1.0) EXECUTIVE SUMMARY 1.1 Introduction

The Project Highway aims at four laning of Nagpur-Saoner-Betul, Section of NH-69 from Km 3.000 to Km 59.300 in the state of Maharashtra and Km 137.000 to Km 257.400 in the state of Madhya Pradesh on DBFOT (Annuity) Basis Project. Thus the construction package for the project includes developing the existing two lane carriageway to four lane configuration from Km. 137.000 (new Km. 0.000) to Km. 257.400 (New Km 117.400) in the state of Madhya Pradesh & Km 3.000 to Km 59.300 in the state of Maharashtra. The total length of the package is 174.462 Km. The Project lies in the Betul&Chhindwara District of Madhya Pradesh State & Nagpur District of Maharashtra State. M/S Oriental Structural Engineers Pvt. Ltd. has promoted and incorporated M/s Oriental Nagpur Betul Highway Pvt. Ltd., a limited liability company as the Concessionaire to undertake and perform the obligations and exercise the rights of the selected bidder under the LOA for executing the project. The Concession Agreement (CA) between the concessionaire and NHAI was signed on 30.08.2010. The Concessionaire achieved Financial Closure (FC) on 25.02.2011. The Concessionaire has appointed M/s Oriental Structural Engineers Pvt. Ltd as Engineering, Procurement and Construction (EPC) Contract and signed EPC contract on 09.12.2010. The Concessionaire has engaged M/s. Indian Technocrat Limited (ITL) as a Project Management Consultant (PMC) for day to day supervision and quality control. NHAI has mobilized Independent Engineer (IE) Grontmij A/S In JV with FrischmannPrabhu (India) Pvt. Ltd. to review drawings and documents and to review, inspect and monitor on their behalf all activities associated with Construction, Operation & Maintenance and Diversion of the Project.

1.2 Scope of the project

The four laning of Nagpur-Saoner-Betul, Section of NH-69 from Km 3.000 to Km 59.300 in the state of Maharashtra and Km 137.000 to Km 257.400 in the state of Madhya Pradesh on DBFOT (Annuity) Basis Project has been awarded to Oriental Nagpur Betul Highway Pvt. Ltd. All the major and minor Bridges and Culverts enroute are also proposed to be widened. Six numbers of ROBs have been proposed to be provided at Rail / Road crossings so as to maintain the designed speed of the Highway. The concession period of 20 yrs. includes the construction period of 1275 days.

The estimated cost of the project is Rs. 2498.76 Crore. The project involves construction of 9 Major Bridges, 6 ROB’s, 54 Minor Bridges, 6 Clover Leaf / Grade Separators, 22 Pedestrian Underpass, 11 Vehicular Underpass, 126 nos. of Box Culverts &154 nos. of Pipe Culverts.

2.2 Additional Land requirement:-

Around 3.422 Ha additional landsare required for construction of way side amenities at Ch. 76+000. In Badchicholi bypass, 9 of the villagers have brought stay from High Court Jabalpur. Moreover, some of the villagers have gone in arbitration court due to dispute in compensation. Due to which the work in badchicholi bypass is at standstill for indecisive time.

2.4.1 MP Section (Km 137.000 to Km 257.400):

Total trees in the available land are felled in MP section.

2.4.2 MH SECTION (KM 3.000 TO KM 59.300) Permission for felling of trees in Km. 14.0 to Km. 59.300 is received only on 18.06.2012 vide letter No. NHAI/PIU/PDN/Tree Cutting/2012/734 and tree cutting work has been started accordingly.

Tree cutting permission for Nagpur (urban), Kamptee&Saoner Tehsil obtained from

Collector, Nagpur. About 95% of trees are felled and cutting of rest trees is under

progress.

2.6 Utility Shifting

All the utilities coming in the construction of highway such as water supply pipelines bore wells, HT / LT electrical lines & telephone lines, etc has been shifted except in Teegaon&Badchicholi Bypass. In Teegaon bypass, land has been just obtained in April-14 and shifting of utilities is in progress. In Badchicholi bypass stay exists from High court, Jabalpur.

