km 399 and Himmatnagar at km 447 of NH-8. Before ending at Ahmedabad it also passes through Prantij and Chiloda at km 469 and km 541 of NH-8 respectively.

Project corridor passes through Ajmer, Bhilwara, Chittorgarh, Udaipur and Dungarpur districts in the state of Rajasthan as well as Sabarkantha and Gandhinagar Districts in the State of Gujarat.

The existing road is 4-Lane divided carriageway throughout except at some section in Gujarat. The total By-pass length in the project is 26 km. The overall length of the Project Road including new By-passes is 555.550 Km. Out of which km 434.500 km is in State of Rajasthan and 121.0 km is in state of Gujarat.

In State of Rajasthan the Latitude and Longitude of Kishangarh is 26o 34’ 28” and 74o 52’ 11”, Chittorgarh 24o 53’, 74o 58’ and Udaipur is 24o 34’ 36” and 73o 41’ 52” Respectively. And in state of Gujarat the Latitude and Longitude of Ratanpur is 23o15’ 46” and 73o 17’ 20’’and Himmatnagar is 24o 23’ 00” and 73o 3’ 00’’respectively.

The project road traverse through major settlement stretches such as Nasirabad, Gulabpura, Bhilwara, Chittorgarh, Mangalwar, Udaipur, Ratanpur, Himmatnagar and Ahmedabad. The Nasirabad settlement starts from km 35+000 of NH 79 A and ends at km 16+000 of NH-79. Gulabpura settlement starts from km 64+000 and ends at 71+000 of NH-79, Bhilwara by-pass starts at km 120+000 and end at Km. 138+000 of NH-79 of the project road, Chittorgarh By-pass starts at km 164+000 of NH-79 and meets at km 213+000 of NH-76. From km 213+000, end of Chittorgarh bypass the project road is at decreasing chainage in left carriageway. Proposed Mangalwar Bypass starts at km 171+000 and ends at 169+000 of NH-76. In Mangalwar the existing alignment of project road traverses in highly congested area.

The present configuration of the road is 4-lane in rural and 4-lane plus service roads of 7.5 m width (7.0 m) carriageway+2 x 0.25m kerb shyness) on both sides in urban areas. At some places the services road is found to be 5.5.m (5.0 m carriageway+2 x 0.25m kerb shyness) and 3.5m (3.5m carriageway+2 x 0.25 m kerb shyness). From km 541(near Chilloda) to km 553 existing road is 2 lane carriageway lanes with paved shoulder.

The Existing Pavement of Left Carriageway is throughout Flexible except 25.900 Km in three different Stretches between Km. 9.600 to Km. 29.600 of chittorgarh bypass and between Km. 196.000 to Km. 193.000 of NH-76 which are Rigid Pavements. However approx. 100 Km. of Existing Pavement in Right carriageway is Rigid in 7 different stretches including existing Bhilwara and Chittorgarh Bypasses.

The railway line running parallel to the project road on left hand side of existing Four lane near km 24+000 of NH 79.

The land use pattern of the project area is mainly agriculture land, settlements, industrial and commercial areas including hilly terrain at some locations along the project road. In general, the terrain is plain, rolling and partly hilly.





1.1.4 Project Location:

The Project Index Maps and Project Location Map are given in Fig. 1.1 and Fig.1.2 respectively. General Terrain

profile along the Project Corridor is shown in Fig. 1.3.

1.1.5 Road History:

The existing 2 lane road was widened to four in lanes in the year of 2003-2007.

1.2.5 Scope of Project

The scope of project includes performance and execution by the Concessionaire of all Design, Engineering, Finance, Construction, and Operation & Maintenance of the Project Highway. It shall also include Strengthening & Maintenance of the existing carriage way from Km 0+000 to 555+500 and Widening to 6 lane standards in accordance with the Specification and Standards and operation & maintenance. It shall also include the performance and fulfilment of other obligations by the Concessionaire under this Agreement. Salient scope of the Project works is given in Table 1.3.

