A Trust is a legal relationship where one person or organisation (the Trustee) is under an obligation to hold property for the benefit of other persons (the Beneficiary).

How do Trusts work?

Generally Trusts are established by a Trust Deed that sets out the terms of the Trust and specifies:

• Who can receive benefits from the Trust (the beneficiaries)

• When the beneficiaries can receive benefits from the Trust

• How the beneficiaries should receive the benefits

What is a Trustee?

The Trustee is the person or organisation who is legally responsible for administering the Trust property in accordance with the terms of the Trust (the Will, Trust Deed or court order). The Trustee is the legal owner of the Trust property and the beneficiaries hold the beneficial interest in the Trust property. The Trustee must act in the best interests of the beneficiaries at all times.

Anyone who is able to own property can be a Trustee. This includes, individuals, companies and the Public Trustee in each State and Territory (e.g. State Trustees).

Common types of Trusts

Inter-Vivos Trust

Set up during your lifetime to support beneficiaries, such as a family member with disabilities.

Testamentary Trust

Established by your Will to manage estate assets and income for your beneficiaries after your death.

Minor’s Trust

Designed to manage and protect assets for a child until they reach a specified age (usually 18, 21 or 25).

Special Disability Trust

Set up to help immediate family members and guardians to provide for the future of a person with a severe disability or a medical condition.

Charitable Trust

Designed to provide ongoing benefits to eligible charitable organisations for charitable purposes.

Superannuation Minor’s Trust

Established after you die to hold a share of your superannuation to a child until they reach a specified age.

Charitable giving through the State Trustees Australia Foundation

Do you intend to leave a gift to a charity? A charity can be named as a beneficiary in your Will. If you are passionate about a cause, you can choose to leave a monetary gift to a charity in your Will, or establish a charitable Trust or sub-fund, which can allow your nominated charity to enjoy the benefit of your gift in the years to come.

A Charitable Trust gives you a measure of control over where your money goes. You can name the Trust or sub-fund after yourself, your family or an organisation. Sub-funds can be established with a minimum donation of $10,000 and you may also be eligible for tax benefits.
