The Urban Municipality Act, 1984________

TO THE HONOURABLE THE LIEUTENANT GOVERNOR IN COUNCIL:
The undersigned has the honour to report that:1 Sections 13, 14 and 24 of The Urban Municipality Act, 1984provide, in part, as follows:
13(1) In this section, “council” means:(a) the council of an urban municipality that intends toapply for an alteration of its boundaries...
(7) The council may make an application for the alterationof its boundaries ... in the form prescribed by the ministerand shall submit:
(a) an application for the alteration of boundaries to:(i) the minister, if all other municipalities affectedby the proposed alteration provide the council withthe complementary resolutions mentioned inclause (e); ...;

together with:(c) a map showing in detail the proposed alteration inboundaries ... and a brief explanation of the reasons forthe proposal;(d) a certified copy of a resolution of the councilrequesting the proposed alteration...;(e) ... a certified copy of a complementary resolution ofthe council of each municipality affected by the proposedalteration; ...; and(g) a written summary of any public meeting held ...and a copy of each written submission respecting theproposed alteration ... received by the council.
(10) The minister may recommend to the LieutenantGovernor in Council that an application made pursuant tothis section be approved, subject to any terms and conditionsthat the minister considers appropriate, or rejected.14(1) On the recommendation of the minister pursuant tosubsection 13(10)... the Lieutenant Governor in Councilmay, subject to any terms and conditions that he considersappropriate, by order:
(a) alter the boundaries of any urban municipality by:(i) adding territory that shares common boundarywith the urban municipality to that urbanmunicipality; ...
(b) alter the boundaries of any other municipalityaffected by an order made pursuant to clause (a) so thatthey correspond to that order.
24 When making an order pursuant to this Part thatresults in the alteration of the boundaries of an urbanmunicipality, the Lieutenant Governor in Council... shall:
(a) describe the actual alteration of the boundaries ofthe urban municipality; and(b) describe the new boundaries of the urbanmunicipality ; ...
2 The council of the Village of Zenon Park has submitted anapplication for an alteration of its boundaries to the Minister ofMunicipal Government in the form prescribed by the Minister togetherwith:
(a) a map showing in detail the proposed alteration inboundaries which involves withdrawing territory from theRural Municipality of Connaught No. 457 for the purpose ofacquiring control of land for the purposes of residential andindustrial development;(b) a certified copy of a resolution of the council of the Villageof Zenon Park requesting the proposed alteration; and(c) a certified copy of a complementary resolution of theCouncil of the Rural Municipality of Connaught No. 457,affected by the proposed alteration.
3 No written submissions objecting to the Village of Zenon Park’sproposed changes were received.4 As a result of the above, it is desirable to alter the boundaries ofthe Village of Zenon Park and the Rural Municipality of ConnaughtNo. 457.
The undersigned, therefore, has the honour to recommend thatYour Honour’s Order do issue pursuant to sections 13, 14 and 24 ofThe Urban Municipality Act, 1984:
(a) altering the boundaries of the Village of Zenon Park byadding to the village and withdrawing from the RuralMunicipality of Connaught No. 457 territory adjoining theVillage as described in the attached “Schedule A”;(b) altering the boundaries of the Rural Municipality ofConnaught No. 457, so that they correspond to this Order;and
(c) confirming that the alteration shall take effect on andfrom the date of this Order and that the attached “ScheduleB” is conclusively deemed to be the legal description of theboundaries of the Village of Zenon Park.

withdrawing from the Rural Municipality of Connaught No. 457 andadding to the Village of Zenon Park, Saskatchewan, territory lyingwithin:
Township 47, Range 13, West of the second Meridian anddescribed as:(1) the following portions of section 13:
(a) that portion of the northeast quarter commencing at a pointon the northwesterly limit of the Canadian National RailwayPlan No. BB4110 with its intersection with the northern boundaryof the quarter section; thence southwesterly along thenorthwesterly limit of the railway, 184.102 metres; thencenortherly to a point on the northern boundary of the quartersection, 101.687 metres west along the northern boundary of thequarter section from the intersection of the northwesterly limitof the railway right of way and the northern boundary of thequarter section; thence easterly along the northern boundary ofthe quarter section to the point of commencement;
(2) the following portions of section 24:(a) that portion of the southeast quarter commencing at theintersection of the southerly limit of Main Street and the westerlylimit of the lane in Block 18, Plan No. 77PA04451; thencesoutherly along the westerly limit of the lane and its productionsoutherly to the intersection of the southern boundary of thesoutheast quarter section; thence westerly along the southernboundary of the quarter section, 56.723 metres; thence northerlyand parallel with the eastern boundary of the quarter section tothe intersection of the westerly limit of Second Avenue West andthe southerly limit of Main Street; thence easterly along thesoutherly limit of Main Street to the point of commencement;(b) that portion of the southeast quarter section commencing atthe southeast corner of Lot 1, Block 22, Plan No. 93PA13033,thence southerly along the westerly limit of Second Avenue Westto the intersection of the southerly limit of Main Street; thencewesterly and parallel with the southerly limit of Block 22,158.450 metres; thence northerly to the southwest corner ofLot 2, Block 22; thence easterly along the southerly limit ofBlock 22, to the point of commencement.
SCHEDULE BThe boundaries of the Village of Zenon Park shall comprise the
territory in the Province of Saskatchewan lying within:Township 47, Range 13, West of the second Meridian and
described as:(1) the following portions of section 13:
(a) the most northerly 27.432 metres in width throughout of thatportion of the northeast quarter lying southeast of thesoutheasterly limit of the Canadian National Railway, Plan No.BB4110; and