1.3 THE SCOPE OF INDEPENDENT ENGINEER

1.3.1 Development Period Responsibility

The Independent Engineer will be responsible for detailed review of Designs & Drawings furnished by the Concessionaire along with supporting data, including the Geotechnical and Hydrological investigations, characteristics of materials from borrow areas and quarry sites, Topographical Surveys etc. The review of submitted designs & drawings along with supporting data shall be completed and send their observations/comments to Concessionaire & copy to the Authority within 15 (fifteen) days from the receipt of the same.

The independent Engineer shall give its observations, if any, within 7 days of receipt of revised designs drawings submitted by Concessionaire based on above observation/comments. The review of the detailed design, construction methodology, quality assurance procedures and the procurement, engineering and construction time schedule sent by the Concessionaire will be furnished within 15 (fifteen) days of receipt thereof. Similarly, EPC Contract or any other contract for construction, operation and maintenance of the Project Highway submitted by Concessionaire, will be reviewed and commented within 7 (seven) days from the receipt thereof.





1.3.2 Reporting Requirement

Independent Engineer shall prepare and submit the following reports in four copies to the NHAI and one copy to the Concessionaire.

a) Design Review Phase

Concessionaire is presently working on allocated activities of development period.

b) Construction Phase

Monthly and Quarterly Progress report covering all aspects such as progress monitoring, Quality Assurance (QA)/Quality control (QC) etc.

c) Operation and Maintenance Phase

Monthly and Quarterly report on existing condition of facility including advise on all aspects of operation and Maintenance. Toll Booths, Bridges or other Structures, Traffic Management & Safety, Telephone, Ambulance.

Monthly report on audit of the traffic using the Project Highway at least once a month.

Monthly and quarterly reports for lane availability.

The Check list to monitor Concessionaire’s obligation under the provision of CA is presented in Table 1.3.

CHAPTER – 2 : PROJECT MOBILIZATION

2.1 INDEPENDENT ENGINEER

Independent consultant is appointed by client as per the provisions of CA. EUROESTUDIO in JV with THEME ENGINEERING SERVICES (P) Ltd. is selected for the IE services on the project. The IE is mobilized at site from 4th May 2012.

2.2 INDEPENDENT ENGINEER’S MOBILIZATION

Contract Agreement for Independent Engineer services was signed on 4th May 2012 and subsequently service was commenced along with mobilization of Team leader in Udaipur.

As per Contract Agreement one Office for Team Leader and 5 numbers Offices for RE is to be established in the Project Corridor. Five Offices are established to supervise work for respective packages. For Sub Professional staffs, CVs are being submitted for NHAI’s review and approval. Approvals for same are being done in phases as per submitted and mutually agreed mobilization Plan.

2.3 MOBILIZATION & DEMOBILIZATION OF STAFF

2.3.1 Mobilization of Staff:

The Team Leader Office is established in Udaipur amd RE Offices are established two in Udaipur and each in Bhilwara and Chittorgarh in the state of Rajasthan and 1 in Himatnagar in the State of Gujarat. Key Professional, Sub – Professionals and Support Staffs are mobilized at their respective offices.

2.3.2 Demobilization of Staff

As per direction of NHAI, HQ letter no. NHAI/Phase – V/Dmega/KUA/2009, dated 14.01.2013 & PIU Letter nos. NHAI/UDA/6-lane/Euro/2012/272, dated 28/01/2013 and NHAI/UDA/6-lane/Euro/2012/453, dated 16/02/2013 Key Professionals, Sub – Professionals, Support Staffs, Offices etc had been demobilized. Dy. Team Leader 1 no., Asst/Survey Eng. 3 nos., 1 office, Support Staffs etc are being retained as given in the aforesaid letters.

2.4 ORGANIZATION CHART

The Organization Chart of Independent Consultant is attached in Appendix – A.






2.5 MONTHLY INVOICE

The status of monthly Invoice of administered under IE contract is given in Appendix – B.

2.6 CONCESSIONAIRE

Concessionaire has established it 3 nos. of Office for project coordination and monitoring. For finalizing Design & Project Coordination Concessionaire is coordinating from Udaipur office. Apart for office in Udaipur, concessionaire has established SPV 2 nos. office in Bhilwara and 1 nos. of office Himmatnagar.

The Concessionaire has appointed General Design Consultant for coordination and management of Design and drawings of the Project. Consulting Engineering Group Ltd., Jaipur is appointed as GDC and agreement is furnished to NHAI under CA clause 5.2.2.