2.7 Rehabilitation/Removal of Encroachment

Presently at site obstructions still exists. Identified encroachments has been attached as Annexure IX

2.8 Tests as per Schedule “I” of Concession Agreement As more than 95% of the Project Highway (Newly Constructed) has been completed, accordingly the tests has beenconducted by Independent Engineer’s representatives per Schedule “I” of Concession Agreement with due intimation to NHAI. 5.0) PREVENTION FROM SITE POSSESSION

At following locations the work could not be taken up due to following reasons

1. Balance Land acquisition Around 3.422 Ha additional landsare required for construction of way side amenities at Ch. 76+000 in MP section. BadchicholiBypass (MP): 9 no. of land owners have brought stay from High Court, Jabalpur due to which the work at Badchicholi is at stand still for indecisive time. Apart from this, again some of the land owners have gone in arbitration court due to dispute in compensation. As a matter of fact, SDM, Chhindwarahas also cancelled his possession letter. It is requested to NHAI to provide physical possession of land at the earliest to start work in Badchicholi Bypass with police protection. Toll Plaza at Ch. 23+000 (MH Section):Toll plaza work is yet not started due to law and order problem. Physical possession is required from NHAI to start the construction work at toll plaza with police protection. Around 10.215 Ha land is required in MH Section at Mankapur, Mankapur, ZingabaiTakli, Bokhara, Panjara, Dahegaon, Patansawangi, Bourjwada, Saoner, BhagiMahari, Khursapar, Pardi, etc. for the construction of service road, drain etc.

2. Clearance of forest area

Total forest area has been handed over to NHAI in MP by forest department where road has been constructed. In MH Section, 2nd stage forest clearance obtained from Authority on dated 21.02.2014 vide letter No. 6-MHB-141/2011-BHO/426, where the work is started.

2. Use of fly ash in the construction of highway:-

As per the instructions of NHAI received vide letter No. NHAI/PIU/PDN/2011/346 dated15.04.2011, we are procuring the fly ash from NTPC Sarni, MP. The source is approved by IE vide letter No. IE/TL/OSE/2012/52 dated 28.03.2012.

We are lifting the fly ash from nearest thermal power plants with our own set up and also engaged few contractors / transporters to supply the fly ash in the compliances of NHAI circular & SP 58. So far we have consumed 17,39,564 Cum Fly ash in the entire project i.e. 5,20,184 cum & 12,19,380 Cum in MP and MH respectively from nearest thermal power in the construction work of NH-69. Fly ash work in MP Section has been finished.

8.0) QUALITY CONTROLL REPORT

The fully equipped Laboratory is established since start at the entire stretch of the project, at following locations:- MH Section (Km. 3+000 to Km. 59+647) :- 1. Km. 15+600 LHS 2. Km. 23+000 RHS 3. Km. 97+270 LHS The list of Laboratory Equipment’s of Individual laboratories are enclosed as Annexure IV (a) All the required and relevant laboratory tests excluding Independent Tests have been carried out at the laboratories as per MoRTH Specifications Section 900. The Status of QA-QC report is attached herewith as Annexure IV All Independent Tests are also being carried out from Third Party as per schedule I of CA.

09.0) POTENTIAL ISSUES (List out delay due to various reasons, change in scope, Force Majeure, change in Law, delay in approvals etc.)

1 Bypass Dispute

1.1 Teegaon Bypass

Electrical utilities coming under construction of highway are to be shifted. Estimate given by MPPTCL to NHAI was forwarded to IE for review which has been reviewed by IE and sent to NHAI. It is requested to NHAI to approve the estimate and deposit the supervision charges to MPPTCL.

In Teegaon bypass, still compensation for some persons are yet to be paid (title dispute). We however, with due consent and cooperation of land owners constructed the highway which is appreciable.

Further, approval of estimates for shifting of water supply line (from Ch. 76+000 to Ch. 79+000) for village road amounting `61,72,320 from Competent Authority is still pending, whilst work has been executed under supervision of PHE Department compromising with the rate as estimate is based on SOR 2009-10 whereas work was carried out in the year 2013.

1.2 Bad Chicholi

NHAI vide letter no. 2171, dated 01.08.2013 issued letter of handing over of land in Badchicholi Village “On Paper not On Ground”, accordingly concessionaire started clearing & grubbing work at site, but work could not proceed due to strong protest of land owners demanding compensation of land & crop on current rate. As well as SDM, Pandhurna has cancelled possession letter

Meanwhile, 9 no. of land owners have brought stay from High Court, Jabalpur due to which the work at Badchicholi is at stand still for indecisive time. Apart from this, again some of the land owners have gone in arbitration court due to dispute in compensation. It is requested to NHAI to provide physical possession of land at the earliest to start work in Badchicholi Bypass with police protection. Concessionaire again requested IE vide letter no. 910 dated 25.02.2014 to impress upon NHAI for physical possession in Badchicholi bypass and IE forwarded the same to NHAI vide letter no. 388 datd 27.02.2014 with a request for providing physical possession to start the work at the earliest.