(b) that portion of the northeast quarter commencing at a pointon the southeasterly limit of the Canadian National Railwaywith its intersection with the northern boundary of the quartersection; thence westerly along the northern boundary of thequarter section to the northwesterly limit of the railway right ofway, thence southwesterly along the northwesterly limit 184.102metres, thence northerly to a point on the northern boundary ofthe quarter section 101.687 metres west along the northernboundary of the quarter section from the intersection of thenorthwesterly limit of the railway right of way and the northernboundary of the quarter section; and

The said plans of survey are of record in the Land Titles Office forthe Prince Albert Land Registration District at Prince Albert,Saskatchewan.

2 The Council of the Town of Wadena has submitted an applicationfor an alteration of its boundaries to the Minister of MunicipalGovernment in the form prescribed by the minister together with:
(a) a map showing in detail the proposed alteration inboundaries which involves withdrawing territory from theRural Municipality of Lakeview No. 337 for the purpose ofexpanding the town cemetery;(b) a certified copy of a resolution of the Council of the Townof Wadena requesting the proposed alteration; and(c) a certified copy of a complementary resolution of theCouncil of the Rural Municipality of Lakeview No. 337,affected by the proposed alteration.
3 No written submissions objecting to the proposed alteration werereceived by the Council of the Town of Wadena.4 As a result of the above, it is desirable to alter the boundaries of theTown of Wadena and the Rural Municipality of Lakeview No. 337.

EXTRACTS FROM THE RULES ANDPROCEDURES OF THE LEGISLATIVE
ASSEMBLY OF SASKATCHEWANRELATING TO PRIVATE BILLS
________
PETITIONS12(1) A petition to the Assembly may be presented by a Member
at any time during the sitting of the Assembly by filing the same withthe Clerk of the Assembly.
(6) Petitions may be either written or printed, provided alwaysthat when there are three or more petitioners, the signatures of atleast three petitioners shall be subscribed on the sheet containing theprayer of the petition.
(9) No petition can be received which prays for any expenditure,grant or charge on the public revenue, whether payable out of theConsolidated Fund or out of moneys to be provided by the Assembly.
NOTE: A form of Petition can be obtained on application to theClerk of the Legislative Assembly.
PRIVATE BILLS64(1) All petitions for Private Bills shall be in duplicate and shall
be filed with the Clerk of the Assembly not later than the twentiethsitting day of the Session.
(2) No petition for any Private Bill shall be received by theAssembly if presented after the first twenty-five sitting days of theSession.
(3) No Private Bill may be introduced in the Assembly after thefirst thirty sitting days of the Session.
65(1) Every applicant for a Private Bill shall deposit with theClerk of the Assembly along with the petition for same, two copies ofthe bill, with marginal notes inserted, and an accepted chequepayable to the Minister of Finance for the sum of two hundred andfifty dollars, if the said bill does not exceed ten pages, and fifteendollars additional for each page over that number, four hundred andfifty words shall be held to constitute a page.
(2) In the case of a bill incorporating a company, a receipt from theRegistrar of Joint Stock Companies for any statutory fees requiredshall also be deposited with the Clerk of the Assembly.
66 No remittance of a deposit on account of a Private Bill or anyportion thereof shall be ordered by the Assembly unless the same hasbeen recommended by the committee charged with its consideration,