2.7 EPC/SUB CONTRACTOR

2.8 SIX LANING PROJECT STATUS

The Concessionaire has appointed General Design Consultant for coordination and management of Design and drawings of the Project. Consulting Engineering Group Ltd., Jaipur is appointed as GDC and agreement is furnished to NHAI under CA clause 5.2.2. To execute the entire project length Concessionaire has divided the corridor in 5 Packages. The






Appointed Date is yet to be materialised, as obligation defined under Article 4 in Condition Precedent is not fully complied. The Details are given in next chapter.





CHAPTER - 3: PRE-CONSTRUCTION ACTIVITY

3.1 UTILITY RELOCATION AND TREES REMOVAL:

3.1.1 Electric Poles:

The identification of electric lines has been completed and estimates are being submitted to NHAI by Concessionaire. The Original estimate submitted for Chittorgarh district was reduced to Rs. 6.88 Cr. from Rs. 17.93 Cr. after review & scrutiny. Similarly, in Udaipur & Dungerpur district estimate of Rs. 36.20 cr. was revised and reduced to Rs. 26.05 cr. & Ajmer district estimate of 28.57 Cr. Ministry of Environment and Forest vide their letter F.8-105/2013-FC dated NIL in April,2013 has accorded Stage I approval for diversion of 173.39 Ha. Of Protected Forest Land in the State of Gujarat in compliance to the Stage-1 approval an amount of Rs. 14,80,27,244/- has been deposited with State CAMPA on 02.09.2013. The State Forest department forwarding the compliance to MoEF, New Delhi for Final approval (Stage-II) in May.2014. Diversion of 173.39 Ha procted forest land in Gujarat state, for Stage-II. Proposal has been return back by MoEF New Delhi vide FNO 8-105/2812-fc July 2014 with three observation to Principal Secretary (Forest) Gujarat.

3.5 CONDITION PRECEDENT

3.5.1 Contractual Provisions

Under the provision of Article 4 of CA, Concessionaire and Authority have obligation to be fulfilled before achieving of Appointed date. Clause 4.1 of CA illuminates respective rights and obligations of the both Parties and briefed as given below.

NHAI has obligation to fulfil following conditions

a) The Right of Way to the Site in accordance with the provisions of Clause 10.3.1 of CA.

Current Status of The Project

(i) Letter of termination given by the concessionaire on Dt.21.12.2012 & 07.01.2013 based on non compliance of condition precedent for environment & forest clearance as per Agreement Article – 4 sub clause 4.1.2

(ii) The Concessionaire M/s. GMR has invoked Clause 37.2 of Concession Agreement and the matter is pending in High Court, New Delhi (OMP-1234/2012)

(iii) The policy for rationalization of premium quoted by the Concessionaire in respect of highway projects approved by MoRT&H Delhi and the concessionaire has been requested to submit the proposal by NHAI H.Q. on 2nd April 2014.

(iv) The NHAI HQ directed to prepare a Web Site for this project. The same has been prepared in consultation with PD Office in this month. Accident data fill in Web Site up to Sep.2014.

(v) The NHAI HQ also develop a Project Monitoring & Information System (PMIS) data entry software to monitor monthly progress of each on going PPP Project. As the concessionaire M/s GMR Kishangarh Udaipur Ahamedabad Expressways Ltd. Has





issued terminate notice on Dated 07.01.13 and at present no work is in progress. Therefore the required data available in this office as well as in PD office has been entered in the system. Now before 25th date of each month, These datas are to be updated as per Target achieved in each sector of the Project in this month.

There was a Training at R.O.Office Jaipur on 17th,18th & 19th July 2014. In which M.S.Pandya, Sr. Pavement specialist (On 18 & 19th July’14), Praveen Jain, Survey Engineer (On 18 & 19th July’14), Mr. Sangram Singh (On 17th & 19th July’14) and Mr. Sanjay Sharma, Computer operator (17th to 19th July’2014) participated. The PMIS Data regarding L.A. has been updated up to Oct. 2014.





Concessionaire is in process of getting clearances / permits / licenses as required for executing the contract in compliance with Rules / Law of Local Government / Central Government. Many of such permits have been already procured by the concessionaire. Summary is presented in Table given below.