2 Clover leaf of GS

GS 5+917: Clover leaf constructed by adjusting it within available land. At small portion of this clover leaf, land acquisition is under process where area lighting cannot be done till compensation disbursement.

GS 53+317: The work of construction of loop and ramp are going on in full swing out of which in loop A, some land of 5 persons were left out for acquisition for which 3 (A) was sent to NHAI by SDM, Betul 2 months back even though it is still pending for approval and publication in Rajpatra. We however are carrying out the work on these lands with the assurance to the land owners that within 3 months we shall provide land compensation to them from NHAI. But due to delay in compensation, now they are losing patience and are becoming hostile and started threatening of stoppage of work

NHAI is requested to resolve the issue at

earliest.

3 Way Side Amenities

Skipped Lands on Project Highway, in GS, Toll Plaza, WSA etc.

The issue pertaining to delay in publication of 3(A) of missed out land has become the burning problem now, since the land owners whose land were missed out in the process of LA and thereby refrained from compensation are losing patience day by day and already threatened our work force as we are carrying out the work in their lands with assurance of compensation from NHAI within short span of time. In this regard, we wrote letter to NHAI vide letter no. 740 and reminded vide letter no. 767, 13.06.2014 with request for immediate land acquisition. The details of such missed out lands are given below:

Closing of unwanted median opening

IE vide letter no. 1211 expressed his concern for closing of unwanted median openings on the project highway. Concessionaire vide letter no. 903 dated 20.02.2014 clearly stated that these median openings have been provided as per instruction received from local bodies&under political pressure. So a meeting is required to be organized with local leaders and local public before closing authorized openings. After that police protection is required to close these median openings.

NHAI is requested to organize a meeting with locals to sort out the issue and provide police protection

6 Blockage of earthen drains

At numerous locations the earthen drains has been covered with soil / boulders by local villagers / land owners to convert it as access to their residence / farming land, thus, losing the benefits which can be driven from the drains especially during rainy seasons. This issue has been brought to Authority's notice vide our letter no. ONBHPL/NHAI/NH-69/Pandhurna/2K13/718 dated 25th Nov. 2013.

Solution to be given by NHAI

7 Toll Plaza at Ch. 23+000 MH Section

Toll plaza work is yet not started due to law and order problem. Physical possession is required from NHAI to start the construction work at toll plaza with police protection.

Supervision charges for Shifting of Electrical Lines within construction zone of highway

Supervision charge for shifting of Electrical lines at Clover leaf of GS 5+917, 53+317 & 55+500 has been deposited by NHAI to MPPTCL, but the same for Teegaon Bypass is yet to be deposited. However, the lines are being shifted in Teegaon Bypass with due cooperation of MPPTCL and electrical contractor, but the supervision charges to be deposited immediately.

A. COS I (PUP with Slip Road at Ch. 50+420 & 66+000): Pursuant to NHAI Letter No. 4037, dated 24.01.2014, COS I with detailed submitted by us to IE vide our letter no. 1052, dated 14.06.2014 amounting Rs. 3,45,45,837/-.

B. COS II (Construction of Teegaon Bypass): In reference to NHAI letter no. 2718, dated 12.09.2013, COS II with detailed estimate amounting Rs. 16,06,13,318/- submitted vide our letter no. 1057, dated 18.06.2014

C. COS III (PUP 29+157 & 49+177):In reference to NHAI letter no. 4037, dated 24.01.2014, COS III with detailed estimate submitted by us to IE vide our letter no. 3270, dated 02.07.2014 amounting Rs. 2,05,60,300/-

D. COS IV (PUP 10+210 & 13+420): COS in principal approval was conveyed to us vide letter no. 4037 dated 24.01.2014 for which detailed estimate shall be submitted by us soon.