or unless the bill has been withdrawn, rejected or not reported upon,in which cases the actual expenses incurred shall be deducted fromthe deposit received before making such remittance.
68(1) All petitions to the Legislature for Private Bills of anynature whatsoever, shall require a notice, clearly and distinctlyspecifying the nature and object of the application and where thesame refers to any proposed work, indicating generally the locationof the work, and signed by and on behalf of the petitioners, with theaddress of the party signing the same; and when the petition is for anact of incorporation the name of the proposed company shall be statedin the notice.
(2) Such notice shall be published prior to the filing of the petitionwith the Clerk of the Assembly as required in Rule 64(1) in twoconsecutive issues of The Saskatchewan Gazette and four consecutiveissues of a newspaper, published in English and having circulation inthe locality affected.
(3) A copy of the notice with a statutory declaration of the severalpublications of advertisement shall be filed with the Clerk of theAssembly along with the petition and bill.
69(2) Every bill for an act of incorporation, where a form of modelbill has been adopted, shall be drawn in accordance with such modelbill, copies of which may be obtained from the Clerk of the Assembly.Any provisions contained in any such bill which are not in accord withthe model bill shall be inserted between brackets and shall be soprinted.
72 When any bill for confirming any agreement is filed with theClerk of the Assembly a true copy of such agreement must beattached to it.
COMMITTEE RULINGIn cases where the proposed bill provides that the property to be
used or occupied by the petitioner be exempt from taxation, either inwhole or in part, the petitioner must file with the Clerk of theAssembly, along with the petition, a written statement from the localmunicipal authority in which the said property is situated approvingthe intent of the provisions of the proposed bill which provide for theexemption from taxation.
The name of the Member who is to present the petition and PrivateBill must be furnished to the Clerk of the Assembly at the time offiling the petition. Such Member should not, of course, be a Memberof the Cabinet.

(2) Si le projet de loi prévoit la constitution d’une société, lerécépissé des droits réglementaires donné par le registraire dessociétés par action est également déposé auprès du greffier.
66 L’Assemblée ne peut ordonner la remise totale ou partielle desdépôts relatifs aux projets de loi d’intérêt privé, sauf recommandationdu comité chargé d’étudier le projet en question ou si celui-ci est retiréou rejeté ou encore n’est pas rapporté. Les dépenses réelles sontdéduites du dépôt avant de le remettre.
68(1) Toutes les pétitions introductives de projets de loi d’intérêtprivé à l’adresse de la Législature nécessitent un avis qui exposeclairement la nature et l’objet de la demande et qui est signé par lesrequérants et en leur nom, avec mention de l’adresse des signataires.Les avis qui visent des travaux proposés font état de leur site; ceuxqui visent une loi de constitution en société font état du nom de lasociété.
(2) Les avis sont publiés, avant le dépôt de la pétition auprès dugreffier de l’Assemblée conformément au paragraphe 64(1), dansdeux numéros consécutifs de la Gazette de la Saskatchewan ainsi quedans quatre numéros consécutifs d’un journal anglais diffusé dans larégion touchée.
(3) Sont déposées auprès du greffier de l’Assemblée, outre lapétition et le projet de loi, copie de l’avis ainsi qu’une déclarationsolennelle qui atteste les diverses publications de l’annonce.
69(2) Si une formule-type de projet de loi a été adoptée, les projetsde loi portant constitution des sociétés sont rédigés selon cetteformule, dont les exemplaires sont disponibles chez le greffier del’Assemblée. Les dispositions de ces projets de loi qui ne se conformentpas à la formule-type sont indiquées et imprimées entre crochets.
72 Une copie conforme de l’accord est annexée aux projets de loiportant ratification d’un accord, qui sont déposés auprès du greffierde l’Assemblée.
DÉCISION EN COMITÉDans les cas où la proposition de projet de loi prévoit que les biens
devant être utilisés ou occupés par le requérant soient exemptsd’impôts, que ce soit dans leur ensemble ou partiellement, le requérantdevra déposer au bureau du greffier de l’Assemblée en plus de sapétition, une déclaration par écrit des autorités municipales localesoù se trouvent les biens en question approuvant l’objet des dispositionsde la proposition de projet de loi qui prévoit l’exemption d’impôts.
Le nom du député qui présentera la pétition et le projet de loi doitêtre fourni au greffier de l’Assemblée lors du dépôt de la pétition. Ilest entendu que le député en question ne peut être un membre duCabinet.

All material for publication in The Saskatchewan Gazette must besubmitted on disk (WordPerfect or Word) or hard copy to the Officeof the Queen’s Printer, Saskatchewan Justice, 1871 Smith Street,Regina, Saskatchewan, S4P 3V7, tel. (306) 787-6896 by noon on theThursday previous to the week of publication. If a holiday occurswithin the week of publication, the deadline is set back to noon of theprevious Wednesday. At least one full week should be allowed formail delivery.
Each document or disk must be complete in the form requiredfor publication and must be separate from the covering letter.Signatures on all documents must be typewritten or clearlyprinted immediately below the written signatures. Publicationof any material received late will be delayed.
Prepayment is required for ALL notices placed in TheSaskatchewan Gazette by non-government clients. Chequesor money orders must be made payable to the Queen’s PrinterRevolving Fund. Please include the GST in addition to regularcharges at the rate of 7% each for those items listed belowunder “GST Payable”.