E. COS V (Construction of New Hume Pipe Culvert in Betul Town):Pursuant to NHAI Letter No. 4037, dated 24.01.2014, COS V with detailed estimate submitted by us to IE vide our letter no. 1053, dated 14.06.2014 amounting Rs. 42,02,027/-.

COS V (Slip Road at Ch. 76+860): Pursuant to NHAI Letter No. 4037, dated 24.01.2014, COS V for slip road at Ch. 76+860 with detailed estimate has been submitted by us to IE vide our letter no. 1063, dated 21.06.2014 amounting Rs. 84,19,639/-.

F. COS VI (Additional PUPs at Km 4+162 & Km 4+477): Pursuant to NHAI Letter No. 4474, dated 03.03.2014, COS VI with detailed estimate has been submitted by us to IE vide our letter no. 3279, dated 04.07.2014 amounting Rs. 2,61,96,921/-.

G. COS IA (Slip Road at PUP 58+525, 104+535 & 107+174): These three locations were the minimum inescapable requirement to provide access at the PUP locations over and above the requirements of service roads stipulated in Schedule-B:and which were strongly recommended by your office and probably inadvertently missed out at HQ, NHAI. Accordingly work executed at site and detailed estimate submitted by us to NHAI vide our letter no. 771 dated 28.06.2014 for Rs. 2,63,37,687/-

H. As per instruction of CGM (T), NHAI, RO, Maharashtra on request of Sri Sukhdev Panse, Hon’ble MLA, proposal and cost estimate for slip road in all four side & RCC drain at PUP Ch. 43+588 has been submitted by Concessionaire vide letter no. 658, dated 24.07.2013 under article 16 (Change of Scope), for which approval is awaited to start the work

I. As per instruction of Railway, to proceed with the construction of ROB using composite girder instead of PSC girder in railway span, we had commenced the work of ROB with said arrangement of composite girder but change of scope for the same is yet to be issued by NHAI.

J. Change of scope in MH Section: A. Culverts &PUP:- (v) Ch. 10+185 (Box Culvert–Reconstruction of Existing Box culvert)

10.0) TRAFFIC MANAGEMENT & ROAD SAFETY

1. Traffic Management Plan for safety in construction zone, incorporating requirements of MORTH &

IRC specifications has been submitted to NHAI & IE for approval on 13.01.2012 & 06.04.2012 respectively.

2. A dedicated team comprising of Safety Manager (01 No.) and Safety Officers (3 Nos.) is deployed at site.

3. Mr. Prateek Thakkar is working as Environment & Safety Engineer.

4. Cautionary signages are fixed,wherever required.

5. Sand bags at construction works are placed with sticking radium stickers, wherever required.

6. Bituminous treatment for temporary diversion roads is provided, wherever required.

7. Provision of railing & crash barrier at location of deep roadway excavation, wherever required.

8. Safety nets, ribbons & barricading with iron sheets painted with retro-reflective paint are provided wherever required.

9. At Structures locations proper diversions is made for channelized and smooth dispersals of traffic.

10. M/s. Lion Engineer has been appointed as Safety Consultant by Authority on 09.01.2014. The Safety consultant has visited the site and hasgiven some observations which have been complied with.

11. The Road Safety week has been organized by the concessionaire from11.01.2014 to 17.01.2014across the project site which includes free Eye Test Camp, Blood Donation Camp, Road Safety Awareness Program in school as well among the villagers / road users by distribution of pamphletsetc.

12. NHAI has dedicated the Nagpur – Saoner – Betul Project NH-47 (Old NH-69) Road to the Nation whereas more than 95% of the Highway has been completed and opened to traffic.

13. Safety workshop has been organized by NHAI on 02nd of June'14 at Hotel pride in Nagpur where IE & Concessionaire's representative were present.

14. In deep cutting section, rockfall netting arrangement has been adopted and the work awarded to M/s Gareware-wall Ropes Ltd., Pune.

Site Visit &Progress Review Meeting:- The Site visit was held on 18th June 2014 in MP Section and on 19th June 2014 in MH Section. The Progress review meeting of entire section (MP & MH) was held on 19th June 2014 at Oriental Camp, Waki Road, Patansaongi, Tehsil – Saoner, District – Nagpur (MH) chaired by Mr. Sher Mohd. Siddhiqui, Team Leader, Independent Engineer. In the meeting Mr. J P Gupta, Director (Projects), Mr. J. P. Tiwari, Project Director (E), ONBHPL, Mr. P.
